incidents were nothing more than pranks. sentencing is scheduled for march 14th. they could each get up to six months in jail. a judge ordered the uber driver accused of killing six people in michigan held without bail. 45-year-old jason dalton appeared before a judge through a court video feed. he is charged with six counts of murder, two counts of assault with intent to commit murder and eight felony gun counts. police say dalton went on a seven-hour rampage and randomly shot victims at several locations. four people were killed outside a restaurant, and a 14-year-old girl was also wounded and is in critical condition. a father and son were shot and killed outside a car dealership. investigators say they are still trying to piece together a possible motive as it appears there is no connection between the victims and dalton. mike towbin has that part of the story. >> reporter: random shootings leaving at least six people dead in kalamazoo, michigan. the alleged shooter, 45-year- old jason dalton making his first court appearance. dalton has no criminal record and no apparent motive. authorities are now trying to put together the exact timeline of the rampage. one couple says they were passengers in his car in between shootings. >> i would never expect someone that had just been out killing people to come and pick me up. >> we feel really lucky that we came out of this unharmed. obviously our thoughts are with the families of the people who weren't so lucky. >> reporter: police are looking into his employment record to see if there's any connection with the shootings. uber says dalton passed their background checks adding to the mystery of what might driven him to violence. >> it's very different from typical taxi, limousines, things of that nature. whether or not they have the procedures and protocols in place to vet their drivers, i don't know that. >> reporter: for now much of the community remains in shock. a prayer service last night giving people a chance to come together, but many say they're still trying to come to terms with the tragedy. >> you see san bernardino and these other communities, sandy hook what have you. you think, are they that much different than us? >> reporter: police say dalton was in contact with several people during the rampage but they're not expecting anyone else to face charges. in cal la zoo, michigan, mike towbin, fox news. >> this afternoon we are getting new information surrounding the homicide of a 22-year-old san jose mother of two. her body was found over the weekend. >> let's get more from ktvu's paul chambers from hayward where police give us an update. that was a little more than an hour ago. what did they say? >> reporter: that is right, mike. this is still an ongoing investigation. the new information we found today is that stacey aguilar's body was found in a rural part of fremont. they also released new information about her boyfriend. she was last seen with him. >> the boyfriend was arrested for domestic violence, and he is one of the persons that was questioned. >> reporter: police say 22-year- old aguilar was last seen leaving a party in hayward valentine's day morning with her boyfriend the next day. august lar's family reported her missing. police say they did question several people about aguilar's whereabouts including her boyfriend. investigators say is aguilar's boyfriend was arrested for domestic violence against her saturday investigators found august lar's body in a rural area of fremont off morrison canyon road. police saying a you lar was killed in hayward and her body was dimped fremont. investigators say there's a person of interest in custody on an unrelated case. however, they would not say who that person is at this time or if they have any relationship to the victim. still, police feel the person of interest is august lar's killer. >> the people in this community can sleep at night, not being worried that there's a murderer out on the loose. we're very confident moving forward that this person of interest is the right person. >> reporter: now, aguilar leaves behind a seven-year-old and a five-year-old. they also said that her parents, her mother, and her sister are in mexico. police say they're not releasing too much information because they're still not sure if the person who killed her acted alone. mike. >> paul chambers live for us this afternoon, thank you very much. developing news late this afternoon on a story 2 has been following now for months. a mother is just hours away from filing a lawsuit in the wake of her son's jailhouse death. >> it all happened at the alameda county jail. ross palombo has the latest. >> reporter: the alameda county sheriff, the county itself and its healthcare provider are all named in this lawsuit. we have obtained an exclusive copy a day before it is officially going to be filed. all of this after the jailhouse death of mario martinez last july. our investigation uncovered that he died while turned care of corizon correctional health this after a judge ordered he receive is treatment for nasal polyps that were making it hard to breath. his lawyer cites corizon's failure to train their staff and implement policies and deliberate indifference to the serious medical needs of patients. martinez's mother has blamed corizon, the sheriff, and the county board of supervisors for months now. >> everyone just failed him. he suffered and died an ugly death, and that probably is the worst part for me. >> the sheriff's department is responsible because they didn't provide medical