Another homeless may have been killed in the south bay. The latest victim was found in the parking lot of a Lowes Home Improvement store. Janine de la vega has been covering the story for us all morning long. What have you learned jeanine. Reporter mike, police have told us that the man was found here in this parking lot right near the Lowes Home Improvement store. Sources tell me that this man appeared that it appears that he was homeless and he was found in the City Position near an suv that was parked here. It has now been towed. Investigators did focus on that suv that was in the strip mall here in north san jose. It was packed with a lot of items. And there was a bike chained to the rear tire of it. Were told that it appears that the man was living in the vehicle. Officers were first called to the parking lot just after 10 30 last night. Someone reported there was a person down and they werent sure if the person was dead. Police say he was unconscious and not breathing. He was pronounced at the scene. Were told that the position that he was found in and the circumstances seem suspicious. And there have been eight homeless men who have been killed this year so its likely that detectives may look to see if this latest case is relate today any of the others. Those happened in other areas of the city. Some the victims were beaten and another was stabbed. We wont know how this man who was killed last night, how he was killed until the coroner conducts an autopsy. So far there is no motive, no suspects have been identified. So the suspect is still at large. Back to you. Thank you, jeanine. Firefighters made significant progress overnight in a fire in napa county. It broke out around 4 00 yesterday afternoon around dry creek road. No buildings were destroyed but the fire threatened some homes. And that forced evacuations. The good news is that all evacuation orders have been lifted. A Cal Fire Division chief says overnight damp foggy conditions and an aggressive fire fight allowed crews to get an upper hand on the fire. He warning warned that homeowners and residents should not let down their guard. These patterns this time of year in the fall do shift from from moisture coming on shore to off shore winds, warming things back up. So were going to be in that flux until we get significant rains in the next few months. Cal fire says the fire should be wrapped up with 100 containment tomorrow. All right. From the lows like a threerun home run by the cubs pitcher in the 2nd to the highs in the 13th. Joe panik sent the fans home happy after five hours and four minutes. He gave up this three home runner to the opposing pitcher jake arrieta. That was tough. The giants kept things close. And then gillaspie had the triple that he got off of the cubs closer. That put San Francisco in front. Then in the 9th inning, the cubs came back. Chris bryant blasted this two run homer to left field. It just went over the wall. Went right over that orange car right there. That tied things up. The game went to extra innings and remained tied. That was until the bottom of the 13th inning. A drive to right. And the giants will win tonight. Tonight. One swing there from joe panik. And that was the game winner. He hit it off of the wall in right center field. Crawford who had double today start off the inning came home. And the giants escaped with a victory. This game lasted just over five hours. It was an exhausting emotionally draining affair. Something that these giants are used to. Used to. Its a roller coaster ride. You know, weve had games like that this season. You know, we have to find a way to come back and gain that momentum back. Thats you know, thats baseball. Weve got a group of guys who have a good perspective about baseball. They understand that they enjoy doing it. They love playing the game. But its not life or death. You go out and play with a certain freedom, i guess. That kind of all attributes to some of the success that weve had in the Elimination Games. It was a familiar position they found themselves in. Today we continue the series on the state propositions on novembers ballot. 17 in all. As part of you decide coverage, were breaking down each one of the measures over the next few days. Monte francis takes a look at a number of new regulations involving guns, condoms and plastic bags. Reporter california became the first state in the nation to ban single use plastic bags at Grocery Stores and pharmacies two years ago. So why is it on the ballot in this election . Because the ban never took effect. Shortly after lawmakers passed the ban, Plastic Manufacturers gathered enough signatures for a ballot measure for a provision in the state constitutes that allows a statewide vote on a new vote before its enacted. Asking voters to reaffirm the ban that was passed in 2014. If it fails, the statewide ban on plastic bags would be repelled. Prop 65 is another one by the plastics industry that redirects the cost that is charged for the reusable bags. It would go to Environmental Programs instead of the stores. Supporters say prop 65 do promote environmental causes. But critics believe prop 65 is an attention by the Plastic Industry to confuse voters into voting no on both props 65 and 67. Prop 60 is a workplace regulation requiring actors in adult films to wear condoms during sexual intercourse. Federal regulations require the use in xrated films but rarely enforced. The measure protects the health of porn actors. Earlier this year cal orb a the state agency that regulates workplace safety, heard testimony from adult performers who say such a law would drive the industry underground and make them vulnerable to lawsuits. They also argued it would drive the industry out of the state, much like the porn industry left los angeles after l. A. County required condoms of porn actors four years ago. New gun control measures would go into effect under prop 63. It includes making gun theft a felony and requiring ammunition dealers to report lost or stolen ammo within 48 hours. Most of the provisions of prop 63 including a requirement for buyers of ammunition to undergo background checks and a ban on large capacity magazines were already signed into law by Governor Brown back in july. By that time, the initiative had already qualified for the ballot and its champion, lieutenant newsome ruing for governor in 2018 rejected calls to drop the initiative. Today is a wig day for samsung because samsung and apple are arguing the long running patent battle in front of the u. S. Supreme court. Apple says that samsung violated the Design Patents including the grid display on the app icons on the screen. Jurors awarded apple nearly a billion dollars over design infringement