Former President Donald Trump, courtesy of florida 24 news. Youre watching cspan three. It is a day history will remember as the 45th president of the United States faces a 37 count federal indictment on i am dewalt her. Saying this is special coverage of the arraignment of Donald John Trump. That arraignment now about an hour away especially will have a producer inside the courthouse bringing you history as that history is made. President trump arriving at that federal courthouse just moments ago. We have Team Coverage taking us through this important day. National Political Correspondent alex miller is outside the federal courthouse. Deputy political director joe st. Georges just above it. Our political director, Andrew Rafferty, with us in atlanta. National security correspondent Sasha Ingraham is in d. C. White house correspondent haley bullies in bedminster new jersey were from President Trump will appear tonight. Got a full house here, ready to talk about. Days lets begin with our national Political Correspondent, alex outside the federal courthouse in miami. Alex, the motorcade arriving literally just moments ago. What are you seeing happening right around where you are . The scene here right now is incredibly different. A night and day from what we saw just 24 hours ago. We spent the day out here yesterday. There were one or two protesters today. There are close to i would say 1000 protesters. Here are most of them supporters of the former president. Lots of them bringing flags. Trump flags. American flags. Decked out in trump gear. People driving around this entire city block. Honking their cars. Writing on their cars. This is a completely different scene. Then what we saw yesterday. But miami police. The mare, they say theyve got it all under control. Press conference yesterday. It is there gonna keep the streets open. So, far for the most, where they have. The street just behind where we are set up did shut down for a little bit of time. Because of a suspicious package. It was reopened. Traffic is flowing here. As normal. Obviously, with a bit of delays. The president s right now it is much bigger than it was yesterday. We got numbers in the Department Homeland security really Walking Around this courthouse. Using really fanned out around the city may. Emmy police cars all around the city. We gotta make sure everything is safe. The mayor actually showed up here just a little while ago. He says hes confident that this can stay a peaceful situation. We have constant contingency plans. Should it not be. Yesterday, they said they were gonna let people walk all over wherever they wanted to go the area behind me leading up to the courthouse. Had remained open. But now, it is not. We saw some protests are trying to walk right behind our live shot location. The police are very quick to run up to them and say that they needed to move. While they want to keep this open situation for the most part, there are little bits of protection we can see the police trying to have. To keep this courthouse safe as the former president arrives a couple minutes ago. That scene on camera where you are. We are seeing just moments ago. Its an indication of the micro macro causes that you see. When you see events like this. It appears that there are thousands of people. The Helicopter Shot a scene to tell a different story. We continue to keep an eye on crowd size. With events like this, its an important factor. You are gauging support of the former president. That is alex miller for us live at the courthouse in miami. Alex, thank you very much. Joe, i know you are also miami. Can you take us through what were about to see moving ahead . Yeah the former president of the United States arriving here at the federal courthouse. Right around two pm eastern time. That hearing scheduled for three pm. Youre wondering okay, why get here an hour before. Thats because the processing has to occur. Typically, you arrive you would arrive before your first initial hearing. You would be fingerprinted. That would be very similar to the case the former President Trump will be doing in the federal courthouse here over the course of this next hour. A digital fingerprint. White house producer cal and howell is with us here in miami. She came out a short time ago. Briefed us on the procedures the former president could be a normal booking process for the most part. There will be some exceptions. We have digital fingerprints. Were gonna have a much loaded to the system as opposed to a mugshot taken. There was a lot of debate over whether or not a mugshot was even necessary. I spoke with one federal prosecutor, former federal prosecutor who says typically mugshots needs of the individual, the clerk, the judge knows who the defendant is in a case. Mr. Trump is one the most recognizable faces in the entire world. He debated the necessity of a mugshot. It looks like were gonna have an uploaded mugshot. All of this will be happening ahead of this three pm hearing. A couple of things to know. A lot of attention has been paid to judge aileen cannon. Shes been the individual assigned to oversee the major portions of this case. If this goes to trial, when this goes to trial. It will be talking about judge aileen cannon. Who was appointed by former President Trump. No indication that there is a recusal there. Typically for this first hearing. You deal with magistrate judges. There is a difference here. District judges like judge cannon theyre appointed by the president s of the United States. Confirmed by the senate. When you have magistrate judges, theyre typically chosen to do the morgue ministry of tasks such as the nso arraignment, the reading of charges, theyre chosen by judges in their jurisdiction. Those are some of the nuts and bolts of what we expect to happen at the federal courthouse in the heart of miami. Well continue to look at these pictures of this courthouse. Which is not just a this is a political story. Were not just talking about the former president of the United States. Heroes so talking about the leading candidate for the republican nomination. In 2024. As well. Former President Donald Trump. Nuts and bolts business as usual few exceptions here and there of some differences. Live in miami thank you. Lets go to our political director andrew as jill was pointing out, so many times. This is a legal. Process it is also a political process. This indictment creating division in the republican party. We are now starting to see some notable shifts. Its interesting, we were talking about donald trump today. Were talking about him yesterday. Im sure well be talking about him again tomorrow. Its a candidate for the white house, once again, it leaves a lot of these republican rivals in a somewhat difficult position. Trying to breakthrough. We know that donald trump has a very sizable lead over those republican president ial candidates. Hes currently running against. We have seen over the past few days a little bit more sharper language from some of his rivals those who have seen Chris Christie come to the race last week. Asa hutchinson, former arkansas governor call on donald trump to leave the race. Not as this early because hes guilty but because this is just such a distraction. Now what were seeing is some more republican candidates kind of saying that what don trump essentially has done is not right. Has put the country at risk who originally in the aftermath of this. News of this and i havent had kind of defended donald trump. She has said that she has some serious concerns. Tim scott even saying that there is a sum he feels the law has been in appropriately applied in this case. When democrats he says have done similar things that have not gotten charged. Certainly not indicted in the way were seeing play out right now. That he still has some concerns. You are seeing a lot of republicans. Especially who are returning to capitol hill today. Not necessarily defending the president but saying that what he did was wrong. But having some concerns about why joe biden is not being prosecuted in the same way we can get into that. There are some big differences between all of these cases. Some big differences that we think donald trump is going to bring out tonight when he speaks in front of a national audience. For, now you are right to say that more of these republicans as with the information from that indictment has become unsealed and is now public. Certainly saying that there are potential National Security issues at play here. Even lindsay, graham the staunch is a doll Trump Supporters coming out and saying that he believes these charges are serious. And jim rafferty, thank you. You can see the clock that were watching right now. 51 minutes exactly before the arraignment of the former president begins. That is our countdown clock as we continue to await the proceedings. Taking place inside the courtroom. Reminder, we do have a reporter inside the courtroom as well. Just to pick off for andrew left. Of all National Security. These are significant charges. With a National Security implications. It is worth noting here. For decades, or spend the sundance with administrations. And the National Archives and Records Administration what to do with documents. My question to you, how should these types of documents have been handled . These documents are generally stored in whats called a skiff. This is a sensitive compartmented information facility. This has very specific in technical constructions to prevent a surveillance. There are layers of security even to get in. Including badgeing, in typing in a code to get in. Some u. S. Embassies leave labels outside of these rooms. Theyre deceptive so you wouldnt even know what is going on inside. Traveling out aside with a top secret document this in itself is very technical in the process that youre supposed to take here. I spoke with the former senior counterintelligence official, peter strzok. He told me that he would have to take a top secret document to just a mile down the road to the Justice Department from the fbi. He would have to go to a special room to get an invitation tory form. It would have a serial number on. It he would put those in they secured bag. He wouldve walked armed across the street to the Justice Department. He would give this to somebody else and they would have to sign the inventory form. Keep a copy and then he would take a copy back across the street. When you go into these rooms, you are not even allowed to bring a cell phone or any kind of technology. To see in this indictment these images of box is with documents spilling out. In showers, bathrooms, ballrooms. The u. S. Government says this poses a grave risk to National Security. Because of course, human sources are risking their lives to share information. They continue to trust this country . What does this mean for military personnel overseas. Just that antidote alone walking across the street. It just paints a picture of how much gravity is around navigating having these documents. Reporting live from washington. Thank. A moment he will enter a federal courtroom in miami to hear the 37 federal accounts against him. All of this related to his handling those secret documents. The indictment alleging that they were stored illegally in a ball room in a bathroom and other locations that maralago. Mr. Trump also allegedly heard on audio tapes showing off at least one of those documents. Matt says the joins are coverage now. Hes live with Trump Supporters outside the federal courthouse in miami. Matt, can you describe the scene at the courthouse right now. Thats going on around you. Yeah, ill tell you right now. There are a lot of people out there moving around. Were actually behind the courthouse. On the west side of the courthouse. Which is where the caravan of suvs with donald trump arrived here today. There are quite a number of people who have gathered all around the perimeter here. On the back of the courthouse here. Hoping they could catch a glimpse of donald trump. They did not happen because the vehicles went down into an underground port. A much more secured area. Where he could get out of the vehicle and enter the courthouse. This is a very heavily guarded entrance right now. A lot of heavy armful east officers and secret service agents. Where im standing is actually something of a little pedestrian mall area. Which offers a lot of shade which i think is one of the reasons one of the two reasons a lot of people came here. Hopefully to catch a glimpse of donald trump but secondly, it is pretty shady over here. A lot of people have been walking. Around they got