Live in San Francisco, im tara moriarty, ktvu fox 2 news. A major announcement today by the contra costa District Attorney in the Bay Area Police station sex abuse scandal. Ment da says one retired Oakland Police captain accused of having sexual relations will face a misdemeanor charge of soliciting prostitution. The 81yearold has not been identified. The da says no other charges will be filed in Contra Costa County against officers from oakland, richmond and San Francisco as well as alameda Sheriff Deputies based on interviews investigators did. All of the sexual interactions that she had with those officers occurred when she was over 18. All of her actions, interacts with these officers were consensual. All of her interactions with these officers were not done for money or anything of value. Therefore, accordingly there were no crimes. He believes Police Wanted to get her help and treatment. This is a story that our Crime Reporter henry lee has been following. The da was given several cases involving former and Current Police officers. You only have the one that is going to be charged. This came down to a lack of evidence. He says that he carefully reviewed the evidence and took into consideration a dozen statements and he says he has to abide by the law and make sure he can prove evidence beyond a reasonble doubt. And i want to read people at home something else. He said it is troubling and unfortunate that we want to file charges but just because it is illadvised that is our not our job but painted the industry in a bad light. And thats what Police Officials have been saying. Some of the officers may have acted immorally or unethically they did not commit crimes but four officers face firings and we have repercussions in other places. They sent her to florida for rehab. Not to help her but to get rid of her and that actually is the allegation that her attorneys alleged while picking her up in florida. No evidence of that. The d asays they truthfully have seen her as a prior victim and they wanted to get her help. Thats what the da concluded. And, of course, other people are still voicing some suspicions over that but they are saying we didnt send her out of the state to hide her because she is back and we have the evidence no matter where she is. All right. To wrap it up. The only arrest, an 81yearold retired Police Officer, all other Law Enforcement officers not going to be facing charges. Thank you and appreciate it. We will stay on top of the story and we will have more coming up later at five. Stick around because coming up in 30 minutes we will speak with the legal analyst michael cardoza. Actually having to utilize a knife and push it through and do physical harm and push it through that persons skin. That is very personal. The Alameda County coroner identified her by fingerprints. Detects believe it was personal and not related to her job as a mentor at the sheriff deputy Explorer Program. Now the Oakland Police were able to solve this crime very quickly and they say they are confident that they have the right people in custody because right after the remains were found in the park they went through the missing persons report and discovered the missing persons report in Alameda County Sheriffs Office and coordinating with the two Law Enforcement. Lee, it is sad but nothing else about possible motive. They did say that the woman was in custody was a friend and that the man in custody, they did not know the relationship, possible acquaintance but they do not believe that she had worked for the Explorer Program for four years and at this point at age 21 she was a mentor and helping the younger children go through the program but they did not believe that was motive for her murder that this was something personal between the three. Continuing coverage of the bay area sex scandal involving several Law Enforcement agencies what the decision to not charge several Police Officers and we will speak of our legal analyst coming up next. Lots of sunshine. It is nice and you can see the hills turning green with that october rainfall we had. We are tracking the track of a few showers and part of the weekend and bigger changes showing up in the five day. All right. It is friday and that means of course the verdict. Michael cardoza. Our legal analyst is here as always and lets start and talk about a couple of things. Lets start about the decision by the prosecutor d. A. Not to file charges in the bay area sex police scandal. He said the evidence was not there especially after talking to a buslin. Im listening to Mark Peterson and told five different stories and she said she did not have sex and if she did she was over 18. Said we cant trust her veracity and we at contra costa are not going to prosecute the officers. That speaks volumes to me and i turned to Alameda County and says why is there a difference . Why do you believe her. She has told a bunch of different stories and thinks she will make a bunches of money. You are representing one of the officers in the scenario. Can you use this to your advantage if you got to a point to go to trial or with the plea barg . I am anxious to see. There will be no plea bargain. We are going all the way. They dismiss it or they got themselves a trial. In this case what we will look to are the jury instructions that talk about the credibility and the veracity of witnesses. We will look to see what she told the contra costa investigators because remember there were two parallel investigations going on. Alameda county and contra costa. She says something and we now want to get what she told those