Back to the desk. All right happening today, as we mentioned people in santa rosa are organizing a huge march for andy lopez. He is the 13yearold boy shot and killed by a Sonoma County sheriffs deputy. Ktvu channel 2 reporter aleck savage there at the memorial for andy lopez and alex we understand that groups from outside the area now planning to take part today. Reporter yeah we did just learn that occupy oakland is in fact planning to bus people from the plaza up here to santa rosa to take part in the large march later on today in the area. Theres a growing sense of frustration in the community over the shooting of lopez which happened right here in the field. And you can see a memorial is growing in this area. Hundreds are expected to march later on today to protest this deadly shooting of the 13year old boy by a Sonoma County sheriffs deputy. At about noon the march will wind up at the Sonoma CountySheriffs Department offices on ventura avenue. Now county offices, city hall, and the courthouse will all close at lunchtime in response to what is expected to be the largest demonstration yet over last weeks shooting. The middle School Student was shot seven times by a sheriffs deputy. And the Department Says lopez was holding an air soft gun. A replica weapon that resembled the ak47 and that he failed to put down the gun. 48yearold Erick Gelhaus is a 24 year veteran of the department. According to his Linkedin Profile hes an iraq war veteran and was also a weapons instructor. One of the organizers of todays march says the deputy was too quick to pull the trigger. I think the community here is tired of being you know somewhat persecuted. Always feeling that theyre suspicious in some way. Reporter Santa Rosa Police are investigating the deputy involved shooting and so is the fbi. A post on the justice for andy Lopez Facebook page is encouraging students here in santa rosa to skip out on class to take part in the event but the superintendent is trying to discourage students from doing that. And trying the get them the stay in school. In the meantime we did speak with lopezs father. Ktvu his father is telling ktvu that he wants justice for his son and he believes that criminal charges are warranted against the deputy involved in this shooting. Live this morning in santa rosa. Yesterday, celebrity chef guy fieri testified he never gave wade permission to take his car. Wade is accused of stealing his lamborghini. Out of a San Francisco dealership in 2011. He said several people reported they saw that car after it was stolen. People would call and wed get reports and my attorney would hear about it. Well to come find out you know that he was driving it . Brave kid. The prosecutors said wade stole the car to impress a girl and when the girl rejected him, he fired shots at her and her boyfriend in mill valley. The chef says he decided to get rid of that car. A troupe of campers protesting a new plan to close the parks overnight. Well they have now gone home but the protests are not over. Christian captain joins us now from city hall where the protestors are set to meet again later today. Christian . Reporter yeah, that initial protest that overnight protest at dolores park now over. We were there last now and now moved to city hall. Protestors plan on coming here 12 30 today. Theyre going home and getting rest and preparing for the rest of the days activities. We have some video of the overnight protest breaking down overnight. This morning, the protestors began showing up last night to raise awareness about a new plan that they oppose. Supervisor scott wiener pitched a plan to close city parks between midnight and 5 00 a. M. And the two dozen or so campers that were out this morning said the plan would essentially criminalize being poor. Now supervisor wiener says closing the parks would give the Police Another tool to fight quality of life crimes like Illegal Dumping and vandalism. Right now, i have just an enormous amount of vandalism and dumping that happens in the park. The cost that costs the park departments more than 1 million a year and that happens almost exclusively in the middle of the night. Both vandalism and dumping as well as sleeping in our parks are already illegal. What this would do is really give the police and rangers extra agency to be in the parks. Disgraced former sap that clara county supervisor George Shirakawa has been indicted by a criminal grand jury. The indictment is tied to allegations of a political dirty trick three years ago. Investigators say shirakawa impersonated a San Jose CityCouncil Candidate on bogus mailers that linked her to the communist government in vietnam. Shirakawa resigned in march due to another scandal. He was accused of stealing public money and Campaign Donations to pay for his alleged gambling habit. A federal judge is ruling that former alameda fire chief dave kapler has to pay the citys legal costs in his termination lawsuit. In september of 2010 he was fired after he was photographed using a city gasoline pump to fuel up his bmw. Kapler appealed the citys decision but last year, it was upheld by a state Appeals Court. On friday the judge ruled that kapler has to pay the more than 260,000 the city spent during that appeals process. That fire started yesterday afternoon in a residential building on valencia street. Fire crews had to help people escape but luckily no one was hurt eight people though are now without a place to live and a Pilates Studio was also damaged. A San Francisco judge a restricting the driver privileges for the gardener accused of a deadly hit and run at holly park. 58yearold thomas burnoski appeared in court yesterday. The judge says that he is only allowed to drive when he is taking his children to school or to find