flags. Theyve got hats like this fellow who came up. I am from pole beans gardens. Prolifers for trump. Why did you want to come out here . What do you think. We have the best president. This is a travesty thats going on. A lot better then. Thousands of people here today. Media everywhere. I talk to people from all over the country. Its been great. Channel five is number. One thing, i appreciated. There are a lot of people knowing around the coffee. Shop places to. It this is one of the relief places i guess. Where people have come. Im gonna keep spinning around because theres a lot more people gathered over here. Kind of all mixed in with the media all working to get a shot of the courthouse. Try to weigh flags and say hello to a lot of people. I think that gentleman just told us, for the most, part from what weve seen, it has been a fairly well behaved. It is very hot here. I dont know if they kind of make people slow down a little bit. There are some signs. We see a lot of signs in spanish out. Here we see a lot of signs in english. There are also some people who are opposed on trump like this gentleman over here. Who is in a prison suit. I believe he has a lock above sign. Hes been quite visible throughout the day here. For the most part, he says hes been harassed of it by people, badmouthing physical. Just a loud at times. For the most part, pretty calm crowd. Well watch outside the backdoor what dont trump win in. Probably try to catch a glimpse when he leaves as well. Were live in miami. Send it back to you. Matt says nurse at the federal courthouse in miami in the shade. Thank you very much in a few, hours the shift north to bedminster new jersey. Thats where Trump National golf course is located. Thats also our White House Correspondent is live. Haley, all eyes will be on you this evening. Because the former president. We expect will deliver his first remarks there this evening. Thats exactly right. It will be a significant moment. It will be the first time we publicly hear from the former president following his arraignment in miami. To date he has called this indictment reckless. Hes called a baseless. He has called it a quote witch hunt. Repeating some of those freezes on social media. Heading into this afternoon. I think its reasonable to expect we will hear something along the same lines of that tonight. Keep in mind, the former president is navigating his role now as a candidate. But also now as a federal defendant. Since his indictment has been unsealed, we have heard him criticize the biden administration. The Justice Department and the special counsel. Really trying to frame this as what he called a political hit job of 2024 in the background of this. During his remarks in georgia over the weekend. We saw him try to draw a contrast between the Trump Administration and the current biden administration. Both politically, when it comes to policy me. An unclassified investigations. Biden faces his own investigation. The big difference there being that his counsel voluntarily turned over documents. Despite the legal woes hes facing, keep in mind a trump has still lead in the polls against his republican challengers. You heard him get into that. That is something we have heard him and take note of during his remarks. I expect that could be the case tonight. At the same time, we have heard some of these republican challengers that Chris Christie, nikki haley, get very more acquainted in their criticisms of trump. While his remarks would be here, its where he typically summers. Here to his golf club. Hell get the remarks. Hes also expected to hold a fundraiser. Keep in mind, since news broke of the Trump Campaign. It has certainly worked to raise money in the wake of. It that is haley bull who is live. Part of our Team Coverage. She is in bedminster new jersey. Haley, thank you very much. I think its time to introduce some new voices hear. Youll want to hear from Michael Zeldin. It worked in the Criminal Division of the department of justice. Is a former federal prosecutor with a wide range of experience. And Lindsey Drummond skis a president ial historian teaching at George Washington university. Thanks for joining. She would say the George Washington university as they like to say. Michael, lets start with you. What went into the decision to charging former president. Specifically venue. All of this couldve been happening in washington d. C. Prosecutors decided on florida. Saying that is where venue was. One question did in the archives have a standing there locating in the jurisdiction of washington d. C. This case couldve been drawn in both jurisdictions d. C. And florida. Most of the acts charge in the indictment took place in florida. Rather than entertain a venue fight with the trumps Defense Attorneys, prosecutors felt the strength of their case was enough that it could take this case to trumps Home Court Advantage to restriction. And still prevail. It was a tactical decision. Well see whether its the right. One michael, i was reading the indictment again. As we informed our audience. 49 pages. Its very interesting ridging. One of the things that stands out is the fact that they are using the former president s words against him. Were all familiar with the chant during the 2016 president ial election, lock her up. Part of that locker is the fact that he would saying that she mishandled classified information with regards to her emails. Some republicans like speaker of the house are saying that why not charge her. She was in charge, why is she charged . Let me read to you from fbi director comey statement on the non prosecution decision in the clinton case. He says in looking back at our investigations in the mishandling or removal of classified documents. We cannot find a case though it supported bringing charges on of these facts. All of the cases prosecuted involve some combination of clearly intentional and mishandling of classified documents. Vast quantities and materials exposed to such a way as to support an inference of intentional conduct. Efforts to obstruct justice. We do not have any of these things here. All of that is present in the trump case. To try to say the Hillary Clinton case and the trump case are comparable is just not true as a matter of fact. Not true as a matter of prosecutorial history in these sorts of cases. Former doj official i want to call on you. Plain and simple. How ironclad is this case . Its very strong case. Is the sort of case that if it was a case against john, and he came to me and he told me what should i do with my best friend . I would tell him delay or plead guilty. Very challenging. The strength of the evidence is significant. That is said, Donald John Trump is not john doe. Hes a former president. He has a very significant following. The judge in this case is shown herself to be very favorably inclined to him. She has a lot of tools at her disposal that can that if she can use to try to help him get an advantage in this case. The fact of the matter is there is plenty of potential jurors out there who are going to feel very strongly about former President Trump. He has some advantages. Typical it wouldnt have. Despite the fact the evidence is very strong. Its laid out in a lot of detail in that indictment. Nonetheless, jack smith and his team can be overconfident. They have a challenging road ahead. As you mentioned at the evidence, i want to ask you what is the significance of having tapes of trumps comments. As you read and youre able to read verbatim. What was said. There is a very important exchange that was taped. Trump essentially admits to multiple crimes. He says, for example, that he has a document. That its a secret document. He talks a bit about the document. He says he couldve declassified it when he was president. But he did not do so. So it remains classified and he cant shared with you with a knee goes on to talk a bit about that document. There he undercuts hes admitting that he has information about classified. Very problematic. The power of those statements. It can and will be used against him to trial. Not only do they undercuts the defenses that he has, but there are four affirmatively sean that he had newlypossessed classified information. That he was willing to share that information with others. Which is an aggravated factors. Its one of the factors that prosecutors look at. When theyre considering whether to bring these cases. Whether there is an intentional distribution to that information. Former federal prosecutor thank you very much. Were also following the developments taking place inside the courthouse just moments ago we found out of the former president has not been booked, fingerprinted. No mugshot as i believe our correspondent on the ground said that it would be we also want to go to a disturbance. Key linda, thanks for being with us. I am a nerd so when i say the George Washington university. Its because a lot of the records that nerds want to look at. That are contained by George Washington university. So if you will say this case closely resembles Richard Nixon and watergate. Isnt a more accurate comparison who also face a multi count indictment of openly criticizing and in fact declared war the prosecutors and the Justice Department. I think thats an excellent comparison. At one of the big differences with the nixon case is that nixon ultimately decided to stand down and to accept a pardon in return for an acknowledgment of wrongdoing. That is what a pardon requires is that you acknowledge that you have in some way acted incorrectly. Really went after the prosecution. He went after the federal government. He went after the case. He refused to acknowledge his culpability. I think that is a good comparison. Were thinking about that. This is not the first time that a federal official has been charged with very serious crimes. Even if it is the first time weve seen a president charge in this way. Lindsay, i dont wanna let the moment go by without getting your take on this. A former president of the United States now booked on 37 federal accounts inside a federal courthouse in miami. Your thoughts . I think its a sad day for the nation that we are in such a place that a federal official like the president , which is the most powerful office in the country has evidence against him that would bring for this type of indictment. The solemnity of that moment cant be overlooked. I think putting this in a global context is a really good reminder for us. Other democracies have held their leaders accountable. They have survived. I would argue its democracy stronger in the long term. It demonstrates that no one person including the president s ever above the law. Thats what a democracy is supposed to be a nation of laws. Historian lindsay striven ski. All of you stay with us as we are awaiting the start and actually the arraignment itself. Were getting word he has been booked and fingerprinted once again on as the surly a booking photograph. He is quite wellknown. We have a producer inside the courthouse who is watching all of these events unfold. Well check outside the courthouse after the break. Youre watching live coverage courtesy of florida 24. Well be rejoining it shortly. Mr. Trump has been charged with 37 counts of unauthorized retention of National Security information. You are watching sports news live coverage of the arraignment of Donald J Trump. About 30 minutes ago, he arrived at the courthouse. We have Team Coverage taking us through this important day. National Political Correspondent alex miller and Michael Williamson scripts news West Palm Beach or outside the federal courthouse. Lets get right now to alex miller. Alex, well start with. You one of the questions going in would be representing the former president of the United States. He was searching for a lawyers even as the day began. Has the lawyer dilemma been resolved . It seems to have unresolved. At least for right now. Yesterday, todd landry one of the president s attorneys in his cases in new york was told that he could not practice because he was not admitted to the bar in the Southern District of florida. Essentially, he was going to have to find a new representation. This is been a typical thing for the former president to find a team here in florida. Really in most of his cases to back him up. To be representing him in this trial. Now it looks like todd to be part of the florida has been granted. Not only will he be there. Hes also retained another lawyer. Name Christopher Michael keys. He is a locally practicing lawyer who says that his private firms. He represents big companies. Politicians and