Of course with three women coming out to level allegations against him and that Judiciary Committee hearing tomorrow. This is top of mind for the president. When he sat down with shinzo abe of japan, the president weighed in on the latest accusations against kavanaugh will filed by Michael Avenatti. Listen to what the president said. I think its ridiculous. Its a con game theyre playing. The democrats have been playing this game that is disgraceful, a disgrace to the country and i think youll see it in the midterms. The white house asked the fbi as part of Clarence Thomass background check to look into her allegations. He was interviewed. There was criticism that it wasnt thorough enough. Kavanaugh will probably get questions on kavanaugh and Rod Rosenstein as well. The president after he wraps up here at the u. N. , will be going back to the white house where he will sit down and have a frank conversation with Rod Rosenstein about all of the allegations. Something else the president brought up today that is worthy of discussion, the charges that he levelled at china and russia again on election tampering saying that china is taking out ads that look like news stories in newspapers like the Des Moines Register to try to swing the election to the democrats and take away some of his power to go after china on trade. North korea, the list goes on and on, neil. At 5 00 or so when the president arrives here at the palace, state tuned. It will be mustsee tv, neil. Neil real quickly. Were hearing reports that the president was disappointed in Brett Kavanaughs response in the Martha Maccallum interview and in his tweets to these women and their charges. That the real sentiment building that the judge has to be super forceful and passionate in his response tomorrow. I think theres no question that the judge has got to put forward his absolute best case. Dont forget, hes not going to be questioned by senators at least on the republican side. Hes going to be questioned by a seasoned prosecutor of sex crimes for maricopa county, arizona. So he better have his a game on. I really do believe that his nomination rises or falls not only on what he says tomorrow but how he says it as well, neil. Neil thanks very much. Ahead of that, the focus is exclusively right now on this hearing about Christine Blasey ford and her charges dating back to when she and the judge were both high school students. But two other womens names have come up in the interim, Deborah Ramirez who has similar claims about her interactions with the judge when they were students at yale. So in college. So then a woman of materialized Julie Swetnick. A Michael Avenatti client that goes on to make charges. Theyre different but part of the theme that the judge was a serial harasser and more. Now, the issue were hearing is that these other women cannot be brought up. That its Christine Blasey ford will be the focus of this. That will not stop the Democratic Senators on that panel when the judges turn to respond to dr. Fords charges to address these other women. Enter emily. This could turn into bedlam, couldnt it . What is your sense . Yeah. This is a very, very fragile situation. I think theres a reason that theres a seasoned prosecutor that will be doing a lot of the questioning tomorrow. Not only because there are no female republican senators on the senate Judiciary Committee but shes seasoned in investigating sex crimes. I think well see her being leaned on heavily and for a reason. But this is a very fragile situation. When you have allegations like this, of course it is. But at the same time, i think its very, very important to note from what i sense the mood of the Republican Base has shifted critically when it comes to allegations of President Trump will feel embolden and that could embolden republicans on the Judiciary Committee. Theres a sense that what is happening a democratic delay strategy and the Republican Base is sick of it and wants to see the senator stand up to that. Neil so lets go on this personal crimes prosecutor will be serving in her role of counsel asking dr. Ford these questions. Are both sides of the senators expected to honor that and let her do all the questioning . If republicans want to jump in, can they and conversely as the judge has to take on and deal with those accusations from Rachel Mitchell, can either side, senators most notably democrats, get their chance to pounce on him an question him . Senator grassley will be presiding over the hearing. I dont know exactly what to expect in terms of whether democrats will try to jump in, whether republicans try to jump in. Im sure that senator grassley has a strategy and im sure that he has laid out his expectations to both sides as to how he expects this to play out. Weve seen him be very forceful. Hes used a great tone in explaining that he wants fairness and he wants people on both sides to come with a sense of primary mission to get to the bottom of this, not boost their president ial bid or put on partisan shows. Well have to see how it goes down. I expect probably a more reserve process than what we saw in the initial hearings. Neil the focus had to be on at least originally christine fords allegations. Its possible the Democratic Senators could go on to the other allegations and particularly with the judge, right . Its certainly possible. I think it would be kind of odd and maybe unfortunate. We have two sessions. One with ford around one with kavanaugh. So you have to give the whole point of the hearing is to give both sides equal time to be probed on what