By the way, janet yellen giving a speech. The fed chair is expected to speak this afternoon following fridays dismal report. Well focus on what she says about the possibility of Interest Rates higher in june or july. Shouldve made this morning, dagen mcdowell, and we cant cap about kevin kelley. Good to see everybody. Dagen they are all fired up. Former cbo director douglas holtzeakin sfs. Judge Andrew Napolitano and former speaker of the house, Newt Gingrich, former heavyweight boxer larry holmes and gerry cooney with us as we celebrate the legacy of the greatest, mohamed ali. Take it off right now with politics. Approaching another primary date tomorrow is fixed is set to vote tuesday. All eyes on california, the largest as democratic candidate Bernie Sanders and Hillary Clinton campaign over the weekend. Clinton seeks to clinch the nomination but tomorrows vote. The secretary mr. Made additional delegates to 2383 and become the presumptive nominee. The controversy still surrounds the delegate count without the superdelegates the race is a lot tighter potentially giving vendors a fighting chance ahead of the july convention. Both candidates find Common Ground in their opposition to republican rival donald trump. Clinton target and the case derail the Presumptive Republican nominee. Were trump is doing is trying to divert attention from the very Serious Fraud charges against Trump University that has basically been confirmed by some of the highest officials who worked with him. So this is typical. He does have that same skin. Judge curiel is as american as i had and certainly as american as donald trump is. Trend du jour manaus Cobb CampaignSenior Press Representative taylor baumgartner. Thank you for joining us. Had we released an attack ad against donald trump this morning calling him out for comments over the hispanic judge decided over the Trump University suit. I want your take right out of the gate on this. Listen to this. We heard her earlier basically with the ad saying what she said was racist. Whats his position on this . I mean look, hillary is trying to divert attention to the many scandals of her life in wouldve been vastly, coordination with Clinton Foundation, getting millions of dollars from foreign countries. Her behavior is dishonest species a threat to National Security. Quite frankly she clearly spent a lot of time on that aspect had in this ad her team. She shouldve put this effort into preventing benghazi from happening in many other things that fell through. Maria how do explain supporters of donald trump saying this was unacceptable, he should not have attacked the judge this way. Talk about people like Newt Gingrich this morning. Paul ryan all denouncing the trump says. This is the case, a private case dealing with the Trump Organization and a private matter. It should be tried in the courts in front of the jury, not the media. The speculation is quite frankly free airtime in its media hype. Dagen healy, the issue is from a lot of Donald Trumps supporters, people in the republican party, why does he keep talking about it . It highlights a civil suit. The republicans as well talking about it, that he is getting his opponent ammunition to target him because hes keeping it in the news. I think theres a mr. Trump did a round robin of sunday shows that aired yesterday. The fact of the matter is he clarified his position regarding the case. Moving forward and at this point it should be tried in the core brand in front of a jury. That is everyones right when going through the court. Whether the plaintiff or the defendant. Haley, the former attorney general for george w. Bush, Alberto Gonzales, came out in support of mr. Trump. Could you give us some color as to why you think he did that . You know, i am not quite sure why alberto did that. He and i are former colleagues. Hes a very respect demand in terms of the department of justice and in the legal profession. You know, i think its a good think that he did. I hate knowledge and for doing that as he thought that was the right thing to do. Trade to kevin kelley, that is the point. People do have the right to question whether or not the judge is going to be fair. But it has been pretty unanimous in terms of people pushing back. Donald trump as a private citizen, not a public figure. Everything is highlighted in precise even more. Every word he says about this is going to come under a giant microscope. It highlights the fact that he is shown when the people can question things. They do have these rights. How he goes about it is a different thing. One of the more important things we need to figure out his g1 to vote for someone that is going to operate at their best interest of themselves are the best interest of this country and donald trump has shown he wants to run for the best interest and that is what Hillary Clinton would do. I agree. I want to touch on that point. The fact of the matter again if this is a private case. Anyone can bring a case. It should be tried in a court in front of a jury and not in the media. There are people who say they will defraud because of Trump University. Getting away from the comment in terms of the judge, what about the issue at hand . You can say anything. Lets be clear on that. Again it doesnt mean it has merit because somebody makes the claim that file. It should remain in the core. Trade to now the focus is on his commentary. Speaker Newt Gingrich on Fox News Sunday this weekend. Listen to this, haley. This is one of the worst mistakes trump has made. I think its inexcusable. He has every right to criticize the chest and face are decisions are right and his attorneys can file to move the venue from the judge. First of all, the judge was born in indiana. He is an american. When you come to america, u. K. To become an american. Maria what about. Com if you live . There confusion the fact this person is american because he is mexican ancestry . Hes american. Book, hes entitled to say what he feels and clearly he made those remarks. The fact of the matter is mr. Trump clarified his position on the sunday show yesterday and that is what should the reference in terms of his position and his comment. But then forward, the speculation should be laid out in the media. Thus totally unfair. Again, whether they beat the plaintiff or defendant is to remain on the court record be decided upon by a jury. Maria does this state . What do you think . Dagen my personal opinion is that to the campaign of mr. Trump himself how he continues to talk about this judge. I will point to an editorial in the wall street journal today. President obama has not been above criticizing the judiciary. He went after the Supreme Court over Citizens United and even made remarks against cheap Justice John Roberts ahead of the above medicare ruling. However, the wall street journal does right by what elevates mr. Trumps remarks to the reprehensible as his equation of ethnicity with bias. They said nobody should be judged by thancestry of their parents anymore to chief Justice Barbara should be barred from ruling on religious liberty cases like Little Sisters of the poor guy sees a roman catholic. Thats the overarching issue the journal touches on this morning. I mean