he works mostly in white collar crime. Which is essentially what this might amount to being he has a history in politics. Not only did he unsuccessfully run for senate. He also has worked for a number of governors. Charlie crist. He was solicitor general which is the top lawyer there. Argued numerous cases before that only the United StatesSupreme Court. But the florida Supreme Court. He was also a member of the transition teams for both governor rick scott and Governor Ron Desantis when it was their turn to become governor here in florida. He does seem to have a full team. At least what he means when he goes into the courtroom today. What happens after today . Its really what were gonna be need to be paying attention. To he has a different legal team. Just last week as these charges were unsealed. There were people. Lawyers on his team talking on multiple networks about these indictments. As soon as they were unsealed. They were off the team. This is really a. Changing process but at least so far for today. Seems all systems are go for his legal. Team before we let you go. Describe what we can here but we can see. We hear the horns im assuming that someone has a sign that says honk if you love donald trump or haunt if you hate donald trump . Is that the sounds were hearing . Yes, i would say for the most part, its honk if you love donald trump around here. There are definitely some protesters here are against the former president. I would say the majority of people here are supportive of him. This is a state that voted for the former president. It has been a red state for quite some time now. They are out here supporting him, people with science, with flags. Theres a lot of chanting of we love trump. But it has been peaceful. At least so far. Alex live for us there in the courthouse i am. Me thank you very much. I have to add, as someone who grew up in miami florida, that honking is a sign of excitement. Ill tell you any exciting event youll hear the honking. Pots and pans. Speaking of someone who is in florida. Living and working in florida. Michael, how do you think the events of today affect trumps standing in the state . Lets put it this. Way if you look at the scene behind me. Protesters gathered just down at. We got several hundred of them. Very raucous on this humid day. Unfortunately for all of us, theyre out and for. Several hundred media tendons in here as. Well a peaceful, as far as how it affects the standing. Consider this. Right after the indictment, he had the fund raising. Trump supporters say these indictments. The one here. And others that he made our only serving to enhance and increase his base. Keep this in mind. Dollar from the candidate. 2016. He wins the state of florida. He lost miami day county to Hillary Clinton by about 30 points he wants to stay 2020. He turns florida red again. He loses miami day county. By about nine points. Down to single digits. To joe biden. Hes been reliably democratic based in florida that is growing. Lawyers are going to look at. That they think theyll have an easier time relatively speaking. If it comes to the point where theyre picking a jury. A good long listen to what Donald Trumps defense team has to say. They think they have a better chance with that. With his standing in florida, politically the fact that hes not arrested. A better chance here than they would have at the indictment washington d. C. Standing strong. What happens legally politically . Thats a landscape that it will be navigated by all of us as we watch it and as he deals with it in the months to come. Back to you we shall see Michael Williams thank you very. Much lets go to our political director. , andrew i can remember a chalkboard that said florida, florida, florida. It looks like once again we are saying florida, florida, florida. But only for a different reason. This time, lets discuss the standing up on republicans. The event in 22 for still a long way off. Even though it seems like it is tomorrow. How will the events that we are seeing unfolding right now in florida affect the candidate donald trump one year from now . Weve been looking at a polling and Public Opinion over the past really weeks since news of this indictment came down. One the most recent things out this morning from Morning Consult shows donald trump polling among republicans proved for points over where he was last week. Donald trump has said clearly. He told us reporters ahead of this rally that he held this weekend that he doesnt want to be indicted. He was already leading the republican primary field. He doesnt need for more points. He was pretty handily in charge. I think it is also important when you are talking about how this is helping him politically. To remember is very possible this is something that helps him politically. Only in the short term. Through the republican primary. Because although he has seen above not only after what were seeing here in florida but also in new york. There are a lot of voters who are gonna be voting on a republican primary. Who are gonna be voting in november of 2024. Who have some rain concerns. That is a mean that they are necessarily in favor of indicting donald trump. But it does mean that it could be a factor if you did in fact put National Security somehow in danger. Thats gonna be on the minds of those independent voters. Andrew rafferty for, us thank you very much. Andrew, you know, as we were watching those images coming out of the courthouse moments ago. I was struck by the fact that you had the lock him about signs or annex of the pro trump signs. And the fact that they are doing what theyre supposed to do in a democracy. Which is protest peacefully. Peacefully, keyword. Theyre absolutely. Were gonna take a quick break. Were about 80 minutes out from that arraignment beginning. In a few minutes, we will dig into the specific charges that the former president is facing. Stay with us. Former President Donald Trump is been charged 37 counts of unauthorized retention of National Security information. Charges of which hes expected to pleaded not guilty. At the Justice Department is a former federal prosecutor with a wide range of experience. Lindsay strove and ski is a president ial historian teaching at George Washington university. Michael, lets start with you this time. So much attention being focused on the judge. Is it possible and im hearing this that when all is said and done. And offense internees move for a judgment of acquittal. She can do so no questions asked . She has to do so consistent with the law. She cant just do it willynilly for political reasons i think if she stays on the case and frankly, were i judge cannon, i think odell is to be recused from this case voluntarily. Were she to stay on this. Case i think she knows that shes going to be under the microscope. That her decisions are gonna have to be very well thought out. She doesnt want to be reversed as stinging lee as she was by the court of appeals. In her last go around with these documents. I dont think she would do that. Unless the evidence is such a terrible case that it is required to be done. Yes, theoretically, not practically. Michael, that we know the politicians are saying about this case. But i talk to an expert yesterday who said had this been anyone other than the former president of the United States, they would be in leg irons and shackles already. Is the case that the government has . Is it that a strong. Its strong. Like every case, it all depends on how the testimony comes in. Personally, i think the obstruction charges and the false statement charges at the end of the indictment are the strongest. Assuming attorney is able to testify hes not been excluded somehow by the trial judge. I think the possession of the documents. Hes charged with mere retention. Not a willfulness not forget the word. Hes just charged with willful retention. I think he can say that he thought all along in good conscious that he was entitled to these documents. There, by creating a defense of no criminal intent. I dont think he really cant sustain that. Elise thats an arguable defense. He has a much harder time at defending the obstruction and the false statements. We know hes gonna be using the president ial records act even though it does not apply. That will be one thing about they will try to argue. From the gio de official Michael Zeldin. Michael, standby. I want to go to you. Zooming out here for a moment. What makes trump different from other president s in our nations history . Some of your political system is crafted on enormous and precedents and cultural expectations. If we look at article two of the constitution. And then even all of the subsequent statutes and other laws that govern executive behavior there still a lot thats not written down. There is really based on this system of. We expect president s to act a certain. Way we expect president s to talk a certain way. We expect president s to comport themselves to a certain standard of the quorum. What i think has been so different in remarkable in some ways. About former President Trump is that he just showed a real disregard for all of those president s and norms. Everything from insulting the press and accusing the media of being an enemy. Now return extended that to a certain extent but generally president s acknowledge that the president in the media as an important part of a democratic society. To doing things like posing with a certain candidate in the oval office. Thats not against the law. Its just not something we expect the president to do. I think so much of President Trumps behavior is beyond our expectations. Sometimes we struggle to wrap our minds around how to respond to. It president ial historian at wendys from inchkeith. Thank you. A question for you, how significant is it that the former president is in a courtroom right now. Facing felony espionage charges under the espionage act. Is this what it was intended. We can already hear lindsey graham. Of the senator from south carolina, Trump Supporters saying hes not a spy. Hes definitely not alleged to be a spy. There are these are not espionage charges. Thats important distinction that you made. These are charges under the espionage act. Like many federal laws that have big names or broad names. They cover a whole variety of Different Things. This is an old law that wasnt acted long ago. For our modern classification system was in place. That doesnt talk about classified documents. Talks about National Defense information. It criminalizes a variety of different types of behavior. One of the charges as michael mentioned a moment ago is the willful retention of National Defense information. What that means is not at eu inadvertently had mixed in with your box is. Not that you had 10,000 emails. And one of them happened to be classified. Inadvertently was included in the unclassified emails. It means you knew you had the classified material. Or in this, case National Defense information. And he will fully retain. Did in other, words you kept it even though you know you werent supposed to. Thats what the former president is charged with. I think thats an appropriate charge in this. Case in the fact of this case. The government desperately wanted these documents back. They did Everything Possible to get their hands on these documents. They not only road letters and sent subpoenas there was a personal visit by the Justice Department. Ultimately, they had to seize them from him. With a search warrant. I think its very understandable why he needs to be charged with the willful retention of National Defense formation. That is the thing when you read the indictment. That leaves out at. You which is the number of times federal authorities beginning with the archives simply asked for the documents. Yet the documents were not returned. Standby as well. All of you stay with. Us were gonna take a quick break could be right back. Youre watching florida 24 is live coverage of the arraignment of former President Donald Trump. Which will be rejoining shortly. We take you back now to live coverage of the arraignment of former President Donald Trump in miami. Courtesy of florida 24. Thank you for staying with us on this tuesday. I am veronica de la cruz. Back with you here in atlanta. I will come back to our special coverage of the indictment of Donald J Trump. That arraignment now just minutes away. We find out moments ago that he is inside. He has now been booked and fingerprinted. We do not believe that he has a booking photo. That was taken because he is one of the worlds most famous and in some cases infamous figures. They are