care. they didn't provide the proper housing. and, of course, corizon is responsible because they had a duty to provide the medical care and they didn't do it. >> reporter: now the mother is seeking damages from all of 24th. again, attorneys will file the lawsuit first thing tomorrow morning. this is not the first time corizon has had legal issues by the way, as we've been reporting other lawsuits across the cousin resulted in settlements worth tens of millions of dollars. and if this case rate here is successful against the county, it will be taxpayers that ultimately pay for any possible damages. >> ross, i know this is developing but nothing yet from the county or the sheriff's department about this new news? >> reporter: no, they haven't commented. with asked them when the notice of lawsuit was filed. they still have said nothing. >> if you hear from them please let us know. but also you have another investigation airing tonight also involving taxpayer money. >> reporter: that's right. we've uncovered a medical transport company that's already cost taxpayers nearly $2 million. it's called med express. they owe medi-cal money. tonight we find they are still in business with vans that are lacking proof of insurance and proper registration, and it's not just patients and taxpayers who are involved. these vans have apparently also been involved in accidents where people are still trying to get money for the repairs. you are going to hear what the owner had to say when we finally tracked him down, and you are going to hear from the state officials responsible for keeping tabs on all this. why haven't they stopped this after nearly a year? "the four on 2" will be right back. today san francisco mayor ed leigh unveiled new reforms for the police department in wake of the deadly shooting of mario woods. the commission and department are trying to repair the damaged relationship between police and minority communities. mayor lee said that sfpd is reengineering the way police officers use force in an effort to make the department more responsive, accountable, and transparent. city officials announced better training and de-escalation tactics and the creation of a new borrow that would oversee professional standards and principled policing. >> to the sanctity of life, for everybody that everybody walks away whenever that could be possible. >> now, this comes more than two months after the police killing of mario woods in the city's bayview district. cell phone video of police officers shooting the 26-year- old stabbing suspect more than 20 times sparked outrage. coming up at 5:00 you can hear what the naacp san francisco 0 chapter president thinks of the changes and why he is lashing out at the police officers association. today it was 83 degrees in scottsdale, arizona, 81 in mesa, and it was in mesa where a couple of siblings started tossing the baseball for the oakland a's. >> that's right, sports anchor joe fonzi joining us live from just outside the a's ballpark in mesa. take it away, joe. >> reporter: good afternoon, guys. i am here in front of the a's facility, their two-year-old facility here in mesa. this was for the longest time the home of the chicago cubs, but then the cubs found a new place. the city of mesa renovated this stadium and the a's have been using it for two years now splitting time with their practice facility down the street here. but we are always looking for interesting stories in spring training, and the a's have a very good one this year. the odds of anyone becoming a major league pitcher are pretty steep. for two brothers to make it on the same team, off the charts. but that will be the story line in a's camp this spring. last year at this time before he was injured sean doolittle was expected to be the a's closer. this year he's joined by his brother ryan, 18 months younger. senate's awesome. it's so cool. i'm so happy for him bick really feel like he's earned it. >> it takes me back to summer ball, high school ball. it takes a lot of the stress out of it for sure but it's fun looking behind me on the mound and seeing him. >> i was trying to think if i've been in a camp where i've had brothers before, and i don't think i have. i'm gad that one throws right- handed and one throws left- handed. >> reporter: the fact that the two throw from opposite sides of the mound is an obvious difference. the similarities to other brothers close to the same age are universal. >> takes us back to the backyard playing wiffle ball, hitting in the cage. we'd pitch to each other. the only way he would let me pitch to him is if i would catch him afterwards. >> he pushes me every day. we're in the gym and i can't let my little brother outwork me. people were giving me grief about how red i was in the face after our conditioning. i said, hey, i couldn't let my brother beat me. >> reporter: beg in camp together puts the brothers in rare company. they were lined up together on the third baseline at the coul same on opening night. >> it would be amazing. i really hope that he can make the most of this opportunity. >> we grew up in california, went to that stadium all the time, season tickets, stuff like that. being on that line opening night would be great, then hanging out in the pen would be fantastic. >> reporter: you know, guys, baseball is always a game of quirky numbers. we like to throw out the numbers and research them. there have been over 60 pairs of brothers in the major leagues but rarely have they ever been on the same team. but there's some pretty famous brothers. phil