The real clear politics polling average right now still does have Hillary Clinton up a couple points nationally over donald trump, but as part of a much larger theme that weve seen here over the last 710 days or so, the the race here does appear to be tightening. For example, the latest abc News Washington post daily tracking poll out this morning has trump up one point nationally over Hillary Clinton, 4645. It is a onepoint lead, but the headline is most certainly trump closing some major ground here. Now, heres what he tweeted out this morning. Quote wow, now leading in the abc Washington Post poll 4645, gone up 12 points in two weeks, mostly before the crooked hillary blowup. Take a a look at that, 5238. That same poll only had him up five points just a couple weeks ago. Today up 14. Trish you know, its really amazing they always say in politics anything can happen and every day is sort of an eternity, but, wow. Trish in that latest abc poll, donald trump has a huge lead among those enthusiastic about this election. In fact, eight points just a week ago she was ahead. Is this what will decide the election in the next seven days, enthusiasm . In other words, youve got to get your base out to vote. Joining me right now is Julie Roginsky and ned ryan. Good to see both you guys. Thanks, trish. Trish ned, youve predicted this for a while. In all fairness to you, youve been saying that he could catch up. Hes there right now, but theres still another seven days to go. What does he need to do to close this . So, there are a couple of things. As you noted, ive been saying this was going to be a close election. I thought this was tightening up last week before New York Times ran an above the fold story on wikileaks emails and bill clinton inc. , and you were seeing these trends before friday and the fbis reopening of this case. I think what trumps got to do is realize hes got to win ohio, hes got to win florida, hes got to win North Carolina. Leave pennsylvania alone, i think pennsylvanias such a tease for republicans. We cant, right now we cant overcome the philadelphia machine. Leave pennsylvania alone and focus on these states. He has to win those states that i just mentioned if hes going to have a chance of winning the white house. He also has to win iowa as well. Trish do you think hes going to win florida . Ive been talking to people, and they feel confident they are going to be ahead of where romney was coming into election day on the ab, the absentee ballot, and the early voting numbers. They think theyll be ahead of where romney was in 2012, and he only lost florida by about 68,000 votes. But youre seeing in other places, trish, like colorado a few days ago democrats were up by 22,000 votes, then they were up 26, now 30,000. Theres states where its going well and states where its not going well. Trish right. You look at that electoral college. Our viewers can see it, this is challenging. You say he can forget about pennsylvania. Can he still win this thing forgetting about pennsylvania, julie. No, im not sure he can presuming he doesnt win virginia, which hes not going to, presuming he loses nevada and colorado. He really has to run the table in four states. He needs to win florida, as ned said, ohio, North Carolina and pennsylvania. And two of those four right now, more and more, are trending in the democratic trish meaning North Carolina and pennsylvania. So she can afford to lose both florida and ohio and still win this election. Trish yeah trish, the fact of the matter is republicans, regardless of what happens on tuesday, theyve got to decide that the next four years are spent on changing the electoral map. Its that bad. And ive joked with friends, we could literally have George Washington on the top of the republican ticket in 2020, and i give him a 50 50 chance. [laughter] trish so its demographics. But this is what the republicans were trying to switch around, right, ned . This is why you had marco rubio making this appeal to hispanics and trying to really change some of the immigration policies of the past. Donald trump, however, has kind of dug in his heels and done, basically, the antithesis of what marco rubio has wanted. It has excited many parts of the base, but yet still makes this challenging for him electorally. Oh, the Republican Party has to commit again after tuesday regardless of what happens, it has to go back to coalition building. We have to go into the hispanic communities and the black communities and not in the last six months. I think going in the last six months is the height of hypocrisy, because it shows actually how much we dont care. Trish youve got to hand it he took on the issues of the to inner cities in a way that perhaps only he could because he met it straight on and said, look, these economic policies from the left have done nod good for your community. Hillary clintons top aide, huma abedin, her lawyer says his client had no idea these emails were on a computer shared with her estranged husband, Anthony Weiner. Newing wikileaks emails show just how much the campaign was panicking over Hillary Clintons emails. Peter barnes joins us from washington with the latest. Hey, peter. Reporter huma abedins lawyer, karen dunn, released a statement saying, quote, that abedin only learned for the first time on friday from press reports of the possibility of a laptop of mr. Wiener could contain emails of hers. While the fbi has not contacted abedin or her about this, that abedin will continue to be, quote, as she always has been, forthcoming and cooperative. Now, there are 650,000 emails on wieners laptop. Armed with a new search warrant, investigators are searching them with help from a a keyword Computer Program that we presume is scanning for any