With respect to the first part of that question, i think one of the things that your going to continue to see from this president is a respect for taxpayers dollars, the money they spend and how theyre spent. We are going to continue to review all aspects of government. I i think youll see further announcements as far as how hes going to look at how hes going to approach and innovate and update government. The bottom line is that we should be paying people a fair wage for their service to this country, but that we should be doing it in the most effective and efficient manner, and i think thats what the president has already shown towards his commitment towards helping reduce the cost of several programs through the government and bringing back jobs. But theres going to be a respect for taxpayers in this administration so that whether its salaries or actual positions or programs, hes going to have a very, very tough look at how were operating government, how many positions theyre in, what people are getting paid. But the president understands that most americans are out there working night and day trying to get by and that washington truly needs to respect the money that they spend, and that we should be doing it in a way that shows with a level of respect in terms of how many people were hiring, what theyre paid, what programs were looking at, whether or not that programs duplicative. Its not just about one department or agency, its really about looking at how government as a whole operates. John. Sean, the president said today in the airlines representatives meeting that he hopes to have an announcement within the next two or three weeks about lowering the burden of taxes for businesses. Right. At the super bowl interview, he was asked can americans expect a tax break in 2017, and he said, i think so, yes, i would like to say yes. Sounds hike hes more confident for the businesses than individual tax breaks for americans. Is the business component at this point ahead of the individual its a comprehensive yeah. Thanks for asking. I think were looking at in the next few weeks rolling out the outline of a comprehensive tax plan that well be working with congress on that will address both the business side of the tax ledger as well as the individual rates. But its going to be a comprehensive plan, something we havent seen since 1986. , but when you look at the segway, weve got two opportunities for reconciliation this year, one is using the fy17 budget which you can easily get Obamacare Repealed and replaced and then use the fy18 to utilize the second reconciliation at reform. We recognize the need, its been since 1986 that Something Like this, of this scale and magnitude,s has happened. Middle class americans need tax relief, the president recognizes it, and thats going to be part of it. But we also recognize and you saw that in all of these business meetings, whether its inversions or other means of shut upping jobs overseas, the profits kept over there, we need fundamental, comprehensive tax reform that addresses both sides of that income stream. If this is going to be a mix between what he had put out there on the campaign and what House Republicans have put out there before, because theres some similarities but, clearly, some differences im just going to say youre going to have to wait a couple of weeks before we put out that outline. But i can tell you its something thats going to spur economic growth, its going to recognize the need to give so many working americans the relief that they need. But more importantly, i think part of the issue that we continue to see over and over again with businesses is that were facing competition from abroad because of our tax code. It favors companies from not wanting to stay, and the president recognizes that. And he wants to create a tax climate that not only keeps jobs here, but makes it, incentivizes companies to want to come here, to grow here, to create jobs here, to bring their profits back here. So i think i dont want to get any further ahead of it, but i will tell you that it is going to be the first time that this nations seen a full, comprehensive tax reform in a long, long time. Yeah. Yeah. The president this morning tweeted that our country is, quote bogged down in conflict all over the place. Where are we bogged down . I think theres several prices that weve been what did he mean by that . If you look at isis in particular and the hot spots around the country, the places that we have to monitor, theres a lot of countries through the middle east in particular, Northern Africa that we are having to address and deal with and monitor because of the threat of radical islamic terrorism. Theres no question that the spread of it has gone in the last, you know, eight years has proliferated. And i think that the resources we have to spend, this isnt a traditional war. We are just looking at the other, you know, enemy with the uniform and saying heres the country were fighting. The proliferation of isis throughout this country has made it so that we have to focus a lot more, in a lot more places and expend a lot more resources because its more of a disparate approach that we have to employ as opposed to having one country that youre facing at one time. Regarding the very nice letter that President Trump sent to president xi jinping last night, im curious about the timing and also later President Trump states hes looking forward to the event of constructive relationship with china. So could you elaborate the importance of a bilateral relationship to the u. S. . Well, i think its obviously important to us, and the president understands that. I think hes spoken fairly often about china, and he understands both the national and economic interests that we have, the desire for our companies to access Chinese Market but also the National Security interests that we have. And so he, obviously, wants to do what he can to have a fruitful and constructive