happened and tell their stories. You know, peter, i listened to Chuck Schumer. He thought this hearing should be delayed and that he went so far to say that the judge should just step down. What is the sentiment building ahead of this on the hill . Neil, its all systems go. 18 hours from now, this room will have Brett Kavanaugh and Christine Blasey ford. The hot seat is there in the front seat getting ready. The way that we understand it, the room empty now but once republicans are in there, they plan to yield most of their time to Rachel Mitchell, the experienced sex time prosecutor from arizona taking leave to be here. Both sides are bringing their own evidence. Brett kavanaugh will be his calendar from 1982 where the month of may lists cutting the lawn, being grounded and basketball related activities. Dr. Christine ford is bringing evidence in the form of sworn affidavits signed by friends that tell the committee that later in life she mentioned that she was sexually assaulted by someone who became a federal judge including one that says it came up during a conversation about the stanford trial of brock turner. This is going on even though theres fresher allegations brought by Julie Swetnick who is represented Michael Avenatti and alleged that kavanaugh and his High School Friend took advantage of drunk girls and were present while some were gang raped. These allegations are absolutely breathtaking. They are a gut punch for this nomination. Kavanaugh allies see a lack of evidence with all of the allegations as a reason to move forward with a Committee Vote quickly. I dont believe Brett Kavanaugh is a serial rapist. Theres nothing in his background the way he lived his life to give legitimacy to these claims. I look forward to hearing from mrs. Ford tomorrow. Chuck grassleys investigators are working right now to try to flesh out the latest batch of accusations and while they do, theyre saying tomorrows hearing will continue because to cancel it in light of anything else would not be fair to dr. Assuming that all democrats vote against the judge. That is not a given but it seems to be a growing consensus here that this latest dust up over the judge and these allegations provides cover for some of those democrats running for reelection in states that the president won big might have an excuse not to vote for the judge. The president has been strongly defending his pick for the Supreme Court. So well see what happens there. Tomorrow is a red letter day for other developments including the president s first sit down with his Deputy Attorney general, Rod Rosenstein. That will be at the white house tomorrow. It will concern his future there. All of this after comments that Rod Rosenstein allegedly made back in 2017 wondering whether he should wear a wire and whether the president was fit for office and invoking the 25th amendment to kick him out of there. What will happen tomorrow with the president . Does he fire him . Maybe Rod Rosenstein quits . We have no way of gauging this. Lets get the read from house judiciary member, matt yates who says the guy should resign but for other reasons. You have a host of reasons. If you took it in the light most favorable to Rod Rosenstein, he would have been joking about wearing a wire on the president of the United States. That is an inappropriate thing to do when you lead the Justice Department. You dont make jokes about destabilizing the presidency in front of your colleagues and subordinates. In an administration where theres a culture to resist the commanderinchief, it seems as though this is the type of contribution to that ecosystem that is very unhelpful. So its my expectation that if Rod Rosenstein is not before the house Judiciary Committee to give testimony about what happened and the context that we may force a vote on his impeachment. So if the president says i want you to stay and youre working with your colleagues and the House Freedom caucus and elsewhere saying we kick you out, youre not on the same page . We have an obligation separate and distinct from the president. Our job is not to work for the president. We work within the congress to conduct oversight on the department of justice. Its literally our job in the Judiciary Committee. I wouldnt care if it was a republican president , a democrat, a president i liked or didnt like. If you have employees at the Justice Department making these jokes or maybe it was a joke to try to gauge peoples reaction to see if it would lead to further conduct, we dont know. Its really bad for the country to be addressing these questions in the absence of facts on the record under oath. Thats why mark meadows is meeting right now with Speaker Paul Ryan to see if well secure a hearing for mr. Rosenstein to give that sworn testimony before the congress breaks for october. Neil we dont know what really happened and whether he really made the remarks. They were in gest or earnest or taken out of contest and how things have changed since they were allegedly made. So much we dont know. Congressman, im curious to get your gauge on lets say you get what you want. Maybe be careful what you wish for because now you have a guy who would turn into a witness for james comey or certainly bob mueller going back to the comey firing and everything else. That could create a bigger mess for the president. I dont think its about making a mess for the president. I think its about transparency for the american people. Whether the information is good, bad. Its good to have things play out committee on the senate side urging the