Prosecutors say 27yearold barry white was in the jewelry mart and got into an argument with the owner over the price of a gold chain. The prosecution and attorneys had said that he shot those two clerks, slitting one of their throats and critically wounding the owner but their viewpoints differed. The defense argued whites actions were the result of an untreated mental condition. A guilty verdict has been reached. We are going live to our reporter Tara Moriarty outside the courtroom, as soon as she can break away from the court, and we will have that report coming up. Now we want to go to san jose. More fallout for the city, Santa Clara County and the Water District after a half dozen residents file legal claims. Back in february more than 100 residents were forced from their homes when coyote creek spilled from its banks, causing many people to get trapped. Our south bay reporter jesse gary with more on the legal action and reaction to it. Reporter good afternoon. This is not a lawsuit but the initial steps taken before a suit is filed. Proponents and their advocates say the governmental agencies including the Water District knew of the flooding dangers and failed to take the appropriate steps to protect people and property. They need to take the steps to be sure this doesnt happen again but they also need to address the claims and take them seriously. Reporter flanked by Haunting Images of flooding victims gathered to put city, county, and Water District officials on notice. The first step before firing a barrage of legal action is being taken with the damage claims. I think this was preventible. Weve seen a lot of evidence that it was. We need to hold the district and the city to account. Reporter a late february downpour became a fight for survival for over 500 south bay households. Days of heavy rain and a release of water from Anderson Reservoir sent thousands of gallons into coyote creek. The result, water swallowed three neighborhoods. With us paying our taxes to prevent floods and the city not having a Warning System in place, hopefully that will change. Hopefully this will bring change. Reporter claimants want restitution for the loss of property. The attorney sees a structured negotiation as one option. The chairman for the district e mailed a response saying, quote, our hearts go out to everyone who sim pact, and the district will give each claim due consideration. The county and city both responded similarly. The city received the claims yesterday, and our Attorneys Office is going to review those, and thats all we can really say at this point. Reporter she and others gathered here hope reason will trump legal strategy, allowing those most impacted to take the next step forward to being made whole. Hopefully we will get some closure that they are on top of the problems rather than kicking them down the road. Reporter there are two more informational meetings scheduled this month for folks interested in filing a claim. One on the 15th, the other on the 22nd. The Company Plans to donate 100 through rebuilding together silicon valley. The money will go towards Building Supplies and helping people affected by the flooding last february. The executive director says the donation from google will be a big help. We have been working since the floods and theres a lot of work still yet to be done for these homes to be safe and healthy. Google is investing in the community and seeing the impact that we do to ensure that all of our residents have safe and healthy homes. Rebuilding together has been making critical repairs for months especially in one mobile home park. The organization usually works on 360 homes a year but this year that number has skyrocketed. Right now crews are at the scene of a grass fire in south livermore. The fire was reported shortly before 2 00 near the intersection of east vineyard avenue and vallecitos road. There are no reports of injuries. Crews were able to keep the flames from spreading to nearby homes. Lets check in now with chief meteorologist bill martin talking about the hot weather. For us, along the coast that fog is going to sit at the coast and be very patchy and very shallow. With a shallow marine layer, that means the fog is not going to get very far inland. Temperatures are going to warm nicely. 99 in fairfield. Fairfield could easily hit 100 tomorrow. These purples are 100degree readings. We are seeing 100 up around sacramento. Its 11 degrees warmer in novato, 10 degrees warmer in livermore than it was at this time yesterday. So a big warmup. I want to go back. Take a look. Everybody warmed up quite a bit. Same with san jose. So tomorrow is going to be just about the same. Not as big a warming because i think were going to hover with temperatures where they are now, but tin creases wont be as apparent because it was hot today, it will be hot tomorrow. Instead of a courtroom, it all took place at a hospital. Crime reporter henry lee joins us now. Henry, the defendant was arraigned from his hospital bed . Reporter yeah, its relatively rare, but because the defendant was hurt in the