Tara moriarty is at the Police Station where weve learned just a few minutes ago, the teenager has was found safe. And tara joins us with exclusive video of the teenager arriving with officers. Good morning, tara. Reporter good morning. About a halfhour ago, we saw a couple of squad cars pull out of here very quickly. We wondered if perhaps they had found a teen and it turns out they did. A happy ending to this story. Tyler simmons has been found. We saw him walking to the station a few minutes ago with an officer. He liked perfectly fine. His parents three minutes ago came and picked him up. He was sleeping on san carlos avenue, spotted by somebody. He woke up by the time police arrived. They were able to locate him. But tyler edwards, found safe. His parents were very concerned about finding him. But were happy to report that this student has, indeed, been found this morning. The public viewing for tommy smith begins tonight at the chapel of the chimes on mission boulevard. The funeral will begin at 10 00 a. M. Tomorrow in Castro Valley. That service will be at the Neighborhood Church of Castro Valley on john drive. B. A. R. T. s police chief announced immediate policy changes as a result of last weeks tragic shooting. Sergeant smith was killed as he and other several officers searched a dublin apartment for a robbery suspect. Yesterday, kenny rainey announced b. A. R. T. Officers will need written approval for any future probation searches. He said the lack of Police Training played a role in this tragedy. We can train the people every day and have them perform on the field. On the off days Something Like this could go wrong. The police chief confirmed for the first time. It was officer michael maes who fired the deadly shot that killed Sergeant Smith. The chief would not confirm reports that maes mistook Sergeant Smith for an armed suspect during a search of the apartment. Officer michael maes will be among the hundreds of people at tomorrows funeral for Sergeant Smith. One of officer maes brother talked about his brothers pain and sadness during this exclusive interview with ktvu news. Michael is very remorseful if you will and very sad. It happened last night on smith ranch road. Alex savidge joins us now with more on the crash and the investigation. Good morning, alex. Reporter good morning to you. Some neighbors believe the motorcyclist in this case was going way too fast when he lost control last night. Although San Rafael Police at this point cant say if speed was a factor in the crash. We know the man was thrown from his bike here on smith ranch road and he was found by officers lying here in the median last night. The man died here at the scene. The motorcyclist was the make i should say was found a good distance up the road from where the man was found. The accident was just after 7 30 last night. There were no other cars involved here. Police tell us the victim was a 43yearold man who lived here in san rafael and he was wearing a helmet when he crashed. Now, the speed limit on this street is 35 miles an hour. One neighbor told me some people drive 50, of 60 miles an hour. People drive like mainny acs on this road mayny acs maniacs on this road. Ive been been hit a couple of times. Reporter this was the third deadly crash. There was a pedestrian hit and killed by a car. In early january, someone was hit and killed by a dump truck near the downtown transit center. I asked police if there may be additional enforcement. They say its too soon to say if anything will be done. The San Rafael Police department will return to this crash scene on smith ranch road later on today to continue to investigate and trying to understand exactly why this motorcyclist lost control last night. San francisco is on the verge of becoming the next major u. S. City to approve a measure known as ban the box. Now, that law prohibits employers and lawmakers from asking applicants up front if they have ever been arrested or convicted of a felony. Exoffenders are often asked to check a box revealing their past troubles with the law. San francisco supervisors are expected to approve a ban the box measure in the city sometime this year. 7 10. In just about 90 minutes, the Sonoma County board of supervisors will discuss a new program for the homeless. It will allow them to sleep overnight in cars on Sonoma County fairgrounds property between february 1st and april 30th of this year. It would also provide up to 50,000 in Motel Vouchers for the homeless during severe Winter Weather. And Livermore City Council is considering a new proposal that targets the homeless. A First Reading of the proposal happened at last nights meeting. It would ban urban camping, the citys mayor says the goal is to clear encampments and get people into shelters. Critics say finding people and threatening them with jail time is not the solution. You can find people who have no money. I mean, thats laughable. So the next choice is, you are gonna put them in jail . Thats not the point. Its not the issue. It gives us the authority to remove encampments. That way protecting public health. Lets take a look at drive times. Highway 4, from lone tree to loverrage, four minutes. Not too bad. This is a look at the bay bridge toll plaza. Hastingss lawyer says the relationship was conseen ual. Prosecutors say the Police Officer poses a risk to everybody. Police officers take oaths to protect and because of that, and because of using and taking advantage of that its in my opinion that he is a risk to the community. Now, officer hastings was involved in another high profile case two years ago. He received a medal of valor for his response in the controversial shooting death of Kenneth Harding junior. Hastings and another San FranciscoPolice Officer exchanged gunfire with harding during a confrontation in the bayview district. Police say that harding shot himself in that exchange. 