possible classified information. Now, new wikileaks emails, as you mentioned, today offer up some interesting comments on the clinton email controversy. On march 3rd last year, Clinton Campaign chair john podesta and clinton aide cheryl mills were emailing about hiring someone for the campaign, and podesta wrote mills, quote on another matter and not to sound like lanny, we are going to have to dump all those emails, so better to do so sooner than later. Mills replied, quote think you just got your new nickname and then one of those smiley things, she typed that in. We presume they are talking about a campaign surrogate and sometimeadviser lanny davis. But on the substance, what does dump mean . Well, a senior Clinton Campaign official told fox news that two days before the New York Times broke the story about clintons use of a private email server, there were discussions about releasing all the emails, so dumping refers to releasing them, not destroying them. We should also point out the next day is when t Benghazi Committee subpoenaed secretary clinton for all of her records. Trish its just all so wild. Thank you so much, peter. You think about anywhere else in industry, right . If you were to do this on wall street when you had, were being investigated, you would be in a whole bunch of trouble. Youd probably be sent to i think a former investment banker with was actually sent to jail over this. In other words, you cannot destroy the evidence. The question is, is that a actually what she did. I want you all to take a look here at a letter from the Justice Department on the latest clinton email probe. In part it reads we assure you that the department will closely or continue to work closely with the fbi and together dedicate all necessary resources and take appropriate steps to resolve this as quickly as possible. Its from assistant attorney general peter causic, and get this, according to wiki leak emails, it appears john podesta and he have a very cozy relationship. In fact, in one email john podesta said this about kadzik, fantastic lawyer, kept me out of jail. [laughter] and in other emails it says the two met for dinner on several occasions. Julie and ned are still with me. Ned, is this a conflict of interest . [laughter] absolutely. At least it raises strong questions as to, you know, how this investigations going to go on this new case thats been reopened. So, you know, it causes real question marks and concerns. When they say theyre going to do this quickly, ive talked to buddies that used to be at doj, they think this could be stretching on for quite some time. So when they say its going to be quickly roadway solved, i think its quickly resolved, i think its impossible. I would hope thered be more pressure so we could think we could have a fair and objective investigation trish but you think this is, like, years in the making . I think its months and months. Trish in other words, its not going to get resolved by next tuesday. No, absolutely not. Trish julie, you know, a lot of people said all of this was baked in, right . In other words, americans already knew about the whole email scandal, they werent really going to be swayed by this, and yet here we are a week before the election, and you see the polls tightening, you see all of this news not, you know, the first investigation, but it looks like now a second investigation. Maybe its not baked in. Well, i think its baked in as the sense that the polls were tightening before because republicans were coming home. You know, i liken this to the fact that lets assume Hillary Clinton not Hillary Clinton, excuse me, a woman came out and said donald trump just inappropriately touched me, is there one supporter that would say, oh, my goodness trish in other words, theyve been down that road. If youre voting on emails, youre voting on the emails. The problem is the question, and this is why the clinton administration, excuse me, the Clinton Campaign is pushing back so strongly on comb my, this is unprecedented, what he has done. Ive been a big defender of his, and i think hes not doing this to put his finger on the scale trish dont you have to . What else do you do . Yeah. You dont do anything to influence an election. Trish but he would have been [inaudible conversations] youre damned if you dont right, exactly. Not really because the problem here is he could have waited a week to do this trish trish no, no, then everybody would have said, what the heck, buddy . First of all, why didnt you do this investigation right in the first place, second of all, why do you wait until after the election . First of all, he released in this information before he even got a subpoena to look at these emails oh, but hes not going to do that without some certainty. Were seeing some sources are saying [inaudible conversations] trish by the book though he hasnt seen the substance of the emails. He hasnt seen them, thats the problem. Theres a certainty that there are Hillary Clinton emails on the laptop of there are sources that are saying this. Thousands of emails that are state. Go, v. The fbi hasnt seen them yet. If there are sources that have seen them, they have seen them without authority because they havent gotten a subpoena trish are you suggesting that james comey simply said, oh, we found this hes not going to do this. No. Trish on this computer that belongs to anthony wiener, and we see a bunch of family emails, were going to reopen how would he know . He hasnt got a subpoena trish julie. He that means he looked at them without a speak that which is illegal. Subpoena which is illegal. Trish except that Anthony Weiner turned over his computer voluntarily, we know that. But those emails, he had no right to trish they saw something. Otherwise you dont open this. The only emails he could have looked at had to do with the investigation of Anthony Weiner, hes being investigated for presumably trish you look at his email account or whatever it was from Anthony Weiner and, by the way, theres a bunch of state. Gov things in there, youve got to go to your boss, and you have a responsibility as an american to uphold our constitution and do whats right. Thats right. Rule of law. Thats right. Trish he believes, and i think most people other than democrats that are trying to talk their side no. Trish you have republicans who are saying the same thing. We know now the reports coming out that there was a massive debate internally, do we move forward on this or not . 