continued warming through the thanksgiving holidays. officers say just after midnight driver the traveling the wrong way on highway 101 and san antonio road on ramp. the driver was heading north in the southbound lanes when he crashed head on into another vehicle instantly killing the driver and seriously injuring the passenger. the woman passenger was taken to the hospital and no word on her condition this morning. both male drivers have not been released. more than 1200 customers are still without power this morning in fremont. last night a pickup truck collided with a utility pole leaving live wires dangling in the street. officers are blocking traffic in the area while those wires are still on the ground. both the driver and the passenger are safe. police arrested the driver on suspicion of driving under the influence of alcohol. it happened yesterday when they said they were working on smoke detectors in the home. officials haven't released an official explanation to how the fire started but the son of the man who died believes he knows what caused it. >> i would be shocked if the report from the fire department indicates that it was cigarette smoking. >> the son because of his dad's smoking there were times he dropped a cigarette and burned holes in the carpet. he believes that might have been the cause in this fire that unfortunately killed his father. crews contain the fire within an hour preventing any damage to nearby homes. >> in belmont a fire broke out and 1 of the units in an apartment complex and started in the kitchen of the 3rd floor while the resident was cooking. he then stepped out of the department for a few minutes when he came back he found the fire. he quickly grabbed his dog and escaped safely but he was unable to save his cat who died in the fire. with so many people cooking this week for thanksgiving. they ask everyone to be extra careful. >> definitely, you know,. can get away from you and leave in a tragedy. >> fire officials say the type of fire is common and most fires start in the kitchen. now nobody was hurt when a train hit a car on a tract last night in south san francisco. the accident happened around 8:00 on linden avenue and people are still trying to figure out working to figure out who has the right of way in that accident. and happening today, coming off 2 road winds the san francisco 49ers are back home to take on the washington redskins at levi stadium. today's 9er game comes with more controversy off the field than on it. protesters will be outside the stadium marching and rallying against the washington team name. kron4 is live at levi stadium with a long debate over the washington redskins should change names and mass scott, mike. this is a move that has picked up momentum. many of the native americans have pushed back against the washington teammate protesting with signs and several this year. earlier this year the u.s. patent and tray office cancelled the team's trademark citing the name as desaging to native americans. president obama even commented saying he was considering changing the name if he was the team's owner. the team's owner, daniel schneider refuses to do so, in he said it's not only about tradition but that the name in his opinion is not effective rather in term of honor and respect. today's protesters deagreed. it's led by the bay area coalition and media is scheduled to start at about 10:00 this morning. they'll protest outside the stadium. we'll chat with them and we'll have an interview coming up at 8:00 this morning. we've reached out to washington team official for comment on this morning's protest, let us know what you think by signing off on the twitter and facebook pages. >> all fra tern 10 i are suspended we'll have more on what led to this decision. why 1 of the victims injured in the florida state shooting says he forgives the shooter. is w so i should probably get the last roll. dad, but i practiced my bassoon. and i listened. i can do this. everyone deserves ooey gooey pillsbury cinnamon rolls. make the weekend pop! night to protest another deadly police shooting. this comes after authorities say a rookie police officer accidentally shot and killed an innocent bystander in the dark stairwell of a housing project. the officer has since then removed. but the shooting comes as nypd faces heavy scrutiny from civil rights leaders following a series of deadly encounters with unarmed citizens. new york mayor called the accidental shooting a tragic accident. cleveland police say officers shot a 12-year-old boy who was using a realistic looking pell at gun. authorities say they were called to a neighborhood rec center because the boy was pointing it at bystanders. they say they told the boy to raise his hands but they say the boy reached for his gun, officers shot the boy and he was then taken to a hospital. there's no word on his condition this morning. police show reporters the gun that they say the boy was using it's described as air soft type pell at gun that closely resembles a real handgun. university of virginia has temporarily suspended all as allegations surface of gang rapes at from the parties. the university made the announcement yesterday. she said the move was in direct response to recent rolling stone article that details claims of rape by female students. one of those alleged victims claims she went to administrators to report the assault, she told the magazine nothing was done. university president says the suspension will allow time to investigate, allow them time to investigate the claims more fully. florida state university honoring the victims of last week's shootings before yesterday's football game against boston college. the shooting left 3 people wounded and the gunman dead. before take off, a tribute was paid to those victims. fsu's president gave words of encouragement to the seminole community for a video message before the game and in light of the tragedy fsu fans say they won't let the incident steal their joy. >> police support 1 another. we love 1 another and coming to the game is just another way that we show support for our seminole families. >> florida state did go on to win their game with field goal and the final minutes remain undefeated for the season. >> meanwhile, 1 of the students who was wounded during that shooting says he forgives the shooter. 