relationship with china. And he looks forward to develop toking that as we go developing that as we go forward. Sarah . The top u. S. Commander in afghanistan said today that they could use a few thousand more troops in afghanistan to help the Coalition Efforts there. Going off mikes question if were trying to get out of conflicts like that, does the Administration Plan to send those Additional Forces to afghanistan . I think the president will heed the advice of the generals and secretary mattis. That conversation has yet to happen, and if we have any further announcements but i think thats right now a department of defense issue that we can, you should just raise with them. Hally. Sean, two questions, first, on the comment from judge gorsuch that have been reported out. Yeah. I. Just have a twoparter. Does the president still stand by his nomination . Absolutely. Given, of course that was number one . No, no [laughter] given where, given judge gorsuchs position on the president s attitude towards the judiciary and given that the president has praised neil gorsuch for his intellect and integrity, does the president have any regrets about the comments hes made about federal judges . I think the president s comments no, he has no regrets, but hes very proud of the selection hes made. Hes going to make a great sr. Do. About the comment, for example, about [inaudible] i understand that. Yes, he has no regrets. Thank you. On immigration [inaudible] [inaudible conversations] when you started, april ryan. Why you calling me out . [laughter] i know the white house has been following the situation of guadalupe pay [inaudible] does the president believe she should have been deported im going to refer you back to i. C. E. On that. Thats an i. C. E. Matter you have no comment . The issues developing in arizona right now, and i would refer you to i. C. E. [inaudible] id refer you back to i. C. E. In that lunch meeting the president said that, you know, he basically said senator blumenthals comments were taken out of context well, no, judge gorsuchs comments his relaying of judge gorsuchs comments were taken out of context. Senator ayotte, who is working with the white house to help shepherd judge judge gorsuch released a statement saying disheartening and demoralizing was the president aware of that . She was in that meeting. This is what senator ayotte said. Judge gorsuch made it clear in all of his discussions that he could not comment on specific cases and that judicial ethics prevented him from commenting on political matters. He has emphasized the importance of an independent judiciary, and while he made clear he was not referencing any specific case, he finds any criticism of a judges integrity disheartening and demoralizing. Theres a big difference between commenting on the specific comments that have been made in a tweet and his general philosophy about the judiciary and his respect for his fellow judge ares. Thats but, and i think the senators comments were very clear about how those are two distinct issues. Right. And the judges right. Were also in that context of president s attacks on the judiciary which is what the senators you just read out was also talking about there. Right, okay. So senator ayotte was sitting right across from him when he said those comments werent accurately no. The way senator blumenthal characterized them, he was talking about the tweets and saying he was disheartened. Thats not what the judge said. He was making two complete, distinct arguments about how he views the comments that he should not be commenting on a political matter or on specific things. But as a whole, he doesnt like attacks in general on the judiciary. It was a very distinct argument that he was making. And i think that thats where i think weve got to be clear, and thats what senator ayotte was saying this morning. Very, very different. Take that onboard . Is he what . Is he taking that onboard . He said he doesnt regret his past attacks on the judiciary. Right. But now you have these con firmed remarks which you were saying was exactly what the judge was talking about. Again, i think its important to understand the judge was very clear that he was not commenting on any specific matter. Right . And then he was asked about his general philosophy. So you cant then take that, equate it back to the specific. He literally went out of his way to say im not commenting on a specific instance. So to take what he said about a generalization and apply it to a specific is exactly what he was intending not to do. But in other words, the president will continue to speak like that. Of course he will. The president s going to speak his mind. It goes back to Thomas Jefferson that president s have commented on judicial nominees. I mean, the idea of one branch talking about or commenting on another branch is as old as our republic. So i dont know why and i find it interesting when president obama criticized the Supreme Court for its Citizens United comments in the state of the union, there wasnt a similar concern about that. There is, the idea that well [inaudible] personal attack. I get it, but at some point it seems there is clearly a double standard when this is applied. When president obama did it, there was no concern from this Briefing Room. When he does it, its, you know, a opportunity of outrage. So with all due respect, i think the president s made very clear he was concerned about how that executive order in particular, which is what were talking about, was applied. And i think weve addressed it from this Briefing Room over and over and over again that the u. S. Code gives the president very Clear Authority to make this happen. Cecilia. I want to make sure i understand what youre saying. Are you saying demoralizing and disheartening was not specifically what the president i think the judge literally made it very clear in his [inaudible] came out and said they corroborated. I understand that. Senator