Passengers after spending two hours stuck on the train because of a fire. The blaze broke out at the walnut creek station. Firefighters were able to contain the fire quickly but could not put it out until electricians showed up to shut off the power. The people on the train did not know what was happening when the train stopped. Once we were stopped it was maybe a few minutes later and then all of a sudden the fire engines came and we were just looking down and couldnt see any fire. When they arrived they found a lot of smoke coming out of the electrical room along with explosions. No one was hurt. Investigators are not sure what caused that fire. They do not suspect foul play. Chaos in berkeley. Police make ten arrests at a pro trump rally. Violent clashes broke out between Trump Supporters and antitrump protestors yesterday afternoon. At one point large groups of people were beating each other with sticks. Many were left with bloody noses and faces. Some used pepper spray and threw smoke canisters into the crowd and some set off fireworks. I knew full well there might be some stuff popping off. It is a sad day and were better than this. For the most part Police Officers standing by in riot gear did not intervene in the individual fights. While fights were happening, kpix5 learned that officers were only intervening when there was a perceived victim. Any other altercation where there is no victim, is a battery situation. The tactic appeared to isolate trouble makers so the police could arrest them. Our cameras got a few arrests like this one. We were walking away from the protest and they started following us for no reason. We started running and they decided to pull over my friend and she started running and it took seven of them to take her down for no reason. We were walking away. Im trying to figure out what they got her on. Berkeley police put out a photo of some of the weapons they confiscated. Some baseball bats and sticks of different lengths including one with nails sticking out of it. Pro trump rallies throughout the country. Most were peaceful. In the nations capitol they listen to pro trump speakers. In new york city couple hundred Trump Supporters and protestors braced the cold near trump tower. The police kept that confined to an area with barricades. Organizes of last months womans march on washington will pound the pavement again this week. They say a day without a woman will be held on International Womens day on march 8. This is video on the march in washington in january. Action items are listed on the website. They call for women to take the kay off work and only shop at small women and minorityowned businesses. Organizers say the strike is meant to recognize the contributions women make to the economy despite the gender wage gap. It is not our concern if their legal status here in this country. The president said he would crack down on illegal immigration and is already removing, quote, the bad ones including gang members and criminals from the country. Joining us now to talk about immigration deportations is hastings law professor. You have been studying this for years. We have not had a change in Immigration Law since when, the reagan add hins stration . Pretty much, yes. The only changes were seeing is changes in policy. Every president that came in has basically set the guidelines under these laws that are existing, correct . Yes. All right. Let us look a little bit how different president s have done it. Compare george bush, say, with barack obama. What were the differences in how they interpret it. When you look at the Obama Administration in all eight years of it you see a high volume of deportation. Higher than the bush presidency. But there is a nuance there, which is that most of the deportations under the Obama Administration happened in the first term of his presidency and in the second term of his presidency, deportations went down. And what led to this was the fact his policy became less compromising and things changed a little bit in the second term. He actually deported more people than his republican predecessor which is a soccer for people out there who would think it is the reversed. It is now become an issue because the Obama Administration justify increased what was the reasoning behind it . What was going on to some extent a political compromise. Obama was reaching out a lot to the right during the first term of his administration. This is one of the discontents of his presidency for many progressive supporters. In the second half, again, they scaled back pretty dramatically, ice enforced a lot less, and the enforcement focussed on different kinds of people, so it matters not just how many people you deport but also who you deport. Okay. Lets look at that between what the Obama Administration was doing and what the Trump Administration is doing. What do you see as the key difference there . The main focus is that the Obama Administration focussed mostly on two type of deportees, folks that just arrived at the border hightailed and sent back immediately on arrival, and people who committed serious, Violent Crimes and were there for serious risk for public safety. What were seeing this administration doing is creating a false nexus between immigration and crime claiming that immigrants commit more crime and a claim that is patently false. Every piece of Research Shows immigrants on average commit less crime than the nativeborn. Okay. That is a political statement. No, that is a fact. Im not disagreeing with what youre saying but the fact that trump says were going to do