But sometimes i dont understand what happened. I dont know what happened. Tommy will always be in my heart and ill love him forever. He is the love of my life and my daughter, they are everything. Reporter tommy called his wife and his daughter his girls. And they were his everything. His family said he was a family man and he loved sports, ken. He loved the 9ers. They were all together on sunday watching the game. No one said goodbye. They left saying, stay safe. They were all together yesterday at Eden Medical Center when they heard into us. An amazing dedicated family and to have the presence of me ind to really express their emotion and sorrow for the other officer involved, thats so unusual. Reporter they all shared the heartfelt condolences. They said when they were at the Eden Medical Center when they heard what happened and then they heard it was friendly fire, they immediately felt sorry for that officer and his family. Theyre a brotherhood as you know and they are all brothers together. Yeah. And the bay area is so lucky to have dedicated officers like that. Reporter absolutely. Tough one. All right, Juliette Goodrich in san ramon, thank you. Authorities knew immediately that it was a fellow officer who shot Sergeant Tom Smith. This was friendly fire. Copy, friendly fire. Police radio recordings identified shot as friendly fire notifying others that the gunfire was not from a suspect but, rather, another officer. Police on scene immediately called for paramedics. In sacramento, the state capital lowered its flag to halfstaff today in honor of officer smith. Several other flags around the bay area have been lowered, as well. Sergeant smith was with several other officers at an apartment looking for evidence in a robbery. As our da lin reports, an autopsy could help determine what exactly went wrong inside. Da. Reporter yeah. The result will certainly provide some clues and those investigators have also interviewed the bart Police Officers who were inside that apartment. The bart police chief said today that both officers the one killed and the one who opened fire are experienced cops. Today we got a look at the apartment where it happened. Neighbors and investigators say the shooting happened inside this onebedroom apartment. The Sheriffs Department now leading the investigation says Sergeant Tom Smith and other bart officers came to recover stolen property. The robbery suspect was already in custody. But when bart officers noticed the door was unlocked, investigators say four detectives went in with guns drawn. Once inside, an officer fired one shot killing Sergeant Smith. Investigators would not say whether it was misidentification or accidental discharge. The bart police chief was emotional talking about the loss. Were shocked, disbelief. Were numb. Were grieving. And please, give us some time. Reporter many people who live at the complex are asking how it could happen. How any confusion could happen is baffling to me. Reporter former bart Police Officer and now a firearms instructor don cameron says officers are trained to stay close when searching a small area. Very close quarters, officers are basically in a line one behind the other. Some will branch off. Reporter while he is not on the case, he has investigated many officerinvolved shootings. He says where Sergeant Smith was shot and the entry wound will help determine how it happened. Being in a tight confined area, limited Movement Capability and probably some type of tripping or bumping accident, thats what id speculate. Reporter again, the autopsy is being done today. A neighbor spoke to us today. She met lee right before thanksgiving. I cant believe that he was involved in activity like that, although in a way its kind of scary but maybe, you know, maybe its something kind of fluke because his character shows a totally different side to the people around here. The Defense Department announced today the death of a soldier from monterey county. 42yearold edward balli died in afghanistan. He was shot and killed after insurgents attacked his camp. He was a chief warrant officer who was supporting Operation Enduring freedom. He was on his fifth tour of duty after joining the army at age 19. He comes from a long line of family members who also served the country. His uncle say he was a hero to everyone and never boasted about his career. Eddie never looked back at what he did. Never complained to anyone. Was always willing to go where his country sent him. For us, we want to remember him and well always remember him as our hero. Balli was born and raised in salinas and graduated from north salinas high school. He leaves behind a wife and three children. Time to act is now. Thats the message from House Speaker john boehner who is calling on his colleagues in congress to pass emergency legislation aimed at drought relief. In fresno today, boehner said it doesnt make sense to favor fish over people. While were going to put a lot of farmers at a big disadvantage and cause them millions of dollars, i think we ought to think about the tens of thousands of farm workers who are going to be put out of work as a result of the government misusing the law because they are answering to people with louder voices. The proposed legislation would stop the controversial restoration of the San Joaquin River through 2015. It would also allow farmers to pump Irrigation Water from the delta and form a joint House Senate Committee to tackle long term water issues. 