talking about potentially a digital photo. The uploaded in this case. We do have Team Coverage for you. Our team is gonna be taking you through this very important day. National correspondent alex miller is outside the federal courthouse. Deputy political director joe st. George it is just above it. Our political director Andrew Rafferty is still with us here in atlanta. National correspondent alex miller reported out. Outside the federal courthouse to miami. Lets begin with alex. Just moments ago, we heard im curious what was the reaction as a trickle down where you or. What is going on inside the courthouse. Are they still waiting to hear from various reports as to whats going on . Its a good question. Right now, there was a lot of confusion. A couple of minutes ago, the former president was arriving. There are people waiting outside of the other side of the federal court helping to get a glimpse of him. A lot of people mistaken he arrived pretty quickly. He was ushered into a barrage, there were questions around in the courtroom. In the courthouse, rather. Right now, this is really a protest, a show of support of the former president. Right now, we have reporters inside. Including our producer. Because cameras and cell phones Electronic Devices arent allowed in the courtroom, for these proceedings, the information is a slow drip of coming out of the courtroom right now. People outside just curious to show their support for the president. Being here to get actual information. Alex, going into today. It was predicted, it was estimated we might see a gathering of anywhere between 500 to 5000 people outside of the courthouse. Those are not the purview of the media but are you seeing crowds that he would describe i guess as small medium or large . I would say not nearly five. Thousand were probably closer to the 500 mark in that if i was guesstimated kind of people were here. People have been moving around. I would say between 500 and 1000 people here. Theres definitely a lot of people here. Lots of people driving by. Just coming in and out of cars to show their support. , its been a very peaceful for the most part. They shut down one street when there was a suspicious package. By and large, i would say this is so far has been a success for the police department. For the department of Homeland Security. For the mayor it came out yesterday and said we are not shutting down streets unless we absolutely have to. Thats what has happened here. I suspect that because this is really a lopsided show support for the former president , thats why this is not gotten angry. Veronica, going. In i was concerned about the feather they were not separated the protrump of the anti trump crowd. That appears to be the one thing that is held. Steady which is they have managed to coexist without any problems. To alexs point, she was saying there are many pro Trump Supporters that are there on the ground. Of things that have been peaceful as we can see right here now. We have been speaking with our reporters who said that there are no credible threats. We know that there are lots of local Law Enforcement. There is Law Enforcement from other agencies as well. Department of Homeland Security there on the ground. As we look at these pictures like i was just saying, we can tell that there are many pro Trump Supporters there on the ground right now. I want to bring a national Political Correspondent joe st. George. Who is also there outside the courthouse in miami. Something that really is difficult in this matter is that we dont have a camera inside of the courtroom right now. In fact, there are no cameras or phones allowed inside that courthouse today. Give us the lay of the land. What can folks anticipate to happen we. Know that the former president has been booked what comes next . Absolutely hes had his fingerprints visually taken as you mentioned, at no mugshot. Previously existing photo. There are plenty photographs of the former president. As far as what is happening in side at the Miami Federal Courthouse right now. This gets underway, we expect the former president to appear before a magistrate judge. That is very common. Its a very procedural day. That is not the start of a trial. That is not the surgeries direction this is the initial raymond the initial proceeding the main judge over the trial is judge aileen cannon. The print trump appointee all received criticism. The main judge doesnt w preside over day one initial hearing. If the initial arraignment. As usual he done by magistrate judges. According to the schedule of the magistrate judge john goodman would be tasked with that. Although his he could always be exchange for another veteran of the bench, former reporter actually in south florida. Known for miami herald. But a humor on the bench. This case is far from a laughing matter. 37 federal accounts against the former president of the United States. Make no mistake about. It this is very much an active situation at the federal courthouse. We have the former president of the United States inside, being arraigned at his very moment. Think about it in a mix. The former most powerful person in the world. Stepping into a room and mushrooms and were so trumped at this very moment, hes not. He is very much in the presence of the judge who was in control of that courtroom who will obviously break down what his next in this case. Make sure that the defendant in this case, former President Donald Trump, is aware of his charges. I want to make one note here i think its the most important thing. We will shift over the course of this next hour or so most likely to say okay. Some of the biggest questions that i think will emerge from this initial revenants. Do we have any future date set or any days being when we go to trial here. That is in south florida, talking to legalize person here for a few days now. Thats a big question. Mark there are some people who say legal strategy former President Trump will be tried and delayed this. As much as possible. Then of course, the Southern District down here in florida is known as the rocket docket. They have a reputation around the Country Special counsel jack smith said on friday he would like he said a trial could have over the winter. The timing is when the former president s could be required to be back in this courtroom. His significant here because he has the potential to impact the president ial race. This is the front runner for the republican nomination for president and he could be who was forced to be in a courtroom during the day. Hopped on a plane and campaigned rallies that night. Joe st. George live for us there in miami. Right outside the courthouse. Were gonna go check back with him. Joe, thank. You we do have a producer inside the courthouse. We just received four moments ago that the former president of the United States has entered a plea of not guilty in connection with the 37 criminal counts he faces. Lets go now to our National Political director Andrew Rafferty. Andrew, as we are watching these crowds. If we are political opponents. As we pointed out earlier the crowds of january six large in the crowd for his inauguration. Politically, how are his opponents processing what we are seeing on our screen . He called for thousands, hundreds showed up. You are right and you know, i think january 6th is in some ways of struck when were talking about the republican reaction into what is going on as Mitch Mcconnell was taking questions from reporters. And declined to comment on this case. It was pretty much the biggest who had not said anything about this. It seems like he doesnt have a whole lot to say. Even after getting to the cameras. Kevin mccarthy around the house side. Has come to the president s defense saying that the bathroom was secure. How trump handle those documents. This is put the white house in a bit of an awkward position. Because number one, they want to ensure the department of justice is seeing thats operating outside of its purview. Merrick garland, attorney general put it on special counsel jack smith. Theyre working on their own. There is no political interference that republicans who latched onto. Joe biden has his own documents investigation thats going on. Theyre the special counsel looking into how President Biden has handled documents found in one of his washington defeat offices. It will maintain delaware. Every indication so far is that he can turn those documents. We dont know a lot about the sense of that case. For those reasons, the white house and on thomas biggest political opponents on the other side of the aisle are kind of thing out of this. Certainly democrats on capitol hill are talking a lot not only the fact that he took these to maralago but that they were places like bathrooms, places that were not locked. Potentially put the United States. National security. As i was reading the diamond there were 150 locations where there. Were gassed inside the mall room thank you very much. Michael williamswood scrutiny as well as palm beach. Joins us now live from miami. Michael, what we know that the former president has now entered on a guilty plea. Hes pleaded not guilty to the 37 funneling counts against him. I do understand that youve heard from one of the former president s lawyers. What did he have to say . The lawyer said, i want to quote, this is from the associated press. One of his lawyers, are lena she came outside the courthouse, this was before he entered a not guilty plea. She spoke to a symbols reporters and said quote today is not about the president Donald J Trump who is defiant. She went on to say quote it is not about the republican party. Its not about the 2024 election. She went on to say, its about the obstruction of longstanding principles that have set this country apart. That from one of trumps lawyers outside more as you said, hes now entered a not guilty plea to all the counts that he faces in this historic day of the u. S. District court here in miami. Were also told reporters are beginning to run of the courtroom so they can file. Well be hearing for a script supporters who were in court, in full. Were also understanding from reports that jack smith, the special counsel appointed by u. S. Attorney general Merrick Garland was in the front row. He had said the other day, no comment today that he had said essentially, slightly paraphrasing here, the indictment was no one is above the law. That is been the argument all along. You heard from the lawyer for donald trump. The Justice Department but there was. Thats an excellent point. Chris case has been part of trumps team since last fall. Hes a former florida solicitor general. Hes been added to the team as counsel. Card blanche last week, former prosecutor who was worried by the trump team. He would not be able to take any active tick role today in court. He had before the florida courts to do so. Theres a scramble to get Carte Blanche certified. His counsel right now. According to the records that came out earlier this morning. We had caution. I talked to one former prosecutor who said as many of you at home no. Mr. Trump has changed legal teams often. It is not yet concretely clear that this team is a permanent one rather than in people out of the team. I talked to one former prosecutor could be surprised given the expertise, if chris case chris case, former solicitor general in there today. [inaudible] to see additions and subtractions in the months to come. Thats a great point. Michael william, scripts news was palm beach outside of the federal courthouse are miami. Michael, thank you. Lets go back to former federal prosecutor still with us at this hour. Walk us through a typical arraignment. Were not inside the federal karoun what has happened. You have seen so many of them. This is anything but typical. Beginning with the fact that the attorney general of the United States was sitting in the front row. Its amazing. Arraignments are all fairly similar. Ive handled hundreds of them. When raymond is using a couple of Different Things at the same time. Its an opportunity for need if anyone to be confirmed with the charges that he faces. The system can be sure that he is so he knows the allegations against him. Then in addition to that, there are a this is his first appearance in court. There is going to be a number of other rights that he has. Some administrative matters that need to be worked. Out lets take each one of those. Hes going to first theyre going to present him with the charges. Theyre gonna ask him if hes attorneys. How they review, didnt they review it with mr. Trump. Yes, they did. They will ask if they