crash, the judge and the court came to him. From his bed, wilson was formally notified of the charges. Two counts of murder, hitand run, and dui. A judge, prosecutor, defense attorney and bailiff came from Contra Costa County for the unusual hearing. Ktvu spoke to the prosecutor after the hearing where cameras were not allowed. It went fine. Pretty routine. It was a hospital arraignment. The arraignment was put over for two weeks. No plea was entered. Reporter wilson is accused of fleeing the scene after he crashed his car with a woman and two children inside. The two children were killed. Its very apparent you can only begin to imagine how terrible the loss is from both sides. This is just a horrible thing. Reporter the chp, which investigated the case, says wilson has three dui convictions and was drunk and driving on a suspended license at the time of the deadly crash. That factored into the decision to charge him with murder and not vehicular manslaughter. When somebody intentionally commits an act which they know is inherently dangerous and they do that act and somebody dies, its called implied malice. Reporter the boys mother, who was hurt along with her son, says she hopes wilson will be prosecuted to the fullest extent of the law. The San Francisco Police Commission has approved a new updated policy on the citys sanctuary city laws. The update clarifies that San Francisco police are not allowed to ask about a persons immigration status. It also bans police from cooperating with federal immigration authorities except where state or federal law requires it. The revised policy follows last weeks decision by the board of supervisors to approve a 190,000 lawsuit settlement filed by an undocumented immigrant who was turned over to officials in 2015 after he reported that his car had been stolen. Meantime the stage is set for a showdown between the Justice Department and sanctuary cities. Attorney general Jeff Sessions had given 10 state and local jurisdictions until the end of last month to prove that they share information with federal immigration officials or risk losing some department of justice grant money. Joining me now to talk more is david levine, professor at u. C. Hastings college of law. What do we make of this, this proof that attorney general Jeff Sessions is asking for . Well, some of it might be kind of proving the negative. Some of it might be clear because if there are written policies which prohibit the communication of information as required under federal immigration law, then a city or state might be out of compliance. But otherwise, if the words of the ordinances seem to be in compliance, then just because some lowlevel person perhaps didnt make a phone call they might have made, that doesnt mean that a jurisdiction would be out of compliance. Lets talk about the sort of crux of all this and the 1373. Spline what that requires. This is a federal statute. What it says is that you are not allowed to have a prohibition against communicating with federal officials. So that as long as a city or a state does not make that prohibition theres very little that the federal government can actually do. To some degree we are seeing a lot of storm and not real nothing real. So, for example, when the litigation took place in march with San Francisco, San Francisco said, look, the executive order the president signed might put us at risk for more than a bels of our budget, but when all is said and done after the judge issued an order clarifying, it was only a million dollars. So there might be much less at stake here than we might think from all the headlines. So ken just read a story about what San Francisco is now ordering its police not to do. If you are attorney general Jeff Sessions and are looking at that, are you saying, oh, they dont comply . What the law talks about is communication between say a local jurisdiction like San Francisco and the federal authorities at homeland security, at i. C. E. So just because the police dont ask for a piece of information, that means they dont have a piece of information to give to the federal authorities. That really the way that cities and other states are going to sort of work around that, do you think . That is probably some of it, because at least as written now now, it might change because the house passed a piece of very different legislation last week, but right now the piece of legislation, this one statute, is a very low bar for cities to clear so they can proclaim that theyre sanctuary cities on the one hand, and on the other hand they can quite truthfully send in the certifications saying, oh, were in complete compliance because the statute requires so little of the jurisdictions. Final question. As the Justice Department is reviewing the statements by these jurisdictions what do you anticipate them doing once they review the documentation and what could the potential outcome be . Well, the potential outcome is that these jurisdictions might not be eligible, then, for a very small number of grants. The whole issue is that you can make incentives to have jurisdictions