democrats to postpone the hearing. Many democrats think its a combination of charges here that the judge is damaged goods and should step aside. How do you feel about that . I think its particularly disappointing that senator hirono from hawaii is fundraising off of this. Making statements about the appointment and using it to dry to generate campaign contributions. That is not helpful to the process were in. I also think its dangerous if we say that the sum of allegations, the volume of allegations is sufficient to not have to test the voracity or truthfulness or legitimacy of those allegations. We dont want to live in a country where the allegation and the conviction are synonymous. We have to test those claims. The senate has set up a fair procedure to do that and well gauge the credibility and move forward with the nomination. Neil all right. Lets see what happens. Thanks very much. The president has been very critical were told of Brett Kavanaughs performance. Not only in the interview with Martha Maccallum but how hes just handled the charges. That he has to bring it up a notch. What do you make of that . The model is what you just ran. Then judge, now justice Clarence Thomas. He did two or three things which are remarkable. He was very, very strong. He was the wrath of god. You ran the best clip of the four hours of his testimony. He condemned the whole process, including senators by name. And then when he was asked what senators thought of professor hills allegations and performance, he said i dont know. I didnt watch it. You could hear a pin drop. You didnt watch it . No. Its garbage. Why would i waste my time watching it. I blew everybody away. It changed some of the winds in his direction. Im not suggesting that judge kavanaugh not watch the morning session neil because they went to great leaps here that he would come second half. But the voracity, the indignation that he showed carried the day. He was looking for a nomination from a senate that was 56 democrats to 44 republicans. He got confirmed 5248. Judge kavanaugh has one vote a majority of republicans. According to bob corker, two hours ago with our peter doocy, i think 20 republicans havent made up their minds. Neil i was going to ask that. A lot on the fence. Jeff flake on the fence. Chuck grassley can respond to these. One second. Just as soon as we got the information neil all right. I apologize for that. He said as soon as we got the information and they left. I think i know what he said. As soon as we got the information from Michael Avenatti about the third accuser, we reached out to him to put our investigators in touch with her to interrogate her on the phone to see if we want to bring her in. Were not going to put off the hearing. Neil its not part of this hearing. But democrats could make it part in the questioning of the judge, right . They could. Neil explain the process. Who is down to do what . Well, the republicans are not going to say a word until after the prosecutor from arizona theyve hired to speak for them has finished interrogating dr. Ford. They can still ask questions afterwards. But only when shes finished. They are going to confine their questions to dr. Fords allegations. The democrats are going to expand their questions to the ramirez allegations, the one about the alleged gang rape, and the i forgot her name. Michael avenattis client neil swetnick. The one that came out awhile ago. Those are very serious. She held three highranking jobs in the federal government which required fbi investigations of her in order to get the security clearances that she received. Neil but all of these were pre that time. Yes. Neil so let me ask you about what the procedure will be. This could go very late, could be out of order, out of order and they could walk and leave, a number of democrats said we think this should be postponed. Chuck grassley said its not going to happen. This is focused on Christine Blasey ford. How is this going to go . I think its going to be extremely contentious. I think youll see clips of the Martha Maccallum interview run for judge kavanaugh and the democrats are going to try to impeach his testimony by claiming they have evidence to challenge what he told her. That he becaasically i dont think he could have come across as forceful. Neil what would have been forceful like you saw with Clarence Thomas. If i was advising him, dont do the interview. Dont do it for two reasons. One, the basic rule of criminal procedure 101 is you dont deny something in public until youve been accused in public. He was answering a newspaper article, not the actual accuser. Neil they did it for a reason to humanize him. You think too much so . I think they did it because they came to the same conclusions that chad pergram is. The at the time they made that decision, they didnt have the votes. By putting him out there, humanizing him may bring some votes in. The other reason for not doing it is you have given your adversaries the ten democrats in that committee more ammunition with which to cross examine you. You dont want to do that. Thats what theyve been doing from the beginning, which is why i think that this information which the democrats have had in their position going back to july was Just Launched at the last minute to try to drag this process out and sink this nomination. I dont think the democrats had a fair process in mind. They tried to hijack this process, turn it into a circus and thats what theyre doing now. Trying to consistently drag this out. So i cant put much stock or credence into any statements