18-year-old elijah valez is recovering from his injury at his home. he was grazed by a bullet during thursday's chaos. the shooter's motive still isn't entirely understood. but he said he's just grateful to be alive. >> i don't have any resentment for anything. he had his own problems to deal with and i can't be mad at him for anything. >> the 2 other victims are also still recovering. the shooter died in exchange of -- with a gunfire with police. authorities are interviewing a number of people who knew the shooter as they tried to determine a motive. >> a denver family forced from their home after wall comes crashing down. the entire side of the house exposed to the elements. the homeowner say the collapse could have been prevented. >> from the street it may be hard to imagine it could just collapse until you see it from the ally and the excavation happening next door. >> looks like they got a little bit too close to that foundation and at the time it gave way and it did come down. >> friends and family the homeowners tell us they were concerned about the excavation for days and pleaded with the company to back off from the home this morn, this afternoon it was too late. >> really terrible and kind of scary because there's so much development going on in this district, when you look at it looks terribly way too close to be digging any way. that's considered a lop side so maybe we should re-evaluate the lop sides because obviously this neighborhood is just too old for the new development being so close together. >> that's very a traumatic thing to go through, to have to deal with. as neighbors we're all here for them if possible, in connection with the sexual assault a child yesterday. they're popped in a park in pacific heights. kron4 took all reports where police say this disturbing encounter took place. >> neighbors say in the hours since the alleged assault they've noticed more police in the area, we though that the alleged victim is a 7-year-old girl and that the alleged assault happened at around 4:00 on friday afternoon. the san francisco police department releasing this composite sketch of the man wanted in connection with this attempted sexual assault. investigators say the incident happened inside this public rest room at the park, but that's as much police will release about it. no specifics, it's a park frequented by dog owners and families in the neighborhood so it should come as no surprise that neighbors are deeply concerned about this. >> that's terrible. it's awful. >> it's scary. the kid are right there on the -- on the playground and people i live right on the park, so it's scary to 5 feet 11 inches tall with brown hair and brown eyes. police say he was last seen wearing an orange hooded sweatshirt with gray and black letters on the front. he had on blue jeans and wore green, a story that we brought you earlier this week and lonnie how well the 12-year-old san francisco girl who went missing 2 weeks ago is back home this morning. her father tells kro fox 4 they got a tip she was on a san francisco bus. they found her on the bus at 3 3rd street and evans avenue yesterday afternoon at around 2:00 p.m. police say the girl is in good condition and being interviewed by investigators. still not clear where the girl has been this whole time but her parents are happy to have her home safe. the boy who survived a 230- foot fall is awake this morning after being in a coma for about a week. here is a picture of 4-year-old sebastian johnson it was taken saturday at children's hospital in oakland. he was put in a coma after he fell from a cliff during a family outing on november 10th november 10th. johnson's parents say he woke up on tuesday and had facial surgery that same day. they say he still has a broken jaw but showing signs of recovery. frustration from uc students continue this weekend after regions vote today pass tuition hike earlier this week. costs from students will go up -- will go up as much as 5% per year over each of the next 5 years at all 10uc schools statewide. that means the average california in state student contained more than 12,000, $800 for tuition, which is $600 more a year. one student says she thinks protests from students sit in sleeping over night on the floor of wheeler hall. the board of regions vote was 14-17. national news former mayor marion died earlier this morning at the age of 78. he served 4 team terms as mayor. they were overshadowed by his 1990 arrest after being caught on videotape smoking crack cocaine. despite his problems, he maintained a solid following and lower concessions of dc. he staged a political come back in 2004 returning to dc council. he was re-elected in 2008 and 2012. he was 1st elected mayor back in 1978 when he was re-elected in 1982 and '86 he was dubbed mayor for life. developing story out of st. louis is waiting game continues as the grand jury has yet to make a decision on whether to indict ferguson police officer darren wilson in the august 9 august 9th shooting death of michael brown. in an e-mail saturday it said that the grand jury will reconvene tomorrow to continue deliberating the case. the e-mails did not explain how the group knew the information. brown's family attorneys says today that he hadn't heard a decision had been reached and prosecutors had promised to tell him when that happened. thanks giving travel could be the highest it's been itself. deup at 8:15. new this morning the chp is saying alcohol may have caused a double fatality early this morning. officers say just after midnight they received reports of a driver traveling the wrongway. now the driver was heading north in the southbound lanes when he crashed head on into another vehicle instantly killing the driver and seriously injuring the passenger. the woman passenger was taken to the hospital and no word on her condition this morning. the identities of both male drivers have not yet been released. more than 1200 pg&e customers are still without power this morning in fremont. last night a pickup truck