that and links Illegal Immigrants with crime, is a political statement. It is not an immigration policy. My question is, what is serious crimes versus serious crimes in the two administrations, obama versus trump, what are the differences there . Trump includes low level of offenses, misdemeanor s traffic offenses. So the whole definition of who is a criminal and who we should be afraid of changed. Would [inaudible] be serious versus obamas versus trumps. There are some both administrations they would be a serious crime of deportation. Yes. Where is the break . I realize you can have the ability under law if you have a parking ticket just the fact youre here illegally is grounds for deportation under the law. If we take the politics and pr and some of the light on hysteria, or whatever, what is the key difference of what we had and what were seeing. There are specifics in the Immigration Law that specify i think the term is crimes of moral turpitude which are crimes leading somebody to leave the country. These are categories defined in Immigration Law and include things that pose a risk to public safety. They do not include plain old offense. Under this administration, there are two things happening. One of definition of what counts as offense and how ice is going to parse their efforts is going to change. And they also increased the time limit for people that theyre seeking from two weeks to two years and that is also a big expansion in the operation. One of the biggest changes is the tone of the administrator saying what it is and linking it and using it as political which brings in the debate. Thank you for joining us this morning. In our consumer watch today a bay area lawmaker is turning up the heat on Public Utilities over gas bills. Julie takes a look at what is behind the issue and how its going to affect you. Yeah, you know we have been getting complaints, a lot of people noticing their gas bills and energy bills spiking. Senator jerry hill is calling on pge to lower bills and better understand when their usage climbs. Hill and his staff did research into the spikes in bills in addition to an approved rate increase. They found the rate structure, higher cost for natural gas and colder winter months were to blame for the increases. He wants the Public Utilities commission to track the usage to avoid those surprises and increase the amount of gas theyre allowed to use in the winter before theyre bumped up to a more expensive tier. They say they are reviewing those recommendations. Electric bills to electric cars. Electric car charging stations could soon be a requirement for new developments in San Francisco. It requires 10 of the Parking Spaces in all rt r. Residential and commercial buildings would have to have electric charging stations. The mayor is backing the proposal. The New Buildings may also be subject to proposed rent control laws. That is one of the items assembly dem kragts are working on democrats to make housing in california more afford darryl. Now a state law limits rent control to buildings constructed before 1995. And they would make it to apply to every building including new ones. When a tenant leaves, landlord can bump up the rent to the going rate. And there may be changes as they go through this process. Obviously, landlords are strongly opposed to this proposal. They would like to see changes. They say it might force some of them to leave units empty adding to the housing shortage in the bay area. They will have another meeting in the next few weeks. I like to go back to the first story involving pg e and natural gas. A system that is aimed at conservation and if you go over a certain amount you find yourself in a whole different area . Pg e up until recently had several different tiers. They simplified it to two tiers. Year round if you use lower am of gas or energy youre in the lower tier and charged a lower rate. The second you go above that you are bumped into a higher tier. What jerry hill is saying, during the cold winter months allow them to use more gas before they get bumped up into the higher tier and let folks know whether be it via text message or phone call, whatever, that youre getting close to the higher tier level. The snow down 2,000 feet. If you head to santa cruz, look at this, you might see dusting over the passes today. And certainly were seeing some of the east bay as well, got rain snow mix as well. And some of the Higher Elevations near san ramon, dublin, well see dusting this morning. We actually have seen as these showers pass through a dusting of snow on many of our mountains including oakland and berkeley foothills, and we have a storm warning in effect for the northern mountains near mount shasta. A little higher for northern sierra, 2,000 and 2500 feet, we could see three feet of snow above the passes. And dusting in lower elevations. Showers will continue throughout the day. Possibility of a thunderstorm with unstable air mass in place. Well talk more about this and time out when the rain will end. Volunteers are busy cleaning up the mess left behind by the devastating floods in san jose. About 350 people were out in city parks yesterday removing mud, branches and debris. At the height of the bloods this area, kelly park, was under six feet of water. The park manager told us the hardest part of the recovery is finding resources. That is why having the volunteers here is so important to us. It has been just it is hard for me to talk about without getting emotional. Without hear help it is an overwhelming task. The city is organizing more volunteer