The rain will stay north of the golden gate through 11 00, but then the front works south and the biggest impact will be tomorrow mornings commute which will be slippery all the way from Santa Rosa South to san jose. Well talk backup dated rainfall totals and the impact this storm will have on your weekend, thats coming up in a few minutes. This just in. A verdict late this afternoon involving that major legal battle over martins beach. Its a big win for surfers and those fighting for beach access. A San Mateo County superior court judge ruled against bay area billionaire for blocking access to the beach. He bought the property in 2008 and built a gate and closed the only Public Access road to the coast. Today the judge ruled he needed to obtain a Coastal Development permit to do that a step that would be extremely difficult to do. People in one part of san jose say they are living near a nightmare neighbor. Not a house, its a bar. Len ramirez tells us the problem has gotten so bad, the city may have to step in. Len. Reporter neighbors say the el tarasco bar has been a problem for eight years. The owner says yes, there are problems but they have a lot to the do with neighborhood issues and he is not to blame all by himself. At any rate, the city is now taking steps to try to shut the bar down. By day the el tarasco bar is empty and quiet but on weekend nights neighbors say it becomes a magnet for the worst kind of crime. [ screaming ] reporter a neighbors home video shows a gang fight in progress an assault that ends with a man down in the street. Prostitutes puking on the sidewalk and men urinating. Its complete lawlessness. Reporter rico mendez shot the video. Its been extremely difficult. We stay up until 2 00 every weekend night and we usually have to call 911 multiple times per night. Its clear that we have to take action. Reporter City Council Member sam liccardo who is a candidate for mayor wants to use things like land use codes and Liquor License violations to shut down the bar that he says is Wasting Police resources. The key here is that were spending too much in police resources, focusing on one bar. And we know we have a lot of needs in this city. We can be more efficient by having Code Enforcement shut them down and focus our police in other parts of the city. Hello . Reporter is the bar really the cause of the problems . I never been raided by the police for selling drugs or supposedly prostitution. Why dont they really dig into where the problem is . Reporter according to state alcoholic Beverage Control records, an employee was caught selling meth in 2013 but no action against the bar was ever taken. Barone says he get blamed for neighborhood problems like homelessness and Gang Activity that liccardo hasnt addressed. This is all politics. Why doesnt he come and talk to me and address the problem see what we can do to fix the problem . Reporter has he ever come and talked to you . No. This is a Business Owner who has had visits from Code Enforcement, police officers, theres nothing more i can say to change his mind to take action. Reporter this afternoon the city council was going to take action against the bar but there were not enough City Council Members present in the meeting to form a quorum to get that job done. So it will have to be put off at least until next week. Reporting live in san jose, len ramirez, kpix 5. The States Department of alcohol Beverage Control has filed formal complaints against the bar. Disciplinary hearing is set for november. San franciscos Firefighters Union hand delivered a letter to city hall less than an hour ago asking to oust their chief. Kpix 5s Mike Sugerman says the union is in the middle of presenting their case to mayor lee right now. Mike. Reporter liz, it appears that the fire chief will not lose her job at least not today. She told us earlier that she now has the full backing of the mayor so she has at least put that fire out for now. Now, earlier, about two dozen members of the union, the Firefighters Union, came to meet with mayor ed lee and they brought with them a letter signed by every group within the union asking the mayor to fire the chief. The letter said there was a grave crisis of confidence and leadership and that the department is failing to protect lives and property. The most public issue now is over a slow Response Time by ambulances up to an hour to get ambulances on scene to take emergency cases to the hospital. And the chief met with paramedics today, in fact, to discuss that. But Union Members have for months complained about discipline the chief has enforced and a couple of well publicized cases. Now, were going to hear from the chief now and then well hear from the union president. As i have with confidence, with the support of the mayors office, if you look at the totality of my career im hard working, im conscientious. Im a problem solver. The work group is good. We have all the stakeholders at the table so yeah, im confident. We are a very proud institution. And we want to serve the public to the best of our ability. And we feel were not able to do that right now so we are a trying to regain our footing and make San Francisco proud again. Thats our goal. Reporter all right. We dont know how long its going to take and we dont know what the outcome of that is going to be but by 6 00, we should know and well bring you an update then. Live at city hall, Mike Sugerman, kpix 5. There are more firefighters battling the king fire right now than any wildfire in the past decade in california. The fire raging in El Dorado County has burned more than 92,000 acres. Because 12,000 homes are still threatened by those flames, thats why theres been such a huge response. There are fears that it could get worse. The winds were forecast to pick up today and the last time that happened, the fire just about tripled in size. Were expecting 15mileper hour winds with gusts up top 35. So obviously, thats very serious. With the map here, you can see when we had our last wind event thats when the fire grew over 50,000 acres overnight. And it pushed