And i think the reason for that is when theyre using those kind of words, it means theyd likely have multiple sources in identifying that threat, and they have specificity in terms of location. So what am i talking about. Likely, some overhead imagery of ships, missiles, moving or being loaded, missiles moving in a direction of possibly iraq. And also, possibly, some messaging that they picked up. Dont know that for a fact, but im speculate aring. One is capabilities, the other is intent. That explains why patriot missiles have gone back into the theaters and, obviously, aegis destroyers have defenses for that. And it also explains why secretary pompeo ordered the evacuation of nonessentials out of iraq, because they believe there is likely a mass casualty threat to iraq and our personnel there. Paul i guess, also, danger of another benghazi, an attack on a u. S. Consulate or an embassy, and you dont want that. The iranian proxies inside of iraq forced the closure of our consulate in basra a last year as the result of rocket fire. And they also punched a rocket at our embassy in baghdad last year. Paul im told by my sources that the u. S. Military, senior levels of the pentagon, are very much onboard for the dethe employments made in response to this. This isnt some operation just cooked up in the white house to oh, no, far from it. From what i understand it, general mckenzie, commander of central command, newly arrived in that position, after having seen the intelligence recommended to secretary shannon, who he reports to shanahan. That we put resources back into the theater. I think for two reasons. One is to deter the iranians from taking the action that they believe was going to take place. And thats critical and, hopefully, that has been successful. And, two, we have the resources in place to deal with it if they do. Paul you have watching the main rain a january general, sole manny, who runs the quds force. Youve watched him for years. How does he operate . There are these threats. The way ive seen him operate is he works through proxies, militias, to allow for deniability. He works exclusively through proxies, hezbollah, hamas, the houthis in gemmen. Paul right. However, in the war in syria, hes billion on the ground been on the several times, multiple times, theres been a number of generals who have been killed in syria and at least 2,000 casualties the iranians have taken in that conflict. Not very well known how committed they are to their control and dominance of syria. Paul but if they were going to operate to try to impose some casualties on americans, they would probably work through proxies. Ing i cant imagine and maybe im wrong here, but tell me if i am would they confront, say, the u. S. Navy directly . If they confronted the navy directly, they would lose in that. Proxies are the likely thing, and they would do it inside of iraq with the Iranianbacked Shia militia which number, quite frankly, over 100,000. And sulemani has been in there a number of times talking to them. They could also, and this may be something the administration has reacted to, they could move rockets and missiles closer to the iraq Iranian Border to conduct an attack from that location as well. Paul theres been some criticism of the general trump that overall trumped a managers strategy on iraq, lack of clarity. Do you think its clear, and what is it . How would you define that strategy . In terms of iraq . Paul towards iran. To me, it is. The jcpoa, they walked away from it because it was a losing deal giving the iranians a threshold and eventually a Nuclear Capability and and this is important to understand the administration feels very strongly that irans aggressive behavior in the region, seeking regional hegemony and worldwide terrorism that theyre sponsoring, they have to be held accountable for that. And the jcpoa, the nuke deal, took that off the table. Paul and it gave them tens of billions of dollars to prosecute the war in syria and also in yemen. What in the administration has done is put that on the table as the certain issue for them. So the objective through sanction regime, which is now crippling irans economy, through that sank regime they want sanction regime, they want to change irans behavior. Paul right. There is no discussion that im aware of regime change in iran. This administration does the not have those kind of ideas. So however, even though the iranian economys being crippled, its contracted 6 and huge devaluation of currency and inflation spiraling, their behavior hasnt changed, paul. Paul so in that sense, the strategy isnt working, but if you squeeze them enough i think it takes time, and you have to have patience. Paul and the president s now saying, come on and talk. I think his objective, when i was talking to people who were discussing the jcpoa, should we stay in the deal or come out of it, right from the very start he said, look, try to improve it. Former cia director john brennan defended that investigation tuesday, insisting that surveillance of the Trump Campaign went through a rigorous due process and was approved by the fisa court. It went through a rigorous due process within the department of justice, the fbi. It was approved by the fisa court. It went through all of those steps, and now if they look back at it in 2020, are they going to find there was something that should have been said differently, whatever . They might. But i think thats what theyre trying to do, uncover something that they will misrepresent as being part of in the deep state effort to try to undermine Donald Trumps election. Paul lets bring in wall street journal columnist Dan Henninger