And yet, in this of all weeks, the left go lower than weve ever seen before with hate and bigotry and violence. So to discuss all that, lets meet our guest tonight. Tammy, its so great to be with you here together in the same studio. I want to start with you. Theres a number of false narratives that have been pushed in the wake of this kavanaugh thing. Im in a pick on a few of them and give them to each of you to respond. First you. There is the story being told that if you are for kavanaugh and happy about whats happened then youre against women, your anti women. Look, this is not new. Its interesting the conversation that the left is suddenly lost her mind. Thats been the approach from the start. When i was on the left, that was the approach. We would laugh at conservatives because we knew they would not defend themselves. We knew we could say whatever we wanted and i hope im making up for those years, this is why this last experience was so fabulous. Finally seeing a president who did not abandon someone because they were accused of being a misogynist or accused of being against women. I know this is not a new approach. It was just much more blatant. Its the difference between slapping someone and punching them in the face. We been slapped for generations and suddenly they just lost her temper and slugged us. Many people need to see it in that fashion. The republicans of course had to follow trumps lead because he would not withdraw him and judge kavanaugh, Justice Kavanaugh made it clear in his answer to the charges that he was not going to withdraw. Suddenly the republicans had to act so this is what the American People saw also was that when you are attacked and obviously, i believe falsely accused, you must stand up for yourself and thats what has been the enveloping message of the president s agenda. Standing up for america, making America Great again, defending ourselves, that is not the wrong thing to do, its the right thing to do, and i think for the left this is what they are. This is the natural thing theyve done, its not new and it will not end. And were going to get to more of that later in the show because i think one of the most interesting things about this whole saga has been the behavior of the left, but greg, let me bring you in here and put you another one of these narratives thats being put out there which is that with disappointment and this confirmation, ive seen this phrase all over the place, this is a hard right turn for the court. It seems to me that narrative totally misunderstands the constitution and the whole point of the court which is not to be right or left, but to interpret the law, not to make it. Thats right. For far too long a liberal activist judge have legislated from the bench and weve seen that from United StatesSupreme Court. This is really a rebalancing of what justices should be, constitutionalist, interpret the law according to that esteemed document. But here we see jerry and nancy pelosi were threatening to exact revenge by impeaching kavanaugh with a further investigation, they dont realize that that thats actually a gift to republicans. It will further anger and alienate many in the electorate and the polling data has already indicated that republicans are newly energized and motivated to get out to vote in november to make sure this sort of thing doesnt happen. Interesting. Lets look at one other aspect of it. More specifically, within the realm of the impact on gender and what were discussing with tammy about being for or against women, the me too movement, this comes a year on from the start of the me too movement. This is the other thing being said, that unless you are with Christine Bob ford, you are against the hold me too movement. I get that, i am against the me too movement because i think its a mob and thats not the society i want to live in. Im against what it is becom become. I think it served a purpose initially where far too long women felt they cannot bring these accusations forward and they will not be met or taken seriously or any action wouldve been done. I think it had a purpose but now weve overcorrected and its become the mob mentality. We saw that with Brett Kavanaugh and ive never been so fired up that i have been these past few weeks. I find it so despicable. If you look at the Senate Judiciary committee, you have summary people on that committee who are former prosecutors and they know the law. That former attorney general like kamala harris, they know darn well there will be zero case to bring against Brett Kavanaugh just like Rachel Mitchell pointed out the 25 europe prosecutor. She said he these cases are very difficult to prosecute. This is weaker than that. No prosecutor would bring this forward. They know that yet they weapon ivs allegations without any proof to try to destroy a man and his family. I just find it so disgraceful and on a visceral level it really moved me and impact me and i think it did for a lot of you viewers. Thats exactly right. We both got fired up last week. The reaction to that was very strong. Its like yes, your speaking for us, thats how we feel about it too. Charlie, one more thing, i keep hearing this is some kind of primal howl, the Republican Base which is old white men so im looking at you now, i dont think of you. Old white men, whats that about. First and foremost, the left is obsessed with race. They cant help themselves but always bring in these artificial constructs into this conversation. This is not the interpretation of the rule of law. Remember back to the Clarence Thomas hearing, who were the people who were accosting him. It was joe biden and ted kennedy, those are the people thing he shouldnt deserve to come on the court. To your brilliant point, he stood and fought and it ended. Brett kavanaugh stood and fought. They said we havent done this in a long time, this president has given our party the courage and the conviction to fight and win. Its as if our party, we forgot how to fight. We always kind of just rolled over and tried to appease the middle and finally we have fought and won and now the court