bay... one man is dead after an overnight police shooting. the issue started late last night at a home on mount frazier drive. officers recieved a call about a family disturbance... a father and son were arguing with each other.... police say when they got to the home... the 28-year-old son came out of the garage and charged at one of the officer's with kitchen knives in both hands. that's when one of the officer's fired his gun... (gerry hernandez/neighbor- the guy got shot down the street. all i heard were three gunshots. when we came out they put the yellow cones on it. i think there were 8 to 10 cones down the street) (reporter- did you know the man?)(gerry hernandez/neighb or-no)(grant) the man was rushed to the hospital and into surgery where he later died... police say the man has a history of drug use, mental illness and prior criminal threats. the officer involved in the shooting... is a 15 year veteran and has been placed on paid administrative leave. the investigation is on going. (vicki) staying in the south bay, closing arguments resumed today in the trial of the man accused in the murder of 15-year -old sierra lamar. as kron four's rob fladeboe reports now live from san jose, the defense is now wrapping up it's case. rob? the prosecution wrapped up it's closing arguments this morning by telling the jury that the evidence demands they find antolin garcia torres guilty. this afternoon, his lawyers attacked that same evidence saying it's not enough to prove guilt beyond a reasonable doubt. lead defense attorney al lopez, as shown here in a courtroom sketch and here with his client antolin garcia torres during a previous court appearence, began his closing argument by asserting to the jury there is scant evidence his client killed sierra lamar and none that he attacked three other women before sierra lamar disappeared. a brilliant strategy says legal analyst steven clark'steven clark/legal analyst" if the jury believes that he is not responsible for those safeway attacks, it's going to undermine the overall view that the case against garcia torres, that he is someone with the proclivity to have gone after sierra lamar...." the defense attacked evidence that put the defendant near the bus stop where sierra lamar vanished, arguing there is proof he was long gone when sierra got there and that investigators not only contaminated dna and other forensic evidence, but failed to look into reports of another car in the area, suggesting they arrested the wrong suspect. steven clark/legal analyst "anytime you as a defense attorney can point to someone else as the person who may have committed the crime, that's something you have to do and that could resonate with this jury when they decide, one, is she really dead and two, did garcia torres killer her...." the defense will resume it's closing arguments tomorrow but the prosecution will have the final word with jury during it's rebuttal argument when steven clark says they will attempt to undo any possible damage done to their case by the defense. live in san jose rob fladeboe kron 4 news (grant) another hot day - here in the bay area but changes are on the way. chief meteorologist brittney shipp is in the weather center - and brit, we are in for a cool down? .hot conditions today as ridge apex shifts inland. tomorrow will be another hot today as the ridge begins to exit into the great basin. a modest cooling trend will start on thursday as coastal stratus returns. cooling trend continues friday into saturday when a slight chance of showers is forecast as an upper low approaches the region. locally windy conditions can also be expected over the weekend. (grant) tragedy in the east bay... a high school student hit by a train in san lorenzo did not survive the accident. (vicki) kron four's philippe djegal reports from grant and railroad avenues... where the young man was pronounced dead. (philippe) backed up traffic at a stand-still... nervous neighbors wait for answers.... after learning a boy was hit by a passing train... reminding thomas ivey about a similarly tragic incident he lived through years ago.thomas ivey/neighbor- "i had something like this happen, uh, when i was 13 years old living in south hayward. um, a gentleman was killed behind my house and it was, it was a very horrific thing to deal with." the victim was a junior at nearby kipp king collegiate high school. near the scene of the accident -- grant and railroad avenues -- neighbors feel for the young man's family.antonio trejo/neighor- "really heartbroken once they find out. you could never replace their life, you know, yeah, so its really, yeah, heartbroken." right now, it's unclear what the boy was doing on or near the tracks before the accident. was he distracted in some way? that's still under investigation.antonio trejo/neighor- "i tell my daughter and grandkids too in that, one earphone off so you can hear what's coming or going." union pacific, which manages these tracks, says a bike was found near the boy, but its unclear if he was on it when he was hit.thomas ivey/neighbor- "especially being a teenager, um, you know, with his whole life ahead of him, you know, before a chance to attend college, and you know, grow up and have a family and everything