President obama smith and barney expected to decide what kind of executive action to take on immigration by the end of the summer. But tonight chief White House Correspondent ed henry reports the Administration May be trying improve talking points about the president s justification forgoing it alone. Reporter after insisting president obama has not overstepped his executive power to push back on speaker John Boehners lawsuit white house aides said today boehners fail tlour act on Immigration Reform will lead the president to take more unilateral action. The president will encourage them to cast a wide net, consider a wide range of ideas. And the president looks forward to that review and looks forward to acting on it quickly. Reporter the key idea being studied is delaying deportation of Illegal Immigrants by giving them work permits. It further drives the narrative a president not interested in enforcing our laws. If, in fact, i could solve all these problems without passing laws in congress, then i would do so. But were also a nation of laws. Reporter today white house aides said the president is not flip flopping noting whatsing changed is congresss failure to take action. He said the president had democrats in control in 2009 and 2010 and fail tlour act on immigration then did not trigger executive action. Back in 2009 there were many things on the president s plate. Israel, gaza, syria, economy. He has a lot going on now. He does. Crisis that we faced 20i7b 09 as it related to our Financial System and our economy hem hagerstowning jobs that that was understandably the focal point of congressional activity but also a lot of activity here at the white house. Reporter some rankandfile republicans warn that deferring deportation of millions of Illegal Immigrants may lead to impeachment. If thats not enough to bring that about i dont know what would be. Brady was shot in the head during tractortrailer 1981 attack. He never fully regained his health. But nevertheless became a symbol an inspiration. Reporter his two loves were politics and public relations, a calling that crested when president Ronald Reagan tapped james brady to become his press secretary. The job almost ended three months later on march 30th, 1981, with the sixth shot fired from the gun of john hinckley. He was shot with a bullet made in georgia called a devastator. They had a small little cyanide capsule in them. It wasnt cyanide to kill someone, it was made to explode the bullet. Reporter no one in that operating room had seen someone survive who had been shot through both hemispheres of the brain. He rewrote the medical books on neurological recovery. We would expect him to recover for a year and work for his recovery and usually patients at a year have pretty much maxed out. He proved that to be wrong. Reporter brady arguably achieved more in his postwhite house days than before, seeing through the passage of gun background legislation that bore his name. Right there, the representative, our senator. Right now. Reporter seven years after its introduction the brady bill became law blocking the attempted purchases of 2 million guns by prohibited buyers. Marine who has spent months in a mexican jail was back in court today. Back this hour. Its the latest step in a long quest for freedom after what he contends was an innocent mistake. Our correspondent is following developments today from tijuana. Reporter under armed escort marine Sergeant Tahmooressi arrived in federal court in tiiana for his third appearance before a judge. Andrew, how are you doing . Reporter four months ago he made a wrong turn in san diego and mistakenly wound up in mexico in a pickup truckloaded up with everything he owned including three weapons all illegal south of the border. The attorney argues mexican custom agents illegally held the marine eight hours, denying him access to an attorney, u. S. Consulate and a proper translator. All alleged violations of tahmooressis civil rights. He will ask the judge to toss out any evidence obtained while tahmooressi was in custody. The evidence dearriving from that procedure will have no effect to prove anything in court. Thats the constitutional sanctions. If we can get the automobile excluded and the ammo theres no case. Reporter a government attorney claim agents followed protocol. Do you see after the cross into mexico many, many letters with illegal guns in mexico. Royal while true he argues it was too late for tahmooressi to turn around and he lacked criminal intent. Having notified san diego from florida for ptsd treatment tahmooressi was trying to drive to a friends house when he turned north near the border. Instead that freeway led to mexico. But the roadside was covered in graffiti. Once on the highway the return to usa sign was nearly invisible. Sitting on the ground across multiple of lanes of traffic. Now the trial has just ended for the day. There was conflicting testimony from the custom agents. Now were told that even if the vehicle evidence is thrown out, that doesnt mean this trial will end any time soon. That he will probably remain in custody through november when we then expect a verdict from the judge. William, we should explain people running there, tahmooressi just came out behind you. What is the could there be any u. S. Witnesses in this trial . Reporter yeah. One of the things thats interesting hes talking about how confusing it was crossing the border at night. Theres might testimony from a Highway Patrol officer testifying about how confusing that road. You see them transporting tahmooressi going back to his prison cell. This is the kind of caravan they got for security reasons, obviously. Hes going back. Its about a 30 minute drive from here to the prison. Iraqs Prime Minister is ordering his military to help Kurdish Forces fend off attacks from sunni militants who captured large parts of northern iraq. Correspondent Leland Vittert reports from iraq. Our families are dying said this woman once she reached safety philippines lammic state is slaughtering them. Others held pictures of fallen friends. Many hoped kurdish fighters would stop isis momentum but the terror group controls key Northern Oil Fields and possibly the mosul dam. Iraqs largest and major power generating station that would give isis control over the entire tigris river valley including the power to cut off water, starving farms or flooding