look, president obama should be focused on instituting sound policies, preserving National Security, not doing billiondollar deals with iran. Hes been a total mass in terms of his president they appeared worse than jimmy carter. I think it is baseless rhetoric on his guard. I just does his comments. Maria things to be done with program. Investors are wait to go hear from the chairman of Federal Reserve, janet yellen will give a speech this afternoon following jobs on friday. Lets turn back to politics on friday. Bernie sanders and Hillary Clinton campaigning in california ahead of the states big primary vote right now. Fox news john roberts onset with us this morning. Hillary clinton believes that shell be able to declare victory as of tomorrow night. You know, theres a lot of primaries, a lot of delegates up for grabs tomorrow. She is less than 30 away after big win in puerto rico but Bernie Sanders is out there in california trying to win the golden state. He is going to take all the way to the Democratic Convention, that he is going to buy for some of the superdelegates. She has 348 to his 46, if she can win california, he can make the case im the one who has the momentum and win in november, come over to my side. Lets listen to clinton and sanders, how theyre portraying everything. Lets see what happens on tuesday. I believe on tuesday i will have decisively won the popular vote and decisively won the pledged majority. You cant get much more than that out of the primary season. Not quite accurate and i think the Democratic National committee has made that clear that what she would be doing combined pledged delegates. Those are the real delegate that is people vote for with superdelegates, people who are appointed by the committee and what the dnc has made very clear that the media should not lump those two together because pledged delegates are pledged to the r to the candidates and pledged candidates with change their mind. Asked by griffin if theres going to be contested, bill clinton said, we have rules and lets see what happens. Meantime, donald trump running into criticism for members of his own party after doubling down comments on Gonzalo Curiel overseeing the lawsuit. He has conflict of interest, because hes mexican heritage, that drew fire from paul ryan and Newt Gringrich who is a supporter of donald trump. Thats indefensible to Say Something like that. Gonzalez, former white House Counsel for george w. Bush, suggesting that there are connections that curiel has with organization that is may suggest that he supports the democratic president ial candidate over a republican. So we definitely have not heard the last about this. Maria we are going to be speaking with Newt Gingrich, we want to get his further commentary on the situation. How likely is it in your view, john, that some of the superdelegates will change their opinion once the convention comes. Thats what Bernie Sanders is hoping. Is the Bernie Sanders strategy to try to overturn the things are going now or turn it in his favor at least or to just get a big position at the Democratic Convention . Typically what happens with challengers, even somebody as strong as Bernie Sanders, once the convention happens, they are forgotten, he doesnt want to be forgotten. Lets see if he can swing superdelegates an they big give him a big position. Kevin we had one of the heads of the nurses union, shes going to be at the delegate and wants to have open and ongoing dialogue of delegates. If Bernie Sanders win california, dont some of the superdelegates, if hillary cant carry california, may we start have to thinking logically speaking you can say that. Maybe Hillary Clinton cant carry california in primary but maybe she can carry in the november election. There is, i think, growing discomfort about the idea of superdelegates. I think they may look at it for 2020. Its not going to change for now. Dagen there was a problem with superdelegates. Its not going to change this year but might for 2020. Maria luis miranda did say they were going to change. The change will come next time. John roberts. Former director doug. Doug, good to see you, good morning to you. Whats your take on all of this . She has all of the superdelegates, sit even fair that she had 400 delegates even before the first vote was cast and as kevin just mentioned we had the head of the nurses union last week, we are going to be making noise outside and inside the convention. I think this is the big difference between the parties this year. The republicans gave up the idea on superdelegates. You see someone like donald trump presumptive nominee. On the democratic side, the superdelegates give establishment their voice. Its going to be a pressure to get rid of them. They are the way they maintain control. Maria we have to talk about the economy, the number one issue has gone back and forth from National Security to the economy. Jobs report was a disaster on friday, 38,000 on friday added for the month, lowest number in six years and half a Million People dropped out of the labor force. People were looking for 160,000 jobs. It was 38,000. Doug, what does this tell us about where we are right now . 68,000 people who were working parttime for economic reasons, slack demand. Thats a terrible number at this point in the recovery. You look over the past three months, we have roughly population growth. Thats the kind of the behavior you get near the peak of the Business Cycle. Its hard to imagine going south from here. I think theres a lot of reason to be concern. Maria Anthony Scaramucci, we were on the panel together and they were shocked. We thought it was a mistake. No way the fed is going to raise rates june 15th. Janet yellen is speaking today. Anthony i think she has to take the june off the table. The reason they want to raise rates is the fact that they have no ammunition. You need 400 basis points at this point in the cycle. They have no ammo in the gun right now. Thats the tension inside the Federal Reserve right now. Dagen thats the author that Jon Hilsenrath wrote in the journal today. They write exactly a rate increase at the june meeting. Maria you could have written the article yourself because youve been saying because the Central Banks of the world are out of ammo. Dagen right, a move in july is still possible. Kevin one of the points we need to take about janet yellen is guidance going forward. It wasnt the quarter rate in december that moved markets, it was the guidance of raising four more times. If she indicates they may raise even one more time after that, two more times, i think that would spoke the market. If you were the chairman of the Federal Reserve, would you be moving rates here given these numbers that youre seeing . Yeah, look, i think the fed has this wrong, i think theyve been entirely too spoked by market reactions to their guidance and moves. They should be raising in june. The reality is they dont have much ammo to make the economy grow faster but dont have to slow much. The fed is really not got the power that thinks it has. With 4. 