ayotte, who was there, made it very clear he was commenting in general about attacks on the judiciary. That was it, plain and simple. Three other senates i understand it, cecilia, i can tell you what senator ayotte whos been with him on every single thing was very clear about that. Theres no so i understand that, and that is, she has made it very clear over and over again. Yeah. Sean [inaudible conversations] sean, your answer about the context doesnt make sense when you think about what senator ben sass said this morning on t. He said he asked judge gorsuch specifically about the president s socalled judge tweet, and this is like the that ive asked and answered no, but this is a different context. This is directly i thawns, and ive said exactly what senator ayotte said. I understand, thank you. Sean, im going to continue on this line despite what you [inaudible] why isnt the white house, why isnt the president concerned about the influence or the appearance of the influence on the independent judiciary . Why isnt he he is, i mean, he is free to speak his mind. Where has this outrage been for the last hundred years . [inaudible] the Obama Administration or any previous administration, im talking about this president and this white house. I understand. Part of the reason the president got elected is because he speaks his mind, he doesnt hold it back, hes authentic, and hes not going to sit back, i think, when he feels very passionate about something as much as the executive order. He was doing it to make sure americans were safe. The order, the u. S. Code is Crystal Clear on this. I think ive read it for three days in a row, and it cant be any clearer how much authority it gives the president. Hes concerned hes doing what he can to keep this country safe, and theres been a lot of activity to stand in the way. So im not sure how many more times i can read the code to you, but 8 u. S. Code 1182 you and me talking about it is not how the judicial process works thank you. Youve asked the question eight times. One more i understand, thank you. Go ahead. Go ahead. Sean, also made from Kellyanne Conway let him go. Earlier from this week, you said this is in context of the nordstroms and not about what she was counseled about, but about manager she said to cnn earlier this week is that the president doesnt comment on everything. And so i want to contrast the president s repeated statements about in order strom with the nordstroms with the rack of comments about some other things including, for example, the attack on the quebec mosque and other similar environments. Why is the president , when he chooses to do you hold on. Before, because you just brought that up. I literally stand at this podium and opened a briefing a couple days ago about the president expressing his condolences. I literally opened the briefing about it. So for you to sit there and say i was here. I know. So why are you asking why he didnt do it when i literally stood here and did it . The statement i dont understand what youre asking. Kellyannes comments were that the president doesnt have time to tweet about everything. Right. Hes tweeting about this, not i actually came out here and what are you, youre equating me addressing the nation here and a tweet . I dont, i mean, thats the silliest thing ive ever heard. Okay, im done, this is silly. [inaudible] listen in. Okay, thank you. You asked your question. Thank you. Does that not diminish the words that youre using . Go ahead. Thank you, sean. One of the criticisms at President Trumps predecessor, president obama, by republicans was his excessive use of executive orders. The president signed three more executive orders today. Why isnt that criticism applicable to President Trump in the same manner i think when you look at the context of what they yeah. What those executive orders did and theres things that are within the bounds of trying to protect this country and ordering police officers, theres nothing i think even democrats would complain with the exception of the one that weve had conversations on. Most of them have been widely, widely praised by both parties to keep this country safe, to get Jobs Creation back. Most of them have been widely applauded. I think difference with what president obama did was stretch the executive order to take actions that have largely been within the realm of congress and to do things that didnt allow for prior input. The stuff that the president is doing is almost entirely highly lauded by both sides of the aisle and won tremendous praise. Theres a big difference in the context in which those two administrations operate toed. One of the criticisms in addition was that president obama in using those e. O. S was governing by executive fiat, he wasnt working with congress. Right, but again, i think [inaudible] absolutely. I just mentioned both tax reform and repealing and replacing obamacare, immigration, theres so many areas where the president s, you know, he literally just, we held up this briefing a little so that eight United States senators could walk out and talk about and, again, that meeting was focused on the judiciary. They talked about infrastructure, they talked about other priorities that they have. He has shown a commitment to work across the aisle, to bring folks in, to listen, to hear their thoughts, to get ideas on a legislative agenda that they can move together with. So i think theres a big difference between the last administration sort of shunned Congress Role and this administration where the president is actively seeking their input and ideas and helping them craft an agenda to move the country forward. Alexis. I want to follow up on the tax sure. Question. Because there are revenue elements of the Affordable Care act if it is repealed and replace, there has been discussion on the hill about what would be the appropriate track to get that into tax legislation or how to treat that as tax legislation. If the president is