contra costa investigators to see how they square up, if they square up at all. We will mention the one person charged, an 81yearold. Right. Come on. ExPolice Officer and where he made his mistake, he said i did have sex with her. She was over 18 and i paid her and thats what they are charging him. Where are the other johns and customers of prostitutes or sex workers why are they arresting this one x Police Officer, 81 years old. I smile at that. Going to a hooker at 81. This is a family show. Okay. Move onto the other case and that is down in los angeles. The d. A. Charged an ex playboy model for body shaming a 70 yearold woman at the gym. She took a photo of this gym and shared it on social media and it was despicable. And she there you see it. She says if you cant if you cant unsee it, you cant either and sent it to friend on snap chat and making fun of the person. You have an expectation of privacy in the locker room. Absolutely. And kudo to the d. A. s office for prosecuting this because this is one of the type of misdemeanor crimes that could fall between the cracks. They are going after her and i think they should come after her. How do people feel when you hear this. You are in the gym and working out and taking a shower and a young woman who is in shape looks at an older person and good luck when she gets older and lets take a look at her. Awful what she did and it is going to be interesting to see what the judge does because they let it go with this person saying gosh i am sorry and i did this and i am off facebook and i dont do it. You wont get away with this. She gets a short blast of jail time to sort of socialize her or give her a lot of hours of Community Service to say this is not something you do. Better she punch that lady and she would get over that punching faster than she is going to get over this deep emotional scar that this woman caused her. I think she should be punished and punished good. Mark tamayo. What do you have for our weekend . We do have a few showers in the forecast for parts of the bay area as we head in the weekend and thats the biggest change that we can expect by saturday night. Looking out towards San Francisco bay. A few high clouds and temperatures in the 70s for today and tomorrow we begin to cool things off on average about 3 to 5 degrees and more pronounced cooling for the second half of the week before we have this guy, this cold front approaching Northern California and this will be the source of more cloud cover by tomorrow and more rain showers as well. Especially to the north of the bay area. Right now we have traced in the surface winds. Still a northerly wind in place and we have mostly clear skies and take a look at the numbers. Very nice. One censor in napa showing 80s and widespread 70s for San Francisco, oakland and fremont and san jose in the mid70s, 75. Another live camera in oakland still in the clear. It will set the stage for a very nice friday evening. The first thing tomorrow morning partly cloudy skies and not only the valley fog a few patches and quite a bit of fog bump up to the coastline tomorrow and temperatures for your saturday will be in the 40s and to the low 50s and its the time of year we change the clock. Before you go to bed saturday night and sunday morning we fall back one hour and take a look at that sunday sunset time. It will be 5 05. That time of year and dont forget as we head to your weekend. The next system set to move in late saturday and also into early sunday morning. You will notice the bulk of the rain to the north and of the bay area and thats where the numbers do reflect that towards eureka and men na siddo. 6. 9inches and those amounts taper off towards the south bay and maybe just trace amounts and a couple hundredths of an inch. Here is the next system next saturday and sunday morning and the next system upstream and the flow. Tomorrow cooling and a chance of a few showers on saturday night. Mainly up in the north bay and then into sunday the chance of a lingering shower. Early sunday morning and maybe 6 or 7 00 and a sun cloud mix for the remainder of the day on sunday and breezy out there as well. Here is the deal with the forecast tomorrow morning. Showing you a return of some fog and coast side and the afternoon and partly cloudy and up to the north and taking this into saturday night and this is saturday, late saturday into early sunday morning and rain showers developing up in the north bay and then kind of breaking up a bit but still a possibility of a few showers. First things sunday morning and even at 8 00 the sunday morning the chance of a sprinkle and partly cloudy by sunday 3 00 p. M. Temperatures for tomorrow. 60s to low 70s and santa rosa 70 and San Francisco 67 and concord 70 and the High Surf Advisory expired and and a big swell for tuesday and wednesday and we will be watching that offshore. Onland the chance of a shower first thing saturday and into sunday morning. Partly sunny skies and into monday and next week looks quiet as we start things up and going to start off the day and 60s and 70s and i always remind people to change the clocks. We will speak with bay area teachers about how they are using this years contentious election to teach students. T h is election is presenting a challenge for teachers as students come to school asking about what they see and hear from the candidates and from the adults in their lives. Claudine wong sat down with one group of teachers. A group from walnut creek schools to talk about how the election is portrayed in the classroom. As a history teacher there are many teachable moments