else, its its very very tragic." while extending condolences to the victim's family... union pacific says the train conductor and engineer have been put in touch with counselors to help get them through this emotional time. in san lorenzo, philippe djegal, kron four news. (vicki) the morgan hill police department needs your help tonight in identifying a hit-and-run suspect. officers say this suspect on your screen... was involved in a hit-and-run incident just a few hours ago. it happened near tilton and dougherty in the north end of morgan hill. the incident left an unidentified victim injured. he was last seen driving this 2000's chevrolet silverado truck. if you recognize the suspect...the morgan hill police department would like to hear from you. (grant) happening tonight... there's another heated debate scheduled... over whether some east bay schools should be allowed to break away from the mount diablo school district. mount diablo is made up of 56 schools serving more than 32-thousand students. it covers a large portion of the east bay stretching from martinez to walnut creek, and pleasnant hill to clayton. the proposed north-gate district, in red, would include five schools and 42- hundred students. opponents of the plan accuse county officials of wanting to create an affluent new school district, which supporters of the plan deny. if the county approves the plan, it would have to go through state education officials and then be approved by voters. if you'd like your voice heard...supporter and opponents plan to face off at the gardens at heather farms in walnut creek starting at six tonight. (vicki) republican leaders are working overtime to pull their new healthcare bill from the brink of collapse. and they would like to have it on the congressional floor átomorrow - but only if they believe it will pass. two key republicans firmly against the latest gop repeal and replace plan, ánowá firmly on board after changes negotiated with the white house the updates try to target the heart of republican unease... about removing price protections for individuals with pre-existing conditions. the deal also adds 8- billion to an existing 130=billion fund to finance state risk pools designed to push down premiums for individuals with pre-existing conditions.... in states that opt-out of obamacare's pricing regulations. a vote is scheduled for tomorrow. (vicki) a major development today in the possible federal case against two louisiana police officers - in the july killing of alton sterling...(grant) a u.s. attorney says there's simply not enough evidence to pursue federal charges against the two white officers involved.. catherine heenan is here with the latest.. (catherine) alton sterling was selling c-d's outside a store in baton rouge last year when police responded to a report of a man with a gun... two officers wrestled with sterling...and after someone yelled that he had a gun.... sterling was shot several times - and killed. police say that a loaded gun was later found in his pocket. today authorities say there's not enough evidence to prove that either officer violated the federal criminal civil rights law. meaning - no federal charges against those officers. corey amundson/acting united states attorney. middle district of louisiana: in order to convict officer salamoni of a federal criminal civil rights violation for this shooting, we would have to prove beyond a reasonable doubt that officer salamoni did not believe that mr. sterling was actually going for a gun when he made that statement, and that he simply decided to shoot. chris stewart/family attorney:we're still waiting on justice from attorney general landry. and we're telling you, it's coming-- from the evidence that we've seen so far. the family's attorney says they've now learned that the white officer who latershot sterling had pointed a gun at the back of his head -- and threatened to shoot him before they struggled. sterling's family is now demanding a state criminal investigation.... his death prompted protests from activists - demanding justice for what they say was the unjustified killing of an african american. vicki? (grant) another big story we've been tracking all day... a commuity college in texas - went on lockdown after an apparent murder-suicide. it happened this morning - when officers responded to a call of an active shooter on campus. students had to be evacuated - while others sheltered in place. hours later.. a female victim and the suspect were found dead in the school's science building. the school remained closed the rest of day. (vicki)the family of the man who carried out a shooting spree at a san diego pool party. . .is speaking out. peter selis shot seven people. . . injuring six and killing 35-year-old monique clark. police say his victims were randomly targeted. . .and that he was angry over a recent breakup.in a recent statement selis' family apologized for what they deemed a "senseless" act. . . stating that they did not know what would have caused him to carry out the shooting.some survivors believe selis targeted minorities to shoot at the party. . . police say they still have no evidence if racism played a role. (catherine) that officer was on another call - near a community