entire cities. We either deal with this now, or were going to have to deal with it later and it will be much more challenging for us. Isis is on the move. Reporter despite isis continued success moving east across iraq the state Department Spokesperson offered no change in a policy thats center dont Iraqi Military. But there is an investigation. I think character counts. Reporter wolf has apologized for his facebook postings. He blames their reemergence in the news on his opponent. Roberts has led the polls in the closing days of this race but the Wolf Campaign has an awful lot of energy. Tea partiers think their best chance to knock off an entrenched republican incumbent may be pat roberts. Thats what they were saying about thad cochran more than a month ago. Carl, well have full coverage tomorrow night all across the board. The president gets ready to go it alone on immigration. Well get reaction from the panel when we come back. If in fact i could solve all these problems without passing laws in congress, then i would do so. But were also a nation of laws. Thats part of our tradition. And so the easy way out is to try to yell and pretend like i can do something by violating our laws and what im proposing is the harder path which is to use our democratic processes to achieve the same goal that you want to achieve but it wont be as easy as just shouting, it requires us a lobbying and getting it done. That was president obama back in 2013 in San Francisco after someone interrupted his event talking about what he should do on his own without congress. That was his response. Now all the talk in washington and at the courthouse is what potentially hell do on his own. Lets bring in our panel. George will. Judy pace. And charles krauthammer. Julie, is there a sense at the white house this is inevitable. It is inevitable. Question still remains what will be the scope of it but i think theres no doubt theres some type of action later this summer, perhaps even before Congress Gets back from their recess where the president will announce executive actions that presumably will allow some number of people who are in the United States illegally now to stay here. George, thoughts on that . Well, during the watergate unpleasantness 40 years ago Henry Kissinger said with his wit of the Nixon White House the illegal we can do immediately the unconstitutional takes a little longer. They can do this immediately, i guess, but what is the antecedent . Its very clear determining the status of people within our borders is article i power. Power of congress. Ed henry reported the white house is considering delaying efforts to deport up to 5 Million People. There are no efforts to deport up to 5 Million People. None. 85 of the 12 Million People have been here five years or more. 60 have been here ten years or more. 40 own homes. They are within the fabric of our community. No one is proposing a police measure is necessary and no one would tolerate it to extract those people from our community. I dont know what they are talking about. Charles . They are talking about going from de facto legalization to de jur. Thats a big deal. If you get 11 Million People getting a green card thats different. The difference is not in the lives of these 11 million but on the effect it has on the next 11 million who are waiting in Central America and mexico for a signal. We know the signals and how they are received. President signals if you come here as a child you can stay with the dream act which he enacted unilaterally, illegal and constitutionally on his own. Im not against it in substance but it is clear that the signal was sent to Central America, send your kids, eventually they will be legalized. So it makes a difference. I think if youre going to do the step of legalizing these 11 million which i would do, that has to come after you have secured the border, there are a lot of ways to do it. I think theres a simple way to do, to start to do it with a event. Theres a fence around the white house after all and it works. If you convince americans that this is the last 11 million, they will legalize. And then you wont be sending a signal to the next 11 million. Take a listen to the senators from the action in the house. The house did pass a Border Security bill before they went out. The senate has not. You cant address that situation if you dont vote. In the United States senate we went for an entire year where we cast less than one vote on a republican amendment per month. The senate spoke last year with an overwhelmingly bipartisan, we talk about gridlock, 68 votes, republicans and democrats, the gang of eight of which i was a part of put together a broad bipartisan comprehensive integration reform to fix our immigration system. That stalled in the house of representatives and havent permitted one vote on that. In light of that the president which my republican friends call upon to act in this case i hope will act because the system as it exists today is broken. Julie, its all about the votes not taken. The senate didnt actually vote on anything before leaving town. The house obviously didnt take up the comprehensive Immigration Reform bill. When you hear senator thuni say why the house stayed they wanted to go home and say we acted. Honestly Neither Chamber is acting on anything. We had a vote in the senate on a comprehensive bill and no votes in the house. We had a vote in the house on the border issue and no votes in the senate. Both sides bare responsibility. George, what about the impact in the election in november and what immigration as an issue could potentially do . If you take a look at the eligible hispanic voters in three big states, colorado, its the highest out of any potential republican pickup. At 15 . North carolina 4 . Kentucky 2 . Most of the states are below 5 . And immigration is not that high on the issue list. On the other hand, in those three states its surprising at least to me if the winner wins by more than two points. This is a small margin but a marginal difference can make all the difference. Charles . Thats right. In close elections it will make a difference. Im not sure the constituencies will be suede by the vote the house took or the president took. He won the hispanic vote over romney by at least 40 points and when you compare to it george bush, w. Bush, who won almost half of the hispanic vote thats a real change. But