collided with a utility pole leaving live wires dangling mt. street. officers are blocking traffic in the area while those wires are still on the ground as safety is their top priority. both the driver and the passenger are safe. police arrested the driver on suspicion of driving under the influence of alcohol. fire officials say a fire that killed one person in san ramon could have easily been prevented. it happened yesterday when they say there was no working smoke detectors in the home. they have not released an official explanation on how it started. >> i would be shocked if the report from the fire department didn't indicate to some degree that it was from his cigarette smoking. >> crews contain the fire within an hour preventing any damage from nearby homes. in belmont a fire broke out in one of the units at an apartment complex. it started in the kitchen of the third floor unit while the resident was cooking. he then stepped out. when he came back he found his kitchen on fire. he quickly grabbed his dog and escaped safely but he was unable to save his cat who died in the fire. with so many people cooking, fire officials ask everyone to be extra careful. >> definitely be very careful any time you are cooking. don't leave things unattended on the stove. it only takes a moment for the cooking to get away from you and lead to a tragedy. >> fire officials add that this type of fire is quite common and that most fires do start in the kitchen. no one was hurt when a cal train hit a car on the tracks last night in san francisco. the accident happened around 8:00 last night. authorities are still trying to figure out who had the right of way in that accident. and happening today coming off two road wins the san francisco 49ers are back home to take on the washington redskins at levi stadium. but tonight's niners game comes with controversy off the field. protestors will be outside the stadium marching and rallying against the washington team name. kron 4 mike is live with the long debate on whether the washington redskins should change their name and mascot. good morning, mike. >> reporter: you are taking a live look outside the stadium. some of the protestors started showing up within the past 15 minutes. they are protesting against the washington tale name. now protestors many of them native americans have relentlessly pushed back against the washington team name during the nfl season. earlier this year they canceled some of the team's trademarks citing the name is disparaging to native americans. the team is appealing that decision. the team's owner refuses to change the team's name and in the media he has previously said in an espn interview it's not only about tradition but the team name is not offensive but it's a term of hop nor and respect. these protestors certainly disagree with that. they all greet fans that enter the game. you can see they've got signs. they want to send a message. they want the washington ownership to change the team's name and we just wrapped up an interview with the coalition head. we'll have that for you coming up at 9:00. we have also reached out to in direct response to a recent rolling stones article that detailed claims of rape by female students. one of the alleged victims claims she went to administrators to report the assault but told the magazine thatting to was done afterwards. the university president says the greek system suspension will allow for time to investigate the claims more fully. florida state university honored the victims of last week's shooting before yesterday's football game against boston college. the shooting at the library left three people wounded and the gunman dead. before the kick off a tribute was paid to those victims. fsu president gave words of encouragement to the community. and in light of the tragedy, fsu fans say they won't let the incident steal their joy. florida state won to remain undefeated for the season. meanwhile one of the students that was wounded during the shooting says he forgives the shooter. 18-year-old elijah valez is recovering from his injuries. he was grazed by a bullet during thursday's chaos. the shooters motive is not entirely understood. valez says he is grateful to survive. authorities are interviewing a number of people who knew the shooter as they tried santa rosa now at 44 degrees. we gained a few there. 50s leaving the house in san jose. 56 in downtown san francisco. future cast 4 shows we will show warmer weather by later in the afternoon. and we will maintain dry weather. satellite and radar shows we are under mainly clear conditions. high pressure building in. we do have the component of offshore winds. that will only increase our temperatures and resulting in a drier air mass over the next couple of days. future cast shows 60s. temperatures near the 70-degree mark. as we break down the highs in your neighborhood, evergreen 68. conditions for most of next week but head into black friday at least that evening rainy, windy weather returns to the bay area and it looks like we will continue as we head into the week. president barack obama defended his decision to use executive authority to enact changes to the u.s. immigration system this morning. joining us now is political analyst michael yanki with more on this move. let's recap the changes that obama is wanting to make. what is the biggest sticking points? >> the big changes, he's giving what is called deferred action. he is suspending deportation for a total of three years at a time to two new groups of undocumented immigrants. first group are parents of children who are american citizens. or permanent residents. and second he's taken the age limit off the dreamers. children that were brought here by their parents as undocumented immigrants. it was cut off at 31 years, now there is no age limit to that. the potential is maybe -- but the question is really how many of those are really going to apply. for the first program in 2012. for the first group of children that were brought here. maybe 50-60% of those eligible apply. there is a reason behind that. the reason is that when you do that, you are essentially turning yourself into the government. you