park sunday when he saw a littleboy dangerously close to a pond.. the bodycam video shows the four-year-old bobbing in the water....gaspin g for air.and then the officer jumping into the water to grab him... that officer eventually asks for someone to help him out - by calling 9-1-1... we learned today that elijah had unlocked a back door while his father was in the bathroom and his mother was at work.. officer aaron bulmer is just happy he was there... officer aaron bulmer:i didn't know that elijah had autism. i knew he was young and the verbal skills weren't there when i communicated with him. when i found out later he had autism it really struck me. it was god's hand of protection on that child. and he used me as an instrument. elijah's mother agrees --- saying she believes the officer was 'sent by god.'the video also shows the officer handing the little boy to a man who happened to be nearby. the 4-year-old was checked at a hospital but he's fine and has fully recovered. grant and vicki... (vicki) prince william and kate middleton are suing a magazine for publishing topless photos of the duchess of cambridge. it happened in 2012 when the couple was vacationing in the south of france. the images show the duchess sunbathing while topless at a private villa. the magazine says the pictures cast the royal couple in a positive light and says they are not a breach of privacy. prince william says the decision to publish the topless pictures of his wife was shocking. they are suing for one-point-six million dollars. ( pam ) good evening i'm pam moore.( steve ) and i'm steve aveson. the shooting happened on market street... between 5th and 6th streets. the streets had been blocked off for most of the day but just reopened about 90 minutes ago. no iffcers were hurt... but there is a second man in the hospital. kron 4's charles clifford is live for us tonight along market street with what we know about the suspect. charles. well, the investigation. . . . now , we do have some cell phone video from the scene. the video quality isn't that great but it does show how caotic it was out here. now this started just before 1130 this morning, when two sfpd officer walking in the 900 block of market street saw a white male adult stabbing a phlipino man. the officers interviened and during the confrontation at leasat one of the officer shot the white male. he was later pronounced dead on the scene, the philipno man was transported to the hospital. the extent of his injuries is unknown right now. no officers were injured. police chief william scott was on scene this afternoon and he promised a very thorough investigation but when asked for more specific information. . .like how many shots were fired. . he declined to elaborate. sot now , as with any officer involved shooting, multiple investigation have been launched.sfpd homicide and internal affairs division, the department of police accountability. san francisco district attorney's independent investigation bureau. and the medical examiner's office are all looking into this shooting. for now that is the very latest here in san francisco, charles clifford kron 4 news. ( steve ) it's been five long years... but the sierra lamar murder trial is just about in the hands of the jury and deliberations could begin by the end of this week. (steve) new at 6. a man who police say killed his wife in walnut creek and held police at bay in martinez was charged with murder. gregory prokopowicz appeared in court just a few hours ago. the 38-year-old allegedly killed his wife 47-year-old roselyn policarpio thursday afternoon on first avenue in walnut creek. after a 19- hour standoff , prokopowicz was arrested friday in martinez. however police say he did not surrender until the swat team fired three rounds of tear gas into the car where he was holding authorities at bay. (pam ) a high school student in san lorenzo was killed this morning... in a train accident. it happened on the train tracks at grant and railroad avenues. the alameda county fire department says, the boy was pronounced dead at the scene. he was a junior at nearby kipp king collegiate high school. the accident was reported just after eight o'clock in the morning. union pacific, which manages the tracks.. says, a bike was found next to the boy... but it is unclear if he was on the tracks when he was hit, or if he was walking. neighbors in the area feel for the victim's family. thomas ivey/neighbor- "oh, its very tragic. i hate to hear something like this."//antonio trejo/neighbor- "grieving for the family too, and you know, just uh, knowing it could have been yours, you know."( pam ) a spokesperson for union pacific says, the company's hearts go out to the family and friends of the victim during this difficult time. the train engineer and conductor have both been put in touch with counselors for support. the area was re-opened to traffic ... just after eleven- o'clock in the morning. republicans are again scrambling to pass health reform...and earlier tonight - word came that the house "will" vote on the health care bill tomorrow.. it is a sign of the g-o-p's confidence ... in repealing 'obamacare'... catherine heenan is here with details on how some skeptical republicans are being won over..