with the election. It is about the conversation itself. Not necessarily the candidates because i think one of the things that we have seen in this lakeeffect election is that they are flawed. Putting this into a context that middle School Students can understand. I won tell you who i am voting for but i will tell you what i dont stand for even with a president ial candidate. I have never done that before an. Usually im completely mum about it and i dont say anything. I sort of got torn between my desire to be objective versus the lessons of history which is you cant stay on the sidelines when you have intolerance. Donald trump is calling for a total and complete shut down of moslems entering the United States. The rhetoric had to be called out. Is this the first time that you have actually made your position known . The only other time in 25 years i ever gave my opinion was proposition 8. The points that i tried to focus on with the president ial election is integrity and looking at the two different candidates and how integrity goes along way. And the disturbing stories just keep coming. I would say this election has had plenty of cringing moments but the students are paying attention. Do they bring a lot of what they hear at home into the classroom and how do you teach without teaching them maybe something that conflicts with what they are hearing at home . I think it is a delicate balance as a teacher to not put your politics in the classroom but if you are teaching tolerance it is not one side but i think you are teaching open minedness and critical thinking. Because he would rather have a puppet as president. No puppets. And it is clear. We had a preschool teacher that said 3yearolds are coming in saying i heard that in this case donald trump is a bully and the preschool teacher is trying to figure out how to manage that. What we have come to accept as educators is that it is coming to school regardless. Whether what do you say. They are parenting their opinions and we keep trying to bring back to behaviors rather than to characteristic. If they want to release more tapes saying inappropriate things. We will continue to talk about bill and hillary doing inappropriate things. There is a lot of slander and things that are coming up from peoples past. You did this a couple of years. You said this in this interview. And you did this with this email and that is how you handled the information and i have been focusing on the integrity part and students building integrity and how that can lead to your future. Have you gotten any push back from parents saying i dont want you to say this to my kids. I dont name names. After you come in for a debate you come in and worked up in your own ways and how you keep that from fingering your class in a way that you dont want it to affect your classes. As educators we come together to disagree and voice our opinions and ideas to one another and do it in a way that is not threatening and it is conversational and even if we dont agree it is okay. There is no issue that separates the two of you more than the issue of immigration. Actually there are a lot of issues that separate the two of you. The benefit of this election is some that middle schoolers can more easily grapple with, is the United States a nation of immigrants and welcome immigrants. Thats a big concept where as taxes and tax rates is confusing to them. One of the lessons in every election i try to make sure i get and this is what our society has lost is that the people that disagree with you arent evil and they may not be wrong. It is okay to civilly disagree. There is things that we still need to have conversations about that we still arent having conversations about and hopefully this election because it is so polarizing to put this in a position to have that conversation. We will hear more from the teachers when Claudine Wong hoss bay area people. National security is at a alltime high. The recent threats made to three specific states made by the terror group of the islamic terror group. The four on 2 will be right back. Stay with us. Law enforcement officials on high alert in three states. This comes as federal investigators are looking into information that there could be issues around election time involving the terror group al qaeda. Rob smith has more. A potential threat of attacks in the u. S. From al qaeda taking place around election day. Thats what federal authorities are warning local agencies of and in virginia. Reportedly identifying those states as possible targets. Right now the way that the nypd is looking at it we are in a state of village lens. That is after what is being called an unspecific threat by the militant group. New york Police Agencies are pledging high levels of patrol at area airports and tunnels. And this is something that i was briefed on several days ago that is at this moment we are still developing information on the level of credibility and not clear and it is definitely not a specific threat. The threat of information coming at a time when new york is preparing to host the citys annual marathon. As well as both president ial campaigns. We want to urge clearly everybody go about your business and a lot of nypd folks to protect you. The Texas Governor says the governor is monitoring the situation and asking people to remain vigilant and to say they will be able to vote safely and taking necessary steps to protect the american people. A senior Law Enforcement source tells fox that reports of an attack are based on low credibility. In new york, rob smith fox news. Ktvu fox 2 news at five starts now.