take a grant, but the strings have to be clear upfront. What are the requirements . So that what might possibly happen is that in the future some jurisdiction might not be a able to continue to take a particular grant. But the grants that are at issue are so small, it hardly matters. So to take San Francisco as an example, San Francisco sued in federal court because they were afraid of losing 12 of their budget, more than a billion dollars. But the actual amount of money at stake was only a million dollars. Thats hardly anything. Professor, thanks as always. We are continuing to follow breaking news. We found out within the last halfhour that barry white has been convicted on two counts of firstdegree murder for the 2013 deaths of the jewelry mart employees as well as a number of attempted murder charges in connection with to a shootout he had with police after that. No surprise, this crime was captured on videotape. Ive done enough trials, i mean, well over 150 trials, that nothing that a jury does surprises me. Would i expect them to come back with firstdegree murder convictions in this case . Absolutely. To look at the way he committed these murders, he brings a gun, he brings a knife to the jewelry mart, which shows some planning. Then the viciousness with which he carried this out. It was horrid what he did. A jury listens to that and thinks, okay, youre not very well balanced. Certainly theres something wrong with you, but, boy, we are not letting you out. We are going to hit you with a firstdegree murder. That gets him 25 to life. The second gets 25 to life. So now its 50. Hes gone for an awfully long time, and he should be, because we have got to keep people like that out of society that can go off like that. Theres a lot of criticism of the jury system, that it is hard to get a conviction oftentimes in some of these cases. The defense brought up the ptsd aspect, trying to get him out of this conviction. Obviously it didnt work. No, it did not. They are trying to ratchet it down from a first to maybe the second, but i am telling you, a jury looks at this and says, yes, there is something wrong with you, but were not going to walk you out of this courtroom where you might get out again and commit a crime like this again. He did have a not guilty by reason of insanity plea in at the beginning of the trial. I thought he would have done better with that. You go to the sanity phase where the jury has to decide did you know right from wrong at the time. He, the way i understand it, made the decision to withdraw that not guilty by reason of insanity. Thats what i understand happened. Lets move on. Rob kardashian was dating black china. They were engaged to be married. He posted some nude pictures of her on instagram. Got shut down. Then posted those pictures on twitter. Many people may not realize that is against the law in california. It is. Even if they send you a nude picture, you cant share that picture without their consent. What some of the elements are, if the picture sharing is like, this is just for you, dont put it anywhere else. Then if you put it out, meaning to seriously emotionally affect the person, and the person is seriously emotionally affect, then you have committed a crime, and it is a misdemeanor and it can garner up to six months. As i watched this unfold, all i can think of, are they pulling a fast one on us . Did they talk and say, hey, lets keep this in the news, lets keep us in the news, and then well be in the news even more. Remember, she was a stripper, too, before. But he posted those pictures without her consent. And jackie spear, the columnist, is getting involved. You said it is a misdemeanor. They want to make this a felony. It is a felony in illinois. Maybe it should be a felony here, depending on the type of picture and what happened. But when i say stripper, that goes to whether she would be seriously emotionally affected by this. The d. A or the defense would want to get in that and say, wait a minute, you did that. How offended or seriously emotionally injured would you be . Its not like somebody that has never done that. So there is a difference. Michael cardoza, thanks for joining us. We want to go back now to our coverage of the guilty verdict today in that 2013 double murder at the San Francisco jewelry mart. As we have been reporting, barry white found guilty on counts including firstdegree murder and attempted murder for the killings of those two store clerks and for critically wounding that store owner. More from ktvus Tara Moriarty, live outside the courthouse with more on this breaking news and this verdict in this very emotional case. Reporter i think this was definitely a relief for the families of the victims who have had to wait for four years for justice in this case. And when the verdict was read it wasnt much of a shock to anyone. It was fairly quiet. It took a very long time for all of those counts to be read. But according to jurors and anyone who paid attention to this case, the video and the photographic evidence was simply too powerful not to find him guilty on all counts. Now, we watched as the families of the two people that were fatally shot and stabbed walked out of the courtroom. They told us they were exhausted. Many family members were not present today but dozens were here for closing arguments yesterday. 