and columnist kim strassel. So, kim, you wrote this week cheering the appointment of john you are the ham. Why durham. Why e do you say that . Well, its overdue, and i ask, paul, what if wed have had someone like john durham put on this case two years ago. Hes an immense live respected career prosecutor who also has specialized in his time at looking at government, improper government action. Hes looked at the fbi, hes looked at the cia. And if wed have had someone like this two years ago when it was incredibly clear that the fbi had played a starring role in this trumprussia collusion story, we might not be where we are now with all of this acrimonious recrimination. We might have gotten some answers a lot sooner. Paul dan, tell us about john durham and his history. Whats his reputation . This is the one gman in the world you do not want on your case, because most likely he will get you. And a guy who knows that, a couple of fbi agents who were associated with the criminal in boston way back when called Whitey Bulger who was public enemy back then, very famous criminal paul mob boss. Mob boss. He framed four guys for murder back in 19 of 8. Turned out he was an fbi informant being protected by several fbi agents. Thirty years later john durham was asked to look back into that case that occurred in 1968, and he got convictions of the two fbi agents who had been protecting Whitey Bulger, an extraordinary investigation into the fbi. Paul so he has experience investigating the investigators, going after the fbi and he was asked by former attorney general mike mukasey in the late bush administration, kim, to investigate the destruction of tapes, videotapes of terrorist suspect interrogations, but he didnt bring any indictments there. So theres no guarantee here that there will be prosecutions. No. Thats why its so important that he was the guy that was named a. Couple of other things about his career. First of all, he seem to be a modest guy. He doesnt give press conferences, he doesnt do leaks, hes not a showboater, and he believes people that have done wrong like the fbi agents that dan mentioned, its no excuse if youre powerful, you cant break the law. But at the same time, hes not someone whos going to gin up a case. He, apparently, is not a thuggish prosecutor in that way. Hes hardnosed but supposedly a straight arrow, and i think thats a what we need in a situation like this to provide the public with a little bit of comfort to think that somebody apolitical is taking a look at this. Paul huge chunk of the public, tens of millions of people suspect that, in fact, Law Enforcement officials and intelligence officials did attempt to surveil and undermine the trump administration. That you cant have if you want to restore trust is and faith in the fbi. No, you cannot. And the question is what did the they do. I mean, paul, i was so taken by that clip we had earlier of john brennan, the former head of the Central Intelligence agency, saying we had i think he said new process in place back in 2016 to conduct these investigations, and he goes now towards 2020 were looking back to try to find something wrong with them. Wait a minute. The cia and the fbi were looking at the Trump Campaign in 2016, rolled forward the president is inaugurated, then the collusion story started appearing in the American Press. And the American Press runs these collusion stories for 18 months. Did john brennan and james comey know back then that there was nothing to those collusion stories, and if they did, why didnt they shut them down . Why did we end up with robert mueller, a special prosecutor brought in from left field, to have to come to those conclusions . What were comey and brennan doing . Paul kim, how is durham going to if fit into the other probes going on, the Inspector General report, for example, and john huber, another u. S. Attorney . Yeah. So just to go back in time, back in 2017 in the fall thena. G. Jeff sessions named john huber to look at some things related to the clinton foundation, also the scandal uranium one and the fisa question. I know that mr. Huber has been waiting for the Inspector General report to come out about the fbis handling of the trumprussia probe in terms of that fisa thing. Degree right now were basically sending them back to china to work for companies that compete with u. S. Companies. Paul what about the the this is different, though, than what the president has proposed in the past, is it not . Hes endorsed the raise act which would cut ilLegal Immigration in half. Right. The raise act also included a similar meritbased system. It would also cut ilLegal Immigration in half whereas this would maintain the current level, it would just reduce familybased migration for distant relatives. Paul mary, what do you think . Government deciding whats valuable, what could go wrong . [laughter] paul youve got to have some rules on immigration, dont you . Well, no, i dont like the idea that theyre, you know, going to decide whos exceptional and theyre going to choose them. Exceptional students, really . Those are usually not the foundation of entrepreneurs. Theyre the people really that you want the least. You want people with entrepreneurial ambition. Paul but government is already deciding on the basis of family ties, so is there is some discretion that but theres another way, you could have a line. You could have a list. You could have a queue where you dont decide, you dont judge whos valuable and whos not valuable. You make the queue, and you process the immigration. The other problems i have with this is the overall number stays the same, which is not good. We need more