theyre making at the moment because theyre all politically motivated. Neil senator, we know this is about Christine Blasey ford and her charges. If democrats wanted to bring up Deborah Ramirez, another woman laying down similar comments while they were in charge and Julie Swetnick, a Michael Avenatti client, they can do that but then it could concei conceivably become a circus. Are you worried . I expect that will come up. Democrats will use any and all means. They go into this hearing, a bunch of them tomorrow that are running for president , including the attorney of the latest accuser. This is all about politics. Theyre going to do everything they can to try to turn this into a circus, try to discredit and launch character assassinations at judge kavanaugh. But i think at the end of the day, tomorrow well present an opportunity for judge kavanaugh to make his case nor dr. Ford to make her case. If they want to ask questions, they can ask questions about the other accusers. Everything is going to be fair game tomorrow. I hope when its said and done, what will come out are facts and truth. Those are the things that our members, republican members, want to see happen. They want to see a process that leads us to the facts, leads us to the truth and not one that is used for political purposes. I think again, thats what the democrats have been doing from day one. Neil they say the same of republicans. That might shock you. Let me ask you about the timetable for this, senator. Mr. Connell has said likely a friday vote out of committee. Setting the stage for everyone staying in town for debate that would end with a tuesday vote in the full senate. Is that doable . Given these other womens charges . You know, from a timing standpoint, it will depend on what happens tomorrow. As of right now, the process that the leader has laid out, well see what happens in the hearing. Just a moment to defend. When you mentioned earlier, you mentioned the democrats attacking the republicans nor being political. I cant think of a more open, fair process. He answered questions for more than 30 hours from members of the Judiciary Committee. He answered questions in a closed setting. He answers 1,247 questions neil theyre saying the way this was handled and the fact that no fbi investigation, no follow up on the other women. Six fbi investigations and every allegation has been raised, the Judiciary Committee has aggressively gone out to whoever that accuser is and tried to bring them in to interview them. Theyre doing everything they can to investigate this. Thats the power that they have. They actually have had authority neil and theres reports theres no corroborations for any of the charges. Ill leave that to the Judiciary Committee. Based on the reporting that weve seen, thats true. Theres no corroboration, theres no sta theres theres theres no neil you think the way the judge came off in the interview he had with our Martha Maccallum on that he didnt show enough passion or rage or whatever . Do you think he comported himself well in that . That he has to be much more much stronger, more in your face for want of a better expression tomorrow . I think he will. Tomorrow will be very combative, which i suspect will bring that sort of passion out. But i think hes handled himself well in the interview. I think people want to see somebody that is measured, who is out there to defend himself and his family, but at the same time does it in a way that is very straightforward and respectful. I get a lot of people, a lot of critics that no matter what hes said or how he said it would be critical. I thought he handled himself in that interview and handle himself tomorrow. This is a real opportunity, neil, to get everything, get the facts out there. Hes denied all of these things categorically. I think at this point, its thyme to get it all on the table and lets move forward with this process. Neil the president will be speaking in 15 minutes. He will want to mention when it comes to Michael Avenatti and his client with the latest charges. Many of your republican colleagues have said please, sir, dont. How do you feel . Its probably better at this point to allow the process to play out here on capitol hill. I think that its been a very as i said, a fair, open process. Senator grassley has bent over backwards to accommodate anybody that wants to come forward with the accusations and interview them hand get the facts. But at the end of the day, its probably in everybodys best interests if the Judiciary Committee do their work tomorrow and then absent anyth changing as a result of this, this process moves forward in an orderly way under regular order in the rules of the senate and we ultimately get a chance to vote up or down on judge kavanaughs nomination. I understand that, you know, the president may want to weighin on this. This is something that hes heavily invested in. Its his nominee to the Supreme Court. We appreciate and respect that. If they were really interested in getting to the bottom of the matter, they would have released the letter that was sent from the initial allegation prior to the sick leaks than what they waited to release it. They would like to see me lose an election because theyve never been challenged like this but i want to open up china to our farmers and industrialists and companies, and china is not open but we are open to them. They charge us 25, 35, 55 for things and we charge them nothing in terms of coming into the country. Cars, 25 . We are at 2 and 2. 5 and dont collect it but we collect it now.