niekro and joe niekro. you think of the madduxs, jim and mike. who can forget the deans, dizzy and paul. but the dolittles trying to be part of a rare pair of brothers making the same team. >> do they still teach each other pitches that maybe they can't throw right now? >> reporter: it's funny because talking to them, the and i'm one of those people, i have a brother who is less than a year younger than me, and we played sports, everything, coming up. so i can relate exactly what they were talking about. you've got the little guy pushing you, and everybody goes, you better not let your little brother beat you. so is shawn and ryan are competing. when you're the older one, you can't have that happen. i'm thinking the about the harbaughs for that matter. jim exceeded john in all the things athletically, but now john has a super bowl championship that jim doesn't have when they actually met each other. so interesting story of brothers unsports. it's a rare thing when it happens. very rare in football with those two guys. but rare with what the a's have going on this spring as well. >> i think it's classic. i've got the older brother. we're always on the phone competing about something out there. thanks joe. let's check in with rosemary orozco, our meteorologist. it's feeling more like spring. >> that's right. with siblings it's sort of like a love/hate relationship. we have a love/hate relationship going on with our weather. we definitely need the rain but we are loving this mild weather. back to spring-like temperatures. noticeably warmer today, even warmer midweek. a look outside our doors we do have a mix of sun and clouds out there. those mid and high-level clouds spilling in over the ridge of high pressure that is building in and strengthening. as we move along through your business week, temperatures will continue to climb. right now 67 degrees in san francisco, low 60s half moon bay. we have widespread mid to upper 60s around the basement 68 mountain view, 68 in san jose. areas like walnut creek, still 70 degrees outside your door. 72 santa rose sacks, 67 in napa. these numbers are up by several degrees, by nine at sfo. by six joke lapped. just a tad warmer at livermore. by four degrees in fair field. as we get into your evening hours we will be partly cloudy to mostly clear. not expecting a lot of fog tomorrow morning because we do have drier air pulling in as a result of the ridge. let me pull back and show you where it is right in here. as this continues to strengthen it's going to continue to push that storm trek to the north, and unfortunately we don't see a whole lot of rain in the next few days. could take all the way to the weekend and it still doesn't look too promising. futurecast model picking it up. we get going tomorrow, more of the same, perhaps slightly warm inter the afternoon. we're now into wednesday where you can see picking up just a little bit here over the northwest corner of california we're not likely to see any of this. we'll have partly to cloudy skies, dry conditions. thursday looks like one of the warmer days. friday the clouds increase, temperatures start to come down. but notice again the rain still remains pretty much to the north of us. could maybe squeeze out a sprinkle. it doesn't look too promising but we will watch that one. next chance sunday. it doesn't look like a whole lot but that will be our next break. hopefully we temperatures begin to slide. still relatively mild. hopefully see some rain on sunday but ace showed that you futurecast model doesn't show a whole lot. >> i have noticed it's a lot lighter when i tim cook is getting a lot of attention for his refusal to help the fbi hack into one of the san bernardino shooter's iphones. >> the steps he took today to thank his employees for their support in his very public face- off with the federal government. apple's ceo tim cook wrote a letter to his employees thanking them for their support. the company has not complied with the fbi's request to unlock an iphone used by one of the san bernardino shooters. in today's letter cook reiterated that apple has no tolerance or sympathy for terrorists but said that unlocking the data would set a, quote, dangerous precedent that threatens everyone's civil liberties. last night fbi director james comey fired back at critics who say forcing apple to preserve the data is a slippery slope. he says this area comes down to the victims, and some are jumping into the battle. those who lost loved ones that in fight are now speaking out. >> i personally feel very upset that apple is not cooperating with the fbi. >> the bigger picture is there might be some information in that phone. >> today apple said it supports a proposal to create a government panel to try and resolve issues surrounding encryption and digital security. napa valley wine pioneer peter mondavi has died at the age of 101. peter mondavi in the blue and white shirt on the left, his older brother robert turned their parents' into one of the top producers in the country. they pioneered the use of french oak to age winds. a family feud kept the brothers apart for decades but they reunited in 2005. this was just three years before robert's death. peter mondavi died saturday at his home. caltrans announced further testing the on the bay bridge tunnel shows that corrosion may be a bigger problem than previously thought. back on january 30th a teacher was oakland-bound in the tunnel when a chunk of that tunnel landed in front of is her. she says caltrans will be responsible for what did