immigration, and the president says, admits we need more immigration, but he leaves the number is the same. Why . Because hes making a compromise with his nativist base. And i think thats not recognizing what we need which is a stronger immigration. It also does not fix daca. Thats another problem. Paul so the socalled dreamers. My biggest problem, dan, is theres no recommendation at all on guest worker. More Legal Immigration that would come in to fill economic needs. If you dont do that, youre leaving the sniff out for more people incentive out for more people to come in illegally. Legal immigration is a strategy against ilLegal Immigration theres no proposal here. Yeah, well, it is true what were seeing here is a tension between the restriction theists and the white house and the people who would like to rationalize the immigration system. I think the baseline, paul, is the reality of President Trumps extraordinarily strong jobs economy. Once again this month if jobs claims are at a historic low. The jobs market is tighter than a drum. Employers are looking for workers at all levels of the economy. And thats going to keep mr. Trumps economy going. With we need workers and probably some of them have to come from the immigration system. So the deal here is, all right, maybe we will help some of them come in at the skills level, the high merits level, not so much at the lower levels. But the fact remains that till sup processes the amount of workers who are available. You can just see the people in the white house saying, look, the retransitionists, saying we think all immigrants repress wages at the high end and low end. Paul is this basically a document aimed at the election in. I think thats right. Or, rather, at the election. Theyre trying to rally or unify republicans. Republicans are kind of stumbling around, theyre not quite sure how to talk about immigration, very similar to health care. The dreamers really was, they tried doing something last year several times, but they got hammered by the right on amnesty. So theyre trying to rally and unify the base, but i dont think its going to beer theically successful. Paul mary, do you think this is a Good Campaign proposal for trump the, or does this give democrats ap edge . No, i think its good for trump. At least hes putting something out there, hes trying. And i think that democrats reaction to it really is transparent. I mean, it shows they dont want to solve this problem. At a very minimum, they could have come back and said, okay, lets see what we can trade. Instead, nancy says dead on arrival. Paul thats particularly true, dan, if they dont solve this asylum issue. Before i give you a chance to go after beto, i want to talk to you about joe biden, because you predicted a while ago that biden was going to be stronger than a lot of people thought. And sure enough, hes showing remarkable strength. I think its the biggest story of the campaign so far. How do you explain how well biden is doing in the polls . Well, this must be a lot more traditional democrats than we thought there were. I mean, at the beginning of this contest we were told that this was all going to be predicated on a new kind of a democrat and exemplified by aoc, by bernie sanders, by elizabeth warren, that the Democratic Party had gone hard left. Now, maybe the activist base has, maybe a lot of primary voters have, but i think that the broader polls indicate there are a lot more traditional democrats who rather than, you know, throwing out our entire Health Care System with the socalled medicare for all, governmentrun, singlepayer Health Care System really want to have improvements and repairs made to the Affordable Care act as joe biden has been talking about. Paul but heres the other question though just in terms of the election in 2020, could donald trump be scaring enough democrats into maybe making a very pragmatic decision about who can best beat donald trump . There could be that because if you bend down and you really dont like the guy whos on top, that, sometimes that dynamic you described works. But also we have a thing that i really do think the Democratic Party, the ordinary democrats in places like iowa, new hampshire, South Carolina and nevada are not the kooky, leftwingers that we see in cambridge and brooklyn and, you know, some of the more collegelined campuses of, you know, treelined campuses around the country paul or in the u. S. Congress, i might add. Or at least the loudmouths in the u. S. Congress, the ones who draw attention to themselves. [laughter] you look at it, the democrats basically flipped 31 districts that there was republican incumbent, and the district had been carried by donald trump. And those people, those 31 democrats tend to be more centrist, but they also tend to be a lot more silent than the loudmouths grabbing attention by, intentionally or unintentionally grabbing the attention on the left. Powell powell so paul so how are these other democrats going to go after him . Is it going to be with policy proposal, trying to dig up things about his past . How are they going to do that . Well, i think both of those things are likely. I was out at the milliken conference two the weeks ago, i was on a conference with Hillary Clinton a officionados, sort of what passes for the establishment of of the democrac party, and the question was asked how are people going to respond when they start going after biden. Therell be a price to be paid, because democrats dont want democrats to take on other democrats. I thought that was maybe setting the table. But, yeah, somebodys going to try and take down biden. The real key is going to take place not