have put yourself on a list to say i came here illegally and now because i meet these certain conditions, i will apply to getth three year stay of deportation. >> so who does this nod include? what groups are excluded? >> right. i think the biggest group that you heard a lot about are the parents of the dreamers. the kids that were brought here illegally and their parents who are also here were not covered by the order despite a lot of pressure by a lot of folks from the latino community because the idea of family union or preventing family break up was the purpose behind this entire procedure. that is not going to happen. what you will hear a lot is the word discretion. that is the president as the head executive of the country has the ability to decide who rewants to deport. what he is essentially saying is i'm using my discretion to excuse one group of category for a three-year period and the other he's not going to. i think they say hay have this memo from the legal council and justice department to say he can't do an executive order upon an executive order. quite frankly i don't buy that. >> big bold move by the president. what do you think are the likelihood of republican retaliation? >> well, it's a question on what kind of retaliation the republicans will take? because this is a very big political issue. this is very important to the latino community for coming up already on the 2016 election where latinos were critical in the election of barack obama. so you will see a lot of noise and screaming. i don't think you will see the republicans in congress there trying to take specific action against the president. what they will do is go to the courts. they will hope by making the courts be the bad person, they can wash their hands of it and say it really wasn't my fault. it was the courts who blocked the president from doing it and try to spare themselves of the political fall out. whether or not that is believable, i don't know. they will probably look at things by blocking appointments, cutting as priorities and spending in other areas. >> obama care maybe? >> i think obama care is up for the supreme court again. i don't know if -- they may try another run at obama care but it will be ticky tack stuff you don't necessarily see but they will -- the president will understand his retaliation. so his nominations may get held up for a year. specific program that the president cares about may find itself defunded. when it applies to the immigrants but other types of priorities. there will be other things you will see all along and it will be coached in the terms of retaliation. >> and what do you think the impact could be here in california and also the bay area? >> it depends on how it effects the community. i think in terms of the practicalities. for example at the beginning of the year undocumented immigrants will be eligible for driver's licenses in california. so that is already happening. anyone covered by this is now eligible for health care or bo ma care, social security, federal benefits. whatever. but a lot of them are covered by health plans in the bay area by healthy san francisco. alameda, the bay area, etc.. in terms of the burden of local government, not so much. in terms of what it means to a community to not have to worry about their parents or their families being broken up or deported or the fact that you are at a workplace and one phone call and you are out of the country. that is a caught on video tape smoking credit card. he did stage a political comeback in 2004 returning to d.c. council. he was first elected mayor back in 1978. he was reelected in 1982 and '86 he was dubbed mayor for life. no contact cause has been given for his death but he did suffer many health problems over the years including diabetes and prostate cancer. developing story out of st. louis. the waiting game continues as the grand jury has yet to make a decision on whether to indict ferguson police officer darren wilson in the august 9th shooting death of michael brown. in an e-mail saturday, it said the grand jury will reconvene tomorrow to continue contributing on the case. they are off for the weekend. the e-mail did not explain how the group knew that information, but the brown family attorney said today he hadn't heard a decision had been made and prosecutors had promised to tell him when that happens. we'll keep you posted. cleveland police aofficer shot a 12-year-old boy who was using a realistic pellet gun. when officers arrived they say they told the boy to raise his hands but the boy reached for his gun instead. officers shot the boy and he was taken to a hospital. there is no word on his condition this morning. the police showed reporters the gun that they say the boy was using. it's described as an air soft pellet gun that closely resembles a real handgun. >> community activists gathered in new york city to protest a police shooting. this comes after a rookie police officer shot and killed an innocent bystander. the officer has since been removed from duty. but the shooting comes as the nypd faces heavy scrutiny. new york mayor bill di blaze owe a tragic mistake. this is the scene in buffalo. the governor is preparing for the worse. >> we are say the incident happened inside this public restroom at the park but that is as much as police will release about this. no specifics as the -- so what should come as no surprise neighbors are deeply the east bay. and the best part it is all for a good cause. jeff, thank you so much for joining us. this is in contra costa county. it is called a heart for christmas. what can we expect in clayton? >> the first thing you can expect to see that you will not see anywhere else is snow. we have brought snow to clayton in the form of some very interesting special effects that put snow on the ground and snow in the air and what we have for you is kind of a whole new world that you can enter. so we have 60,000 christmas lights and we have projection and water fountain and all sinked to a 20 minute light show. and so we've got our character snowball and flurry. and the families that come see this will be able to really leave contra costa and enter our make believe