is back to a 5 4 constitutional majority. Its about the rule of law. The idea that young people, that theres no young people. Its not even close to being true. We had an event with over a thousand students and this was during the kavanaugh controversy, roaring u applause we talk about due process and crossexamination in the rule of law. Ill tell you what. There are people on College Campuses that see themselves in Brett Kavanaugh. Wrongfully accused about anything whether its cheating on a test or not being a party or disobeying curfew. Everyone somewhere in life has been wrongfully accused of something. We have conversations about Prison Reform and Justice Reform and their arguing for an end of resumption of innocence. Their arguing about the need for justice and Prison Reform which relies on due process and you think about will anyone talk about. [inaudible] or to kill a mockingbird. The core American Value about defending the accused and thats when fairness sits in and the ability to trust the end result of criminal trials and those with whom we punish with whatever our system can bring in especially in this is also about women, women who are victims especially rely on due process because we must be believed. We are reliance on the system taking us seriously, and we cant be taken seriously if false allegations or questionable allegations which we would need to apply due process to never get a serious hearing. So greg, last word to you on this part of the discussion, we got no time to talk about the detail, but all this comes as i know we noted earlier at a time when youve just got this incredible drumbeat of success, economic success and the president moving forward on relation to trade and china and whole range of everything on exactly the agenda he promised. Anyway you look at it, it feels like this has got to be one of the most successful first two years of any presidency ever, but you dont hear any of that. Will thats true, and in fact it was largely overlooked this week when the president basically had the best week of his presidency, the lowest Unemployment Rate since 1969, the most robust economy according to the Federal Reserve, new trade deal with mexico and canada, and he stood up to china this week and of course he was able to get the confirmation of Brett Kavanaugh through the United States senate. A week of incredible accomplishments, but all you hear from special Interest Groups and activists and protesters are character assassination and unconscionable smears and that was really the most important thing that Susan Collins said in her floor speech. She condemned the distortions by these people and said, quite clearly that insofar as their outrageous behavior is concerned, that backfired on her, she repeated it tonight in a 60 minutes interview that the political threat shes been receiving, she called them extortion at one point that had steeled her determination to make sure the kavanaugh confirmation was fair and resulting in her vote in favor. He talked about america, he talks to them all the time, and if by no means the majority, as we know, but it is a very hardcore are responding to him and supporting him. Status america. Honestly. Youve never seen a republican senator say anything like this. Please, get up in the face of some congresspeople. What exactly does a republican representative ever do this. Do you see anybody from that cabinet in a restaurant and the apartment or gasoline station, you get out. [inaudible] you tell them theyre not welcome. These daily scenes of mayhem and violence, how many of those hate filled faces are conservative . If not both sides, is one side. Its one side that started the cycle of hate and no it was not Mitch Mcconnell blocking marek garland. Heres the senator who first stated no Supreme Court justice should be appointed in a president ial election year. President bush should consider following the practice of a majority of his predecessors and not name a nominee until after the november election is completed. Heres the senator who ended the 6 60 vote will a bust or rule who ended bipartisanship. Change the rule regarding president ial nominee will apply equally to both parties and republicans are in power, these changes will apply to them just as well spread that mr. President is simple fairnes fairness. Simple fairness. Heres the senator who throughout centuries of bipartisan advising consent tradition and vowed to block a Supreme Court nominee within hours of its announcement before a single second of testimony, before a single case had been reviewed. I believe our party, the Democratic Party must be a party that fights fire with fire. When they go low i say we hit harder. Sure enough, the left are now saying Justice Kavanaugh must be impeached or the Supreme Court packed. Will have more on that later in the show, because hes too political but i dont remember conservatives calling for the impeachment of Justice Ruth Bader ginsburg over this. I can imagine what this place would be, i can imagine what the country would be with donald trump is our president. Said the justice come out for the country it could be four years. For the court it could be, i dont even want to contemplate that. Now its time for us to move to new zealand. And its not that supposed authoritarian, that great undermining of democratic norms donald trump calling for packing of the court, its the democrats. Yes we are in polarized times, but no it is not both sides. Conservative academic, however much they disagree with liberals simply dont talk like this leftwing professor at georgetown university. Look at this course of entitled white men justifying it serial rapist entitlement. All of them deserve miserable depths while feminist laugh as they take their last gasp. Bonus. Senator Susan Collins, who over 21 years in the senate has sponsored 28 bills on sexual violence, who has been an outspoken champion for womens rights, who even as she voted on Brett Kavanaugh spoke powerfully about her hope that the confirmation process would lead to more justice for Sexual Assault victims than decent, thoughtful, sincere