on what happens on camera each and every day, but in getting organization in iowa. I made the point in my last column on in that, remember, we had this moment in november of 2007 where barack obama made a fantastic speech at is the jeffson jackson day dinner in des moines, iowa, in front of thousands of democrats, and it grand national attention. The polls stayed where they were until january 3rd when he got a surprise upset victory in iowa against Hillary Clinton. What mattered was that he had spent months building an organization in the state. Paul right. The speech energized his people and brought new converts to the cause, but it didnt change the National Polls appreciably, but it guaranteed him the ability to score an upset, and he did, and thats when the contest began to close between barack obama and Hillary Clinton in the National Polls. Paul all right. Beto to roarke was going to be the new hot, young thing, and turns out he may have been a shooting star who fades out. Whats gone wrong . Well, in politics you only have one chance to make a First Impression, and Robert Francis orourke did not make a particularly good First Impression when he jumped out with the vanity fair article, and he went around the can country gazing at his navel. There didnt seem to be a there there. And it proved again that before you jump into a contest, you better figure out what you want the arc of the narrative to be and to have a plan that allows you to build that narrative for some four or five weeks. You contrast Robert Francis orourke with joe biden. Biden has clearly got an idea of what he wants to do and how hes going to do it. I dont think thats going to be hes not going to be able to continue to do two events a day, low key, dont come into contact with the press. Ask your doctor about eliquis. Paul the Supreme Court overturning a 40yearold case as alabama passes a sweeping new law effectively banning abortions in the state. The move is widely seen as an intentional gambit to, ultimately, get the Supreme Court and us new conservative majority to revisit previous abortion rulings. Well, according to the Justice Stephen breyer, they have overturned a precedent, a 40year precedent, and this indicates stare decisis. If theyre going to overturn this, whats next, is what he essentially said in his dissent. Paul so it was a signal to people to say, look, roe is in jeopardy. But theyre very different cases. Right. There arent any, quoteunquote, reliance interests. This in this case, state sovereignty, whether a state can sue or be sued in other states courts. There have been 14 cases over the last four decades, in the isnt a huge eshoo. Paul whereas the abortion issue couldnt be any bigger. The case they the overturned was nevada v. Hall. Not quite as famous as roe v. Wade, but it was a precedent, and thats the argument, that theyll overturn roe v. Wade the same way paul by the way, i dont buy that at all. I dont think and lets start by considering that alabama case. So this is a direct challenge, no question, to undue burden test in planned parenthood v. Casey. If you ban all abortions, it couldnt possibly pass the undue burden test. So is as this goes to the courts, my assumption is the courts at the lower level will point to those precedents on abortion and say this is struck down. Yeah, thats most likely the case. There are other lesser laws that are being passed, though, that are more interesting. Theres at least four states that have passed a law saying you cannot conduct abortions once a fetal heartbeat has been established. Thats been done in kentucky, mississippi, ohio and georgia paul i think those dont pass the undue burden test east. Either. Would, then, if those cases are struck down, those laws are struck down, would the Supreme Court take the case, kim . What do you think about that . Would take the appeal . No, they will not take the case. Paul why not . Look, this is why all of this somewhat hysteria is overblown. Chief Justice John Roberts does not want to go here, okay . Theres been so Much Division over the court. Its such an ugly issue. There were all these predictions that when gorsuch and kavanaugh went to court, all these things would happen. Hes very mindful of the court and worries about its legitimacy, and theyre not going to go out of their way to take a case. Now, the question is whether or not there might be smaller cases like, for instance, in arkansas where they passed one moving their law from 20 weekes to 18 weeks 20 weeks to 18 weeks. Would that make it through the appeals section, and would this be pressure on the court to have to do something. That the, i think, a more likely prospect. Paul and do you think that, do you agree with kim on roberts and kavanaugh, for example . I think the i do agree. If you recall, last december there was a case that was asked to grant cert involving a louisiana medicaid provider and whether they have a private right of action. This case had nothing to do with abortion rights. But ostensibly, chief Justice Roberts and Justice Kavanaugh did not agree to take up the case because it had planned parenthood as the plaintiff. Paul dan, what do you think . Heres the backdrop, because for years now really decades the abortion opponents have pursued an incremental strategy; that is, they understood a frontal assault on roe was not going to work after the casey decision came down. So were going to work with incremental regulations in the states that could pass muster. Now theyre giving that up and going for the whole thing. And thats a pretty risky strategy, it seems to me, because what happens if it doesnt succeed . Yeah. I think itll be a problem