7 Unemployment Rate and year over year inflation, around 2 . They should be much closer to normal and start getting there and watching the real economist doing and spending less time of all the markets, having said all that, theyre not going to move in june. Theyll repeat the mistake in july. Maria implications of low rates, deals and buybacks about an economist is saying, the rockbottom rates is dictating Balance Sheets and thats why you are seeing so many dividends. This is another issue for markets, doug. There are new polls over the weekend that show that there is actually increasing growing support favoring a british exit from the european union, currency markets reacting to the news this morning. Whats your take here . The referendum is on june 23rd, doug. The uk vote to leave the eu. We may and there will be economic repercussions. I dont think that most people seem to expect. Im puzzled by that. I will say its a political disaster. The uk leaving the eu leaves the eu in a very procariuos state. It was designed to give europe a big voice in the global state. The doors opened for eu to maria guys, what do you think . Let me just say when uk not decided to go with the euro. That was a smart move. Kevin im glad you brought up currencies, what happens during the jobs number, the market moved 1. 8 on the dollar going down. That was on the jobs number. Can you imagine when if they leave what happens to the currencies and thats going to Impact Global trade across the board, but the thing that people arent talking about when it comes to britain leaving is that they may get a worse deal trying to renegotiate some of their trade agreements and some of the immigration policies. Anthony i dont think its been explained to people so i will try to explain it. You have rising tide of nationalism from the fact that we are losing veterans from the second world war. Dagen you know what today is by the way . Anthony the Economic Union and the eu were put together to try to stabilize europe to stop these wars. When you lose your wartime memory from your political leadership, you get a rising tide of nationalism. If they leave, its the dam breaking in europe. You dont want europe destabilizing because there wont be another war. And thats the thing that no politician is really explaining to the average person. Im surprised that cameron hasnt gone into the whole nationalistic, hey, we are much better together, we are much stronger together, and theyll be reduction in violence and increase in prosperity. Maria they dont like the open borders of europe. About. Anthony i understand that. Once you separate dagen i think that its hard for americans in some way to understand whats going on with europe because of the multiculturalism that was basically policy not just in britain but other countries and youre seeing what happens with that with the terror attacks in paris and brussels, the separate yet equal societies within these countries, i think, that that feeds how a lot of these native britains feel. Anthony as a team sports player we are always better and stronger together than we are separate. This would be a mistake for great britain. Maria would it create a market meltdown . Anthony its definitely going to destabilize the markets. Kevin because of the Financial Center of europe. Maria all right, thats implications for everybody. It is the anniversary of d day. Dagen june 6th. Maria straight ahead kanye west fans causing chaos. Even Mark Zuckerberg is not exempt from the hackers. Back in a minute maria welcome back, we are expecting higher opening for the broader averages, lets take a look at companies on the move. Goldman sachs receiving 250,000 applications for jobs this summer. Financial times that applications are up 40 compare today 2012. Block rock selling in singapur for 2. 5 million. Facebook founder Mark Zuckerberg is the victim of hackers. Cheryl even the facebook founder can get hacked. He lost accounts on sunday thanks to hacker group our mind. Zuckerberg was vulnerable because he reused passwords. The group taunted him on twitter, hey, you use it had password, dadada. I guess that was the password. Kanye west show causing chaos. Thousands of fans arrived for the popup this morning following performance that was rained out on sunday. Fans climbed on top of cars, dumpsters, a lot of damage was done, that show was canceled after crowd grew large and violence, i should say. Cheryl its hard to tell. Thats her. New jersey newlyweds. The groom sisters got her to come after mothers death, their mother should attend and danced to one of her songs at the time. Swift was touched that she showed up to perform blank space as the official motherson dance. Maria are you a fan of taylor swift . Kevin how can you not be. This is who you want to listen to. Maria imagine her showing up to your wedding. Dagen i like her more now but generally know. Kevin think about it. She stood up for independent artists. She stood up to apple and what happened . Anthony kanye didnt busted on the wedding and steal the piano for her. Kevin she awards herself at an award show. Dagen shes the theater kid at age 16 that sings in the hallways and could you just walk into one class. [laughter] maria this morning we are remembering the greatest, meanwhile the world mourning the loss of muhammad ali, live report from hometown of louisville, kentucky. General motors bitter on virtual dealerships, details coming up. Dont forget to check mornings with maria on facebook, we are on twitter at mornings with maria, keep on eye on daily polls and highlights and daily s we were born 100 years ago into a new american century. Born with a hunger to fly and a passion to build something better. And what an amazing time its been, decade after decade of innovation, inspiration and wonder. So, we say thank you america for a century of trust, for the privilege of flying higher and higher, together. Maria welcome back, you know by now the three heavy weight champion muhammad ali passed away, controversial outspoken, ali family is finalizing arrangements right now. Fox news correspondent lauren green is covering the story outside live in the museum in louisville. Good morning to you. Good morning, maria. You know, just to be part of history to collectively mourn and celebrate the man simply known as the greatest, yesterday muhammad alis casket arrived, celebrate him as native son and citizen of the world. Its been a mournful yet beautiful time. Its like losing a brother or an uncle, deeply personal feeling here but the main thing you feel here is joy and appreciation for him just being part of our team here in louisville. At a home they waited and sundays visitors got a glimpse of the man who knew ali better than most, his younger brother. He knows him simply as his big brother. I want the world to know that muhammad ali to me was the most genius, caring person in the whole world. He hated nobody. He was a great champion and had conviction and love and he will be in heaven and my mother and parents will be in heaven. Now, coming in little more than an hour theyll be a press conference to details about the Funeral Services and Memorial Services later this week, maria. Maria all right, lauren, lauren green. Two men who new former champ well, larry holmes and jerry coney. We will be right back he has a sharp wit. A winning smile. And no chance of getting an athletic