Theyll advise the commanders. The white house says this latest move is not a change in strategy but an expansion of the mission already there. The president does expect that they can have an impact in intensifying our strategy for building the capacity of local forces inside of syria to taking the fight on the ground to isil in their own country. Two American Indian tribes are suing caltrans for what they say has been blatant disregard of their sacred site and theyre accusing the agency of bulldozing the ground while building the by pass up in men seen no county. Theyre firing back saying theyre doing everything to protect the environment. Stephanie chuang is live. Reporter caltrans saying it was completely caught off guard by all of this. Here it is, 76 pages of the complaint as well as the exhibits filed in District Court yesterday. The tribe saying that caltrans has desecrated say credit land. But caltrans is firing back saying its those two tribes that have not been working together in good faith. So this again is surrounding the controversial highway by pass project thats drawn criticism. And now, these two tribes are suing caltrans and the department of transportation for failing to work with them to protect these an says treel sats. Caltrans saying it would never bulldoze over sacred land. Most of the art facts discovered so far are flakes of stone, likely from old human tools. All of them are catalog and will be distributed to the tribe. Both sides seem to stand very discant from any resolution here. Its as if caltrans was going to bulldoze your church and then come yards and ask permission from you. Your church is desecrated. Thats the way these tribes have been treated by caltrans. Caltrans is very surprised at some of the things that are being said in these allegations that are being put out to the public. Caltrans has our own environmental experts and archaeological experts. And they are doing, you know, truly, theyre doing what they feel is best for the environment and for cultural resources. Reporter now, caltrans says the timing is also questionable. The agency sent out a final draft of the agreement to all of the tribes involved asking them yesterday so they kuld be done with the chapter. They worked with the tribe that lives in the project area coming to an agreement 14 years ago and only two years ago did these two tribes come to caltrans and approach to get involved. The spokesman saying those two tribes dont live in the project area, about ten and 30 miles away. The attorney for both tribes say theyre seeking monetary compensation for art facts they believe have been damaged and destroyed by caltrans but dont know exactly how much money theyll be asking for because they dont know the extent of the damage. Trying to figure out what caused a strange smell at a Peninsula Hotel that sent dozens of guest to the hospital as a precaution. Firefighters were called to the westin hotel right across from stran ford, university. Crews noticed the smell coming from the garage. The authorities identify this man as a 22yearold. They said the shooting was not random but they have not said much about a suspect. The attack happened less than a block from wilcox hospital. Hernandezs death is the first homicide in santa clara since 2011. After two months and a video that went viral, the city of roanoke park says this officer who pulled out a gun on an unarmed homeowner did nothing wrong. The officer said he was in the wrong to check parking violations. A homeowner recorded him on his cell phone as all this happened. Hes got a gun, yes, right there around the words. This all took back in july. The city says this is okay but the man behind the camera has lodged a formal complaint against the city. The actions of the officer were so egregious that we felt that we had to look into it. The lawyer expects the claim to be rejected by the city since the investigation is now closed. If that happens, he plans to file a lawsuit on his clients behalf a new lawsuit claims that 0 woman shot and killed was not facing the officers when she was shot and killed. Its a relatively large asteroid. They think its somewhere from 900 to 2,000 feet wide and its going to come close to her. The astronomer here, how close is this going to hit us . Its not going to hit us. Dont panic. But it will be about 300,000 miles away, 30 father away than the moon. Is that a near miss . A close shave . I think for the size of the asteroid it would be a near miss. Not a close shave. Its so big that even at that distance its something we take notice of. Now i think what was disconcerting is when you mentioned earlier that we only found out about this yeah, october 10th. Thats when it was discovered. Thats not much notice. Thats not unusual for small are asteroids. But this reminds us there are probably more out there that we dont know about. Reporter and there could be more that might not be a near miss and would hit us. How bad would that be . Depending on its size, if this one hit a city, the city is gone and many miles every direction. Reporter and we dont have any technology to send a nuke up. That would compound the problem if you blew it apart, bruce willis style, it would make Little Things showering all over the earth. The way theyre talking about possibly defending the earth against these, if you have enough time, warning, years perhaps, you might be able to nudge it out of the way. So if you have enough time to do it, a little nudge can go a long way in deflecting it and making the difference between a hit and a miss. So one of the ideas is to send a big spacecraft out, park it next to one of these objects and let the gravity, the gravitational direction pull it a little bit. All across the bay area, the temperatures are in the low 60s. Reaching 72 in San Francisco, the north bay up to 86 degrees, 82 in the east bay. Its only october. Its not supposed to be this warm. Into the weekend we have changes headed our way. A look at the walnut creek hour by hour forecast. At 1 00, take it outside. Its nice and 78 degrees. 