27yearold barry white was also found guilty for trying to kill the store owner who was seriously hurt but survived. White was also convicted of attempted murder of Six Police Officers who responded to the scene that day on july 12th, 2013. We spoke to both prosecuting and Defense Attorneys just minutes ago. He didnt have any mental defense. It was a fake mental defense. And thankfully the jury saw through that and did the right thing, not only on behalf of the civilian victims but also on behalf of the six San Francisco Police Officers that almost died that day, trying to take him into custody. Barry was a young kid, and now his life is changed forever. So its a tragedy all the way around. What did he go through . He went through a lot. He is a young man that was shot at the age of 19. He has had issues ever since then. He is going through a lot right now. Were going to have him evaluated by Jail Psychiatric Services and make sure he is in a good position. Prosecutors say white went on a rampage because he felt the owner had short changed him on a necklace. They say he waited for 20 minutes until all the customers left the store before his attack. The defense claimed that white suffered a brain injury in 2009 during an antiokay Police Shooting which left him with ptsd. They felt the charges should have been downgraded to manslaughter, but clearly the jury did not buy it. The specific acts that were committed were Pretty Simple to decide, yes, they happened, and he did them, because there is a lot of video film and stuff, so it was Pretty Simple. Reporter now, we sat behind barry white so we were unable to see all of the expressions on his face, but from our angle it seemed that he had very little emotion, and he faces life in prison without the possibility of parole. Basically it is where the water comes out of Lake Berryessa and comes down into the valley. A lot of smoke. A long line of fire there. There were 200 firefighters on the scene. At last report this fire has burned 80 acres and is only 10 contained. The good news, no word of any structures burning. It is mostly ranchland, grassland out there in that area. However, there is a concern that this fire could spread. Bill, you were talking earlier that it is about 98 degrees. Its hot in the valley. Theres not a lot of wind but watch that fire distance. Thats the classic fire creating its own weather. The fire gets hot and hot air rises and cooler air comes in. You can see the turbulence. Almost like a dust devil type thing. You will see the fire spin up. Im assuming, kenny this is along the creek. It is. Im looking at that time map, bill. This is the exact same area where we had a big fire a couple years ago that burned along Lake Berryessa. Remember, horses were being evacuated. Very scary for people who lived on those ranches, and here we go, the exact same area. A different weather environment. The prevailing winds arent hammering too bad, but they will. Right now the humidity is definitely low, the temperatures are high. You are not seeing much green. Theres an air drop there. I was just thinking that we hadnt seen that, but finally we have. And there were some marks. You can see the orange residue on the ground from earlier drops. This illustrates, too, kenny, we had a fire the other day, and its like a flash fire. This is that wild oak. Thats the creek going up to the dam to the left, i think. You are not seeing trees engaged yet, and thats because well, two fires. Theres a second fire. That looks like its down toward vacaville. Were going to have to check on that one. That one is interesting as well. When you see the smoke plume laying down thats a function of wind but also of the High Pressure sinking. Whats happening youve got very dry brush. In the first fire youre not seeing the oak trees engaged in the fire. Thats when you start getting in trouble, when you start getting trees. Right now this stuff is flashing underneath the fuel. So its not burning that hot yet. I mean, when i look at fires, even this one, im looking at a field on fire. Its moving quickly. It can be put out generally pretty quickly. But when you start bringing trees into the mix and more topography, then you get into trouble. This is not a surprise. This is how it is going to be. I mentioned it last night. When it gets up to 98 degrees, 100 degrees, we will start seeing fires. Its a. 75 correlation. You are going to get fires on these hot days this time of year. A beautiful shot there. No fog at the coast. Thats how you also know it is pretty warm out there. When the fog is not present, you have got temperatures that are getting up there. So the warming trend continues. That creek fire, theres a lot of traffic that comes out of Lake Berryessa, and theyre dragging boats up and down that road, and it is not hard they use chains for these trailers.