happen and on the hook to make sure it doesn't happen again. >> all of a sudden a big piece of concrete just fell directly down in front of my car. so i didn't hit it head on, butt scraped along the side of the car, then popped my back tire. >> what we normally do, hitting it with a hammer, because good concrete will have a good ring to it, and bad concrete sounds more thudy. that's when we found the additional 12 problems. >> the roots of this problem appear to go back 52 years when the deck that holds westbound traffic was rebuilt. decades of leaking water have attacked a masonite fiberboard pad causing corrosion underneath. eventually the concrete wall failed and repairs will be undertaken but caltrans says all is safe for now. if the feels like we have been talking about california high-speed rail for yeah, we have. but now the state agency that is planning it says a slight change in plans will get things going and save californians $5.5 billion. we'll explain how. plus, new numbers in the case. housing prices may be taking a hit. is a downturn really starting? "the four on 2" will be right back. california high-speed rail is a $60 billion plan approved in 2008. the goal to link san francisco to los angeles with only a three-hour train trip. now a new plan could get the trains running as soon as 2025 and save the state some $a .5 billion. >> the high-speed rail authority wanted to build the first route from merced to bower bank but just a few days ago the authority linked this -- released this new map. we are taking four minutes to see if high-speed rail is a dream or will it be a reality. >> with us now, the executive director of the monetta transportation institute and a past chair of the california high-speed rail authority. rod, thanks for being here. >> nice to be here. >> so $60 billion approved back in 2008. lawsuits, delays, debates. is this why we are seemingly nowhere, or is there some progress that we're just not seeing? >> well, there progress. over $4 billion of contracts have been let in the central valley between north of fresno down towards bakersfield. so there is construction occurring right now on the high- speed rail project in california. >> hey, rod, i feel like this is kind of nice chess move to change the plan like this and involve silicon valley, bick feel maybe more people will kind of jump on board the train, and specifically companies here in the bay area. and by doing that, maybe you're able to generate more revenue and raise more money so that this high-speed rail is actually completed. is that one of the reasons for switching the plan, to get more money? >> actually, the reason is so that an operable segment will make money in operations and can be built quickly. and the ability to build the project from the central valley, especially the fresno and merced area over to silicon valley will create a market immediately that will make money in operations. and that's the real objective. >> well, rod, let's talk more about the engineering of this, the challenges of going north versus going south and this new plan now that has been put before everybody. they say it's going to be tricky, the older plan would have been more tricky in this new idea would be possibly more cost efficient? >> oh, yes. it's much less expensive, almost a third less to come from fresno and merced over the pass and down through gilroy and up to san jose than it would be to go from bakersfield up over the mountains and all that difficult terrain, then down through the canyons into san fernando valley. but you have to link the central valley portion where the maintenance base has to be and where your original line is. you have to link that with the market. and the market in silicon valley is a robust thriving expanding market, and it's less expensive to reach. so it was a no brainer. >> there's some lawmakers in southern california who aren't necessarily happy about this new move. what do you say to those who are disappointed that the first stop is here in northern california? >> well, i agree with them. we have to after statewide system. so we have to find the money to complete the project, and we'll have about, oh, 20, 25, $30 billion of the project done, and it's a $64 billion project. so we have to come up with about 5% of the cost to have it reach from anaheim up to san francisco. that's a reach. that's what we have to do. it's a matter now of finding those funds. they can come from government or they can come from private investors. we have private investors from all over the world that are looking closely at our project. and i think they're going to hop in and be again helping us build this as soon as we get from silicon valley to central valley. >> so why would you start building something when you don't have it completely funded yet? >> because the portion from central valley to silicon valley will be profitable. it will make money on operations and maintenance. >> how many people do you expect to ride that leg from the central valley into silicon valley? >> let's look at it this way. right now you have in excess of 50,000 trips a day coming from the north central valley over terribly dangerous roads. highway 152, highway 580, 680, burning $2 a gallon, $3 a gallon gasoline, taking two-and- a-half hours per direction. you get to work, you're tired. you get home, you want to kick the kids in stead of hugging them. instead of doing that the run from fresno to downtown san jose and silicon valley is 51 minutes by high-speed rail. >> but is there any estimate how many