Happening today, state officials will ask a judge for an injunction that would bar any b. A. R. T. Strike or lackout for the next 60 days. This mornings hearing comes after Union Negotiators and b. A. R. T. Management failed to reach a deal last night. This rare hearing is set to get underway in just about two hours. Alex savage live where the proceeding will be held. Reporter this unusual Court Hearing gets underway two hours from now here at the Civic Center Courthouse in San Fransisco. A superior court judge will be ruling on this petition that was filed last week by Governor Brown asking for an injunction to essentially block any strike or lockout for the next 60 days by b. A. R. T. s union employees. In essence the governor is asking for a cooling off period for the next two months. The judge could deny the he could deny the governors request although observers dont believe thats likely. The law requires the judge to grant a cooling off period if a strike would significantly impact or disrupt Public Transportation service which both sides agree would be the case. Meantime b. A. R. T. Management and three employee unions are continuing to bargain this weekend trying to get a deal done, hammered out by midnight tonight, but the two sides are not talking face toface at this point. Theyre only passing proposals back and forth through a mediator, and they remain very far apart on the key issues of pay and benefits. Our team united have done everything we can to get that deal. Were going to continue to do that. Were going to look at the numbers we get tomorrow. Were going to weigh it out versus the proposal we receive this evening and keep pushing. You just want to look at things, just see where it goes. Now b. A. R. T. Representatives and Union Representatives are planning to resume their negotiations at 1 00 this afternoon back in downtown oakland. Of course everyone involved will be keeping a close eye on the outcome of this mornings Court Hearing here in San Fransisco to see if the governor will be able to order that 60day cooling off period and put off a b. A. R. T. Strike for another two months. Todays Court Hearing will be a first here. The Civic Center Courthouse has never before opened on a weekend ever since its never opened before for a weekend hearing since it opened in 1998. Offered a 9 raise over four years compared to the unions demand of a 15 raise over three years. B. A. R. T. Would have employees contribute 2 to their pensions in the first year with increases after that. The unions want a point 5 contribution. The union wants to limit employee contributions to 5 increases each year over the current contribution. While it appears trains will be running tomorrow b. A. R. T. Riders tell us their patience is running thin. Come on. I meantimes up. Its time for them to come to an agreement. They just to pound it out in my opinion, get to the bargaining table, pound it out. New this morning, two teenagers have died and three are in the hospital after an overnight car crash in san jose. Police say it happened around midnight. Five people were riding in a ford contour, the male passengers inside were all 17 to 19 years old. Police say the car lost control, went on top of the median and then hit a tree. We have an Accident Reconstruction Team at the scene, and they will do a complete investigation to determine the manner and circumstances surrounding the accident. Two of the passengers are expected to survive. The third passenger who is still alive remains in critical condition. So far the cause of that crash is unknown. Now to the developing story of the california teenager who was the subject of that nationwide amber alert. 16yearold Hannah Anderson should be reunited with her dad at an Ohio Hospital today. The week long ordeal ended late yesterday afternoon when the fbi shot and killed her alleged kidnapper, 40yearold james lee dimaggio. A helicopter spotted dimaggio and anderson in the dense woods. Officers hiked 2. 5 miles to the camp site before an fbi tactical agent gunned him down. This was a homicide suspect in a rug area and we had a 16 yearold girl we wanted to bring home safely. We wanted her home and thats exactly what happened. Investigators believe dimaggio killed hannahs mother and younger brother and torched their San Diego County home before before taking off with the teen. We are going to have a live update on hannahs condition and the fbi rescue. Evacuation orders remain in effect for some residents near the silver fire. They first sparked on wednesday. The wildfire has burned 30 square miles and 26 homes. Ten firefighters have been injured. Fire crews say it is 70 contained and expect to have it fully contained by the end of the weekend. Im grateful. Im so grateful. It couldnt look any worse than what europe looked like when i was a kid, world war ii, the bombing. At its peak, the fire forced 1800 people to evacuate. On friday Governor Brown declared a state of emergency for the area, even freed up additional funds and resources for the firefight and recovery. Dozens of people came together for a prayer vigil in east haven connecticut last night to honor the four People Killed in fridays plane crash. The