if it doesnt succeed. I do think going for it all at once is a big overreach, no question about it. But the interesting thing is democrats think this issue goes against republicans because think think everyone is in they think everyone is in favor of abortion. The fact is abortion on demand under all circumstances is not that popular. The fetal heartbeat bills that i just described, the hill and harris poll did a survey on that, those are supported by most of the population, like 5545 favor restrictions after a fetal heartbeat. And younger people, its Even Stronger in favor of restrictions. Paul but that argues for the incremental strategy. Thats right. I think its a bad idea. We should stiphate in the beginning that i think what society wants to do as a whole is insure we have mobility. Paul economic mobility, social mobility if. Yeah. That you can move up. Mobilitys a very important part of the american experience. So thats the attempt, okay . Is so lets just establish that first. Now, whether this is a good i dont think this is a good way to go about it. Number one, because the s. A. T. Score is supposed to be numeric. In other words, the schools have always done some of this, or in the last 30 years theyve aimed for diversity, so theyve done some of this. Putting it into the s. A. T. Score, i think, is a big mistake because it really fuzzes up what qualifications the student has x. In the end, youre not doing a student the any favors by putting a student whos not prepared into a school that has higher standards. Those students dont cut it. And so i think its, this is also an example of how our society will not fix Public Schools. I mean, that is the last thing were going to do. Were going to try Everything Else before we fix Public Schools because the reason why these children get stuck and cannot get ahead is because they go to Public Schools. Paul dan, youre middle class parents, you scrimp and save and dont take vacations and sacrifice to live in a better neighborhood with better schools, youre going to be penalized because of that sacrifice, potentially. Yeah, thats right. And, you know, youre getting at something thats kind of, i mean, mary is right, we do promote upward mobility in the United States. And there are lots and lots of families whose upward mobility consists of a generation working class family, works very hard, moves to a better neighborhood, they move up, their children go to college, first ones who go to college, and then those children move on to a better neighborhood and have children. Paul right. This would strike at the heart of that first Generation Movement up the income scale. Its one thing, you know, we talk about the privileged kids, they live on park avenue, theyve been rich, their grandparents were rich. No, this would hurt people who, in one generation, had moved up the income scale. Paul whats interesting to me is these 15 factors. Theyre not based on individual factors, your talents, your individual character, what youve done for extracurriculars. These are your socioeconomic circumstances that are, in many ways, beyond your control. Whats the neighborhood, whats the family like, whats the school you attend. That means in many ways your performance is taken out of your hands. Thats right. This is going to be a quoteunquote, algorithm essentially that weighs different variables, and we know how these can be. One of the ironies is all these colleges are promoted as holistic admissions because they want to be able to judge and consider individuals on an individual basis, upon their merits and their socioeconomic backgrounds. This is going to consider individuals based on the census data and aggregate data that really devalues personal achievement. Paul why is the College Board doing this . Well, as i said in the beginning, i mean, i think they have for a long time said that diversity is important to them paul colleges say that. Yeah. Its, you know, maybe you can say thats politically correct, and maybe you can say they have good intentions, but thats what theyre after. I think the point that dan made though is really important which is that you dont make spaces for these students without knocking other students out. And that strikes at the, at the heart of the fairness of the system, you know . That parents who are strivers, who save money, who try to get their children into better neighborhoods, you know, who make a lot of sacrifices along the way, theyre going to be bumped off because theres not going to be enough room for both groups. Paul the wall street journal, dan, had a story on this this week and had an interesting quote saying, you know, this is about getting to race using race, rather, without having to use race explicitly. You do it kind of on the sly by using these socioeconomic factors. Is that whats behind this . I think thats really, indeed, in large part whats behind it. They know that the strikes are going to strike down using race as the basis of admissions. This uses an algorithm by a private contractor, itll be more difficult to sue on that basis. We know theres a lot of Political Polarization in the country, paul, and this just throws more gas heene on the fire. Gasoline on the fire. One group this clearly is aimed at is asians because theyre out there on the far end of tests and admissions, and theyre the ones who are really, really going to be disadvantaged by this plan, and they are already filing lawsuits as we know against harvard because of that. But going paul briefly. Going to race issue, the Public Schools. You know, these children that are trapped in the these Public Schools, they can never get ahead. Paul all right.