people actually make that commute? >> there are, and i don't have it at the tip of my tongue, butt certainly will reduce the congestion, the air pollution, the aggravation, the danger on those roads. and we could get you the number of riders that are estimated in the business plan if would you like that. >> rod, you talk about the numbers, private funders possibly stepping in to help get this thing funded. we're in 2016 now. realistically when do you see this being a done deal and we can say, yes, we have high- speed rail from the south all the way up here to the authority? >> well, it's a done deal now. we have high-speed rail being constructed. >> i guess the finish line. >> well, the line from central valley to san jose is supposed to be done now by 2025. and that i believe will be accomplished. then i think when that's happening, countries like china and japan and france and germany and italy and spain and all the other countries that have high-speed rail programs and with like to built for us will step in and help us complete the project. in return for being able to operate the system for us for a period of time. >> okay. transportation expert rod, thanks for being with us today. >> nice to be with you. >> thank you j. tomorrow the republicans have their shot in nevada, and donald trump says he is now unstoppable after his big win in south carolina this past weekend. peter deucy has the latest. >> reporter: the gop candidates are gearing up for their next campaign showdown as they chris cross nevada making final pitches before tomorrow's state caucuses there. and it comes on the heels of another big win for the front runner, donald trump, who is now suggesting he is unstoppable after taking first place in the south carolina primary. >> i'll win michigan, which nobody else can even think about winning. i'll win new york. i think i have a good chance of wing new york, new york state. if i win that the election is over because there's so many delegates. i do things that nobody sells going to do. >> reporter: with jeb bush officially tout fight between senators ted cruz and marco rubio is intensifying. the two lawmakers coming in second and third place saturday are each positioning themselves as the stronger anti-trump alternative. >> now, it's every single day something comes out of the cruz campaign that's deceptive and untrue, and in this case goes after may faith. this is a pattern now. i think we're at a point where we start asking about accountability. >> reporter: the democrats are turning their focus to south carolina. bernie sanders looking to regain ground after a loss in the know vat that caucuses. >> virtually every idea that we are bringing forth in the only is the ritt idea, it's what our country needs, is what the american people want. >> reporter: clinton and sanders will go head to head one last time before this weekend's primary when they attend a prime-time town hall event tomorrow night. in washington, peter ducey, fox news. >> you heard senator marco rubio complaining about ted cruz's campaign taking jabs at him. cruz asked his national spokesperson to resign. spokesman rich tyler tweeted a video of rubio that depicted rubio dismissing the bible. >> cruz said that he is still looking into exactly what happened with regard to that tweet but he asked for tyler's resignation to make it clear that his campaign will conduct itself with the highest level of integrity. he was saying it almost felt like he had no other choice but to threat guy go. coming up, we've been hearing about housing prices skyrocketing. buyers getting outbid. but now there's a sign some housing may be on the decline. our real estate expert joins to us break down the numbers. dryer, warmer weather settling into the bay area. we'll have a look at your current conditions, talk more about this warming trend and how long it's going to last coming up. and here's a live look outside eastbound 80 not good in emeryville. berkeley, westbound -- well, pretty much the same. new numbers showing the price for con doins san francisco has dropped for the fifth month in a row. with us now our real estate expert matt fuller. thanks for being here. >> when you hear that statistic, that number, new condo, san francisco, fifth month in a row drop, what does that mean to you? >> i think it's a great reminder there's a difference between reading a headline and reading the news. but once i kind of dug into it i put together a graph and looked at two sets of numbers. one that looked at brand-new, the other resales. if we look at brand-new construction, for about the last five months it's down $150 per square foot using this particular model. if we look at resales they're actually up slightly. so then i found out that the overall inventory both for condos and single families, and if we were in a softening market we would expect that to be going up. >> tell us, what does the blue represent? >> the blue is going to be resale condos. so condos that have been newer and kind of compete with brand- new construction but are a little bit older. then the green behind is it what's been happening with brand-new construction. so we see it coming together. the at some point would you expect new construction to set a ceiling for resale construction because why would i pay more for something that's already been lived in. >> you follow the trends. your biggest take-away when it comes to san francisco real estate, the market now, and when you saw that blog that we talked about. >> absolutely. as soon as i saw that one of the