pilot has been identified as bill heninsgard. He was flying with his teenage son when their plane crashed, a 13yearold girl and her 1year old sister inside one of the homes were killed. Classmates of the young girl say theyre devastated. Its hard, i cant believe this happened. Its horrible. I wish she was here for another minute so i can like say hi to her. Investigators say the pilot was trying to land at a nearby airport, and the cause of that crash is under investigation. Logan stevenson, the 2year old toddler from pennsylvania who died two days after serving as best man in his fortunates wedding has been laid to rest. He was born with a rare genetic disorder. Last weekend his parents celebrated their wedding early after being told stevenson didnt have much longer to live. He died in his mothers arms monday night. It was the most beautiful thing i ever seen because i brought him into this world, and i watched my son leave. Logans funeral was held yesterday, attended by about 75 friends and family. His grandmother says its hard to understand a child dying so young, said that logan had a very big impact on everyone who knew him. The garage was shut down while police investigated. Investigators do not suspect foul play. A man hunt for an accused killer and kidnapper is over. His alleged teenage victim is safe this morning looking forward to reuniting with her father. An update on the Daring Rescue of 16yearold Hannah Anderson. Dominick. Good morning mike, yes, we are expecting Brett Anderson, the father of hannah to reach idaho at some point this morning where hell be reunited with his daughter after a traumatic and dramatic week. She was kidnapped back on sunday by a man named james dimaggio. He was a family friend. He killed her mother and 8year old brother and the circumstances which are still not quite clear. They vanished and were tracked down to the wilderness in idaho about 30 miles east of the tiny town of cascade. There underwent an extraordinary operation. Two fbi Tactical Teams dropped by airplane. They had to hike for two and a half hours to get into position before they could actually confront dimaggio. When they did they shot him dead. 16yearold hannah was found not just alive but apparently unharmed says the fbi. She at the moment is in the hospital we believe in boise where shes undergoing physical and psychological evaluation. We understand that physically if shes okay the issues may be psychological. It depends what specifically shes been through. The Authorities Say she fared pretty well, thats very good news. Her father very very upset by what happened to his wife and his son and has been absolutely frantic about what was challenge to his daughter. He had been working in nashville at the time. He was a little out of the loop he only heard moments after what precisely had been going on. Friend of the family and the rest of the relatives expressing just how much relief there is at this news. Take a listen. I cant even cry anymore im so happy. I really am. I want to cry because im so happy, and i dont have any tears left. Me either. Its been a hard week. And news of the reunion should come out later on today between hannah and brett. We know that they have to prepare for the funerals and thats going to be a lot for both of them to take on board, totally unclear at this time whether hannah knows whether her mother and brother are indeed dead and that is going to have a tough impact on her if she doesnt know at all. Four gang members have been arrest in connection with a driveby shooting that injured 15yearold boy. That shooting happened around 1 30 yesterday morning on murray street near sea bright avenue. The victim was airlift today a Trauma Center for surgery. So far there is no word on his condition. Police say they chased a car seen speeding away from the the shooing after using a spike strip to stop the car, all four suspects were arrested. Oakland police say about 100 guns were turned in during a buy back program. It was held yesterday on macarthur boulevard in east oakland. Gun owners were paid 100 for each gun and 200 for each assault weapon. No questions asked. One young person says she hopes the buyback will help end Violent Crimes in her community. Shouldnt be 13yearolds, 15yearolds shooting each other. That shouldnt be happening. Theres something wrong with it and theyre not getting the guns from nowhere. I think this gun buyback is good. Organizers passed out about 10,000 in exchange for those weapons. The murder trial of a 79 yearold accused serial killer is dom an end. Joseph naso is representing himself in the trial in marin county. He did not take the stand. Hes accused of killing four women in the 1970s and 90s. Prosecutors are scheduled to make their closing arguments on wednesday. A Research Project could helps tension between occupy the farm protesters and the university of california. The university has invited 40 people, including demonstrators to take part in an experiment in urban farming at the guild track in albany. The university owned land has been at the center of a long dispute. Supporters hope the project will help build a better relationship between the university and the