land of our two acre property. >> well 60,000 lights. what is the electricity bill like? i can't imagine. >> you know it's 100% led. we are set up to run 100-amps of power if we need to. >> how did you get this idea to do this really big, big christmas light display? >> well, when i was in college i spent most of my time at disney land. and the inspiration really came from this little girl which is is what our charity is about. i have a background in theater and lighting and film so i wanted to take the skills and put it to a good cause because i wanted to do something for the families to be able to come and enjoy but we also have this little girl that needed a lot of help. and we found that we could do an out reach with those skills. >> tell me about katie. >> katie grace is i believe she just turned 12. we met her when she was 6 years old. she has pulmonary hyper tension. very rare heart and lung disease. very difficult to treat. and the only treatment of any listening long-term value is a transplant. transplant is not a cure within itself. it is more of a disease for a disease. ultimately we knew her for half a decade when she wasn't supposed to live each year. what we did is we are going to do this christmas display to bring outreach to her. and so that is what we did. and by the grace of god i think in june she finally got herhearted and lungs. so it's been really good. >> that is wonderful. and this is a peek of what you did last year. >> actually this is exclusive video for this year. this is all brand new. last year we put up lights and they danced to music. this year it is really to reference disney kind of microfantastic. we have a story line, a 20 minute show. it's not a drive up where you can come at any time. there is specific show times because you want to be there for the beginning, middle, end. because it's an emissional jersey. >> and then the great thing too is the display is for sale or parts of it; right? >> yes. >> and all goes toward katie and supporting her and her family. >> exactly. the display to come and see it is free. to make it snow on you it costs $0.25. people would come in and say this is really cool, i haven't seen lights like these anywhere else, can i take them home? last year it wasn't an option. this year i essentially purchased extra and said these lights if you want to come and you see something you really like, you can actually take it home that day in what we call katie's trading post which is a reference to frozen. this whole show is inspired by frozen which is a lot of fun. but you can purchase most, not everything, but most of the lights you see you can take home that day. >> and tell me about some of the behind the scenes work that goes into this. i mean you are stringing up thousands of thousands of lights and decorations. what sort of manpower is behind this project? >> there is about 50-60 people in total that have come to help. a lot of volunteers have come from volunteereastbay.org. and then i have a core team of people i work with. i started official design of this back in may. i have clocked something like 300 hours. and then i reverse my sleep schedule and live in a tent outside. it's been aned a vaneture. >> come to my house and help me with mine. i just want to put lights up. >> it's fun. it's a lot of fun. it's been about 50-60 people and then this year we have volunteers on site every day and we don't even have them all signed up yet. it will be a couple hundred people have worked on this. >> and you guys are also going to be donating to is it children's organ transplant association? >> yes. the finances we bring in if you choose to donate while on site or online, the finances go through the katie grace fund. and the way that works is the money that goes through there gets ports to katie grace. and if she doesn't need that anymore, then the finances go to another family in need. that is why we chose that charity because it jumps around as necessary. looking at dry weather through next weekend. we do have another storm on the way. this could effect your black friday shopping. details coming up in 15 minutes. new this morning chp is reporting that alcohol likely played a factor in a double fatality in novato earlier this morning. just after midnight they received reports of a driver traveling the wrong way on highway 101 near the san antonio owe road onramp. the woman passenger was taken to the hospital and no word on her condition this morning. the identities of both male drivers have not yet been released. more than 1200 pg&e customers are still without power this morning in fremont. last night a pickup truck collided with a utility pole leaving live wires in the streets. while the wires are still on the ground as safety is top priority. both the driver and passenger are safe this morning, but police did arrest the driver on suspicion of driving under the influence of alcohol. fire officials say a fire that killed one person in san ramon could have easily be prevented. it happened yesterday when they said there was no working smoke detectors in the home. officials haven't released an official explanation on how the fire started but the son of the man who died believes he knows what caused it. >> i would be shocked if the report from the fire department didn't indicate to some degree that it was from his cigarette smoking. >> crews contained the fire within an hour preventing any damage to the nearby home. >> in belmont a fire broke out in one of the units in an apartment complex. it started in the kitchen of the third floor unit while the resident was cooking. he stepped out of the apartment for a few minutes. when he came back his kitchen was on fire. he quickly grabbed his dog and escaped safely. he was unable to save his cat who died in the fire. with so many people cooking this week for thanksgiving. they are asking fin to ever -- >> don't leave things unattended on the stove. it only takes a moment for cooking to get away from you. >> this type of fire is common and that most fires start in the kitchen. no one was hurt when a cal train hit a car. happening today coming off of two road wins the san francisco 49ers are back home to take