cleanup projects this afternoon. What a difference a little dry weather makes. Here is a look at the anderson reservoir. The water isnt even close to spilling over but a couple weeks ago water was pouring from the spillway. It is what led to flooding along coyote creek. Two days after a successfully restarting the power plant at the oroville dam, officials shut it down once again. The crews are deepening the water channel so the plant can reach full capacity. The shuttledown is expected to the shut down is expected to last one or two days. The spillway eroded last month prompting evacuation of 2,000 people. Another top story. Punches thrown, smoke canisters set off and faces blood deed as violent clashes erupt at a pro trump rally. The berkeley officials took a handsoff approach. They instead focussed nar attention to arresting instigators. Trump supporters said they were determined to assert their free speech rights even in potentially hostile territory. We tend to ignore the hotbed like berkeley and it grows and grows and pushes us out. It is turning into something awful and it is important that people address the issue and not run away from this intimidation factor. At least 10 people were arrested. Meanwhile members of congress are calling on the president to provide evidence supporting his stunning claim that president Obama Wiretapped his phones during the 2016 election. Trump tweeted is it legal for a sitting president to be wiretapping a race for president . A new low. Now, even republican senator ben sass and others say President Trump those elaborate. No one ever ordered any surveillance on u. S. Citizen and any suggestion is false. The president is developing a new travel ban according to cnn. Iraq will be removed from the list of banned countries. The original order blocked u. S. Entry from seven predominantly muslim countries. That was halted by a federal appeals court. President trump could sign a new version of that as early as tomorrow. And the u. S. Attorney general is at the center of a scandal accused of lying under oath about his contact with russia. Now much of this revolves around what is meant by the words meeting. A Justice Department said the attorney general Jeff Sessions spoke with Russian Ambassador of the United States twice during the president ial campaign. But sessions did not disclose that information during his confirmation hearings last month. Even though senators asked him about contacts with russians. If there is any evidence that anyone affiliated with the Trump Campaign communicated with the russian government in the course of this campaign, what will you do . Senator franken im not aware of any of those activities. I have been called a surrogate at a time or two in that campaign and i did not have communications with the russians. And im unable to comment on it. A lot of the Debate Centers around what were those meetings, were they planned meetings to discussion Campaign Issues or were they social issues with senators normally meet with foreign dignitaries. The Justice Department says the conversations occurred in july and september. At that Time Sessions was serving as a republican senator for alabama and adds visor to the Trump Campaign at the same time. We spoke with face the nation host John Dickerson and asked if it is normal for a new administration to have so many stumbles out of the gate. We just won a big ee location election, and they think we can do a lot of things, but what is unique to this president perhaps from president s, gosh, going back a long time, is that he has come in with a jeel agenda to move very, very fast and almost used chaos chaos created by the Quick Movement to his advantage. Lot of the chaos in the sessions situation seems to be rotating around the word meeting and what happened. I asked San Francisco mayor willie brown who knows how to parse out a word. Meet means paums anything to anybody who is using that term. What do you think about this whole business . Well, i think, you know, look, you expect the head of the department of justice to be able to directly answer a question without adding Additional Information and without purging himself. It was interest, perjury is the intentional miss statement of facts. He is already setting himself up to defend against a perjury charge. You spent a number of years in public office, what do you think . He should be very clear on letting everybody know that there was no formal meeting on anything; that there was a number of meetings where they discussed what happens with alabama and whether or not they can beat ohio state and become number one. He should go through all of the possibilities of things that he said and let it go at that. In sort of if we pull the lens back a little bit, there is a meeting and then theyre in the context of how youre being asked about the meeting and was the meeting were they asking about meetings with regard to the campaign and relationship to russia, right . You understand this is all screwed up. Under no circumstances should there be anybody denying that on occasion when i bumped into you, we discussed the campaign. We discussed the show. We discussed my absence of comp timely payments of my child support. We discuss all the things we discuss. Period. That is not a meeting. This man named sessions you recall during his confirmation, he had to testify about things that happened in the 80s, that he made racial slurs. Okay. Next question, melissa, youre a lawyer and mayor brown is a lawyer, we have calls for independent outside investigator into all of this and now that