community. Theres been a lot of tension about the access to this land, and i think this is a positive step. The urban farming Research Project will continue for the next four months. Protesters have not backed down from their post outside the Downtown Berkeley post office, and their message remains the same. We shall not be moved. We shall not be moved. About two dozen people have been camped out outside that Historic Building on allston way for two weeks. They want to stop the sale of the 99yearold building. Demonstrators say theyve received multiple warnings from postal inspectors to pack up and leave. Theyre trying to sell it off. Theyre trying to sell this one off because its a Historic Building with a lot of value in a downtown area. Big money. The Postal Service says even if the building is sold its hoping to rent back part of the building to use as a post office. Hundreds of other locations across the nation have also been marked for possible closure. We have a happy ending to a story we told you about, a partially paralyzed dog in richmond who had his wheelchair stowen. This is smoocher and on friday someone stole his wheelchair from outside his caregivers home. A woman named Sandra Gordon contacted her caregiver to say she a dog wheelchair she wanted to donate. She lost her own dog to a spinal cord disease earlier this week, and after seeing our story about smoocher knew what she had to do. I had an incredibly special dog and he continues to affect people and change peoples lives after hes left me. Gordon says it all seemed meant to be and that the wheelchair did not even need to be adjusted. As for smoocher he was especially glad to be back on wheels. A spectacular light show will take place tonight in the sky. The appears yet meteor shower is one of the most anticipated celestial events of the year. People can see some 70 meteors an hour. Good morning and this is the first time there will be a weekend hearing, a hearing on a weekend here at the courthouse in San Fransisco since the place opened in 1998. Theres a sense of urgency here today with a strike deadline looming tonight at midnight. About an hour and a half from right now the superior court judge will be ruling on this petition filed by governor jerry brown asking for that 60 day cooling off period in the ongoing b. A. R. T. Labor negotiations, what have been very bitter labor negotiations. The judge in this case is judge curtis karno. It has been one month since 21monthold daphney webb of oakland was reported missing by her father. He says he left her in a parked car on 79th avenue along with his mother while he ran into a store. He says when he got back daphney was gone. Daphneys grandfather says the family Still Believes she will be found safe. Were just trying to keep everybody aware. Its been a month, which makes this harder and harder for us to deal with. Family members have set up a web site, find baby daphne. Com in the hopes of locating her. We may have to wait until tomorrow to learn if a body found in vacaville is that of missing oakland woman sandra coke. Crews found the remains near lagoon family park. Coke was reportedly seen one week ago. Oakland police have identified randy ilana as a person of interest in the case. The two dated briefly 20 years ago and he had recently reappeared in her life. Search crews in the sierra recovered whats believed to be the body of a missing hiker. 65yearold john nie daniel was reported missing on thursday. The National Park service says it is suspending its search for daniel until the body is identified. A group of tourist got a little more than they paid for. The tour bus they were traveling on caught fire. It happened after 6 p. M. Last night. The fire started in the engine compartment. If i recalls say the paige Officials Say the passengers were quickly evacuated and no one was injured. A peaceful horse and buggy outing suddenly turned into a wild ride in petaluma. It happened during a family get together on East Washington way. A man was giving an 11yearold girl a ride when the horse got spooked and took off running. The carriage hit a street sign and the driver was thrown from the buggy after it crashed into a pickup truck. Approaching eastbound pickup truck saw what was happening and stopped in the roadway thankfully. The horse at the last minute darted in front of his truck and the carriage collided with the front end, injuring the 11 yearold that was in the backseat. Police say the horse wreck free after collide broke free after colliding into the truck but was not far away when they caught him. That 11yearold suffered minor injuries. People in colorado are cleaning up this morning afterred flooding and mud slides made a mess of their communities. In El Paso County volunteers used shovels and wheel barrels to try to get rid of the mud and water. The flooding is in the same location where the waldo fire broke out last year. The ground is especially vulnerable to flooding because the soil absorbs less water. We are hoping well be spared for the next round of possibility, flooding possibility, but were going to have to get this finished and then kind of assess. A 53yearold man was killed in the flooding. Three other people are still missing. Nearly a year after Superstorm Sandy devastated parts of the east coast, new jerseys famous Seaside Heights casino pier is back open. The mile long walkway and rides were destroyed my the storm, including the jet star roller coaster that plunged into the ocean when sandy hit. It has been replaced by a new ride called the super storm. Business openers are hoping for a strong finish to what they say has been a issue have difficult summer. Hopefully we can put a couple back to back weeks together and finish on a positive note and turn around for 2014 and come back bigger and be better. 