scholarship. And that is why you invest. The best returns arent just measured in dollars. Maria good monday morning, everybody. Welcome back, im maria bartiromo. It is monday june 6th. 7 00 a. M. On the east coast and ear are top stories right now. Futures showing will open higher this morning. We have janet yellen speaking later this morning, later this afternoon, rather, that is certainly a focus after the job report. The market is expected to open fractionally higher this morning. Fox news Andrew Napolitano coming up. Former heavy weight boxer larry holmes. Both Hillary Clinton and Bernie Sanders campaigning in california. Two Democratic Candidates running neck and neck. Robert gray is in Hermosa Beach with the latest. Hermosa beach, hey, good, maria, thats right. Its going to be a tight race, we are all expecting Hillary Clinton edging so much closer, just about two dozen and change delegates away from clinching the nomination tomorrow. California and new jersey offering a bounty of delegates, 475 in california alone. Bernie sanders 1667, if you take a look at delegates, he cannot clinch with delegate count but if you look at superdelegates in particular youll see that Hillary Clinton has a tremendous lead there. If you take a look at where theyve been really going crisscrossing the state here, particularly where the polls have narrowed in just a couple of points, clinton with a slight lead. You can see them crisscrossing the state, Hillary Clinton has a couple of stops in los angeles today. Has a concert, if you will, in theater. Bernie sanders in presidio in san francisco. Clinton continuing to take shots at donald trump and ignoring Bernie Sanders and had comments about the judge in the Trump University case. What trump is doing is trying to divert attention from the very Serious Fraud charges against Trump University that have basically been confirmed by some of the highest officials who worked with him. So this is typical, he does have the thin skin, and judge curiel is as american as i am and certainly as american as donald trump is. Now, maria, its going to be interesting, take a look at the new Voter Registration surging in the last couple of weeks before may 23rd, the deadline, 646,000 new voters, 76 of those were democrats so overall both republicans and those with no Party Preference independents both lost a little bit of market share, if you will, total swell to go 17. 9 million, thats a record heading into a primary, maria. Maria all right, robert, back to you with the latest there. Sparks flying on both sides of the aisle heading into the california primary tomorrow. Candidates are turning up the heat against president ial rivals watch. We are going to have a very Contentious Campaign because im going to point out at every single moment that i can why i believe the republican nominee should never get near the white house. She keeps campaigning. What she did was a criminal situation. She wasnt supposed to do with the server and email. I hope the democratic establishment understands if we are deadly serious as we must be in making sure that a disaster like trump never becomes president , we are the strongest campaign to defeat him. I dont want to pick a fight but if i was him i would be screaming too because if you figured this out they are closed for election day. Maria republican strategist and Donald Trump Campaign along with democratic strategist. Let me get your expectations going into tuesday, jessica, kick us off here. Shes only 28 delegates away from clinching the nomination. We are obviously going to see that by the time new jersey gets called there. Im sure youre going to see another Bernie Sanders speech like that. I have been paying no attention to how anyone voted and carry on. Its quite amazing we need to focus on beating donald trump when youre 300plus delegates behind and youre not going to be the guy and ive seen reports that within the Sanders Campaign about when he should step down and unify here. What he did yesterday bringing up the Clinton Foundation very good attack. How kind of him to take your attack lines, i really appreciated that. [laughter] dagen thats the Sanders Campaign. Maria thats amazing. I dont see it going as smoothly as a lot of democrats wished. Hes got the book and addicted to running for president , sanders does and he knows losing deep inside but the money is still kind of there, he doesnt want to admit. Kind of being the word. Maria what are the chance that is some of the superdelegates change their minds and go with the sanders . Very low, why would they . Hes making maria what if he wins california . The polls right now plus or minus two for him but the real average is 8 right now that shes ahead and we have seen a little bit of Movement Since her Foreign Policy speech on thursday which was meaningful for democrats to preview what shes going to be liked versus trump. As for california its very close but still split. Dagen your boss the wall street journal wrote about superdelegates if sanders wins in california that he will offer a rules change to require superdelegates to vote for the candidate who won their state primarily. Theyre saying that he has a shot but his message is switched. Youre hoping for the superdelegates that put you over the top. A pretty good amount of hip hypocracy. Its going to happen likely this week. Its not plenty of time. He lost it. He saw that opportunity to let the speech. Youve seen a lot of polling. The speech did not make any move with independents or republicans. Of course, democrats loved it, anything she says. The speech did not really didnt make a move. A lot of people on both sides of the aisle. It was an attack speech with Foreign Policy. [inaudible conversations] she doesnt have one. Shes a terrible secretary of state. Here we go. Trump it up. Maria but this is exactly the point that trump needed to come out to counterpunch and you have to wonder why. Because of this issue about the mexican judge and his thin skin. He spent 48 hours wasted going on about this judge than saying maybe a muslim judge wouldnt be impartially either. Theres also been a strong Foreign Policy speech already from trump. He was rebutting him. None of her own policy. She could not point one success as secretary of state. Terrible secretary of state. Dagen the wall street journal wrote an editorial how he felt flat not rebutting that her speech on thursday. Thats not theyre not a voice in the wilderness in how trump responded. Speech was on thursday. Its only monday. Dagen he could have tweeted. He did tweet a lot of responses. Thats not an answer. Maria she could have gone to the russian reset as one item. Russian reset, libya. To [inaudible conversations] obviously i know the talking points of the other side. Osama bin laden was taken out. Thats not the department of state. Anthony what about all the foreign money thats gone into the foundation while secretary of state . Not to her. It was her husband. It is now but it was not at the time. [laughter] it makes a difference. Maria hes getting the money. He is getting the money. Listen, when theres a clear line i understand. Anthony how you answer that . I understand that, i think any responsible democrat understands