31 days out from the election 11 days out from the election, guess what . All right, Hillary Clintons top aide, huma abedin, in hot water today, to say the least, as new evidence shows she may have lied under oath about the existence of thousands of state Department Emails on her home computer that she shared with her nowestranged husband. During a june deposition with the Controversial Group judicial watch, abedin swore she had returned all devices that contained any state departmentrelated work on them, but according to sources there were state. Gov emails discovered on that home computer that she shared with her estranged husband, anthony wiener. Joining me right now the tom fenton, president of judicial watch. Good to have you here. Huma abedin said under oath she turned over every device that had any work usage emails on them, and yet here we are in a situation where it seems investigators have found her husbands computer had numerous state. Gov emails on it, thats according to sources, and that is what has led james comey to reopen this entire investigation. Where do you think the truth is as it relates to what huma knew . Well, thats an issue we have to explore. I guess her lawyers saying she didnt know that her emails were on this other system. You know, in the end its occupy to the government to figure out up to the government to figure out where the records should have been and where they were. There was classified information on mrs. Clintons email server or, abedin was the only other state Department Employee were aware of who had an email account on that server. She was in constant communication with mrs. Clinton. Weve been releasing documents from abedins emails that she did turn over the the state Department Almost once a month, and repeatedly theres been classified information in those emails. We dont know what it is because its redacted. So the phish. Trish to so your point is she was emailing classified information. It sounds like youre citing, you know, or giving fault here to a few different entities, one of which is the fbi for not doing a proper investigation in the first place in finding these emails . You know, thats true. And state department and abedins initial sin was taking records that she shouldnt have taken from the state department, all those government emails that she created on her separate email accounts, the clinton. Com account, her yahoo account evidently. One of that, she should have retained. She should have turned it all over the to the state department. Trish shes saying that she turned over all the devices well, she didnt hold on. Trish, she didnt say that. She said she trish her lawyers saying to her knowledge. And her lawyers never told us or the court as the court requested that they turned over all the emails. Trish so heres my question. So suppose we take her at her word and she didnt know all these emails were on the home computer that she shared with her husband, auctionny wiener. She must have, at some point, likely plugged her device into the home device, perhaps to load something, it could have been as innocent as a picture or whatever, and im just thinking out loud here as to how this could possibly be and how you reconcile them. And then somehow everything got lopedded onto his loaded onto his device. Either way you slice it, whether she lied or didnt lie, youre left with the knowledge that our classified information, our countrys secrets were somehow loaded onto his computer whether she intention aally did intentionally did it or not, that seems to be a real problem, tom, and maybe gets back to this whole idea of the private server and just exactly carelessness with classified information overall. Well, thats why its illegal to keep classified information oniongovernmental servers and insecure places. Abedin and Hillary Clinton left classified information on the internet equivalent of a park bench. You know, frankly, mr. Wiener having access to that information trish well, that makes is the least of our problems. [laughter] given the fact that the russians might have, the iranians, the chinese, who else knew . I know youre going to tell me trumps going to win, so im going to start with jon and get your overall sense of, is this nervousness . This down 160 points right now in the market, related to concerns about donald trump winning . Yeah. I think the market doesnt like uncertainty. The polls are starting to narrow x so investors are starting to price in the possibility that trump is going to win. Now, you know, expectation for the last few months has been that hillary would win. You know, you mentioned these, the track record is that the market tends to be down in the months before an election when the incumbent party loses. I dont think you can go by any historical track records in this election [laughter] so much has happened thats just to hard to follow or to base on anything that has to do with history. I think all we can say right now is that the market is pricing in the uncertainty that trump trish