300 feet of boardwalk needs to be repaired. Officials say they plan to keep a few pieces of the jet star roller coaster in hopes of using them to build a memorial. Another effect of Hurricane Sandy is being felt. The vehicle Records Company carfax says about 212,000 vehicles flooded by sandy are out there on the roadway. Many of them were submerged in the storm, dried out and sold at used car lots. The dispute happened last month at boomers, the Contra Costa Times reports four cousins were told they could not ride unless they remove their turbans. A San Fransisco resident battling aids says he may get evicted evicted from his home and his friends are taking action. A group of activists rallied at the Tenants Union on cap street for renter jeremy michaels. My calls has lived in his rent controlled apartment for 18 years. Last september his landlord served him with an ellis act eviction giving him one year to move out. For me to move to any other place i wouldnt be able to afford living in the city. Im pretty much fighting to stay in my rent controlled apartment and to stay close to my doctors who have kept me alive this long. Reporter and this is a critical Court Hearing. In this case a judge has the power essentially to make sure that b. A. R. T. Trains will continue to run for the next couple of months. He will be deciding on questions from the governor for a 60 day cooling off period. Theres a sense of urgency here. This will be the first time that a Court Hearing has been held on a weekend here at the Civic Center Courthouse in San Fransisco. The hearing starts just an hour from right now, and in essence the judge will be deciding on this cooling off period. The governor requested this earlier in the week. Superior court judge Curtis Karnow will rule on this petition filed by the governor. Observers believe the judge is likely to grant an injunction preventing a strike or lockout for 60 days. The law requires the judge to grant this cooling off period if he believes that a strike would significantly disrupt Public Transportation service and both sides agree that would certainly be the case. Meantime b. A. R. T. Management and three employee unions are still hoping to hammer out a deal by midnight tonight. They negotiated until midnight last night in oakland. But the two sides are not talking facetoface at this point. Theyre only passing proposals back and forth through a mediator and they still remain tens of millions of dollars apart on those key issues of pay and benefits. New this morning, two teenagers have died and three are in the hospital after an overnight car crash in san jose. Police say it happened around midnight off smell and chenoweth avenues. They say five people were riding in a ford contour. The driver of that car lost control, went on top of the median and then hit a tree. We have an Accident Reconstruction Team at the scene, and they will do a complete investigation to determine the manner and circumstances surrounding the accident. Two of the passengers are expected to survive. The third passenger who is still alive remains in critical condition. So far the exact cause of that crash is not known. A california teenager who was the subject of that nationwide amber alert is safe this morning. 16yearold Hannah Anderson should be reutility united with her father at an idaho hospital. The fbi shot and killed her alleged kidnapper, 40yearold james lee dimaggio. A helicopter first spotted dimaggio and anderson in the dense woods. Officers then hiked 2. 5 miles to the pairs camp site before an fbi tactical agent gunned him down. This is a homicide suspect that was in a very rugged area, and we had a 16yearold girl who we wanted to bring home safely. Thats what we wanted. We wanted her home and thats what happened. Investigators say they believe dimaggio killed hannahs mother and younger brother and torched their San Diego County home last sunday before taking off with the team. It is a bittersweet time for hannahs family. While they are relieved she was found alive, they are still coping with the loss of hannahs mother and younger brother. Now we have to focus on burying my daughter and my grandson who was murdered, and thats something that will take a long time to deal with, but the positive note is hannah coming home. Hannahs family feared that dimaggio was eventually planning to kill himself and hannah. They say yesterday was the anniversary of dimaggios fathers suicide. He died after setting his own home on fire. Coming up at 8 35 were going to have a live update from idaho with more on the rescue mission and