2013 was a recordsetting year because we barely saw any rainfall. But it may go into the record books as the driest year in half a century. Ann notarangelo talked with a berkeley professor today who believes the past could indicate a dire situation. Some people have said that this could be the start of a several decade long dry spell. Reporter dried up creekbeds in golden hills that look like august instead of january could become our typical landscape if history repeats itself. Ucberkeley professor lynn ingram is the author of the west without water. She looked back 10 to 20,000 years and came to the conclusion, we live in a dry climate. The its important to understand our climate history and know about drought and years of extreme flood. Reporter ingram is a paleoclimatologist who examines history to forecast the future and the study about tree rings led her to predict we could be in for the driest winter in 500 years narrow tree rings indicate little or no water for growth. Just like we saw in the 1500s. They put on rings every, single year. So you can actually be able to detect one year of drought. Reporter another indication, but not as precise, are sediment cores that can stand a few thousand years and point to the saltiness of the bay. More freshwater and the salinity drops. And what they are seeing is at least something on par with what happened here in 1976 to 1977. And this could be the norm for quite some time. That was like the year with no rain. We could be on track for heading into a drier sort of period. Reporter some droughts like one in the middle ages lasted more than a century. Ingrams not predicting that. She says thats like predicting earthquakes but calls this time anxiety provoking. The bay area was built up during the wet 20th century. We may be formed to adapt to a drier 21st. In concord, ann notarangelo, kpix 5. The professor says we should use this information to rethink how we use, save and recycle our water. Cautious optimism today from governor jerry brown in his state of the state address. While things are improving he says we have a ways to go. As kpix 5s phil matier explains, its what the governor didnt talk about that is getting the most attention. Were not out of the woods and were certainly not out of the drought. Reporter the message from governor jerry brown was clear, the state might have a surplus this year, but it still owes over 100 billion for state worker pensions and Retiree Healthcare and it needs another 65 billion to repair its crumbling roads and other infrastructure. So we cant go back to business as usual. Reporter and, of course, theres the drought. We need everyone in every part of the state to conserve water and we must prepare for forest fires. Reporter but many republicans and even fellow democrats said it was what the governor didnt talk about that got their attention. And no mention of his controversial plan to tunnel Northern California water to the south. Both of which are proving unpopular with voters and lawmakers. I would not support his proposal. Its just that most of them are still awake and biologists are keeping track of them with radio collars. Special homing antennae help locate them as the biologist needs to track down that special bear. Each collar has its own frequency so we can differentiate between bears. Reporter in the campgrounds, those special bears get special attention from special radio repeaters that automatically detects them when they show up looking for food. The woman at the center of this lawsuit said that this was her dream job that she loves the raiders loved being a raiderette but said it hit home when she had to pay about 1,000 in outofpocket expenses and didnt see her first paycheck until the end of the season. Lacy, who describes herself as a married stayathome mom, signed on as a raiderette cheerleader for the 2013 season and said she was at first thrilled. I had opportunities to dance in front of some of the best fans in the nfl, raider nation. But honestly, uhm, it was a Financial Hardship for me. Reporter lacy is now suing the Oakland Raiders accusing the team of flagrant violations of state law. She said the raiderettes would only get paid at the end of the season and that if added up their pay wouldnt be 5 an hour. We received 1,250 at the end of the season which is 120 per game. And that was it. But we do practice up to three times a week. We had overnight stays for photo shoots. We had an overnight stay for minicamp. So there were a lot of other hours we were putting in to be a raiderette. And there was going to be no compensation for that. It certainly stood out to me that they dont get paid until the end of the season. That on its face is a violation of law. Reporter the lawsuit claims the raiderettes could be benched forced to sit at games unpainted if they gained weight as little as unpaid if they gained weight as little as 5 pounds. Although the client signed the contract, the Attorney Says its in violation of law. The contract that lacy brought to us was one of