work. Burnoski has been suspended without pay from his job at wrecken parks. He is accused of running over and killing christina have they are my. Very lucky to be alive and he says his cell phone has to be thanked. Thats because that cell phone stopped the bullet fired at that clerk during a robbery yesterday morning. The clerk had no idea hed been shot until he felt a pain in his chest. The suspect who was wounded in Sundays Police shooting in San Franciscos Marina District may be formally charged today. Police say they were forced to open fire on the gunman after he beat and shot another person at chestnut and pierce streets. The ktvu news learned the name of the man wounded in this shooting is navares mobo jr. Hes in Critical Condition at San Francisco general hospital. The woman accused in a deadly drunk driving crash in menlo park killed a couple walking their dog is expected to be in court today. Reporter yeah pam ronald reitzell says his sister marge yee has been dealing with in issues and it spiraled out of control since the death of their mother last year. Now Marjorie Reitzell was supposed to be in court yesterday but it was postponed because of an undisclosed medical condition. She is expected to appear in court today. She is accused of drunkenly driving her car and killing the couple balbir singh and his wife kamal last thursday. The District Attorney says she was driving with a blood alcohol level well above the legal limit of. 08. We spoke with her brother who offered his deep condolences to the family but because of her Mental Health issues marjorie doesnt remember the incident. I think its going to take its toll on her. Once it sets in right because right now she doesnt realize what she did. I just visited her yesterday and she didnt realize she still dont believe she killed nobody. Reporter she has had several runins with the law dating back to 1984. Last year she pleaded no contest to drunk driving but had undergone a Substance Abuse program and was allowed to drive again. Past convictions also include possessing Drug Paraphernalia and driving without a license. As for members of the family they didnt want to speak to the media yesterday. Family members say 79yearold Scotty Morris was last seen monday afternoon leaving his home on raulston avenue. His wife thinks he went for a walk several blocks from their home. We are getting more details now about the case of a Castro Valley nursing home where 14 people were found abandoned. Yesterday, we got a look inside that home. On saturday the people were removed by paramedics after someone called for an ambulance. And there were just three Staff Members there on duty. The owners Attorney Says that she had spent more than 100,000 fixing up the nursing home. She says she was fixing deficiencies found by state inspectors. Her Attorney Says the patientser not abandoned and that a staff of three is adequate. Time now 6 40. The price tag to build a new San Francisco arena for the warriors keeps going up. The San Francisco chronicle says the cost to rehab the aging waterfront piers where the arya would be built could be as much as 170 million. Thats about 70 million more than planned. The team is also facing a shrinking time frame to get the arena project approved and built in time for the 2017 nba season. Thats when its lease at oracle arena in oakland runs out. A bay area apartment complex has caught the eye of the department of justice and its being sued. It all has to do with allowing kids to play on the property. Ktvus janine de la vega joining us live from fremont now with all the details. Whats going on janine . Reporter i put in a call to the department of justice for more information but heres what we know. The department of justice is saying that the owners of the woodland apartment complex is being discriminatory towards some of the tenants here because theyre not allowing the kids to play in the grass at the complex. The department of justice filed a lawsuit against the owners and operators of the woodland Garden Apartments alleging they discriminated against families with children. The suit says they prohibited kids from playing in the common grassy areas of the complex which is in violation of the fair housing act. The lawsuit arose because five families with children filed complaints with the department of housing and urban development. Several Online Reviews by former tenants say management of the complex was threatening eviction if kids continued the play in the gas to play in the grass and instead suggests parents take their kids to a park. Now the suit seeks a civil penalty, monetary damages for the families as well as a Court Order Barring future discrimination by woodland garten apartments. Strike one week ago. The results are expects late friday night expected late friday night or early saturday morning. The board of directors would then decide if they will ratify the new contract. Both sides are expected to approve that deal. More than 120 new bike racks, theyve been added to the North Berkeley b. A. R. T. Station. And b. A. R. T. Says more bike racks will be installed at the lake merit station in oakland in the next two weeks. B. A. R. T. Police say these racks are more secure than the standard poles. Later today, San Franciscos supervisor wiener will call for a new tax on sugary drinks. Now he wants to raise the price of sodas and other sweet drinks by two cents an ounce. So a 12ounce bottle or can would cost 24 cents more. Wiener says the money raised will pay for health and nutrition programs for kids and teenagers. The San Francisco supervisors are expected to approve this proposal. But it would still need the voter approval as well. Also starting today, Santa Cruz Police will crack down on halloween partiers.