hannahs condition. Evacuate orders remain in effect for residents near the silver fire. The flames sparked up on wednesday in the mountains east of los angeles. The wildfire has burned 30 square miles and 26 homes. Ten firefighters have been injured. Fire crews say its 70 contained and expect to have it fully contained by the end of the week. At its peak that fire forced 1800 people to evacuate. Dozens of people came together for a prayer vigil in east haven connecticut last night to honor the four People Killed in fridays plane crash. He was flying with his teenage son when their plane crashed into two homes, a 13yearold girl and her 1yearold sister inside one of those homes were also killed. His parents celebrated their wedding early after being told logan did not have long to live. In canada two Young Brothers strangled by a snake were buried together in a casket. They say a 15foot python escaped its enclosure from an exotic pet store located below the apartment they were in. It happened around 1 30 yesterday afternoon on murray street near sea bright avenue. The victim was airlift today a Trauma Center for surgery. So far there is no word on his condition. Police say they chased a car seen speeding away from that shooting after using a spike strip to stop the car. All four suspects were arrested. Police say they are all confirmed gang members from watsonville. Oakland police say 100 guns were turned in during a gun buyback program. It was held yesterday on macarthur boulevard in east oakland. Fun owners were paid 100 for each gun and 200 for each assault weapon. One young person at the even hopes the buyback will help end Violent Crimes in her community. Yesterday a woman named Sandra Gordon contacted smoochers caregiver to say she had a dog wheelchair she wanted to donate. She said she lost her own dog to spinal cord disease this week and after seeing our story about smoocher she knew what she had to do. I had an incredibly special dog and he continues to affect people and change peoples lives after hes left me. Gordon says it all seemed meant to be and that the wheelchair did not even need to be adjusted. As for smoocher, his owner says he was especially glad to be back on those two wheels. He looks happy. In essence a superior court judge will be decided whether to green light a 60day cooling off period in the contentious b. A. R. T. Labor negotiations. That would mean no strike or lockout during that period of time. This will be the first time the Civic Center Courthouse has actually opened up on a weekend for a hearing since it opened back in 1998. You get a sense of the feeling of urgency there is here today. Superior court judge karnow will rule on a petition filed by Governor Brown. He wants to block a strike or lockout by b. A. R. T. Workers for 60 days. Observers believe the judge is likely to grant that injunction because really theres no one opposing the request at this time. In addition the law requires a judge to grant acology off period if he believes the strike would significantly disrupt Public Transportation service and both sides agree that would be the case. B. A. R. T. Management and the three employee unions are hoping to still hammer out a deal by sunday at midnight. They negotiated until midnight last night in oakland but the two sides at this point are not talking facetoface. Theyre only passing proposals back and forth through a mediator. Were here today to try and get a deal. Were not looking that far in advance. Were looking to today. Thats why were here today, thats why well be here tomorrow, to get a deal for our members and get our health and safety precautions in place so our riders will be safe on the system. The two sides remain very far apart, tens of millions of dollars apart on issues of pay and benefits. Representatives are planning to resume their negotiations at 1 00 this afternoon back in oakland. Of course first comes this all important Court Hearing in front of a judge here in San Fransisco. It gets underway at 9 00 this morning. We will be inside and monitor whats going on inside there. Im told that a ruling from the judge could happen during the hearing itself this morning, or he may issue his ruling at some point later on today. Search crews in the sierra recovered what is believed to be the body of a missing hiker from san rafael, 65yearold Johnnie Jean Daniel was reported missing thursday. Yesterday searchers found a body about 1,000 feet above monarch lake. The park service says its suspending its search until the body is identified. A peaceful horse and buggy outing turned into a wild ride in petaluma. It happened around noon during a family get together on East Washington way. Police say a man was giving an 11yearold girl a ride when the horse got spooked and took off running. The carriage hit a street sign and the driver was thrown from the buggy after it crashed into a pick whereupon truck. The pickup truck saw what was happening and stopped in the roadway. The horse at the last minute darted in front of his truck and the carriage collided with the front end injuring the 11 yearold that was in the pack seat. Police say the horse broke free after colliding into the truck but was