the most egregious contracts i have ever seen. There are just so many illegal provisions its hard to imagine that a group of lawyers at a franchise like the Oakland Raiders would have presented this contract to a group of women to sign. Reporter now, this is a class action lawsuit. So far, no other raiderettes have joined the lawsuit. The attorney claims that if the raiders would pay the cheerleaders what theyre owed, they would have to pay them tens of thousands of dollars in back pay. We contact the raiders this afternoon. Killed yesterday investigating bart crimes in dublin. They are showing remarkable strength and incredible compassion. Not only my family out here grieving, his family. Theres another officers family out there grieving. Just hope that the community respects everybodys grief and supports everybody involved. Should try and make sense of it. It doesnt make sense. Did very much for his family and was always out in front with his daughter when she was riding her bike or scooter. Reporter today the driveway where Sergeant Smith once watched his daughter is packed with family and friends. As i heard about it, just on the news. Reporter john felt the dread and disbelief before smiths name publicly surfaced. When he heard the fallen officer had a sixyearold daughter and a wife that was also a bart officer. There were words exchanged. Reporter we met smith a year ago while covering a bart story. We feel loss in our neighborhood and loss certainly going to feel a loss in our community and i know that in the bay area were all going to [ crying ] feel the loss. Pretty difficult. Reporter john is flying an American Flag in tribute and posted a message saying, our neighborhood hero, tom smith, the flag has special meaning to him. It was given to his grandmother when his uncle died in world war ii. It represents that symbol in my family of loved ones and i hope that, you know, were trying to express our love for him by flying that flag. Reporter in this quiet cul desac, one neighbors message of gratitude certainly is loud and clear. And that message of gratitude is starting to spread. In other bay area headlines tonight the woman suspected of shooting and killing a man at a vallejo trailer park this morning is now in custody. Police say they received a call just before 6 00 reporting gunfire on san miguel near 80. They found a man in his 40s shot inside a mobile home. The shooter was described as a woman in her 30s completely unclothed. She was found a few hours later and then taken into custody. A second shooting involving chp in as many days. Two officers made a traffic stop last night about 9 p. M. On wentworth near bancroft in east oakland. One man tried to run. The officers say he had a gun. Both opened fire killing the man. The driver of the suv sped away and now investigators are trying to track him down. The car is described as possibly a silver Toyota Sequoia with red and white paper license plates. New details about last falls deadly shooting at l. A. X. Just minutes before the shooting, two armed officers assigned to the area left for a break without letting in this dispatchers know. As paul ciancia began shooting the lapd officers were outside the terminal. A tsa agent was killed and three other people hurt in that shooting. The minis were the worst performing group of any car tested so far. The chevy spark was the only mini with an acceptable rating. At the same time federal safety regulators are proposing upgraded standards for car seats to protect children in sideimpact crashes. If the rules go into effect, car seats for the first time will undergo tests simulating t bone crashes. Currently car seats are only tested in those front impact crashes. The new test will also use dummies representing one to threeyearolds. Manufacturers will have three years to meet the new standards, which regulators estimate will prevent 60 injuries and save five lives a year. You feel like youre the only one going through this and you feel alone. Reporter janet cofounded willows in the wind almost 7 years ago after her daughter needed to be sent away to school. She found there were very few free resources to help parents with teens in crisis. It could be flatout behavioral, it could be mental health, bipolar, depression. It could be for many reasons. But it all equals the same thing. You have a child thats in danger and you have to do something. What does it mean to have a child thats out of control . Reporter its not a replacement for professional help. Its about parents helping. Janet and her all volunteer board have been there. They all have graduates. They welcome us on the other side. Everyone has struggles. Reporter once a month parents can drop into free meetings in los altos and oakland. Its a chance to connect and as one mother jennifer described i came and its like, oh i didnt feel alone. I felt supportive. I felt like there are resources. If anything, the ridge is building so far to the north which is the wrong direction, by the way, a tiny area of low pressure will go around the top, come back down and move through the bay area on friday. Thats the reason why well get a southerly wind flow for one day and a cloudy day coming up on friday. Aside from that, its all about the ridge.