that. You can draw a Straight Line and say she said, hey, lets, you know bill and Hillary Clinton. Im talking about the donations and her role as secretary of state. Maria he had to get approval from the state department because he we wanted to give a speech in north korea and they told him no. And its hard to separate bill clinton from Hillary Clinton as shes secretary of state with the foundation donation. Theyre husband and wife. Anthony i want her to give her her point of view. We have deals going on. I want you to reply and say im clean as a whistle. I dont think you can say clean as a whistle and its a major problem. Thats another thing about why trump made a big mistake last week because she had a terrible week before. That report basically said what she had said in the past about use of her email. Dagen can i ask you as a trump advocate, can he learn from his mistakes, can he look at last week and said, i would have done a few things differently . Maria i had a missed opportunity. Seeing some down points of the campaign and seen great rebounds. I dont think last week was as bad theres no panic button to push at all. Again, the polls are dagen a few missed opportunities. Theres been a lot of discussion that theres going to be great rebuttal this week. I will look forward to it and you will as well. He went back at her on all Foreign Policy failures and email scandal. Anthony one year ten short days from now. This guy has been adaptive in terms of what he has done. He continues to be out there, continues to beat 16 people that thought they were going to have numbers in primaries, now two others on the democratic side, absolutely. Maria final word, jessica. We are seeing him recede back to loud mouth, thin skin, i remember as ted cruz was falling apart at the end there that heroes up and he seemed president ial in a couple of the press conference and i said, this is a problem for my side and then when i watched in the interviews, jake tapper pushes him jake tapper pushed him around. I dont want a president that calls jim acosta a real beauty. I would have been a reagan democrat. Maria is there some truth to the Mainstream Media not reporting the broad there may be. Maria yeah, there is. He says what he feels. Theyre sick and tired of people like Hillary Clinton. Anthony protestors helping them too. She has the money. Dagen she came out and said there are paid people out there. Im sure there are. Maria important conversation, you guys. [laughter] i absolutely think that, the answer is yes. Maria thank you so much. Crude oil getting support mid disruption in canada. We want to bring tom, chief analyst. Good to see you, tom. Nice to be here. Maria we see oil right below 50 a barrel, is that sustainable, you think . Its sustainable, to get really above that number its going to be difficult. Every dollar is going to be very difficult because we are up there now because weve got about 4 million of barrel of disruption, nigeria, libya, sudan, northern iraq, the odds are that we will probably wont exceed 4 million in disruptions and we are going to get a little bit more saudi oil and iranian oil. Maria we have been in this range for so long, 20 to 40 and to see it close to 50 stabilized the stock markets. Anthony my forward question is do you think we see 75 a barrel in this Business Cycle . It depends on how you define Business Cycle. I dont think we are going to see 75 in 2020, we will definitely see it in the next decade. We will see 75 and 100 in the next decade although maybe not an entire month for a quantitierly cycle. Outside north america than we have in 3050 years and that will come back to haunt the market probably about 2019 on. Youre going pay probably 3 plus for much of the life of the car. Dagen is production and exports, are they camping up quicker than you would expect . Absolutely. They are doing much better than we expected. Theres obably a little bit of shock. We would like to see iran suffer and we dont think they have the capability with the engineers, but they are able to toss more oil on the market now. Itll be interesting in the next opec meeting because they will ramp up something closer to capacity and theyll be more amenable to a freeze. Theres really nothing to talk about when they have the gatherings. Kevin shell producer to turn on more wells and ramp up production because weve seen time and time again over the last 23 earning cycles that management said 50 is the number that theyre using, is it 50, 45 . There was certainly reason to believe, which i did, dont what i practiced was in keeping with others practices. Maria tamil time seizing the opportunity to attack hillary being held to a double standard and should be punished. I have spoken to and ive watched and read many lawyers on the subject. Not even on one side or the other, mutual lawyers. Everyone of them without a doubt said what she did is far worse than what other people did, like general petraeus who essentially cut a two year jail term. General petraeus and others, their lives have been in a sense destroyed. She keeps campaigning. What she did is a criminal situation. Maria joining us now to senior judicial analyst judge Andrew Napolitano. Good to see you. Morning. Maria let the portions of the espionage act that could prove costly. What are you looking at . Espionage is the failure to keep secret National Security secrets entrusted to you. So if you knowingly put National Security secrets in a nonsave, nongovernment venue, thats espionage. Penalty for espionage is a sliding scale depending on your access is secrets when you put them in their nonsecure venue. Mrs. Clinton detoured 100 of her emails in the four year she was secretary of state. 66,000 emails. She kept and refuses to return 33,000. 33,000 she did return. Other 33,000 she did return, investigators found 2200 that contains state secrets. It is espionage because she diverted them from her secure government server to her nonsecure private server in her home in new york, which intelligence folks tell us is a certainty. Maria i find it disingenuous of her campaign to say this is what predecessors were doing. Nobody had a server in their home. What she is talking about is powell, secretary powell maria using gmail. Correct. He answered using his gmail address. It was not his own server. Most importantly, it did not address matters of National Security secrets. Of the 2200, 22 were topsecret. Topsecret meeting information that could cause grave injury to National Security. She doesnt seem worried about it at all. Thats great poker playing on her part. What he thinks going on behind the scenes . I think its great poker playing. I think she knows shes in very, very hot water. She said the document her first day in office after a twohour tutorial by fbi agents in which she agreed on the proper and lawful care and keeping of National Security secrets. In that document, she swore she recognize something a secret, whether its stamped secret or not, it is secret by the nature of it. She also knows that brien pagliaro, and interesting characters supposed the given immunity but still claiming her selfincrimination, who was her i. T. Specialist is cooperating with the fbi and mr. Beast and the nikon has