women would described by the womens march as a rape apologist. The womens march is not a fringe organization. Its endorsed by countless democratic members of congress. They own that. When President Trump allowed the populist movement to be tainted by the neonazis of charlottesville, i spoke out against it on this network, on the show. Where are you kamala harris, cory booker and all the other self righteous hypocrites who constantly lecture the rest of us. Will you speak out against this hate . If you dont condemn it you are part of it. Of course they wont condemn it because hate is the lefts currency. Hate is their energy. Hate is there path to power. Just as haner said, the xena phobia means suspicion and hatred of people who are different, its a very definition of the modern Democratic Party. Their brand is hate and if they win, it will get worse. November is coming they chanted on the steps of the Supreme Court. Yes it is. We know Senate Democrats went out and tried to find accusers about the new yorker piece which, mind you, even after interviewing Something Like 70 people, not a Single Person came forward to corroborate deborah rimers story. Yet the left ran with it. And it didnt matter to them. President trump distinctly said this that you dont get a match to an arsonist and you dont give power to a leftwing angry mob parody thing americans are sitting back right now after witnessing this process and realizing how dangerous the left really is. And heres the important part, we as conservatives always try to appeal to the better angels of democrats. We probably have a lot to agree on, we just have different way to get there. Were done with that. These people do not want whats best for this country, they want power. They want this president impeached and put in prison. Im sick and tired of saying democrats want whats best for america. They dont. They dont believe in the america of free speech and free market and agree to disagree. They want power and they want to destroy anyone who disagrees with them. That is not a liberal value, that of the leftist value. Theres a distinction there and we, as a decent minded people have to keep them the moral high ground. I think its fighting back, but lets remember, the party itself is whats been pushed so far to the left, abandoning the average democrat. This is what i would submit. In fact you are correct. Theres not two sides doing this but i contend the country itself is not divided. You have 200 people fighting out from the Supreme Court, that is not a mass movement. As we are looking at this shocked, so are women who might be democrats who may be are now identifying as independents, looking at that thinking this is not a real alternative to whats going on, and besides, things are going well, who are these people, and there represented and then leadership. Theres no one in leadership for the Democratic Party saying forcefully this is acceptable because theyve lost control of that dynamic. I also suggest that the polls that we see, we know the enthusiasm votes, it would be a mistake to suggest that the democrats are responding positively to what this is and so, if i tell my Radio Audience and i would tell everyone watching this, have faith in your neighbor. Youve made this argument you want the democratic president as you hope it will be in 2020, you would be all right with a republican president in 2024 or 2028, boosting up to 13, youd be okay with that, right. A compromise would be a constitutional amendment that eliminates lifetime appointment on the Supreme Court. That would reduce the zerosum character of Court Appointments denominations and it would allow the Supreme Court to more closely reflect the outcome of president ial elections. So that we could reduce the tempter on these appointments by guaranteeing every president the right to nominate two justices for four year terms but yes, youre right, i think if that compromise is rejected i do endorse expanding the Supreme Court by at least two seats depending on how many it takes. Just to be clear, you also support a republican president increasing another two seats after it, yes. I dont see much of a functional difference. Yes. 0k with republican president doing it. What i would say is that the difference between mike im just trying to understand if youre okay with that with republican president or not. I already said yes, but what im trying to say. [inaudible] if democrats increase the size of the court, they will control the court for two years or eight years or whatever it is. Republicans will respond and i will have control of court looking back. Sorry to cut you off, but i think youve just made the argument perfectly why this, even i as a british person, relatively new understands that the whole point of the Supreme Court is to be different to the branches to the branch thats part of democratic politics. Its not supposed reflect the political moment. Its supposed to judge the law, not make the law. Arent you arguing for something thats totally at odds with the whole basis of the court . No, im not. What i would point out is, if you have a constitutional amendment that gives every president the right to appoint two justices for a fouryear term, we would reduce the partisan anchor around these appointments because it would make it possible to recapture her court in four or eight years. I just want to get the others enough. What you make of this . Is silly. We could add additional justices every four years whenever there is a new president elected. Look, its a practical impossibility and heres why. As you pointed out in your intro, Franklin Roosevelt tried this in 1937 by adding six additional justices. It requires, however, as fdr found out, a legislative act, a bill passed by both houses of congress and signed by the president. His efforts were viewed as so devious and underhanded, even by democrats that his bill didnt even get out of committee. Its goes to the principles that have been established since 1869 when nine justices became the rule. You were very fired up. Is quite disingenuous. Theres a reason