uncertainty, thats the name of the game, right . Investors hate the idea of change. And lets face it, donald trump represents a lot of change. Steve, you know, hes you Better Believe it. [laughter] trish hes not exactly a fan of wall street. Despite her talking against wall street as she does over and over again, wall street has been a big bankroller of hers,s has paid for many, many thats for sure. Trish speeches, etc. So its understandable that corporations would be getting a little nervous here, investors would be getting a little bit nervous about a change . Uhhuh, yep. Well, look, i mean, first of all, the reason the stock market has been so flat now for the last, what, year, year and a half has been corporate profits are terrible. Lets not forget it all really comes down to the profitability of companies in terms of the stock market. And thats a reflection of a poor economy. More those people who are worried about a trump trish profits are weakening but, you know, i would still say earnings have been relatively strong. Theres been a ton of cost cutting, a lot of mergers yeah, this true. Okay. Trish were in this no mans land i agree with that. But, look this quarters earnings numbers, theyve been rolling in for a few weeks, theyre rolling in all right. Trish you could have all the earnings in the world, my point is if people arent working and getting paid, you have trouble contributing to the okay, got it. Let me make my point about why investors should not be so nervous about a trump president city and why i think just for investors in the stock market is better than hillary, and it comes down to taxes. I mean, were going to cut the business tax by over half. Trish right. So that means the aftertax earnings, right, jon, of companies are going to rise under a trump presidency, theyre going to fall under a Clinton Presidency trish but its change. Theyre used to gridlock in washington, absolutely nothing ever getting done, jon, and investors are seemingly okay with that because they give janet yellen and Company Helping things along, the fed aggressively acting to try and help by the way, really quick, i want to talk to you about Sheldon Adelson to. Hes pouring 25 million into an antihillary super pac. Thats a lot of money to be spending here in the final week before the election. Steve, why now . Why didnt he do it earlier . Oh, i think a lot of republican big donors have been on the sidelines for the last six months because, a, they dont agree with trump on a lot of issues and, b, they didnt think he was going to win. I think youre seeing some late money surge into the Trump Campaign as an indication that this is now a tossup race, essentially, and people now who thought it was hopeless are saying, look, with a little bit more money, trump can actually win this thing. I dont know if i would call it a tossup race, but i say it isnt over. A couple weeks ago it looked like it was over, and its looking more and more like a close call. Trish we told you it wasnt right here on the intelligence report. [laughter] we did. I said that two weeks ago. Trish i know. You cant have the victory laps until its all done and over and, frankly, its not right to the American People to let them, you know, basically be thinking its over before its actually over. If you think about, it Donna Brazile is working her own book there, and you know, it seems to me that as a network, you need to make sure that you got some precaution in place to make sure that someone like Donna Brazile isnt getting the questions and leaking them to the candidate. Right, Donna Brazile, what she did is cheating, no question about it. She did it twice two, different cnn forums. She damaged her own reputation and cnn she worked for, for years. Jeff zucker shouldnt have staff Conference Call leaked to the media. He needs to publicly address this. Will there be an investigation . Who leaked the questions to Donna Brazile . Will the person be fired . This goes to the networks credibility. Trish at fox business we had our debate, i was one of the moderators, it was very, very closely held. There were people involved in the planning, et cetera, that saw questions that myself and coanchors had, but they were people that had been very, very heavily vetted and had no political bend or were connected in any previous lifetime to the rnc, et cetera. There were precautions that we took. Did cnn not do the same thing . They had a small team, you cant have a gossipy newsroom knowing the questions in advance. There was a leak, multiple leaks, there was a department in tv 1 and flint, michigan was purely a cnn production, its compounded by the fact that Donna Brazile, in an interview with me and megyn kelly and others she was vehement that she denied trish she doesnt deny the emails, per se, shell tell you its all russia, but doesnt deny the emails. She just denies that she actually did this . Yeah, in both cases, the wording in her emails was victim verbatim the way the questions were asked. Its not only a problem for cnn that zucker needs to get ahold of this. There are people think that this is routine to give candidates questions. Trish by the way, if youre Hillary Clinton, if you are given an opportunity to cheat on a test, do you on it . I dont want to get pollyanna for everyone but shame on her for taking the questions. Can he salvage this . Reputational damage has been done . I dont know what Hillary Clinton did, all i know is the emails from brazile went to some of her top aides, whether she used them or didnt, i dont know, be carb cautious here. Either you bring in a couple outside lawyers to investigate, or you put an ombudsman in charge and you give interviews and talk about it on the show. Maybe its time for an investigation into this.