enough information to lay out a course of espionage to prosper. We dont know what kind of immunity he has gotten. He either has an order of immunity from a judge or a promise from prosecutors not to prosecute them. If its the latter is not worth the paper its written on. An order of immunity from the judges called use immunity. It means that the feds cant use his word or evidence reasonably derived from his words against him. They could still prosecute him for the underlying crime, but they cant use his own words against him. Is she going to jail, judge . If she indicted, and theres plenty of evidence, particularly if the intelligence character is correct in that unit capacity working in romania succeeded in hacking into her account. The president speaks out about this. Its an Ongoing Investigation and he said a sickly to the attorney general, dont touch this. The president has a conflict himself because some of those topsecret emails were sent from him. How could he not have known where he was sending state secrets to a nonsecure venue. Maria thats a good point. Donald trump is defending common he has made regarding the judge presiding over the Trump University civil lawsuit. His comments are not racist. Newt gingrich, paul ryan and Mitch Mcconnell disagree. Listen to a former attorney general Alberto Gonzales has to say. To qualify someone on that would be inappropriate. Its perfectly legitimate to look at other reasons. Ua that again. You want a fair trial. You want to win that case. They should not matter. It does not matter to the litigant is, whether they are a terrorist, child molester, or erase his spirit everyone in this country is entitled to a fair trial before an impartial judge. To question whether or not donald trump gets to see that in this case i think its perfectly legitimate. Maria where are you want this . Ill tell you what i used to do in a situation like this. I would say at the outset is there anyone that doesnt want me to try this case for whatever reason . Is there anyone whos uncomfortable with this judicial mind and heart deciding the outcome of the case. If thats the case, ill get off it. Theres hundreds of cases lined up right behind you. Rarely do people ask me to go off. Quite frankly, very few other judges did the same thing. Ill tell you why i did it. People need to know the person making these decisions is fair. You cant make this judgment midstream. You get one opportunity at the outset of the case to make this. Dagen linking ethnic city with bias is different. Good to be with you. Maria talk about Trump University entrance candidates. First california. Amazingly tight race. How do you see it . First of all, sanders for the first time took the gloves off about the Clinton Foundation taking millions of dollars from gators. That opens up a further weakness in hillarys candidacy. If they win is a huge break for them, they soared to accept the fact to be the nominee. The impact on friday and the controversy covered. That jobs report means we are creating one new jobs for every 8000 americans. That is the worst in five years. Thats the biggest political newsweek, not all the controversy. The difference is on a wide range of issues from the Supreme Court and they will appoint radicals where he would be for the keystone pipeline. Shes against it. He wants to create energy field. She wants to kill them. He has a chance here to win by a huge margin if he can elevate the campaign to the Big Decisions that matter in the lives of the American People. Maria that was like a lock to him, that jobs report. How about the Foreign Policy speech. He shouldve come out and said what about the russia reset. All of these things is not seen anything in a sack in about the judge in the Trump University case. I think he has a chance to talk about Foreign Policy one day this week. They showed this page the following data took apart hillarys record because the problem for hillary if she can do worse, fine. Shes a brave person, but she cant explain libya. She cant explain benghazi. The russia reset, which is my favorite moment where she and her staff go and get the button off of whirlpool in the hotels they are stating in. Their interpreter thinks hes been in reset in russia. Hes actually painting overcharge. The russian Prime Minister breaks up laughing. She looks like a fool. The russian reset we are supposed to be so grateful for . Mr. Speaker, speaker, you included with this weak jobs number, this could be a continuation of the Obama Administration and its policies should Hillary Clinton become elected. Is that the biggest threat to the economy . I think you take what god frank is doing to destroy small banks that ironically increase the biggest banks. You look at what obama carries doing to just kill Small Business. Gallup reports this is the third year in a row for more Small Businesses are dying men are being created. Almost never happened before outside the great depression. People should be worried because it is the rise of Small Businesses that generate the wealth, they create a middle class. Weve had 25 Million People drop out of middleclass status in the last decade. This is a tremendous problem for america. Thats the love of the campaign not to be fought on. The level of big results, Hillary Clinton is nothing she can do to stop catastrophic defeat. Dagen mr. Speaker, it is transfixed. You see president obama campaigning from the clearly word about her legacy much if not more than getting elected to the president. Does that hurt her . He is lying on her show boat out on top her if you will. Is he a liability for her campaign . Hes a liability. The American People want change. Every poll we have seen by huge numbers, people want change. In fact, what are we getting . Hillary clinton will be more like the last eight years. That is the worst possible message in the middle of this kind of an economy in this kind of a national mood. I think the country by Something Like 62 are 65 thinks were on the wrong track. Hes the wrong track and if he embraces hillary coming to guarantee she cant get away from it. Maria let me ask you about one of the top stories in the journal titled vocal rollback on gop agenda. It basically says if republicans win in november, there will be a big rollback of regulations. They want to build on those regulations. The feeling of triumph when of the rollback happens. What do you think . Look, trump has an opportunity here to dramatically reset the american economy. The number one goal is to build the wall and mexico. Hes promised that as a priority. The Trump Administration has to rebuild the american economy, create jobs, give us the economic strength. Thats something he could be very, very good at. I think that starts with deregulation and even more than tax cuts. Regulations today are the largest killer of jobs and they are impossibly complex. Nobody understands them all. Maria which you attribute the Regulatory Environment to the 30,000 number on friday . Youve got a couple things. In the loss of confidence in the futures of people dont want to take risk. Youve got an Energy System and a certain amount of turmoil. Youve got obama carrots eating of Small Business and eating of peoples marginal incomes. Start