on the washington redskins' at levi stadium. today's niner game comes as more controversy off the field then on it. protestors will be outside the stadium marching and rallying against the washington team name. kron mike pelton is live with this long debate. mike. >> reporter: good morning, annie. that protest starts at 11:00. this is put on by the bay area koalation. and they have one clear message they want washington ownership to change the team name. it's a name they call very offensive. this protest is just the latest to greet the washington football team. many of the protests have popped up at some of their games. many native americans are urging the team to change their name. earlier this year they canceled some of the teams trademarks citing the name as disparaging. the team is appealing that decision. the team's owner daniel snyder is not budging to this point. not choosing to change the team's name. protestors want to send him a message today. >> i would say please take a moment and look at our people and our culture and traditions. talk to some of us. talk to some of us that are not in your survey. work with us to understand -- to get this changed. >> reporter: and this morning washington team official declined comment on this protest but the owner daniel snyder said earlier this year in an espn interview he is not changing the team's name. he called it honor and respect. you can see the protest still an hour away but a few dozen protestors already gathering. they do not feel that term is respectful and plan rapes at fraternity parties. details claims of rape by female students. one of the alleged victims claims she went to the administrators to report the assault but told the magazine that nothing was done. the university president says that the suspension will allow for time to investigate the claims more fully. florida state university honoring the victims of last weeks shooting before yesterday's football game against boston college. the shooting at the library left three people wounded and the gunman dead. before the kick off a tribute was paid to those victims. fsu president gave words of encouragement to the semino community. in light of the tragedy, fsu fans say they won't let the incident steal their joy. florida state won their game with a field goal in the final minute to remain undefeated for the season. meanwhile one of the students who was wounded during that shooting says he forgives the shooter. 18-year-old elijah valez is is recovering from his injuries. valez was grazed by a bullet during thursday's cay use. the shooters motive still isn't entirely understood. valez says he is just grateful to be alife. authorities are interviewing a number of people who pressure in control right now. high and dry conditions. we're also dealing with the addition of on and offshore winds. temperatures will increase as we head into the next couple of days. future cast forecast by 12:00 60s blanket the bay area. so all and all looking at temperatures just slightly above where we should be for this time of year. san jose 65. 68 for evergreen. 64 expected in redwood city. lots of sunshine, mild conditions in the east bay with union city and hayward. downtown san francisco today looking far high of 64 and a couple degrees warmer in through napa. if you are heading to levi stadium to root on the niners, kick off at 1:25. it will be a little chilly by the tailgate. game time we are talking about temperatures in the mid 60s. lots of sunshine with a few clouds in the forecast. you will notice temperatures will only continue to warm as we head into next week with peak heat expected for wednesday. travel weather looks great if you head to grandmas house for turkey day. low 70s for the warmest inland spots but rain returns to the bay area. anne. a grand jury has been considering whether to indict the ferguson police officer who shot and killed unarmed teenager michael brown. michael, why are we still waiting for the grand jury? >> there is a couple factors that go into it. first it's an officer involved shooting. and stats show when there is an officer involved, grand juries take a little bit longer. somewhere around 3-4 months. this is out of the ordinary for that. second is that this is a grand jury that requires 75% of consensus of the folks to nine out of 12 to make it -- to make a decision to bring forth what is called a true bill. that and a lot of other jurisdictions it takes a majority. third and this is the most controversial is that the prosecuting attorney bob mccullough who gained a lot of notoriety early on because of the attempts by members of the -- to ask him to qualify himself because his father was police officer killed in the line of duty. because he himself has had a spotty record in terms of prosecuting officers in the past. he's decided to do something entirely different. you have often heard the theory that a grand jury can indict a hand sandwich. it comes from the fact that the prosecutor and grand jury. the prosecutor only presents a certain amount of evidence that is favorable to what he wants to do in terms of the charge and that is how an indictment comes down. this is very different. mccullough has decided he will bring everyone before the grand jury. everybody. he let darren wilson the officer testify. he's let every witness that could possibly identify testify. he has not cherry picked which ones he wants to bring. he's even allowed the expert who did the autopsy for michael brown's parents to come in. he hasn't directed them as to what he wants them to do. he has given them the range of charges they can look at. but he is not prosecuting within the context of getting an indictment. in many ways it's a mini trial and that is very, very different. >> and so what are some of the options before the grand jury? >> i think basically they have everything from first degree murder which would be very, very hard to prove to second degree murder which is delivering an intent to kill. to involuntary manslaughter to -- to voluntary manslaughter to involuntary manslaughter. for example in the grand jury proceeding for shrimp boy and le land yee you have not heard anything. hear you