things that came to mind immediately is there is really no such thing as the san francisco market or the bay area market. we have all of these kind of very small inter-related markets, a home in pacific heights and a condo in hayes valley. obviously they're interrelated but they're not exactly. so what's happening in one area may not be happening in other areas. we have seen kind of around new construction a little bit of a softening in this one particular model, but that also speaks to where new construction is in san francisco. it's not in every neighborhood. >> we've been talking about this being a sellers market. when you see this blog talking prices are dropping is this a sell isers market or do buyers at least have the power to negotiate right now? are we fighting just to get a house? >> that's a great question. i wept back and looked at that time january numbers. in january for all of the sales that were reported in san francisco through the mls, 75% went for more than the asking price, which tells you, though, the flip side, one out of four bayers is able to either negotiate something at or under. so yes there are some spots where you can negotiate. it's not going to be kind of the most -- the neighborhoods where everyone wants to be or the price points that are most competitive. but if you are willing to look around, yeah, there might be some opportunities. >> finally, matt, bring us home now with the bigger picture as we wrap this up and you have one more graph to show us. >> i kind of wept back and since 2011, if we start back and look at the bigger picture, we have crazy price increases. most of the city is up around 75% in the last five years. in fact, the lowest performing neighborhood is district 7 which would be kind of pacific heights, the marina, and that doesn't speak to the fact that it hasn't appreciated but just that it really didn't depreciate during our last downturn. when we look at these prices that have increased so dramatically, 75% in five years, that's not sustainable. so yes we need to come into something else that is more sustainable, and the question is, you know, have we arrived there. i think everyone is looking at these numbers and wants to tell kind of the story they would like to tell with them. >> okay. so basically stay tuned, watch the market. >> stay tuned. real estate expert matt fuller, thank you. thank you matt. there. we do have those high clouds that moved through the area. as i pull back will you be able to see just how they move through. so the ridge right about in here, and they just sort of spill rate over the top. notice the storm track on the back side here and continuing to nudge north ward as this continues to strengthen and deflect those storms. so for the next couple of days we're going to be dry, unseasonably warm, and again we will see those temperatures continue to climb, perhaps nearing 80 degrees by thursday, at least that's what the models are suggest at this point. but the clouds moving in and out, sometimes the clouds will offset the heat in the afternoon. so we will continue to watch that for you. but in any case it is going to be dry, mild. here is a look at some of the rainfall amounts way back since july, still between 80, 90% of the seasonal average. but again we know we had a relatively dry february, so we're hoping for that rain to come back by march. giving awe look here at the futurecast models. tomorrow morning we will be partly cloudy as we get into the afternoon. a lot of 60s and 70s back in the forecast. upper 60s to mid-70s. a few upper 70s for some of the warmer locations. tomorrow morning as we get out the door 51 degrees for pacifica, low 60 for san francisco, low 40s for concord and livermore. to the north bay, some of the cooler spots, 3 for santa rose sacks, 41 in napa, 45 for you san rafael. afternoon highs tomorrow nice and pleasant once again. 71 for novato, shifting our eyes to the east where we have upper 60s for richmond, mid-70s for oakland tomorrow. 73 for danville. livermore 74. as we get into the south bay upper 70s for los gat together, gill roy, mid-70s for santa cruz. shifting into san jose you are expected to hit 75 for the second half. the peninsula tomorrow redwood city 74. 72 san mateo. 70 in san francisco. the extended forecast temperatures warm slightly as we get into tuesday and wednesday. a bigger bump on thursday, getting into the weekend, temperatures begin to cool off some. we do have just a slight chance at scattered showers moving in. on friday it didn't look like much. sunday 10 to 20%, hopefully crime and battery of their african-american roommate. >> we were inside the courtroom when the verdict was read. maureen. >> reporter: frank and julie, it happened on the third floor of the courtroom. the jury of six women and six men found those college students guilty of battery but they did not convict any of the hate crime. one juror told us afterwards that the evidence was all circumstantial. >> reporter: colin warren hung his head's left court, the only of the three white men charged in the hate crime and battery case against their african- american suitemate. >> we're obviously disappointed that colin was convicted of the battery. i thought there was a reasonable doubt. but i'm not surprised at all that the jury didn't reach a verdict on the hate crime. >> reporter: d.a. filed the charms on the two saying they called dj williams derogatory names, locked him in a room, put a bike lock around his neck and hung a confederate flag in a shared room. the defendant said the