interested in unveiling a tax package that is as comprehensive as you just described, would the revenue elements of the Affordable Care act be on a separate track, or is he talking about folding them into one reconciliation package . So right now, as i mentioned at the outset, i think were primarily looking at two reconciliation tracks, one utilizing the 2017 budget so you can put your Obamacare Repeal and replace and the 2017 reconciliation package, and then you could potentially do tax reform, comprehensive tax reform in the 2018 budget. But i also want to say, i mean, just so were clear, these arent prescriptive. I think we continue to work towards congress on a range of options and ideas to accomplish both of those and other goals. Those seem primarily the two most opportune ways to get this done, but i wouldnt want to rule anything out. I think both speaker ryan and leader mcconnell are going to weigh in on what best vehicles are, can be utilized to make this thing happen. I dont want to be prescriptive. Ben. So you talked about the president s tax reform plan in the coming weeks. Is that something hes talked about with leaders in both houses of congress, and are they prepared for this . Absolutely. As i mentioned, he has met with, just wrapped up a meeting with republicans and democratic senators, but this is something that the legislative affairs team as well as the president himself have, has engaged with members of congress to talk about this both privately and in bigger groups. But theres a very large conversation going on to achieve bipartisan support for a package of this nature. Jonathan. Does the president believe that [inaudible] major retirement reform, and if so, how . I think one of the things the president has looked at is not just the cutting side, but the revenue stream, and one area in particular, Natural Resources, regulation and tax reform, how we can grow the economy and bring in additional revenues to the government on the revenue side. So its, there is a balance to how the president s looking at bringing down the deficit. And be i think before i get hes going to well have a budget out in a few weeks. I think that will answer a lot. But, again, when it comes to deficit reduction, which is something that he is very interested in, it is not a one side of the ledger option. A lot of what he is trying to talk about in these meetings and with Business Executives is how we can expand the economy, and that expanded economy, that job creation, those explorations of Natural Resources and additional new jobs also bring additional tax revenue in. So theres a way to do this. If we start bringing businesses back, creating more things, creating more jobs, that creates a revenue stream that has a Significant Impact on the deficit, on being able to drive down the deficit and balancing the budget. So i think its not something i want to get in too much detail now, but the president has been very, very keen on trying to make sure that we look at the revenue side as much as were looking at the spending side. When it comes to the spending side, again, youre looking at a wholeofgovernment approach at how we look at every department, every agency, every job, the spending freeze the hiring freeze being one of them. How do we make sure were looking at are these positions necessary, are they duplicative, are we using taxpayer money in the best possible way. It isnt a single, like, look at those particular programs and try to figure out what we can do. Hes looking at everything and figuring out if we can make it more effective and efficient. Yeah, scott. Yeah, sean, monday House Oversight committees going to mark up congressman chaffetzs bill to strike down the district of columbias death with dignity act. It could soon come to the white house. Has the president articulated any thoughts on that or the other bill to strike down d. C. s gun laws, marijuana, federal funding for i abortions in the district . Any thoughts on all these things that are coming your way . As they come our way and they get passed by both houses, we will issue statements of administration policy. White House Press Secretary sean spicer just wrapping up a rather contentious News Conference there, trying to get tough with reporters at one point telling one journalist that his line of questioning was just, quote, silly. The media was piling on to ask about judge gorsuchs alleged comments that he is said to have made this morning. At issue here, is he back . Im being told that spicer just came back to the podium. To the Prime Minister. Thank you, guys. Trish all right. We missed that one. Anyway, hes said to have made these comments this morning, judge gorsuch, that is. At issue, any criticism of the judicial process is, quote, demoralizing and disheartening, and reporters are taking that to be a direct hit on President Trumps criticism of the judge in washington while the administration says, no, that was simply gorsuch speak anything generalities. Welcome to the intelligence report, im trish regan. We have rich lowry and former defense attorney greg jarrett. Good to see you guys. The markets up 136, were going to talk about tax cuts, but lets get to the issue of gorsuch. Youve made the point, gregg, that its not unusual for the president to go after, so to speak, a judge. Right. Trish and criticize the judicial process, and its probably not that unusual for a judge to say, hey, we dont like it when they do. As spicer pointed out, jefferson had a very public feud with the Supreme Court, jackson did it, lincoln did it in his first inaugural. Fdr hated the courts, tried to stack them, made it very publicly known. Obama on three distinct occasions lashed out, chastising the courts over various orders regarding his bills and orders. So, i mean, why is everybody getting their knickers in a bunch here because trump does it, for goodness sakes . And by the way, the First Amendment allows the president to express his opinion