have been hearing leaks. there has been a lot of testimony that has come out. a lot of officers have been speaking on and off the records to reporters. there is a -- one of the things that is bothering the community person is the lack of integrity they see in the entire grand jury proceeding. the unusual nature of how it's being conducted. that is why you see all of the unrest and that is why you see people getting very nervous. a journalist just got arrested in ferguson for allegedly breaking some peaceful demonstration law. the government already declared a state of emergency. even though no emergency exists. there is all of this cry shown doe of i don't know anticipation, awareness, nervusness, fear. >> they are getting ready for the potential fallout from whatever they do decide. so tell us a little bit about the grand jury i understand it reflects the community that they are in. >> yeah. it's six white men, three white women, two african american women, one african american male. again nine of them have to agree in order to make -- to bring forth any kind of charge. their term has been extended. it has been extended again. usually around 60 days. it has been given the maximum of four months. it can go until december if need be. everyone is convinced they would bring an indictment down last week or at least a decision down last week. no one knows what is going to happen. we to know, now know, the parents of michael brown have been told they will be told first. now they have been told whether that means two minutes before the press conference begins, a day before, as soon as the grand jury reaches a decision. no one know what is that is. and govern nixon hasn't helped much saying we need 48 hours to prepare. the fact is with so many leaks in this process, once the decision that they make is made, it will get out there and then stuff is going to happen one way or another. >> and the grand jury doesn't indict is it over? >> it can be over. you can always convene a new grand jury. in this case i have no idea what will happen. likelihood of a civil rights is minimal. you have to show they had a racial discrimination. it all depends on what the grand jury does this time. >> thanks for joining us. we're back with more mayor. his terms were over shadowed by his 1990 arrest after being caught on video tape smoking crack cocaine and despite his problems barry maintained a solid following. he staged a political comeback in 2004 returning to the d.c. council and served two terms. barry was first elected mayor in 1978 when he was reelected in 1982 and 86 of the council. he was the mayor for life. no exact cause has been given for his death but he has suffered many health problems over the years including diabetes and prostate cancer. cleveland police say officer shot a 12-year-old boy who was using a realistic pellet gun and that boy has died. they were called to a neighborhood wreck center buzz they were pointing the pellet gun -- officers shot the boy and he was taken to a hospital where he died this morning. police show reportersth gun that they say the boy was using. it's described as an air soft type pellet gun that closely resembles a real handgun. community activists gathered in new york city last night to protest another deadly police shooting. this comes after authorities say a rookie police officer shot and killed an innocent bystander in the dark stairwell of a housing project. the officer has since been removed from duty but the shooting comes as the nypd faces heavy scrutiny from civil rights leaders. new york mayor called the accidental shooting a tragic accident. massachusetts state police arrested a man after he assaulted another man at boston's logan international airport while he was naked. police say he stripped inside of a women's bathroom, climbed into a drop ceiling, crashed through and landed on the floor and assaulted an elderly man all while naked. police have no idea what motivated this action. the man faces multiple charges including attempted murder, mayhem, assault and battery. a sea world rescue team faces an unlikely surprise. team members say they were targeted by hecklers and someone was throwing rocks at them. nobody was hurt but the employees say they had to leave and return to ocean beach with police protection. thee have faced more frequent harassment. sea world uses to capture and keep killer whales. coming up kron 4 news regents voted to pass a tuition hike. costs for students will go up as much as 5% per year over each of the next five years at all ten uc schools statewide. that means the average california in state the semester. i think the sentiments from it will last through the coming ye. >> students have been holding a sit in. sleeping over night on the floor of wheeler hall. the board of regents vote was 14-7. we have an update to a story we first brought to you earlier last week. emani howl the 12-year-old san francisco girl that went missing two weeks ago is back home. her father tells kron 4 they got a tip that she was on a san francisco bus. they found her on the bus at third street and evans' avenue saturday afternoon at 2:00 p.m.. the girl is in good condition and being interviewed by investigators. it's still not clear where the girl has been but her parents are happy to have them home seam with them. this allowed pedestrian safety improvements and service reliability along the 71 route. the project will eliminate several bus stops and add curb extensions. the project supports the city's policy to eliminate all pedestrian deaths in ten years. construction is set to begin in spring of 2015. yesterday was the fist day of st. anthony's annual turkey drive in san francisco. every year st. anthony's serves thousands of meals on thanksgiving. it's all possible thanks to turkey donations from the public. >> by 6:00 a.m. thanksgiving morning we've got about 4,800 pounds of turkey ready to go. >> every year i think people really step up. they know this is the time of year to accepting donations until the night before thanksgiving. and thanksgiving travel could be the highest it has been since 2007. aaa says californians plan to travel 50 miles or more during the four-day