7 25. Legendary folk singer and social activist pete seeger died last night at a new york hospital. Seager was best seeger was best known for where have all of the flowers gone and if i have a hammer. There are changes to security at the college of marin after a man was sexually assaulted after leaving class last week. Brian flores is live to tell us about the changes. Reporter the kidnapping and Sexual Assault was reported in parking lot 13, which is about two or three blocks from where were standing. But since then, the campus has made changes to safety to make sure the students are safe. I want to go to new video. That photographer sid farhang shot of flour or five flood lots installed over the weekend in parking lot 13. Previous there are no lights. They are increasing the number of onduty campus Police Officering. Also in terms of the parking lot itself, the college also says it will now close it after 5 00 p. M. When it starts to get dark. This comes after a man was reportedly sexually assaulted and kidnapped while leaving class around 8 15 last thursday night. When the man got into his car at lot 13, another man was already in the back seat and ordered the victim to drive off campus to a location somewhere in southern marin. The suspect then sexually assaulted the man at gunpoint. Police say the victim was able to run away and was treated at nearby for injuries at a nearby hospital. We spoke with students this morning to get their reaction of what happened last week. Im really scared because i come to school on thursday, and i leave at 9 00. Ive taken previous classes before. I leave almost at the same time all of the time. So i feel pretty insecure. Reporter we have limited details on the suspect. Police are continuing to look for him. Hes described as a plaque male between 6 feet and 62 and 220 to 250 pound. We have calls into the Sheriffs Department of marin leading the investigation as well as School Officials. Weve not heard back yet. But we understand that a School Official is on his way to give us an update on the other changes that may be coming as a result of what happened last week. Thats after reports the girl was inappropriately touched on campus. The girls mother tells ktvu the alleged attack happened last week at east bay waldorf school. The mother says her daughter was pushed to the ground by one or more boys who took off her clothing and touched her. However, School Administrators tell ktvu that the boys pushed the girl to the ground but did not take off her clothing or have any inappropriate contact. The richmond Police Department says they are just starting the investigation. 7 35. Memorial Services Begin tonight for the b. A. R. T. Officer michael maes will be among the hundred of people at the funeral and one of maes brother discussed his sadness. Ooches he said his brother and Sergeant Smith were Close Friends and golfing buddies. He said the tragic accident is a nightmare for everyone connected to the b. A. R. T. Police force. John maes says family members have been staying with his brother to provide him support since the deadly shooting one week ago. 7 36. Its possible, you heard steve, we may get rain this week. However, bay area Water District, they are still worried about the drought. Today zlars Water District will meet and talk about santa claras Water District will meet and talk about a 10 voluntary reduction. Marin county supervisors will talk about what action they should take. They already have voluntary water restrictions in place. Ktvu has learned by the end of the week, San Franciscos expected to call for water use cutbacks. Other areas with voluntary restrictions, include Alameda County and santa cruz. People want to help in any way possible. I think it will be okay. Theres plenty of ways to save. Some of the Water Districts say they could put restrictions in place by the end of february. Today well find out more about the condition of bay area vineyards. A Napa Grape Growers Association will give an update on how the drought is impacting the area. It will also talk about what farmers are doing to prevent damage to the wine grapes. The city council is considering a plan to install smart meters downtown. Janine de la vega joins us from san jose to explain why this may happen and how high the rate could be. Good morning, janine. Reporter good morning, tori. Right now, it costs a dollar an hour if you park here downtown in one of these coinoperated meters. Its been that way since 2002, the price has not budged. If smart meters are not installed, the cost could go up to 2. The city is set to install solar meters in the downtown area. They are similar to these ones that you aring looing at that are looking at that were installed in walnut creek. This will allow users to increase time by using an app on their cell phone. They can receive an alert before it expires. The cost is 1. 