would like to have the indictment formally read in court. Used to happen in the old days. Does not mean today. Theyll ask what the plea is. His plea weve heard is not guilty to all counts. That is absolutely standard. I would be flabbergasted. I might fall out of my chair if there is anything about that. That would be the expectation. He will be advice regarding his rights that people at home have heard before. Someones facing a maximum of 150 years in prison. That sort of thing. That will be damaged. Doesnt mean much in terms of the time that it should be or could be. And then there will also be some administrative matters that are he will certainly be out on bond. There will often be discussions between the defense and the prosecution and advance to work out those conditions. If there is a disagreement among those. Conditions that will be concerned by the judge of that time. So the conditions and number of deadlines will ultimately be said in the case. Deadlines that a will for example determine when emotions can be filed. In this case, given that there is National Security information. Whats called a protective order. Which will protect the National Security information contained in the discovery. Not oh, i want to get inside the prosecutors view on something. I know that when a defendant is sentenced. The marshals are brought in place because theyre stepping back. They literally fall back into the brussels arms. They realize youre going to prison. What happens when a defendant like former president comes into the courthouse for courtroom. Realizes when he sees the prosecutors. When he sees jack smith. When he sees mark earl. And theyre no longer intangible targets. There are real people who now control his future depending on the outcome of his trial. Do they shrink in terms of stature when they realize the gravity of the charges they face. It does make things much more real to someone. I have been a prosecutor for many years. For almost a decade. Ive been a defense lawyer for years. For both perspectives, i can tell you that it is humbling for people to be in a situation. Its a very stressful and challenging situation to be in. No matter what you may be thinking at home. If youre watching the. This is a very stressful and challenging situation for many want to be in. I dont know who they are. It is without a doubt a difficult moment in someones life. That said, i mentioned a moment ago, generally speaking, a whitecollar defendant and certainly in this case President Trump will be out on bond. What often happens is theres a compartmentalization where this is a bad experience. Youre trying to think about it. You put it on off to the side. You go about your daily life. Often that can kind of not be something the defendant thinks about until trial. It is an important moment. This is a very stressful experience. Renato mariotti thank you very much. Interesting veronica that right now he is addressing an audience of one. In this case it would be the magistrate judge. It soon he will be addressing a crowd of hundreds in bedminster. After that, it will be a crowd of a 12. Jurors who ultimately decide the fate of the former president. Which is the way our legal system is supposed to work. I think whats interesting to point out in this case is that when you talk about this grand jury were going to be seeing in miami. And this is a state that he won. A 2016. He also won the state in 2020. Itll be interesting to see how that impacts this, how that affects the seeding of the jury. They had a staunch supporter of luxury. E. Jean colonel case of new york. S. Marshals and Prison Guards cannot really protect and theyre so if he would be given any sort of antipathy would be a home detention style but not true for nada he would go to jail i think that he has to think long and hard about whether he will spend the next five plus years in jail because of loyalty when in all probability he can strike a very favorable deal for himself where he can testify southeast aches for him are very high and i think the separation of the two will help him make an independent decision about what is in his best interests versus what is in the president s best interests all right former doj official Michael Zeldin michael will circle back with you later lets pick up the threat with mary of a former prosecutor this situation will not cannot talk to donald trump he is his man he is his valet the fact that they cannot talk if you were the prosecutor in this case would you right now be making a move on walt nada to see if he would flip i think i need you to activate the sound on your computer we cannot hear you sorry about that i was on mute the short answer is i think that is why jack smith charged him and other words i believe jack smith trust him because he believes he has the evidence but i can think of one reason jake smith brought us charges is because he wanted to achieve cooperation because that will create a lot of upside for jack smith to have a coconspirator testifying against the former president that said whether that will actually happen is anyones guess at this point he has not cooperated on and three skate double of what is going on with or there will be no communication between the two particularly since they are coworkers a lot of times the judge will make some sort of exception and that circumstance and say that they can talk about their employment but not about the case that sort of thing but not it seems to have thrown his boat and with trump so to speak and he is swimming in the same borders and ultimately the pressure will be there whether there is actually a break remains to be seen renata i dont want to start a fight between you and Michael Zeldin but michael indicated that not could be going to prison but the former president might not be hit a two person maybe hundred there is also january 6th any indictments that will come out of that grand jury if the former president is convicted in connection with january 6th and the insurrection do you see him one time kevin to actually serve prison time instead of hung the tension it is a very difficult question obviously unprecedented it is worth noting the former president faces a couple of other factors as well he faces a charge in manhattan which i dont think would get person time also potential charges in Fulton County georgia it is unprecedented it is also worth remembering of course the former president is in his mid 70s and the legal system does take some time to wind through to its conclusion as a practical matter i think this case might not be over for years to come a sentence not four years to come so it is possible i am not i am list offended even michael i think it is possible at the present time but given all the facts and circumstances i wouldnt bet my life on it either Renato Mariotti thank you talking about the former president h george w. Bush the former president born in the same year within months from each other that should give you an idea of sending someone like that which is way way far in the future because theyre still has to be a trial he is innocent until Proven Guilty but should he went up being sentenced anything for a man at age is literally considered spent the rest of his life behind bars or in home confinement and dunn figure this is not the only candidate from right now legal entanglements of the former president is facing this is just one of a couple we want to bring in lindsey should been ski right here she is a president ial historian lindsey what do you make so far of what we have been witnessing unfold with trumps arraignment lets talk about how unprecedented this is i think all of the preparations and even our conversations today demonstrate how much care and still has to go into this process but a thin terms of the security we see the gods outside the courthouse we see protections against potential violence against potential threats but we also see people grappling with how to talk about any potential punishment or implication because it is south of beyond anything weve seen that we are really wandering in the dark legally speaking so i think it is good and wise for everyone to move cautiously to move slowly and of course everyone present at the courthouse is tracing the former president as though he is innocent until Proven Guilty which regardless of the evidence is the right thing to do especially given the stakes and the unprecedented nature of this case what is particularly interesting lindsay is a lot of this is being communicated by the former president on his website truth social it is almost hard to know because so much information and so many statements unprecedented acts so many crises are scandals produced during the Trump Administration that we almost dont know what is going to bubble up to the top yet when the history is written of this particular incident i have no doubt that people will share that a lot of times this news this broken by trump himself on social media to try and get out ahead of the news cycle and craft his own narrative but the final words sometimes it is hard to know what that will be until we have seen all of the evidence and the outcome it is one of the reasons that historians are very bad for your product is because we are really used to seeing the past when all the facts are in front of us president ial historian lindsey should been ski thank you very much and a big thanks to michael and ornato as well thank you so much for joining us we will be right back you are watching florida 24 live coverage of the former President Donald Trump will be rejoining shortly President Trump is the first former president in federal history to be charged with federal crimes after his arraignment today in miami before President Biden g to deliver remarks from the Trump National golf course and bedminster tonight at 8 15 eastern you can watch live coverage of the spending box and couldnt spend now out free mobile video app and online at cspan. With alex miller, caroline, you are inside their. Or you have been our eyes and ears on the ground. Exactly what took place and what have you seen so far . Caroline just ran out of the courthouse and we are just going to ask for a couple of questions from here, if thats okay with you, dell, she cant hear you . Kellan, set the scene for us. You are in there for quite some time. What was it like inside the courtroom . Alex, we had to wait all day to even get into this courtroom. They allowed a group of us and and about not i am and we were allowed to have cell phones, no telephone devices. It was just kind of waiting. Finally, at about 2 45 my group of reporters was argued in. About 40 reporters, total, were allowed to come in. Plus about ten members of the public. When i got into the courtroom the former president was already seated. He was wearing a blue suit. I sat directly behind him, behind about two rows of secret service detail. The court room was full. On site it was maybe about 60 people total in their. I did see jack smith the special prosecutor in this, sitting on the other side in the audience, not in the prosecution benches. The president did not speak at all the entire time. When the plea was entered, it was his attorney who entered that plea. He said, of course, we plead not guilty. Sort of, not in a joking way, but there is no question it was going to be anything else. There was some discussion, back and forth, that made this arraignment take it longer than we thought it was going to. We thought it was just going to be the not guilty, the reading of the bond, and then we would be out of there. But there was some disagreement between the government and the defense over one of the special conditions of the bond for the former president. That is who he is allowed to talk to. About the facts of the case, without going through council. They sort of went back and forth on producing a list of potential witnesses in the case. What was ultimately decided by the judges of the government, the prosecutors would produce this list that would then be potential witnesses that the former president is not allowed to speak to about the effects of the case. But there was a lot of back and forth about that. Did they have somebody specific they really wanted to talk to, but i mentioned . They didnt mention anyone specifically, the issue we dont know who is going to be on this list. It could potentially be papal the president interacts with quite regularly. They did mention that one of the potential witnesses is the president s, continues to be the president s Legal Counsel. That was mentioned, not by name, but they expressed some concern