holiday weekend. it's due to increase disposable income. more than 600,000 state residents will fly while almost 200,000 will take another mode of transportation. if you plan on doing driving here's a [ laughter ] >> and it will keep them warm this holiday season. they plan to make the tree sweater project an annual event. the town of redding pennsylvania has a christmas tree and it's quite a site. a site they don't really want to see though. they already had a lighting ceremony but they might have to have another one. residents were complaining that this tree is just too ugly. it's a 50-foot spruce and it looks like it has to be replaced. the city council president is raising money to buy and decorate a more impressive tree for the holidays. officials hope to have a duo over tree lighting next weekend. we're enjoying lots of sunshine. there is a live look from mt. tam. full details. plus i'll talk about the holiday week when we return. good morning. and thanks for spending your morning with cron crop 4 news weekend -- with kron 4 news weekend. if you are heading out right now temperatures are not as cold. we started the morning off in the 40s. it looks like we have warmed things up into the 50s. san francisco pretty close to 60. we are high and dry around the bay area. we also have the edition of -- addition of offshore wind. that will keep any moisture out of the bay area. temperatures will only increase as we head into the next couple of days. today will be on the mild side. future cast shows 60s blanketing the area by lunchtime. temperatures will increase as we head into -- 65 in fremont. 64 your high in half-moon bay. remember last week we did see a series of storms ahead to our area. we did see some impressive rainfall amounts. we saw over an inch in san francisco. inch and a half for oakland. but honestly not too much accumulated in the south bay. sunnyvale did pick up a quarter of an inch. we did have an opportunity to bring wet weather around the bay area and increase those totals. the good news is thanksgiving will be dry. temperatures in the low 70s for thursday. but wet weather back in the forecast as we head into next weekend. one of the busiest shopping days of the year is coming up but not every black friday deal is a good one. black friday can cost you big time and bust your holiday budget. financial professional safety turner from turner advance financial is here with more on what shoppers should know. i'm not going to call you scrooge because you were telling me you can't buy too much for yourself. >> shopping for the holidays is not difficult. but it is easy to track. and what i'm recommending is that people just try to avoid the following four blenders. just so we can stay on track and have more money for themselves. >> so what is the first one? >> well buying to save is something you definitely want to avoid. >> i do that all the time. >> i say look i save more. you need a list. you need a budget i guess. that word often scares people. and how much you are going to spend on that. you can get one at my website turneraf.com. when you see half off, you look at your list and say oh no i need one sweater not two. >> isn't it good to buy what is on sale? >> well, you know it can be. >> okay. what is number two? >> signing up for store credit. and what i mean for that is you go in buy your purchase and do yo want to sign up for store credit we will give you 15% off. it sounds attractive but what you are signing up for an apr of 23%. unless you are going to pay that balance off 100% in full each month then it's a really bad idea. and 40% of americans do carry a credit card balance. >> and it gets really hard and tempting especially during the holidays to start charging things on the credit card. >> exactly. >> and number three gifting to yourself. >> yes. that is really fun. as we were talking about. you go to the store and one for them, one for me. and then it makes a great day. but the average american does spend $130 on black friday for themselves and this is a fantastic way to bust the budget as you might guess. >> even if i'm saving money. >> yes. [ laughter ] you are basically going over budget and that means you are most likely putting it on some sort of credit card. which comes to back to bite you later. >> so you just need to stick to the list and not veer off the list. what is number four? >> number four is that you need to not use mental notes. so in other words this budget is only as good as the paper it's written on. so you just have to have this thing with you and you have to not only include -- you start with the people that you want to buy gifts for, but then don't forget to add the drinks and the food for your party and for decorations, etc.. add all of that. if you have receipts from the prior year which i most people are not going to. you can put them online sames if you put them on a credit card. and use those. but at least you want to print off this budget that you used this year so you have it for next year so you have an easier start. >> how do you go about budgeting what you think is reasonable for the family holiday presents list? >> that is really tough. it certainly depends on your income. but i think that you really need to look at your whole budget. hopefully you have one. if not, that is not too hard either and i can help anyone that wants help with that. of course just making a budget. so it is sort of got to fit into your annual budget. >> okay. all right. but some people at home might be watching we've got a list but once in awhile you do come across amazing black friday deals. you're not saying not to shop at all on black friday; right? >> that is right. just make conscious decisions so you have the budget as your shield against all of the marketing that is coming at you so that you are in control and not the corporations are trying to get you to buy more. >> all right, thank so much. anything else we should know? >> well, the main reason i want to emphasize why this is so important, the av does spend about $400 on black friday. of course in this area it will be much higher than that. . this isn't in your budget, then where is this money coming from?