paying 25,000 you dont have much left over for anything else. If youre a normal american you can even afford it. I think we have seen a succession of disasters which have compounded. The left is now fighting with venezuela. We are watching all the economic chickens come home to roost. Maria speaker gingrich, good to see you. Thank you so much. This new charge has to do when tranelevetraneleve n was the ceo of the truck bed. They allege he failed to disclose a document that he controlled shares to investors, shares what she dispersed to seven employees, but maintained control over those shares. Thats the addition of conspiracy charge on top of the reasonable southern charges for fraud in conspiracy. Mr. Tran 11 amends and a great deal of trouble. It will not begin until december or january. He will be incorporated this morning. None of this has to do he is not charged at all with what he did when he was ceo and raise the price of the one drop from 13 to 750. This is an earlier situation when he was ceo. He was forced out by the board in 2014 when these charges were originally initiated. What drove ran is suing shkreli. I want to read one quote from the civil case because it sums up what is part of all of this. Tran 11 was the urban starting in 2012 and continuing until he left the company. He used his control to enrich himself and pay off claims to investors. As pastors were invested in one of the hedge fund and when it went bust essentially what the prosecutors here maintained as well as the civil side is that he used stock to pay off those other investors. That would be a big nono. Maria you know, his attitude when was in court seems to keep getting him in trouble as well, adam. Reporter it gets him in trouble with the judge. She has thateprimanded him yet, but you should know he has a huge following a dose of media. He is to retain any assignments website called lab every day. Were talking about legendary boxing champ muhammad ali, he died at age 74 following a battle with parkinsons disease. His body was accompanied by his wife and close family members. And his funeral will be followed by a public service. Thank you for joining us. Thank you, maria. Maria let me kick it off and say condolences to you both. You both knew muhammad ali so well. Hey, larry. Maria larry, kick it off here, ali lost to you at the end of his career, second to last fight. What are your thoughts this morning . Well, my thoughts is, you know, back in 1971. One of the greatest days of my life when i got an opportunity to meet him. Not only to meet him, but to get in the ring with him and second of all, i got a black eye out of that. A lot of people thought i was crazy and didnt let anybody put any ice on it. It was my bragging piece that muhammad ali give me a black eye and i loved it and i wouldnt let them put ice on that. Maria it was a rite of passage, like you were proud. Isnt that right, jerry . Hes a magical guy. Guys like larry holmes, kenny norton, George Foreman, and muhammad ali with holmes again, he was the greatest guy and made money for anybody, never turned away an autograph. Never turned away a smile. He had a glow about him. I watched him in an airport and he had a glow about him walking down the are you runway. Thats who he was. Hes been sick for 32 years. Maria unbelievable. And his daughter says time for him to have peace. Maria im glad you mentioned everything you mentioned. Because its true, larry, he wh you hear about muhammad ali, you dont just hear how amazing a boxer he was and what he had in terms of his strength, and strategy, but also what a good guy he was, that he always tried to do the right thing. He had convictions, stood up for what he believed. Yeah, you know what . If youd stopped ali on the street and there were a thousand people, he would try to sign every last autograph. Most athletes dont want to do that. Before the autograph id hurry up and sign it before they changed their mind and not want it. He was a good guy, tell jokes and tell you how great it is and say to him that he was one of the greatest. One of, but still a lot, joe louis and everybody else, but none of the fighters that i ever heard of had that charisma that muhammad ali had and you know what . Im going to miss him. A lot of people are going to miss him because boxing is not the same. It wasnt the staple when same when he retired. Maria he changed his name. Why go from cassius clay to muhammad ali. His religious. He turned his religion around. Maria an incredible conviction. He stood up for what he believed in right until the end and youve got to respect him. Do also feel those military guys who defended the United States also have a word at some point, but muhammad ali was the greatest guy in the world and i became a prize fighter because of watching him fight. Who would have thought id be fighting larry holmes a couple of years later, right, larry. Maria wow. Go ahead. And i tell you one thing about ali, he had a right not to go in there because that aint our war we fight. Were always fight be somebody elses war we need to fight our war and protect our ground. They should not condemn this guy. I didnt want to go over there and fight nobody i didnt know either. So you know, a lot of my friends got killed over there, but you know what . They did it for their purposes and ali done what he wanted for his purposes. We should not cast away ali because he believed in not going over there. Maria when you went into the ring with ali, larry, how did you prepare for that . I mean, obviously, you watched him, you knew him, but when you first got into the ring for the first time, how did you prepare for it . Well, the very first time we got in the ring with him was in 1971 when i was his sparring partner and he told me he held his hand up, hit his hand and he said, do you want to be a boxer, and put on exhibition. I should sure, i get in the ring with you, i was so happy. And he said, yeah, he gave me a black eye and tried to put ice on the eye, would not allow that because i wanted to show everybody that muhammad ali gave me a black eye, throughout the years, my love for him grew even more, you know what . There was great moments that i had with him, boxing with him and travelling with him, seeing ali the way he acted when people asked for auto graphs, and most dont want to look at you. Maria gerry. Go on youtube and learn about muhammad ali and larry holmes. Maria what was it Like Fighting larry holmes . You want to fight me again . Were so hold probably wont get through the ropes. Maria what do you do post fighting . This is unbelievable. How long can one person go on . As a career . As a career, i boxed 30 rounds this week, i still spar, but listen, larry has a great life, a lot of charities, and help people and me, and i do the same thing, we keep ourselves out there and love life. Boxing is a great sport. It needs to be monitored more, but some of those punches that Larry Muhammad took toward the end hurt him. We have to watch that. Maria and to go to parkinsons, larry, for 32 years and suffer through that all that time, he was incredible. He was incredible, and every time i seen him and tried to talk to him. The last time i talked to ali or tried to talk to