because originally there was discussion of him not being able to talk to these people in any way not just about the effects of the case. What was decided on before the prosecution produced a list, then it would be people who the president is not able to speak to, simply about the effect of the case, without going through council. If his Legal Counsel has a problem with that list, they can petition to the judge for a review of. It when ive been in the courtroom, he would roll his eyes, he would make a lot of facial expressions. I know you were sitting behind him but could you see what his demeanor was like and there . I couldnt see his facial expressions, i was sitting behind him. I joke with you it felt like it saint and succession, looking at the back of his head. I could see that he went back and forth from folding his arms. He did lean over and whispered quite a bit with his representative, his lawyer, blanche. He didnt speak with his other Legal Counsel. At the end, when we were adjourned and we were auditing to be escorted out, the former president stood up and turned around and looked at us and the press and assist us. Didnt say anything, just sort of get a quick glance, then turned and walked away. Didnt say anything, didnt make any gestures. You mentioned the first two rows head in them. Was there anyone there on behalf of the former president . I didnt see his family members or his entourage that i would recognize. It seemed like a lot of his secret service that was there with him in the courtroom. There may have been other people that are waiting outside the courtroom but from who i could recognize, i did not see anybody, members of his family or the people we normally associate. To the judge say anything about his lawyers. Hes had legal representation go on and off, people have been on and off the ship. Was it a hectic start . They make a comment about that . They did established the two lawyers who are with the former president today will be representing him permanently. One of those lawyers was actually given that special waiver we have been talking about by judge aileen cannon, who has been so controversial in this case already. Those two that we saw today are going to be representing him permanently in this case. There was a bit of back and forth on the other defendant in this case, mr. Nauta. His lawyer today, his name is woodward, has not received a waiver. Because of that, his arraignment actually had to be delayed by about two weeks. They were able to go through with the reading of the bond, his bond has the same conditions as the former president s. They both and have a financial condition, they dont have to pay any fines, there is no travel restrictions, they dont have to give back their passports, theres no restriction on owning firearms, but there is that special condition about who they can talk to about the facts of the case. Because of what we were talking about what that special waiver for that lawyer, woodward, who is not borrowed in the specific Southern District. They are going to delay his arraignment where he enters the plea of guilty or not guilty, by two weeks, when they do come back for the arraignment, the judge said that mr. Nauta does not have to appear in person at rd mugshots earlier. We did hear earlier in the day from one of the u. S. Marshals, who was going through the procedure would be for the booking for mr. Trump, for the former president , and former star nauta. What he said to us when we asked about the mugshot, we were told that it would be a previously uploaded photo, not a new mugshot. We asked why, and what we were told was we all know what he looks like. We have seen his face millions of times and we dont consider him, hes not concerned with a flight risk. Its not something that could just sneak out of the country and we wouldnt know about it. Prosecutors today also said they dont consider him a flatters, thats why theres none of those travel restrictions being placed on him. That is an interesting justification front having a mugshot. Dell has a question for you. Alex, i know youre going to really my question, so dont tell her how impressed i am with the incredible detail that she has managed to describe everything that happened inside that courtroom, because i recognize that she is not holding any notes. Im wondering whether she has an orographic and photographic memory. That said, eric trump. We know he was with the former president. I am curious, did you see any other family members of the former president , ivanka, melania, or any others with the former president as the arraignment of place . Did you see any family members, i know you mentioned you didnt see any in the courtroom, or any roaming around the halls . I did not see any family members. None of those faces we are so familiar with. The most of the people i was seeing or u. S. Marshals, people who worked for the courts, a lot of journalists. There were probably at least 100 of us waiting in a holding room all day. But there were a handful of members of the public who were there as well. I did talk to a few of these members. Some of them slept overnight in this line to get into the court, but what i was kind of surprised by was that safe for just one of them, the folks i talked to that were there or not flag waving extremely pro Trump Supporters, a couple of them or just swept up by the history of what was happening today and said that they just kind of wanted to witness it and see this history taking place, something that never happened before, and witnessed them for themselves. Were they saying they were not angry about it, i just wanted to see . It one man i talked to, let me flip for my were not fairly quickly to get a little more detail on him. He is actually a federal litigation attorney who lives in california, but he was out here in florida, traveling for basketball camp for his daughter, about an hour away. When he heard about what is going on, he said, im a federal litigation attorney, i want to know whats going on. He drove into say this. He told me he was a trump supporter, that he did vote for President Trump in 2016, but that he doesnt support him anymore after the events of january 6th. He said, he really just wanted to witness this moment in history today, especially someone who practices federal law, he thought it was something fascinating to be party to. He got here at about 10 00 last, not and cannot overnight in order to get into the courtroom. Trump is greeting some people right now, dal, i will send that back to you so you can talk about whats going on down there. Caroline and alex, thank you to both of you. We want to go to brian the chief of staff. As we say the former president s now and little havana, brian is also a foment leading republican through the. Just the politics of this, the crowd of thousands was cold full, a crowd of 100 or 200 might have showed up. By some estimates, they locked aside might be 500. You will vote on the politics of what we saw unfold today in miami . I think its really interesting. I think its good for the country that we did not see the kind of chaos that was being asked full and being requested on social media this week, where we heard members of congress saying guard the bridges, i think, you know, that everyone was understandably on edge with all of the talk about the potential violence. Especially after what happened on january 6th, trump asking people to close home. I think its a very good thing that we didnt have that today. At least we havent had that yet today. You brought up january 6th. What im gonna point out for a lot of people, they dont seem to remember there was also another incident was violent and december, and which Trump Supporters clashed with anti Trump Supporters and washington, d. C. That being said, do you think what we saw today in florida gives rise to his political opponents to be more prison aggressive and criticizing the former president . We sort with Chris Christie and Asa Hutchison to a certain extent we officer it with former governor nikki haley and south carolina. Do you see the door open now for other critics of the former president , and political opponents, to seize on him maybe politically being weaker than he thought he might once have been . Absolutely not. In fact, this morning nikki haley was on radio saying that she was leaning towards a pardon if she is a look at president s. This hasnt changed, at. All you have a man who is the front runner in the republican primary, his people, his base, is not going anywhere. They have been with him on the beginning. They remain with him. They are the largest chunk of the republican voting base. So what i think is this, for his president ial run, i dont think it matters. I think his people get fired up by this kind of thing. I think that he is probably going to use this for fundraising. To not he has an event. There is a fun present play going up with it. Unfortunately, you know, it is a cult. They are acting county. They are going to absolutely follow him off the bridge. Brian, standby. I want to bring in a political director Andrew Rafferty. As we are seeing these images, the former president right now and little havana, go into the restaurant after his arraignment. After being indicted in herring his 37 criminal charges right against him. You are looking at someone who already is working the crowd, you are right. Even after the indictment was announced, the fund raising text went out. Is this a bad day or a good day from the former president . Look, donald trump has been very clear that he did not want to get indicted. He told reporters that. Even if his post to go, up but here are these images. I believe this is the first side bakery in little havana. Anyone who has covered president ial politics in florida, trends ive gone there with a candidate. The fact that he went straight from the courtroom to and off the Record Campaign stop, i think, is a pretty clear indication of what we should, at this point, expect to see out of the former president. He is not leaving any of his legal traveler him down. I think his campaign team, tonight, you mentioned they are holding a fundraiser. I think they are working hard to raise a lot of money. Andrew, we spent a lot of time talking about the venue. You see the crowds and everything else. We have a country that is in decline like never before. We cannot let it happen. Im going to make a little speech tonight. In bedminster. I hope you are going to be there. I hope you are going to be there. You can come to, if you want. Thank you, everybody. Thank you. Thank you everybody. I was going to ask you just moments ago, venue. We talked about the judge. We talked about what the jury pool will be from. We also didnt talk about it, concerning what might be different. The image we are seeing right now, had the former president been iran and washington, d. C. What we are seeing on a screen with him and little heaven, we would not have seen in washington d. C. Certainly not. That is the other side of the spectacle of this. Florida is an area very important donald trump. As we are he decided to make his president s after leaving the white house. Just so happens to be incredibly politically important. Just so happens to be the state where his chief political rival is the governor of. So all of these are playing into what has been a very interesting endemic throughout the day. To see him as in the campaign trail, getting one last stop, not going to waste a visit to florida just for an arraignment, going to make sure i get some Campaign Time out of it. I think that is very telling about where Donald Trumps mind say it is, his campaign at around us is. They want to show a certain level of defiance they have seen over the weekend and those rallies both here in georgia and North Carolina continuing on today with this stop before he heads back to the airport, and back to new jersey. I want to point out, we have been on the air now for the better part of three hours. Guess which name we did not mention until now. That of florida Governor Ron Desantis. This is his backyard. He is the governor. He had overwhelming support in his race for the governors mansion. He is Donald Trumps political opponents. Why is he invisible . This is going to be a really challenging time for the rest of the republican field. You remember that first indictment, back in new york. That came at a time where donald trump was actually either magnetic or trailing one desantis in the early polls. After the indictment, we saw rallying around donald trump from the republican establishment. He ultimately is no pretty