why its a lifetime appointment so you are not vulnerable to political pressure. Thats the entire point. This is what you dont want them to have to deal with. This is a deliver the body. It should not be a responsive body or reactionary body and yet its a reflection of how the left uses it. They cant convince the American People. I would also argue that this argument as was roosevelts, was part of the action to intimidate the sitting judges now, to suggest that if you do not, its like of batterer. Its not supposed to be this body that is political in the way that you wanted to be. Right, but i think that we can see from whats happening in our Politics Today that the fact that Supreme Court justices have lifetime tenure means that these battles take on this really terrible significance in our politics. It creates a zerosum battle over these Court Apartments and if you just amended the constitution okay let me get charlie very quickly. Timmy made a grad great point but what is a judge. Is it an activist or intimidation of the law. We believe it should be an independent arbiter an and interpreters. They believe it should be an activist to advance their agenda. Hes upset because we have five justices that will look at what the text says, not what they hope it says. This is a war on the constitution and the rule of law and hes not upset that we cant get medicaid for all. [inaudible] also the book is called its time to fight dirty so you sort of see what hes thinking. Also elections have consequences. You know how may people Hillary Clinton has confirmed to the Supreme Court zero because she lost. President trump has had to because he won. That is how it works. This is what democrats do as you pointed out earlier. When they lose they try to change the game. One President Trump won we had to get rid of the Electoral College and also calling for defectors to defect, but whats hilarious is that more people went against Hillary Clinton without them President Trump so backfired. One correction, he continues to say that the division in this dynamic, there is no division. Its only the democrats who get upset. Weve never done that. Lets look at that red if we look at the effect of this kavanaugh process on those Crucial Senate races, and weve just seen how important control of the senate is. North dakota is a crucial battleground. This was just a while back where heidi had camped, and look at the turnaround where she is now a long way behind. Thats a race that we really, weve already heard about and it was factored into this discussion about her vote on kavanaugh, but heres a new one thats really interesting. If the republicans take north dakota and, if ted cruz holds on in texas which is looking increasingly likely, the republicans only need one more to keep that 50 feet margin in the senate which is enough to have control, and obstinacy. That was looking really dicey for Marsha Blackburn a while back, but look at this turnaround, just a new poll out showing her with a big lead in tennessee. Thats really interesting because its north dakota safe and tennessee is safe and you get texas, thats 50. Thats all you need. Two things i want to discuss with you, first of all is clear that in the moment right now, this whole process is helping republicans in the senate, but will that last 30 days . I think it will because i honestly think one, democrats are already very fired up and weve seen this in the special elections and polling and i think this sort of woke up the Republican Base and it also align the Republican Base and got the Republican Base to come together because going through this confirmation process you brought the never trumpeters in the pro trump and everyone come together to try to get him through and youve seen the injustice. Im comfortable calling the race right now ahead of november 6 that Heidi Heitkamp is done. You look at tightening races in missouri, jeff was up in some recent polls as well. I think republicans look really good in the senate. The house is still very much in play and weve seen it cut in half in one months time. They essentially dissipated and disappeared during the whole kavanaugh confirmation process as well. I think it does move the number numbers. What about the fact that over the last two years ever since 2016 theres been this Incredible Movement on the left, organizing people to vote, lots of tools to help people figure out where to go to volunteer, if they live in a district how to help out in a battleground district. Thats not there in the right. In certain areas, i think thats more coastal than the midwest. This will be a midterm bull like any other. I think its because of President Trump. Hes doing a rally every night. Hes defining the terms of the selection. I wanted to think, i dont remember in recent political history where incumbent president has taken a midterm the seriously. On saturday night at 9 00 p. M. Eastern hes doing a rally in kansas. He doesnt want to lose that governors race. No one is working harder and hes different term defined the term like this. You want the chaos of the left or the trump agenda. This fires the base and the conviction to get us to win. I think the biggest problem for the president is the problem of success. Everybody gets comfortable. There is this tendency in america to think this is the natural state. Arguably, it is the natural state, because the government is off our back. So you think oh, were doing this and thats true, but it is a mechanism of legislation and attitude and the president s involvement in arguments and rhetoric, and i think they realize there is actually a monster in the closet and its the democrats. The Kavanaugh Hearing was closet and there really is something hiding in our under your bed. Thats really scary. And is not just a dream or a scary thing. Thats key, but also when it comes to the nature of the elections, the house elections are about local get out the vote dynamics, but these senate races indicate not necessarily a wave, but an awakening of people who not only will be voting for the senate but also voting for those house races.