and gorsuch is allowed to express his opinion. Its no surprise that gorsuch is disappointed or disheartened. You know, federal judges in the courtroom, theyre elevated on these benches, and they take it seriously like they have this lofty position above criticism. Well, i got news for em, theyre not, and often they deserve criticism, especially the ninth circuit. Trish you kind of think the medias making too much of it. Is it in part because of the person delivering the message . In other words, perhaps hes delivering his criticism of the judge in seattle with a little more panache thanker say, president obama or even fdr, or is it simply they are just occupant to get him at every single turn, rich . It is part of the way he does it, called him a socalled judge. But gregg is exactly right. Theres nothing that exempts the judiciary from criticism or its rulings from dissent. And lincoln, it was more just than criticizing judges. His whole view was each branch should have its own view of the constitution, its own responsibility for enforcing the constitution as it saw fit and wouldnt necessarily need to abide by the Supreme Courts rulings. Thats kind of out there in todays context, but dred scott, one of the most notorious decisions in american history, when lincoln was elected president , he and the Republican Congress just ignoringed it. Ignored it. You have a separation of powers which doesnt mean no one gets to criticize anyone else. Trish its natural, right . Youve got this tension, thats part of what separation of powers is all about. And, you know, one group gets a little annoyed with the other when things dont go their way. Well, and if President Trump had the benefit of actually being right, he read almost verbatim the federal statute upheld in past decisions, even the ninth circuit upheld it. What bothered trump was apparently listening to the ninth circuit hearing, and he said i couldnt believe what i was hearing. I listened too, i couldnt believe what i was hearing. One judge said what evidence is there of terrorism . Another judge said is there really a risk of trish that one drives me crazy. I would have responded by saying, with all drew respect due respect, your honors, its none of your damn business. Does he have the authority to do what he did, not whether hes exercising his authority wisely. Trish by the way, i find that to be a really lousy argument, because shouldnt our goal be to prevent any kind of terror activity . Of course. Trish in other words, the government has historically, and youve seen this, it doesnt matter whether were talking about terrorism or whether were talking about trading activity thats illegal and the sec getting to it too darn late. In other words, they cant anticipate. Theyre only reactionary, and we need especially when it comes to keeping us safe to anticipate more. Right. And thats the president s responsibility. Its not the judicial branchs responsibility. They dont get intelligence briefings, they arent on the hook for decisions they make one way or the other. The president is. And thats why the Supreme Courts been very clear in this area that its almost unreviewable. Especially when the president has inherent powers to conduct foreign be affairs Foreign Affairs and immigration interacts with that area, and you have Congress Giving the president an explicit grant of authority. The Supreme Court said in the youngstown decision, famous decision, thats when the president s authority is at its very apex. Trish i find this kind of alarming. I mean, its alarming to think that, you know, you get a judge in seattle trying to strip our president of powers that he should have. Right. And the judge in seattle also, the most obtuse question of all was when he said, well, what have there been any individuals from these seven nations that have actually committed any terrorist acts or been arrested for that, and then he answered his own question by saying none. The judge is completely wrong. There have been a lot of them. The white house issued a memo yesterday identifying 24 arrests and or convictions from those seven countries since 9 11. Not only that, we know that intelligence officials told the Homeland Security committee and congress isis is trying to actively infiltrate the Refugee Program to get into the United States. Look trish so they said it. And by the way, it exists in europe. You have only to look at brussels, to look at paris. I mean, these are guys that went back and forth to syria, you know . Listen here to what senator Chuck Schumer had to say after the Senate Confirmed Jeff Sessions to be attorney general. Watch it. When Jeff Sessions was passed, it turned my stomach. I dont have anything against him personally, you know . Its known were in that gym together in the morning. But to have a man like this with his record on immigration, hes probably almost certainly the most antiimmigrant senator of the hundred, on civil rights and Voting Rights hes probably one of the top three or four against these sacred rights, civil rights and Voting Rights. He doesnt belong there. Trish it turned his stomach. Then, of course, theres this tweet from senator elizabeth warren, and ill share it with you, and you Better Believe every senator who voted to put Jeff Sessions radical hatred into the Justice Department will hear from all of us too. Ford, i mean, i get it, its political. Theyve got to rally the base somehow. Is this the best way for them to really do it . They are unhinged. They dont know where to go. They know they have to do something. The concern they should have at what point do you just become the party of outrage. Where they are incapable of actually accomplishing anything. This is hamburg and respond. And so to put up something that was as racially divisive as Jeff Sessions was in the highest office in the land was disconcerting. Thats why you stop that ground swell of opposition. You lost bigtime. The amendment is what matters here.