handily ahead of ron desantis. The real challenge, not just today but for the foreseeable future, how do the rest of these republicans kind of make a name for themselves and stand out when they cannot really go after trump for these charges because, we know, the republican primary voters are pretty handily on his side. And the rest of the republican establishment is mostly focused on what they are calling the weaponization of the department of justice, that the department of justice is somehow unfairly going after the former president while opting not to go after people like Hillary Clinton and joe biden. Of course, there are some very key differences that we will continue to talk about between some of those past instances and what we saw today. But it is a really challenging time for one scientists, nikki haley, tim scott, and anyone else trying to run president next year as a republican. For anybody watching these images, wondering whether a politician can emerge more popular after being indicted, history in the usa has shown us politicians have campaigned amid scandals before in the past. The former mayor of washington d. C. , marion perry, reelected upton time in person. Also, huey long and other politicians. Our history is checkered when it comes to that particular issue. Dont go anywhere, a special coverage of the arraignment of Donald John Trump continues right after this quick break. Well be right back. We take you back now to live coverage of the agreement of former President Donald Trump in miami, courtesy of florida 24. Welcome back to our continuing coverage of the arraignment of Donald J Trump. Im del walters in atlanta. Former president making an impromptu stop hostile evenly courthouse, he lived the restaurant after being greeted by well wishes. Not exactly what you expect to see after a criminal indictment is read in federal court. This is critical of court right now, as you can see, the small contingent of Trump Supporters is leaving. The day ended without incident, the aaron meant lasting roughly 47 minutes. The president s son, former president son, eric trump, was by his side. The plea was entered by his attorney. That play being, not guilty. I want to bring in juliette janai. Julia, we had a interesting conversation. You deal with the law, only. This is the law and politics. You will thoughts on what you are seeing after the former president left the courthouse . This is different to see how people are responding, those supporting him, that is not supporting him. Different from what you see it and iran meant. Its not a rally. When you look at cases, oftentimes you see people taking and. Looking at the facts, about the fact the irreducible whats going on . In this case, it seems there is a very high number of people. I would go to certified acai a majority of people, dismissing the fact completely because didnt believe in the why this was handled, all those who seem to be on board with it because they believe this person is guilty. As you are seeing these images, our key reminded of the faiths jury nullification, in which you only have to find that one member of the jury who says, i do not believe anything that prosecutors are putting forward and therefore im going to continue to vote for acquittal, no matter what evidence you present. Is there a strong case right now for an argument of drawing nullification on a part of his defense team . Jury nullification being that they dont want to follow the law . Even if the law and facts lineup, even if there is proof beyond a reasonable doubt there are going to have nails . There got, how they feel about the system. It is possible in a case where a juror could go that route. Jury selection is going to be so important. Federal juries usually are much more intensely vetted, and will likely see as close to a group of unbiased people, people who arent polarized on one side or the other, who will serve as jurors, if this case gets to a jury. As you are now seeing the images, politically, and also the images legally. What is now the most important part of this case moving forward, jury selection, the evidence that is a lot to be selected . I know you will say all of the above it is all of the above, can i see transparency . For the public, the need to see as much as possible about how this process works. Federal courts, they will not be cameras, they will not be able to see how this unfolds as they might be used to it is that course. The first state is this and document, its thorough, its got pictures, a lot of animation we dont often see and a federal indictment early on. I think a lot of things will be sealed, but i think as much as possible the Justice System needs to make sure the public understand the process so they understand the outcome. One of the reasons that have argued for tickets about not having cameras in the courtroom we are watching helicopters, watching the motorcade of the phone president make his way through the streets of miami. Whistle, moments ago, him live at the restaurant and little havana. Meeting and greeting people. The moment after the arraignment. We saw nothing that happened at the current publish whatever that happened after that. Is this a strong case for the effect that, i guess, the Legal Proceedings have now become part legal part theater, or has it always been that way . I think its always been that way in terms of the Public Interest in certain cases. They certainly have an interest in this case. I dont expect it will be any exceptions made for more awareness inside of this courtroom, even journalists wont likely be able to take in devices to relay information. But i think you are highlighting a really good point. We have herrings, things are over, the former president will be able to come out, give a rally, speak, say what he wants to say about what happened inside. And then will likely overshadow what the prosecution cannot divulge. We know prosecutors very often cannot speak about a case. So, likely the entire narrative of this process will be through either the former president and his reporters that are the, journalists inside trying to relate what is going on. You have the right to remain silent until you dont. Joining us from korte v. , julia jenae, thank you very much. Lets go to joe st. George, about the federal courthouse in miami. John, we have been focused on the form of prisons movements after leaving the courthouse. What aspect through what just happened inside that courtroom, as that history was made. Good afternoon, once again, del. Some of this could have been provided of time. Experts throughout the day on scripts news predicted correctly. A not guilty prairie. Judge, as our producer said previously, the president was ordered to limit contacts with certain individuals, including his codefendant in this case. Also we learned there would be no travel restrictions. There was always the possibility his passport might be surrounded all that his International Travel may be restricted. Not the case here. I was struck at the courthouse, hearing the helicopters of where he had, it just half an icing. Del, you are a student of history, as am i. Just have fascinating a from a president mr. Trump. Is twice paged, twice indicted, but he lays the courthouse and guys to a Campaign Stop right away. His supporters are with him is if nothing happened. It is important for us as the media to remember there are two that we are a divided country. You have half the country who are saying, of this indictment, finally. Half the country saying this is justified. You have another half of the country saying this is politically motivated. This story is playing out one way in new york and in washington and another white in cheyenne, wyoming. They are asking this question right now. What about President Biden . He had classified documents, too. There is a special counsel investigation into the president as well, happening. What about him . Well, very different circumstances. When you read the 49page indictment, that i know a lot of viewers might not have the time to, we did it for you. If you read between the lines of this indictment, del, it suggests that if former president turned over these box when he was asked, perhaps we would not be live here in miami. The former president would not have just been arraigned in federal courts. And President Bidens attorneys, from Vice President mike pence also dealt with these issues, they turned over the documents right away. It has been a fascinating day. How many afternoons and accurate which out about a story of the day involving former President Donald Trump. Today was one of those days. Looking at these images of the motorcade making its way to the airport, i am reminded that there is another lands looking at this. Children, sitting in classrooms around the nation. Many of them will be returning home, asking what happened on this day. Parents will tell them, on this day, a former president of the United States was around on criminal charges. This will be one of those moments and time, in American History, we are so many people will say on this day, this is what i was doing, and this is what was happening. So many people will ask what it was like. Del, if i could interrupt you just quickly. If you are born and 2010, 2014. All you have known is the politics of film of President Donald Trump who emerged on the escalator in the summer of 2015. Reporters said he didnt have a chance. He ended up winning the nomination by a landslide, and winning the presidency. Here we are now, our Third Straight president ial cycle, where he is the front runner for the nomination and this indictment has done nothing to change that fact. Welcome back, you are watching scripps news rain continuing coverage of the arraignment of Donald J Trump. Former president s. Im del walters in atlanta, joining us now poll, from a prosecutor, thanks to being with us. Came to get your take just moments off to live in the courthouse. The former president officially had in the campaign trail, with legally moving forward, head of a couple up to try a case who got 74 million votes and is portraying him as a victim, not an accused criminal. Its not the first time that a defendant is going to use victims that is as his defense, one of his defenses possibly. It is something that federal prosecutors face diane and die at. This is a little bit different, obviously, given who the defendants. That makes it, his youve seen happen today, a federal courthouse as a very different environment than a political pit stop. I think there is some seriousness, some nobility in a federal courtroom. Eight different type of roles, and there. Rolls of evidence wont allow him to do too much victimization. Poll, as you know, the based day for a prosecutor is the day that the indictment is unsealed. In this case, the indictment was unsealed two days ago, not today, when it is usually right during the formal arraignment. That being the case, as the prosecution have they lost the momentum . I was a federal prosecutor in the Miami Federal Court has five thing is, i used to tell my people that i supervised, that not only was the day of the indictment a good day for a prosecutor, every day we are at the as a good day for a prosecutor. We did good work and burgundy and almond forwards. And this case, its a solid and document. All of the stuff we see coming on in the public with Campaign Stop and things like that, thats not something that will translate in the court. It may affect the potential jury pool, but in the court room there are rules of evidence. Rules of procedure. It is a very different environment in the courtroom. If the prosecutor has a great case, every day Going Forward is a good day. In this case, when we look at the indictment, it appears to be and and that meant that is built upon a pace of very strong, almost impenetrable evidence. I think that is the mountain of truth that trump is going to have to face. All of this stuff on the campaign trail does not get admitted in federal court. I think that this case, the prosecutors have put a very strong case, so long as the judge acts like an impartial judge. Their job from here on out, not as easy, but straightforward. Paul, ive got 30 seconds left before i lose you. We spend so much time talking about whether a defendant can get a fair trial with a jury. In this case, do you think the prosecution, because he has been so much time in florida, can get a fair trial with a jury . Yes. That would be in the jury selection. Jury selection, even though in federal court it is not as detailed as it is in that court, jury Selection Process, prosecutors are