This morning a woman who arrived in new jersey from west africa has tested negative for ebola in a preliminary evaluation. The woman has not been identified. See flew into new jersey yesterday and remains in isolation. This comes after a Doctors Without Borders physician tested positive for ebola virus in new york. Meanwhile the governors of new york and new jersey have issued a mandatory 21day quarantine. New this morning president obama says the u. S. Reporter a powerful volcano that helped create the big island of hawaii is threatening thousands of people who live here. A river of redhot lava quickly oozing the length of six football fields in just the last two days. You can see just below here in these cracks is actual molten lava. The flow erupted from the kilauea volcano in june traveling downhill 11 miles, now less than one mile from a small town. Its really the geography that controls where this lava goes. Sometimes speeding you up, sometimes its slowing down, but its always a threat. For some of the 10,000 people affected, evacuations could be just days away. Road construction crews are racing to make sure they have a way out. The island is no stranger to kilaueas power. Its been steadily erupting since 1983, wiping out nearly 200 homes in 1990. The volcano has been belching explosions of fiery lava ever since and has no signs of cooling off. Abc 7 news has learned that San Jose Police will launch an investigation into possible misconduct by its officers who may have violated the departments gift policies. This following an abc 7 news exclusive report that members of its command staff accepted free tickets for 49ers games. Abc 7 News Reporter vic lee has the story. Reporter the complaint was received by the office of san joses independent Police Auditor judge ladoris cordell, who will now trigger an investigation by police. Once we take the complaint in, it goes immediately over to the internal affairs unit of the San Jose Police department and they investigate. Reporter the complaint is confidential. We do know it was filed after our story aired. We reported that assistant chief eddie garcia got free tickets to the niners first preseason game last year at candlestick. Hes on the sidelines here in it this picture with a field pass which says invited guest. He also got tickets to this game two months ago at levi stadium. Deputy chef jeff marozik also attended this game as a guest of the niners. The department told us they were invited because it was Law Enforcement Appreciation Day and both complied with state regulations by filling out form 700, a declaration that they accepted the gifts. But garcia and marozik violated san joses gift ordinance that says Upper Echelon managers are only allowed to accept gifts worth less than 50. The teams front office told us each ticket was worth 187. The ordinance prohibits tickets to professional sporting events. We were eventually told that the chiefs had reimbursed the team for the tickets. When we asked the Police Department when the chiefs paid, they replied last week. That was the week after we inquired about the tickets. Once we were made aware of the actual value of the tickets and that it did exceed that amount, we reimbursed it. But, again, were very glad to be a part of this. These partnerships help us foster stronger partnerships with the community. Perhaps more importantly, the two chiefs appeared to have violated the departments own duty manual. Judge cordell would not comment about the specifics of our story but pointed out that under the duty manual officers cannot accept any free tickets period. Those are deemed be to be gifts. A discount, a gratuity, favors, any of these, if theyre not offered to everybody, you cant take them. Reporter and judge cordell said again theres nothing in the duty manual about repaying people for gifts. If you break the rule, you cant then undo it. If you get caught, you cant then undo it by somehow, you know, making restitution or reimbursement. Reporter cordell says after the Police Investigation is over, her office will review it to see if it was thorough, unbiased and complete. Our office is to check on the system. So while internal affairs investigates, we are the ones that look at what theyve done. Reporter so that investigation will go forward now that a complaint has been filed. We dont know the scope of the probe, if its to see how rampant the gift violations are or if its focused on specific officers.