through this canyon here and created what you see. So were trying to prevent that from happening again. So far the fire has destroyed 12 homes and more than 50 other buildings. A man was arrested last week and accused of intentionally setting that fire. Developing news, another wave of u. S. Led air strikes against isis targets in syria. San jose firefighters had to deal with not only flames but downed power lines at a fire this afternoon. That fire started on the roof of an apartment complex near city college at about 2 p. M. You can see flames roaring from this cell phone video. All the people who lived in the building there were able to get out. However, because of the power lines, firefighters had to fight the fire from the outside only. Nobody was hurt. Bart has a long list of people who shouldnt be on their trains. But if you have been naughty, how can they enforce the ban when tens of thousands of commuters ride the bart every day . Kpix 5s da lin asked bart how they can keep tabs on the rails worst offenders. Reporter yeah, its a tough task. More than 300 people are on the barts ban list. Its a restraining order designed to keep violent riders out of the transit system. But bart admits its not perfect. The bart prohibition bans some of the worst offenders from people convicted of Domestic Violence on bart platforms to this. Run, run reporter assaults ah hay stop it reporter this naked man was one of the very first people banned from bart after he attacked passengers and station agents in San Francisco last year. [ screaming ] gives us the ability to make an arrest and remove them from the system for trespassing. Reporter since the bart bans went into effect 18 months ago, 339 have made the list, some for up to a year. They are going to be kept out of bart and our passengers and our workers are going to stay safe. Reporter bart police admit enforcement is tricky. 400,000 people use bart on a daily basis. They say its impossible to identify and prevent those offenders from using bart. They say station agents are the first line of defense, looking for repeat offenders. The other way to identify them is when officers respond to service calls. Well check that person for wants and warrants. We have an internal database and we keep track of who has been issued the prohibition order. Reporter bart Police Believe its another tool to keep trains and stations safe but not everyone thinks they are on the right track. What if they are having a bad day, what if for some reason theyre intoxicated under the influence and its a onetime deal . They should be, you know, unable to use a Public Transit system because of one mistake . I really dont think thats fair. Reporter bart says its simple. You violate someones else rights you lose the privilege to use bart. By the way, Domestic Violence is the category with the highest prohibition orders. One month since the napa earthquake the recovery continues. The damage then and now and how people are continuing to pull through. ,,,,,, beach. Earlier we told six point oh earthquake last month is just now startio its feet. A napa Valley Mobile Home Park hit hard during the 6. 0 earthquake last month is just now starting to get back on its feet. This is what it looked like right after the quake hit. Mobile homes went up in flames after a ruptured gas main caught fire. Four homes were destroyed. Six others were damaged. But today, you can see the things are pretty much cleared out cleaned up. Theres remnants of one mobile home that was burned, but Everything Else has been moved out. The empty spaces are now ready to go for new homes to come in. Napa is well on the way to recovering after the devastating earthquake but theres still a lot of work to be done. Kpix 5s ryan takeo gives us a look at the progress. Ryan. You see the two machines acting as braces holding up a law office building. Now heres what it looked like right after the earthquake. This is one month ago. You can see the masonry that fell on that car and made a mess all over this parking lot. This building is still red tagged. But theres work being done. Today we checked in with homeowners who were redtagged. Sherrys house, it was not safe. So she had to live in her neighbors trailer for 20 days. She is now back inside her house. She has been back for a week and a half. And she still cannot believe it. Sometimes no, really. Sometimes i think, wow, i really am in here. But its still not finished but at least im in. Im happy im in. Reporter sherry is one of the lucky ones. She is back in her home and got it fixed for free. Well tell you how that happened. She is lucky. There are others still red tagged. This particular front has more moisture to work with and it is a stronger front than the one that we had this time last week. You may hear the pitterpatter on your roof while youre sleeping. There will be a light to moderate rainfall at times overnight tonight. Setting the stage for you as for whats coming first, the big area of low pressure is well up to the north but a well defined line of rainfall thats the front, thats the first thing that will get here overnight tonight while youre driving to work tomorrow, the front moves through. Thats our first wave of rainfall. It looked at first as if the rain chance would be done by thursday afternoon. We cannot say that now because the actual low Pressure Center will pass right over top of the bay area keeping things unstable, keeping things cooler, and cloudier and even all the way through friday afternoon we may she showers as the low pressure system is the second thing to move through. By friday afternoon how much rain are we talking about . North bay will see the motor, 1 4 to 3 4 of rainfall toward mount tam and higher elevations. The east bay. 2 of rainfall or double what you got last week. The south bay at. 10 of rainfall in the santa cruz mountains. 25 to half inch of rain. We have rain coming tonight decreasing our fire danger. This is wonderful news unless youre driving to work tomorrow. Evening cloud cover tonight. Sprinkles in the north bay this evening.