ali, we were down in louisville with opening up the hall of fame and he h not saying nothing, George Foreman was trying to talk to him and he wasnt saying anything, and made me feel like, wow, man, come on, the greatest, ali, you can fight this, you can beat this, you know . And thats what i said to him and sent chills through my body just to see him sit there like that and he was a great man and i think they had him sit there like he was because of him being so great and wondered what he was thinking and going on in his mind. And knowing that he had been the greatest, everybody admired him around the world, he would go. We went to africa, and they were ali, and in the philippines, we fought, when joe frazier, we went all over the country fighting and people loved him, followed him. I waste jealous, i was heavy weight champion, too, they was talking about ali and im pushed on the side, but i understood it and i loved every minute of it. He let me enjoy his life like that. Maria most important remembrance for emerging boxers about muhammad ali. He fought in different countries. They loved him. They he represented more than just boxing . He transcended sports, the greatest guy. Maria larry, final word from you. I know black people should be proud they had a guy like him he was like a Martin Luther king, wanted nothing, but rightness. He was not a racist or whatever and he was a good man and didnt care what color you was as long as you do the right thing, ali was all right with that. Maria all right. Were 45 minutes away from the opening bell and expect the higher openings and the broader averages. Janet yellen speaks at 12 30 eastern today. A couple of companies on the moves. Check out whole foods, the stock is trading higher this morning. As for barons, they reported that the supermarket Business Prospects improved adding to the recent cost cutting will allow for competitive pricing. Were watching googles alphabet, and hes stepping down and google acquired that company. Fidel says hell continue as an advisor. An analyst at jeffries, upgraded the stock and saying that battleship is starting to turn. Onto the markets we go. And janet yellen speaking later today. And about the fomc statement and likely Interest Rate conversation. On friday, the jobs rate, the numbers were so horrible, cant imagine that the fed would raise Interest Rates in this fragile economy, right. Stuart absolutely, how on earth could you do that . After that bombshell report on friday, only 38,000 new jobs created in the month. After that, how can you go ahead and raise Interest Rates . The economys growing at less than 1 . Not many new jobs are being created. Theyre not good jobs, the ones created. In that environment. How can you turn to the American People and say, yeah, Interest Rates have got to go up. But extend this for a second. Janet yellen has essentially financed president obamas redistribution policies. Theyre not produced real growth, havent given us many new jobs and quality jobs. Shes going to keep doing that. I dont see how she raises rates now or late summer and certainly not before the election, i dont think she can. In the face of this data were getting on the economy and the face of her, i say politicized Federal Reserve, very much in favor of president obama, i dont think she raises rates. I may be wrong, but i dont think she can. Maria what do you think is mind the weak economy and the fragile story, is it regulation, obamacare . The president is going to say its international weakness. Stuart its policy, and regulation as you point out. Its obamacare, i think obamacare has a huge impact the deductibles. No wonder theyre not spending much money, theyre going to keep it for the deductibles. The lack of tax reform that lowered rates somewhere, whether its corporate or individual youd have the engine for growth in the economy, but we wont have those tax changes in the Obama Administration. Its all of the above, plus whats happening overseas. Maria here is dagen. Dagen if she wants to prove shes not a political pawn, shed pull the trigger on Interest Rates in july, maybe september. Stuart if she wanted to prove that point, probably would do that, but i wonder what the market consequences would be. If you then set off a nasty shock to the stock market, you wont do much for Economic Growth. You wont bail president obama out of his failed policies. What good would it do other than to show that yes, were not political. Were not in support of president obama. I dont think she does it. Stuart, did i hear you correctly when you said you didnt think she would raise rates at least one time . Wouldnt that be devastating to the market because its already being priced in. The economy has sort of stabilized. The numbers are bad, 1 gdp, the recent job number was pretty bad, but they finally enough they could raise one more time. Do you think that they cant raise at all . Yeah, i am. Think of it, youve got this british exit from europe coming up the end of this month, that could destabilize markets if they decide to withdraw. Then the election in november, the conventions in june and july. Its a strange political environment for the Federal Reserve, the worlds central banker to go ahead and go against the grain and raise rates in a difficult economic environment. You may be right, maybe she will to prove appoints, but i just dont see it. I just dont think its going to happen. Maria all right. Stuart, in 15 minutes well be watching. Stuart im not known as a qualified fed watcher, maria, as you know. Dagen i almost fell off my stool when i found out, stuart. Maria such a bad jobs number theres all the different angles to the story, theres the Interest Rate story and also the jobs story. Its just a fragile time. Stuart what tools do we have in the toolbox to get real Economic Growth in the next 12 months . I dont see it. Maria i think its tax reform. Dagen getting out of the way. Maria its getting out of the way and allowing them to do tax reform and regulations. Stuart but youre not going to get tax reform. Maria well, well see. Varney company starts at 9 a. M. See you in a few minutes. Stuart thank very much. Maria ahead. Cupcakes, dog treats, customized goody bags. As we look at the market today and saw what happened on friday, investors need to be very conscientious of figure heads, chairperson yellen the earning season are over and a lot of policy decisions. With the elections coming up. And referendums have huge implications. Maria does the fed speech, Anthony Scaramucci, mean moving marks . I dont think so. I think theyre priced in the rates. My money is on Prime Minister cameron, he pulled it out with scotland. Two and a half weeks ago and my bet is that he keeps the u. K. In the Economic Union. Maria you dont think theyll leave . I dont think. Maria that will be a big story. Dagen, what are you looking at today . Remembering the sacrifice and fearlessness on dday of all who served and remembering why were free this day, june 6th, 1944. I think that the further we get away, and you touched on this earlier, the further we get away from these defining moments in our history, the more dangerous it becomes because we dont really know what sacrifice means, not today.