84 degrees, we continue to warm up through at least the early afternoon hours and then the evening, mostly clear skies again. We wont see the low clouds rolling in. And we desperately need some rain. And a look back at how much weve had in san jose throughout the month of october. Only 300ths of an inch now. On average we get about threequarters of an inch for the year. We are down over seven inches of rain. In San Francisco, more of the same, also in oakland. We havent measured any rain there, even though owe had low clouds and mist. It wasnt enough to go into the rain bucket and measure up to anything. You probably recognize that speaker, raiders owner who made an unexpected appearance last night. He was greeted by a standing ovation. And he was also met with nfl officials and the oakland mayor to talk. But so far no word on what the discussion was. Up next at 11 00, distraught foster parents tried to do the right thing. I dont understand why this happened and why they let it two on over and over. Well investigate the failure to protect the little girl and what saved her. Welcome back. A rare behind the scenes look at the system that is failing our society. We exposed the foster care system where kids are abused and victimized by the very people who are supposed to protect them. Investigator reporter vickie wynn dug into the department of social service to find out who is watching out for these kids. We reveal a broken system few have seen up close. Youll meet people who open their homes to children in need but youll also hear their frustration about how they tried to do the right thing for a 4yearold girl only to have the reports go nowhere. Some of the pictures in this story are very hard to see but were showing you these images that reveal the abuse that so many people tried to report. Signs are everywhere in the house. These are all good kids. What was built as a retirement home for two. We were going to have them here for a little while. Turnds into a slightly crowded casa. And then we had them going on three years. For four growing children. They changed our lives totally. After raising her own family, isabelle wanted to give back, so she and al went through the process to become emergency foster care parents. When they were asked to take in two kids, they did. Eventually ending up with two more of their siblings. The fifth, a 4yearold girl lived in another home. The brothers and sisters met often for visits. She was the normal child. Very active. But then something changed. She ran out of the car and went to us with her arms open and then gradually that changed to a point where she didnt say hello, hi or nothing. Isabelle noticed the first bruises and scratches on the girls face in january of 2014 during a visit at the library. I went in there and i said, oh my god what happened . Because she looked like she had somebody hit her in the face. The two gois took her scarf off and she had black markings around her neck. Two weeks later it was al who saw the signs of abuse. Her lip was turned inside out like that, like she was punched. After both incidents, they reported their concerns to the department of social services. Worried that the girl was being abused by her Foster Guardian and half sister. The 21yearold seen here in facebook photos lived in san jose with her brother and their mother. Nobody did anything about it until it was too late. They were in touch with the girls mother. She lost custody after her husband was accused of physically abusing one of the children. But she was granted regular visits. And it was during those visits that she too began to suspect abuse. She took these photos to document her daughters injury. They say this is what social workers ignored. The mom constantly in every visit, she would pull the gloves off and take pictures and then she would come back and show us the picture, oh my god. This couldnt be happening. And records obtained by the investigating unit revealed how social workers responded to the reports of abuse. The concerns ranged from two black eyes and a burn on the girls cheekbone to a bruise underneath her right eye and the tip of her right index finger that appeared smash. Crystal always had an explanation for the wounds. The burns for an accident from a curling iron. Crystal said she took the girl to a princess party. Police records say she also provided 13 doctors note to explain the injuries and lengthy absences from school between january and june. In these three cases social workers saw the girl and determined the allegations of abuse were unfounded. What did you say the first time you got the report back and they said theres no findings . I started crying. Leslie is the executive director of the Childrens Law Center of california and a Child Welfare specialist who also served for years as a social worker. When i read the various reports, the first thing that struck me was that the little girl was not interviewed privately by the social worker. That is a big red flag. We asked her to review the case. She says while it can be difficult to detect abuse, social workers missed multiple signs and failed to vary fie the doctors notes. There were many bruises and bite marks all over her injuries. Those were not discovered until she got to the hospital. But they would have been readily visible to the naked eye. Just reading the words on paper is heartbreaking. He was hurt and no one came to rescue her. Reading those words no one came to rescue here, even after 25 years in this field, its heartbreaking. At the same time they reported abuse, the Police Records show the girls preschool teacher called dhs about deep cuts on the girls face and bruises on her head. She suspected the child was abaccident because crystal was trying to give the injuries time to heel. She described bizarre behavior as well. But it wasnt until june, five months after the first reports, that the girls mother convinced a social worker to check on her. These are photos taken the same day the girl was found, bruised, her eyes swollen shut, bite marks and scars covering her body. Police records show instead of calling 911 or taking custody of the girl, the social worker told crystal to take her to the hospital. When the worker called hours later, the girl was still at home. Police records show four hours passed before crystal finally took the girl to urgent care where he was rushed to the emergency room and given a blood transfusion. The doctor con cluesed he was a severely battered child and could have died from blood loss. Now crystal facing felony charges of child abuse and child torture. Remember the doctors notes she showed social workers. Police termed that seven of the 14, forged. Crystals mother and brother are out on bail also facing felony charges of child abuse pull awe pleaded not guilty. None of the accused abusers want to answer questions about what happened. Robert man kouachi is the director of social services. We were hoping to talk to you about how