3 million. To pay for it, the city may double the parking rate. We spoke to people who work downtown about what they thought. Theres too many things running our lives. Its another tracking device in our society. Thats why i dont like them. Its inconvenient to look for rains when we go to the market and park horn the street but to park on the street, but to raise the cost, i would like to see the cost go down. Reporter transportation Officials Say the current meter rate is significantly lower than other cities and the rates that are charged in san joses parking garages. City officials want the new meters because the current operators dont accept cards and have no reporting capabilities and are powered by batteries that need to be replaced. House Speaker John Boehner is encouraging his republican colleagues to approve a farm bill when it comes up for a vote tomorrow. The fiveyear farm bill would boost phone mor Crop Insurance and ease cuts to the food stamp program. Take a look at this video of the winter storm in ohio. Schools from eastern texas into the Florida Panhandle have canceled classes today before the freezing weather hits there. Flights have been canceled because of the freezing weather. The airline say the snow and ice on the east coast also causing a lot of delays. San jose mineta airport is pushing for more passengers to fly from their airport to Southern California instead of going to sfo and oakland. They have released this new ad which says why drive north to fly south . Police arrested the suspects yesterday after getting information from witnesses. The Twin Brothers are due in court tomorrow. Police in oakland are investigating a deadly shooting outside of a walgreens store in east oakland. It happened in the parking lot on high street near interstate 580 about 9 00 last night. Police are hoping to check Surveillance Video this morning to get clues for their investigation. A couple of minutes later, there was another shooting in oakland, just miles away on hide street near peralta hacienda historic park. The man was taken to a local hospital. Hes expected to be okay. So far no arrests have been made in either case. Were learning disturbing new information about the Pennsylvania College student from the bay area charged with possessing a weapon of mass dez trucks. The 18yearold is a russian citizen who graduated from Carlmont High School last year. Police say he admitted experimenting with explosives whilive willing here in the bay area. A San Francisco firefighter filed a legal claim accusing the Fire Department of defaming her in connection with the asiana plane crash at sfo. Take a look at the video from a firefighters helmet camera of the crews responding to that plane crash. In the claim, firefighter Elise Duckett said her name was released media. She was identified as the one who drove over a 16yearold girl and killed her. However, miss duckett said another firefighter struck the girl first. Duckett said shes being discriminated against because shes africanamerican and also a lesbian. 7 56. The San Francisco family has filed a wrongful death suit against uber for the death of a 6yearold girl killed in a Traffic Accident on new years eve. Sophia liu, her mother and brother were in the crosswalk at polk and ellis streets when investigators say they were hit by the driver. Sophias mother and drawer were hurt. The little girl was killed. The lawsuit said the driver was logged onto ubers app and was available to pick up passengers. Available for people to pick him as a driver which is the very essence of ubers business. Without those people having empty cars, uber has no business. Uber says since the driver was not carrying any passengers, he was not actually working for the company at the time of the accident. So far, the driver has not been charged. 7 57. The police in palo alto say if you have a rental car, be aware of breakins. At the fish market restaurant, this parking lot is a lot zone where the windows of nine cars were smashed in one night. Several of the vehicles were rental cars. Tara moriarty is at the belmont Police Station where you have exclusive video of the return of the teenager and, tara, you found out a ktvu viewer played a role in bringing him home safe. Reporter thats right. Good news all around. The officer said that the tip actually came from a ktvu viewer who saw our broadcast and decided to call police. The boy had apparently been wandering around all night so he was in a little bit of a shock. But otherwise pretty good shape. Tyler edmond simmons walked into the Police Station with an officer shortly before 7 00 this morning. Ten minutes later, his parents came by to pick him up. According to dispatch, he was sleeping somewhere on san carlos avenue near alameda right at the belmont border about a mile from Carlmont High School. Thats when the ktvu viewer saw him. He had been woken up he had woken up by the time police arrived. They looked around a little bit. They were able to find him. Hes 16 but only has the mental capacity of an 8yearold. He can be pretty antisocial. So his parents were quite concerned about finding him. Were happy to report that he has been found this morning. A nice ending to the story. Police officer who was accidentally killed by another officer one week ago. The public viewing for Sergeant Tommy smith begins at 7 00 at the chapel of the chimes on mission boulevard in hayward. The funeral re begins at 10 00 a. M. Tomorrow. That service is at the Neighborhood Church the Castro Valley on john drive. The police chief has announced changes. Sergeant smith was killed as he and other officers searched for a robbery suspect in a dublin