>> we will talk about the facts. this is only the third hearing in judiciary committee to present the facts and the facts are really there, there was nothing like a print quote quote or extortion or bribery, they -- at the end of the day got the 8, they did nothing to get the aid and everything went forward. the interesting issue is they don't want to deal with those facts and couple democrat said and even the press said they are not dealing with fact of the case, we dealt with the facts and they are pretty simple, nothing happened. when you have truth on your side it is easy to debate, or is the law professor said last week, something may have happened, you have a real problem with impeachment. >> what do you say to folks like jerry nadler who said as chairman of the house judiciary committee that if we don't allow the -- we don't move forward with this we will allow situation which the president disregards congress by not complying with things like subpoenas and other document request whether it is democrat or republican it is not something congress should allow. should we establish that type of president? >> it doesn't vindicate anybody who touched this. shannon: james comey taking a victory lap after the report says not so fast. national security attorney bradley maas and fox news contributors molly hemingway and andrew mccarthy, great to have you with us. what do you make of this. we had the op-ed from mister comey saying the facts are all out, this is the truth, the fbi got it right, there were so many lies about us and he is vindicated. >> typical behavior for comey. you did something similar when he was referred for criminal prosecution, demanded apologies, he has amazing pride in his behavior given all the bad things that came out about it. this couldn't have been more definitive with the inspector general said, that no one was vindicated, he laid out so many problems with the fisa process, not just the 17 errors on the warrant to spy on carter page but everything else to deal with the process. one of the things most scandalous is learning the fbi knew the dossier was complete and utter rubbish by january 2017, continue to leak about it suggesting they took it seriously and comey himself was suggesting it was a legitimate document when they knew sources were denying it saying this was not accurate information and should not of been taken seriously. shannon: the 17 significant errors or omissions, this is what the inspector general said before the senate testifying. >> i think it is fair for people to look at all of the 17 events and wonder how it could happen. shannon: it raises the question about how can you say there's not political bias if you have somebody who doctors a document to say the opposite of what it did say and uses that for fisa application, the average person out there is not going to buy it. >> the president and his allies throughout 200 different conspiracy theories of political bias and come political conspiracy the last few years and managed to land wanted to and that is the entirety of it so what do we have? a whole bunch of these theories the president put out, the white house, president obama, the dossier was used to create the investigation, that there was political bias to launch the investigation, no, confidential informants were used improperly, no. you had a fisa warrant against one individual who was nobody, they didn't know who he was and there were issues for how it was done. it should not happen. but nothing in this massive report from the ig found that it was political bias, nothing found this had anything to do with the larger issue of the russia investigation, it is barely a footnote in what robert mueller laid out in his report. shannon: the 17 mistakes, errors, omissions, were simply -- is that a bigger problem than saying we are not going to assign this to bias, tough equation for people to make sense of. >> first of all he doesn't say there was no bias, he says he can't make a determination one way or the other, he doesn't have positive evidence that there was bias but he did say when you move from the question of opening the investigation to the misrepresentations in the fisa warrant it becomes more murky in terms of determining bias. one of the things i complain about with the way this all plays out in the way the inspector general who i know for a number of years and think highly of but one of the real problems here is if you were to try a case as a prosecutor or any kind of trial lawyer to a jury of justice department lawyers and they all thought the way horwitz presented it today you would never convict anyone. thank god we actually try cases to commonsense people because you never get positive evidence, you never get testimony of somebody who says i am biased or document that says i am biased. you evaluate the conduct before you and draw irrational inferences from what people say and do and as or what himself said, the bias question is an open question. >> i want to do a lightning round to hear from all 3 of you on this but i want you to weigh in on whether or not or to what level surveillance was used or confidential human intelligence was used and those kinds of things because there has been a lot of back-and-forth whether this is semantics on that point. was the trump campaign spied on or that is totally phony? >> one of the most ridiculous arguments in recent months, wiretaps, national security, confidential human sources, overseas intelligence assets, is that spy or not? of course it is buying. you might not use that term if you are a lawyer or something but the rest of us use the normal term for these things which is buying. it is absurd to say otherwise. >> bradley? >> they spied on george papadopoulos, they spied on carter page, these were nobodys on the periphery of anything of the campaign, they were not spying on donald trump or michael flynn and they weren't spying on donald trump junior or any other senior members. >> i did wiretap cases for 20 years and i felt if the defense lawyers didn't accuse me of spying i probably wasn't doing my job. it makes no difference what you call it. monitoring, spying, electronic surveillance. the question is is it properly predicated under the law. if it is that is what we ought to be focused on. what you call it is beside the.. shannon: will there be major changes to the fisa court system? >> i hope there are. the fact that even republicans are admitting problems with an unregulated court, that is good news. >> your concerns? >> i certainly have always been willing to get more reforms, we did some in 2014, lindsey graham wasn't there. hopefully he's there now. >> you practiced in these arenas. what do you say?