allowed to weed out those people who might have praised elections either for or against trump. The jury Selection Process will weed out people that wont be fair. That being said, i think that the biggest hill to climb for the prosecutor is getting a fair judge. Remember, this judge has shown in the past that she is inclined to lean towards a treatment towards trump who appointed her to the federal branch. I think that, by the way, is the biggest hurdle that the prosecutors need to climb now. Former federal prosecutor, paul pelletier, thank you very much. We are looking at the motorcade of the former president now arriving at the airport in miami. That is of course the plane of the film a president. On the campaign trail, he refers to it is trump forest one. I want to go to our National Security correspondent, sasha, who has been watching todays correspondents. Sasha, for the people inside the courtroom, it is a case. For the people who you talk with until the basis, this is about protecting the nation secrets. I am curious about which image from the indictment is ringing louder for those people to cold sources . Those boxes out in the open at maralago . Because they know that people in some instances put their lives on the line to get information and all those boxes. Absolutely, del, those images were so striking these were documents that belong insecure rooms called scifs. Sensitive compartmented information facilities. Instead, they are sitting in a bathroom, sitting in a pool of room, skewed on the grounds. According to the indictments, one of the documents that was just laying on the ground was a top secret documents. The prosecutors also alleged, from a former trump attorney, that trump said wouldnt it be better if we just told them we dont have anything here. I think that what is going through the hands of a lot of the people that i speak with is the fact that, essentially, this is not just about the pieces of paper laying in those boxes. These are valuable streams of intelligence that keep the country safe. These are people who are sharing information with the United States, risking their lives, could potentially be child or killed or vanished. There are u. S. Military personnel who are serving overseas to depend on information being withheld so that they can do their mission safely. This could certainly damage relations with u. S. Allies as well. The question becomes, do americans, after seeing what happened in this case, do they continue to take care of the protection of National Defense information, what the special prosecutors are using it as an umbrella term for all of the classified documents, and even some non classified occupants that we are talking about, Going Forward. Do people still take risks to help the United States and mexico fights for this country . There was an itemized list of 31 documents here. And they are signed off on by the National Security agency, by the cia, by the National Geospatial intelligence agency, via the Departments Bureau of intelligence. And other intelligence agencies. We are part of the transcript, reporter conversation the former president had with others who did not have security clearances detailing a potential attack on iran and acknowledging that he did not declassify it. There was information about white house briefings on Nuclear Capabilities, military capabilities and attacks on Foreign Countries. As well as a u. S. Potential vulnerabilities to attacks and nuclear weapons. Although, a lot of the information was not disclosed to the public, there were indications they were classified markings such as tea is for a top secret, h c s for human control system, meaning human sources, no foreign, meaning no Foreign Government should be seeing this, and one important one, formally stood the data. This means it was previously classified for the Atomic Energy act. Related to the militarys use of atomic weapons. This is material with the department of energy and the department of defense will declassify, the president would normally not be involved in that. There is also a conversation about what these documents could be. One document, for example, document number 14, that says it came out in january 2020. Military options of a foreign country. Around that time, United States had killed a top iranian general. The iranians were tolerated. We can speculate about what some of this was. Del. Live for us in washington, sasha inger, one of the questions that my comment in the trial, why. Why with the former president want to keep 70 document classified. Why would he not want him a vote of the archives, if and it was the case . I want to go now to a White House Correspondent, live with the Trump National gulf coast invade minister, new jersey. It is safe to say you got a preview just moments ago of what comments the former president making this evening. Del, that is exactly right. He really kept in line with what we have heard from the former president to date in these comments. He said a preview of what is to come later during his stock in miami that this was a quote, country and decline, and he followed that up on social media thinking, aiming for the quote warm welcome, on such a sad day. Trump is expected to be making his way from miami to hear, to his golf club in bedminster. This is typically where he spends his somewhere. You can see behind us, these stages set for what will be his first formal remarks since his arraignment in miami. Now, today it, says this indictment has been unsealed, we compass to his criticism on the biden administration, the Justice Department, and the special counsel, framing this is a quote, political hit job. That is a term he used during his remarks and georgia over the weekend, and as quote, weaponization of the doj with 2024 in the backdrop. It certainly stands to reason that we could hear more of that tonight. In another focus we heard since the indictment was unsealed was on tv polling on President Biden as well as his republican challengers. The polling shows that he lead solidly against some of those republican challengers, though some of them, notably nikki haley and Chris Christie have become more vocal and their criticisms of the former president. The Trump Campaign has looked to fundraise and the look of this indictment, sending out notifications today, and this evening trump is expected to be holding a fundraiser here in bedminster. We are looking at the images coming up of miami, florida. That is the president s plane, he is now safely on board. His next stop will be where we saw haley awaiting the speech tonight, there are minor to stay with scripps news because we will be listening to the remarks from bedminster tonight, and bring you all of the relevant portions. He speaks at eight pm, tonight, eastern, seven pm central time. We will be right back, you are watching our historic coverage of the arraignment of Donald John Trump. Stay with us. We take you back to live coverage of the arraignment of former president , donald trump in miami, courtesy of florida 24. Welcome back, you are watching script news, continuing coverage of the arraignment of Donald J Trump, our political director is back with us you saw something as a former president made his way to havana, in miami, some of us did not see. This is the former president s plane leaving right now, getting ready to depart miami. Tell us what you saw, the images you are seeing right now. You can see the president s right shoulder there, i believe that is the codefendant. His right shoulder, my Left Shoulder for the viewers. Right there, in the red tide behind him, he is hes donald trump, what is known as a body man. What that is is essentially a highprofile individual, especially when they are in dynamic settings like this. Essentially help their person through crowded spaces, and help make sure their needs are met. You will see him there in that footage as he has been known to those whove covered donald trump on the campaign trail. His righthand man, this is coming after a few moments ago. It dutch told them that they cannot speak about this case, even though they Work Together nearly every day. Imagine that scenario play out, where you have this arraignment, this earth shattering historic event, and you are now not allowed to talk about it without facing further legal scrutiny. So, the face of defiance not only in that campaign, but how donald trump is conducting himself. The judge said that they couldnt speak about the case, but the question becomes just moments after those images that we just showed you, the former president , once again reiterated that he believed that he was being politically persecuted, not his words, but a description of the way that he framed what happened today. How does walt nada not really listen to the arguments coming from the former president , and how does he not participate in what the judge is telling him not to do . It will be a difficult situation. Even more difficult and now facing his own federal charges, just, im sure thinking that he was doing what his boss was asking him for. We know, according to that indictment, he had a chance to come clean in the words of the prosecutors, and the department of justice, and they feel like he was untruthful with them. Thats why hes in the position hes in right now. This plane is going to take off momentarily, and take off to new jersey, where we are going to see a politicallycharged remarks from the president. We know that there will be some highprofile republicans on hand, to listen, we know that the reports that actually a u. S. Senator, tony tuberville, missed a pretty key vote today in order to be in new jersey, eight to attend the remarks that are happening tonight, that of course is going to be paired with a fundraiser, and i expect that we are going to hear from the Trump Campaign, just how much theyve been able to fundraise over the past 24 hours after this arraignment as a sign of their political strength. I want to go back to our correspondent who is outside of the federal courthouse in miami, alex, we think about well scripted plays, but this one began with a rather bumpy start. Specifically on whether or not the former president was going to have adequate legal representation [inaudible]. The Southern District of florida, usually, those kinds of waivers to be able to at least appear with your client, we are told from legal experts that this could take a couple of days. And it didnt, it took less than 24 hours, and we are told that that waiver that he was given in order to be able to isnt next to the former president , was given by none other than judge buchanan. She is the one who will likely preside over this trial, she is the one whos already had a little bit of a dark cloud around her because of some decisions that she made relating to this case. Relating to appointing a special master on to borrow the fbi from looking at the documents that they seized from maralago, and an interesting choice that she made to allow him to appear today to give that kind of difference. He is the one i am told from our white house producer who was in the room who was entering the not guilty plea, the one doing the negotiating on behalf of the former president. And the one the former president was speaking to during this entire proceeding. This process took a lot longer, it seems like, then it did during his charges in new york city during his arraignment, then. So it is interesting that he has signed on to another case for the former president , now it remains to be seen if he will stick through what could be a very long process. It is clear that he is the person here despite the fact that they brought somebody else onto the team today because he had practices in florida. I wonder how much he was there as almost a figurehead to show that they had somebody representing him from florida, when really taught blanche was the one taking the reins. Alex miller, our National Correspondent for us on the ground throughout the day, in miami, florida, alex thank you very much, and i think you as well. Specifically we want to thank each and every one of you for watching our coverage today, a reminder that our coverage continues tonight from bedminster, new jersey. The former president , now taking off from miami, getting ready to go on to the next phase of his campaign. A former president of the United States, the man in charge of the criminal Justice System in this country, standing before that same system, today charged in a 37 count federal indictment, charges relating to the espionage act and whether he mishandled some of the nations most closely kept secrets.