apartment. Chief rainey says there will be need to be written approval for the search of suspects. We can train our people every other day and have them perform out on the field on the off days, and probably Something Like this could go wrong. The police chief confirmed for the first time it was officer michael maes who fired the deadly shot that killed Sergeant Smith. However, the chief would not confirm reports that officer maes mistook Sergeant Smith for an armed suspect during the search of the apartments. Officer michael maes will be among the hundreds of people at the funeral. One of maess brother discussed that and his pain during an interview with ktvu news. Police in san rafael investigating a deadly accident involving a man on a motorcycle. It happened last night on smith ranch road. Ktvus alex savidge here now with more on the crash and alex, the investigation is underway. Well, good morning. Some neighbors in this area reported seeing this motorcyclist speeding shortly before he lost control. San rafael police at this point are not saying if speed was a factor in last nights accident. The man was thrown from his bike as he was riding along this section of smith ranch road at about 7 30 or so last night. He was found right there in the median by officers who first arrived here on scene. The man died here at the crash scene. His motorcycle was found a good distance up the road. There were no other cars involved in this accident according to police. They say the victim was a 43 yearold man from here in san rafael. He was wearing a helmet at the time of the crash. The speed limit on this street is 35 but one neighbor told me some people drive 50 to 60 miles an hour. Its four lanes. People race each other and theres rarely any policemen out here enforcing the speed. Its dark. And its long. All of those things. Reporter this was the third deadly crash on city streets in san rafael. In middecember, a pedestrian was hit and killed by a car while crossing civic center drive. In early january, someone was hit and killed by a dump truck near the downtown transit center. An an officer i talked to morning couldnt say if there would be stepped up enforcement regarding these accidents. A San FranciscoPolice Officer charged with child molestation is due back in court in march. Officer Richard Hastings of concord needed not guilty in Contra Costa County court yesterday. Hes accused of molesting a 15 yearold boy last summer. Hastingss attorney said the relationship was consensual. But prosecutors say the officer poses a risk to everyone. Police officers take oaths to protect. Because of that and because of using and taking advantage of that its in my opinion that he is a risk to the community. Officer hastings was involved in a highprofile case two years ago and received a medal of valor for his response in the controversial shooting death of Kenneth Harding, junior. Hastings and another San FranciscoPolice Officer exchanged fire with harding in the citys bayview district. Police say harding shoot himself in that exchange. 8 26. Ktvus brian flores, live at the colleges kentfield campus to tell us how Campus Security is changing. Reporter the Sexual Assault and kipping was reported on parking lot 13. This is a temporary free parking lot that at the time didnt have any lights. Since that time, the college has made several upgrades to keep students safe. This comes after a man was reportedly sexually assaulted and kidnapped while leaving class around 8 15 on thursday night. According to marin county sheriffs when the male student got into his car at lot 13, another man was already in the back seat and ordered the victim to drive off campus to another location somewhere in southern marin. The suspect sexually assaulted the man at gunpoint. Police say the victim was able to run away and was treated at a nearby hospital for injuries. Now, since then, the campus has made security upgrades including installing five flood lights in parking lot 13. These will be removed because officials said a new gate will be going up starting today. They have added more campus Police Officers as well. But the installation of the gate will come in conjunction with new hours for the lot as well. That was in lieu of putting up a gate. That will go up today. Once the gate goes up, well be able to take the flood lights down mainly for the benefits of the neighbors behind us. Theyve never had lights like that in the parking lot. Thats why were trying to close the lights before it gets dark. Reporter we have limited details on the suspect. Police describe the suspect as a black male between 6 feet to 62 in height and between 220 to 235 pounds. The marin county Sheriffs Department is leading this investigation asking for any witnesses to come forward. Campus Officials Say they will be holding a series of town Hall Meetings to talk about this case as well as Campus Security to students and staff. The first one tomorrow night at 6 00 here. The 18yearold is a russian citizen who graduated from Carlmont High School in bellemont last year. Police say he admitted to experimenting with explosives while living here in the bay area. The fbi says some of the bombmaking material found in his pennsylvania apartment was imported from china. Like all bombmaking materials, it depends on what it will be used for. These items are used in the making of fireworks. Investigators say the teenager planned to go to a remote area of pennsylvania to set off the explosives.