caught not far away. Again, the 11yearold suffered minor injuries. It has been one month since 21 monthold daphney web of oakland was reported missing by her father. Anthony webb said he left her in a parked car along with his mother who suffers from dementia. Nearly a year after Superstorm Sandy devastated parts of the east coast, new jerseys famous Seaside Heights casino pier is back open. That mile long walkway and rides were destroyed by the storm, and that includes the jet star roller coaster that plunged into the ocean. Thats when the storm hit has now been replaced by a new ride called the super storm. About 300 feet of boardwalk does need to be repaired. They say they plan to keep a few pieces of the jet star roller coaster in hopes of using them to build a memorial. Another effect of Hurricane Sandy is being felt. New this morning, two teenagers have died and three are in the hospital after the overnight car crash or car chase in san jose. It happened around midnight. And they say that five people were riding in a ford contour. The male passengers were 17 to 19 years old. Police say that the car lost control, went on top of the median and then hit a tree. We have a Reconstruction Team at the team and they will do a complete investigation to determine the circumstances surrounding the accident. Two of the passengers are expected to survive. The third passenger who is still alive remains in critical condition. So far the cause of that crash is not known. A california teenager who was the subject of the nationwide amber alert is safe this morning. 16yearold Hannah Anderson should be reunited with her father at an idaho hospital today. Her week long ordeal ended late yesterday afternoon when the fbi shot and killed her alleged kidnapper 40yearold james lee dimaggio. Helicopter first spotted them in the dense woods. Officers hiked 2. 5 miles to the camp site for an fbi tactical agent shot him. Reporters talked to her family about the relief and the bittersweet emotions they are experiencing this morning. I thank you. And she is coming home. Now we need to focus on burying my daughter and my grandson who was murdered. And that is something that will take a long time to deal with. But the positive note is hannah coming home. Reporter hugs and tears as the family of Hannah Anderson learn their granddaughter is safe. And most wonderful feeling i think that i have ever felt except for the birth of my daughter. Reporter the news bittersweet after a day of the home that she shared with her mother and little brother, both murdered by her kidnapper, james lee dimaggio. Its the most horrible thing you could ever imagine happening. Reporter they dont want hannah to ever have to return to that home and all the memories she shared with her mom and 8yearold ethan. No matter what they were doing they were together always. And its going to be a tragic thing for her to have to live through. Reporter hannah is in an idaho hospital under evaluation. Her father, Brett Anderson in route there now to bring her back home. A reunion that they fear will only make this tragedy even more painful. Im here for her. And hannahs family said that yesterday was the anniversary of dimaggios father committing suicide. They were worried he would observe it by killing himself and hannah. Evacuation orders remain in effect for some residents living near the silver fire. The flames first sparked up on wednesday in the mountains east of los angeles. The wildfire has burned 30 square miles and 26 homes. 10 firefighters have been injured. Fire crews say it is now 70 contained and expected to have it fully contain by the end of the contained by the end of the weekend. Im grateful. And during this hearing, the judge said essentially that the bart strike of any kind, they would have a Significant Impact on the ridership and would obviously hurt the Public Safety and the welfare in general and that is a part of the reason that he said it today or indicated that he would sign the order authorizing the 60day cooling off period. The superior court judge was considering a request for the governor for the 610day cooling off period. Now once they sign the order, which they say they will, the employee unions would not be able to strike for the next two months and the order is expected to be issued later today. They were represented at this hearing by the members of the attorney generals office. And there were also attorneys representing bart employee unions. And now no one opposed this request for the governor. That they will require the judge for granting off the period here for them or distract the Public Transportation service. They believe that would be the case. Now, after the hearing, a member of the board of directors weighed in on the judges decision. Well be placing pressure on continuations of the negotiations in the hopes of reaching a settlement that is considered not only of the needs of our workers to have a wage and to benefit the package, but as well as the riders, taxpayers and the public. Reporter in the meantime bart management and three employee unions involved in this dispute are still trying to work out a deal as they negotiated until midnight last night.