sessions is saying he is going to recuse himself, my question is, how is the Justice Department ever going to conduct an independent outside investigation of the organization it works for . Whatever happens there is going to be tainted. First and foremost, independent means independent of the Justice Department, not just independent of sessions. And the public should get that clear. Sessions should make it clear. He didnt. When he said im recusing myself but im handing it off to my deputy. That is not independent. What if he had said, you know what, we did meet, we met in the hallway, we talked about sports. Im surprised he didnt. Because for a politician, let alone a lawyer, for a politician in that situation, that is how they clear their throat. The fact he didnt and we have another story we will be out there covering. I have recused myself in the matters that deal with the Trump Campaign. I should not be involved investigating a campaign i had a role in. Sessions maintains he never intended to mislead anyone. President trump is standing behind sessions, calling him an honest man. The question this morning, did the nations chief Law Enforcement officer commit perjury. So far no response from the white house. Thats right, joining us to talk about that and all of this other things is professor hastings, law professor. I got to ask you, you have been in washington, ufk around this. It seems you have been around this. In the modern presidency we say, here is your office, here is your staff, here is your special investigator for whatever allegations that seems to be popping up, whether white water or whatever. In your opinion, did segs commit perjury . Hard to say. He made a clear statement in his testimony under oath, and that statement was contradicted by at least he had two meet joogs do they rise to that level . Perjury is a hard crime to prosecute. Prosecutors dont like to do it unless it is clearcut. You need to show intent to deceive. So it is hard to say, but i think the important point here is that the perjury issue is a small piece of a puzzle. Noisy piece. The thing that will get attention and he recused himself from an investigation from a russian governments allegation, that the russian government involved itself in the election. That is the issue here. 82 yes. Does that rise to the level of a special investigation . I think it could well. Were seeing people from both parties calling for some sort of independent investigation because the issue is not did the russians hack into servers and did the russians try to disrupt the election. But the bigger issue is did the russians have contact any any kind of collaboration with the Trump Campaign. That is a huge issue that goes to the integrity of the government and the system. Is it illegal . It could well be. You know, there are a lot of laws there that could be violated by Something Like this. But more importantly is the integrity of the government and what went on and the American People need to know what went on and that requires, i think, an independent investigation. Okay. How would you come up with an independent investigator . Who would call the shots for this, if sessions says im recusing myself, then it would be recusing himself for selecting who ever would do this. Who would come up with it . There are different layers to this. Sessions recused himself which means his deputy, the Deputy Attorney general, will sort of run the Justice Department on this particular issue. Now, interestingly enough, President Trump has named his deputy, but he hasnt had has not been confirmed yet and he will have confirmation hearings this week in the senate. Well see action in the Senate Judiciary committee. Im sure he will be questioned about all of this and what he intends to do. That is level one. What is the attorney general or acting attorney general going to do . The next question is what is cress going to do. Another question Congress Going to do . And another question could the president name independent counsel or investigator here. Nixon did that. 82 yeah. And he fired him. Yes, but then named him again because the political pressure was too great. If we look back at the campaign, questions are being raised about Trumps Campaign contacts with the russians. But those exchanges have been brought to light supposedly by wiretaps possibly, by the fbi possibly, of Trumps Campaign team or people connected with the campaign. What kind of questions does that raise. 82 well if the federal government is eavesdropping on people during campaigns . Presumably if that was done, it was done because a Foreign Government somewhat hostile to the United States, the russians, were trying to interfere with our election, and that is a question that the Intelligence Services would want to find more out about. And if it turns out and we dont know yet at all, that they listened in on conversations that involved people with the Trump Campaign, that is a relevant fact that ought to be known. So could donald trump order an investigation into the security, nsa and fbis investigation into his campaign . He could. He could. Now this is where this is where our system hopefully comes into play, because President Trump is very powerful, the executive branch is powerful but there is another branch of government out there, the congress, that is independent. The congress could conduct its own investigation through its intelligence committee. So well have the presidency, supreme court, the legislature, the congress, and then the special investigators, the new arm of the government. Stay tuned.