the county investigates child abuse cases. Im heading to a meeting right now. We caught up with him after the countys lawyer said no one from the agency would answer questions about the policy or training. What are your social workers trained to do . Well talk lasht about this. Minutes later the county offer an oncamera interview with the woman in charge of the department of family and childrens services. Two days later the county canceled. I dont understand why this happened and why they let it go on over and over. Here im practically screaming and telling everybody. As for the little girl found like this, shes now a new foster home still seeing her siblings. Now she comes over and hugs us, holds us and everything else. Signs of a happier life returning for a girl whose life was lost. Maybe we were meant to be here for just this case. We also reached out to every social worker that was name in the reports. They are being sued in two lawsuits filed on behalf of the girl. No one wanted to speak. Coming up tonight, a comprehensive audit reveals how many abuse calls go unanswered and the accusations this department is failing to properly screen foster homes where these children are placed. We have more on the dolphins death and the lawsuit that followed. Dolphins swing in a tank in vallejo. Two former employees who worked in animal care said that the water they swim in is dangerous, even deadly. When they raised concerns about the water and other an million issues to management, they were fired. This lawsuit confirmeds what we know is going on with the abuse of the animals at six flags. Denise is with advocates for the animals at six flags. The group pants to let parkgoers know about the animals. Every time you pay a dollar to six flags, youre paying them to deprive the animals. A usda inspection report in may of 2013 say these two dolphin calf deaths and the chronic problems in other dolphins are related to the Water Quality issues in the system used throughout the facility. Michael and holly morocco didnt want to talk on camera but their attorney released a statement. Theyve dedicated their lives and careers in taking care of animals. A enwherever they work they never compromise on the health and wellbeing of the animals. Animals shouldnt be housed with roller coasters. Reporter sigs flags did not return our calls for comment tonight but did tell a publication that the animals are safe and the lawsuit is without merit. Weve been fighting for eight years to achieve this dream and today i will be seeing that. The act of kindness that brought two strangers together and forever changds their lives. Ill detail that in the microclimate forecast. A man taking some of his first steps after a gun shot wound welcome back. We have a touching moment for you. A man taking his first steps. He had been paralyzed by a gunshot wound about eight years ago. And would you believe watching him take those steps again is not the best part of the story. Heres Garvin Thomas with todays bay area proud. When this incredible story started, eugene and arthur were strangers. But after eugene took millions of steps so arthur could take one, these two are in step forever. Youd think after 2600 miles of hiking, after weeks of solitude and sometimes days without food, youd think finishing the Pacific Crest trail would have, eugenes favorite part of the track. I can remember that moment like it was yesterday. I know exactly where i was standing. We did it that came a couple weeks earlier in washington state. Youre going to walk. The appreciate the moment, youve got to understand the back story. It we gins in a San Francisco parking lot in 2007 when a robber mugged and shot a rapper. The bullet severed arthurs spine but didnt touch his spirit. Arthur going on to become a fulltime advocate speaking out against gun violence and urging newly paralyzed patient to not give up on their dream, just as he wasnt giving up on his dream to walk again. All he needed was 80,000 to buy one of these, a robotic exoskeleton called rewalk. Which is where eugene and the Pacific Crest trail come in. Learning about arthurs story via social media, eugene decided to hike the trail and raise that money for a man at the time he had never met. So good to see you. But the farther eugene traveled, the closer he and arthur got. And that moment on the trail, well that was when eugene heard they had reached their goal and arthur had his rewalk. Of course hearing isnt seeing. I cant believe this is happening. And thats why this day is perhaps the best of all. Hes been fighting for eight years to achieve this dream and today i will be seeing that. Eugene has not seen arthur since finishing the trek and he has never seen him do this. Oh my god. Thank to eugenes kindness and determination, arthur can indeed walk. And thanks to his friendship this is unreal, man. Hell likely never walk alone again. I wouldnt be here if it wasnt for you. While this whole experience has of course changed arthurs life, eugene says its changed his as well. As you head out for the halloween parties or just going out for dinner this evening, maybe grab a light jacket as those temperatures start to drop off quickly once the sun sets. Well be up to 80 degrees in san jose and cupertino 87 degrees, San Francisco some low 70s and in the north bay 80s today. And the east bay up to 79 degrees in oakland, and pittsburgh 83 degrees, livermore climbing to 87 degrees. Heres the reason why. We have High Pressure. Is not giving us an ocean breeze and the temperatures continue to warm up for today as well as tomorrow. But by sunday thats when the cold front moves in as we set our clocks back on hour. Well be watching for the possibility of some showers to move into the north bay and then elsewhere across the bay area as the front drops in. Behind the front well have moisture moving through and that could bring snow showers to the sierra. Look at the future cast, rain holding off for halloween and then heading into sunday, especially sunday evening. We could start to see some of the rain falling to the ground, some scattered showers possibly through early monday morning and tapering off into monday afternoon. The estimated rain looks good at this point. At least a tenth of an inch in some spots. Parts of the east bay where you missed out on the rain last time. And as far as the sierra, we could have 1 inch in kingville, of course we watch kirkwood, up to 3 inches of snow possible. Great news heading into some of the wetter months of the year.