if i could say one word on substance. I think this is a bogus argument. The president saying the republicans havent acted so i have to act and legalize a Million People. A its a nonsequiter. And the republicans have acted. They changed tea 08 law and provide money to help the kids already here. It has two elements that everybody originally agreed had to be done for the crisis until obama had a meeting with his left and caved in. Its action and one that would have very real impact on the crisis and its the democrats in the senate who did nothing. But it also overturns his dreamers executive order, the piece of legislation that he passed through the house. Look, if the senate wanted to take it up, and accepted element one and two, the changing of the 08 law and provision of the money for the kids and left that out, it would pass for sure. Down the road, executive order by the end of the sum center yes. But as julie says we dont know how appalling the scope will be. I dont think thats a quote. Constitutionally appalling. End of the summer. Hes up on tip toe, he has to kiss somebody. Next up, terrorists make gains in iraq so what will the u. S. Do . Test test. Test test we do . I took the trash out. I know. Isis son the move that is a threat to the National Security of the American People that is what we should be focused on that. Means we should be using air strikes and advising iraqi forces and using air strikes in support of their operations. None of this is easy. Ill be the first to admit that the world is more complicated and dangerous today than at any other time in recent memory. In some cases, as in iraq and isis those are dangers that have to be addressed right now, and we he have to take them very seriously. But for the most part, these are not you know, the rockets arent being fired into the United States. Isis, the terrorist army in syria, now in iraq, in many of the cities there. And also there is a fight for the mosul dam, a big power station as well as control of the northern oil field. Some of those, there you see a picture of the mosul dam. Some of those in control of kurdish fighters there is a big battle ongoing with the kurds and isis. Eare back with the panel. Charles, serious situation, as it is expanding. Expanding and over othe weekend they took over a town in lebanon. So they expand to the west into lebanon. They started in syria. They expanded to the east in iraq. And the one place where we thought we had a fire wall were the kurds who are real fighters, they dont abandon their uniforms and run away. They have had the Great Success in the past. And the fall of these three towns over the weekend is quite ominous. Our one Supreme National interest in this region is less supportive of the baghdad government which apparently has little authority and less strength but the kurds have been a u. S. Ally for years and i think supporting holding that line would be extremely important with weaponry, which i think they have asked for but it looks by the response of the president and by kerry by the nonaction today that there is no urgency on this. I think there is urgency particularly on the kurdish front. Is there a sense, julie, that they are changing their view of this and that somehow air strikes will materialize . It doesnt appear that there is anything eminent. They say they are still considering all of these options but in a more broad context, not necessarily to what we are seeing with the kurds right now. They continue to say that really any military from the United States is contingent on iraq having a more Inclusive National government that is a slow process ongoing. There is no real certainty about how you would decide that yes iraq has a more inclusive government. They have fill all the positions but that doesnt lead to the outcome that they talk about when we talk about inclusive government. We have these advisors there. Some activity but not the kind that many people like jack keane and others are calling for. They say that they are getting information from these advisors on the ground. Thats helping inform their thinking about. This in terms of air strikes providing heavy weaponry from the United States that does not appear to be evident. Meals ready to eat. Mres dropped to the kurds and all the rest. Lethal aid is not in the represent par of this administration it seems to me. What makes isis so fascinating is its not as though they had a coupe and take over a nation with recognizable orders. Its not as though they are like the germans when they were rampant in germany using germany as a basis to get borders back to where they once. Were there are no borders relevant here. Expand until they meet something that pushes them back that was supposed to be the kurds. So the iraq government lends the Iraqi Air Force to the kurds who rather like to leave iraq. They are supporting people who might be wanting to dismember the very country whose air force is now helping them. What about the president , charles . As in iraq and isis, those are dangers that have to be addressed right now. And we have to take them seriously, very seriously. But, for the most part and he goes on about other hot spots, we are not taking rockets into the u. S. Look, can i understand my sympathizer with the relative inaction with baghdad because its not reliable. Maliki is not reliable. Is he still acts as a shiite war lord. Is he essentially a proxy of iran. And the sunnis cant will not join the government because of who he is. He has to fall. I think when they talk about inclusive government, what they mean is a new shiite Prime Minister. But, with the kurds, thats never an issue. They are reliable. They are our friends. We have abandoned in the 70s and we came back to them in the 80s and 90s. They really are proamerican, prowestern, they want to be independent. Why not . They were dealt out of the paris peace accords in 1919. The only people in the region who arent given a country and they deserve it. Julie, i mean, listen, we know the polls, people dont have any appetite for getting back involved in any place. However, you talked to most intelligence folks in this town and they will tell you the threat from isis is exponentially worse than al qaeda. Isis worries everybody because if you watch the way that isis has moved, its clear that they are strong and strategic and also there is a fear of foreign fighters joining.