back in 2012 but the two have carried the battle to the highest court in the land. Besides deciding if samsung should pay apple damages, the court is expected to design the value of design work. A decision is not expected until next year. The exploding smart phones of samsung are more of a problem for the company. They have permanently stopped production of the galaxy note 7. That comes one day after it stopped selling the phones. Last month samsung had identified a manufacturing defect in the batteries for the 800 phone. Then it started shipping replacement phones but customers soon started reporting problems with those phones too. And then it explodes. We thought we were safe with the new phone. Major u. S. Wireless Companies Including t mobile, verizon and at t had already suspended sales and exchanges of the note 7s. You can now learn to lose weight the next time that you head to the supermarket a a weight loss clinic has happened in many safeway stores. We will talk about the challenge for local police when it comes to toy guns. A frightened woman calling San Ramon Police about someone in her neighborhood who appears to be carrying a gun. Can you hold on just a moment. Hurry. Hurry. Hes got hes got hes at the front door. She then goes on to describe the gun as an all black rifle. Police responded. When they arrived, they detained two 12yearold boys and two 14yearold boys at gun point. Turns out the guns those boys were armed with were actually air soft guns that can be mistaken for the same thing. San ramon Police Released the phone call to remind parents to talk with their kids about gun safety. They challenged people to pick out which ones are real and which ones are fake. The woman who made the call made the right call. It could have been a much more tragic situation. First and foremost, i want to commend the boys for doing the right thing. They complied with the orders of police. There was no violence, there was no activity by police. Get out of the bush and put it down. Exactly. Drop the weapon. I tell my son, we play with nerf guns. If they ever tell to you drop a weapon, make like a goal post and prove that you have ten fingers. Thats the best way to come out alive. I commend San Ramon Police for releasing the statement and the video. Its educational for others. You have to talk with your children. The children want to play with guns. Even if theyre little sticks made to look like guns. They want to play cops and robbers and army or what have you. Its important to have the proper parenting skills to ensure that they know comply with lawful commands and you will be fine. Did the air soft guns need to have the orange tip on them or they dont have those. I dont know if they do or dont. Some models do and some models dont. What is problematic is some times guys are painting the tips orange. That is not so much an indicator as it was in the past. Incidentally too, some bad guys have put real guns inside of the nerf type guns. So its a real weapon disguised as something that looks like a toy. The most important thing is to drop the weapon. Whether or not it looks like its real or not. Lets talk about Something Else happening in the news. We covered one Police Shooting in full and one in north carolina. In one case the video was released almost immediately. Do you think that police should be required to release that body camera footage . So many people, our viewers say what good is is taking the footage if its not released publicly. Its a piece of evidence that goes to trial. Whether its a civil or criminal case. It is evidence. There are pieces of evidence that have preexisted. So we had photographs and surveillance and the introduce of cell phones. It is an additional piece of evidence that can be used when they go to trial. Its not meant for public consumption necessarily. Ill tell you this, theres been discussion about having a standard of when you should release. Right. The standard is conduct a full and thorough investigation. Now, in some cases an incident will be so abundantly clear that it can be released quickly. In some cases there are so many pieces of evidence to evaluate that you cant say were going to do it in 24 hours. Whether or not but a lot of the tapes they release it because there are protests going on. And families are releasing their own video of the wife taking. It didnt show the shooting. The audio was worth while. It was useful. That was one other piece of evidence. The body cam is one piece of evidence. The picture of the gun that the subject had, thats a piece of evidence. I argued on police1. Com that that could have been released in a timely fashion. While you evaluate what you have. Video is good. But its limited. It doesnt capture things like when im holding you, you can flex. It can help build trust with the community. But it cannot repair trust with the community. It has to be used in conjunction with other things to do with Building Community relations. And thats having Police Officers on the street and bike patrol and foot patrol, mounted horse patrol, Police Officers having coffee with a cop, things like that. Its not the be all and end all fix. Right. Before there were police body cameras, there was not this sense that police have something but are hiding it. For some people that might be there now. Transparency and truth are different things. I will get you the evidence in the most timely fashion as possible after ive conducted my thorough investigation. The truth is getting to that you know, analyzing all of that evidence. Putting all of the data together. You have all of these pieces. Put the puzzle togethe. Two of the Largest Police departments in the country, vegas and chicago, have made it Standard Practice to release the videos after Police Shootings. Do you think that legislators should get involved and the statehouse should make the rules . I think at ground level, the investigator really has the best authority. The District Attorney has the best authority. Because theyve got the experience in doing investigations and understanding what you have at hand. So not lawmakers. I dont think so. Doug wiley. Then rain thursday and friday and then a windy saturday, you guys. Thank you, steve. Youre welcome. Now to a story so much of us remember. An 8yearold girl from vallejo was kidnapped. Her name is misty sanchez. She is now 24 years old. For years she refused to think about what happened to her. Now she is sharing her incredible story of survival with ktvu. I missed you guys. In december 1999, 7yearold fairchild disappeared from her home in vallejo. Nobody knew it at the time but she had already been murdered by a local taxi driver named curtis Dean Anderson who had also kidnapped and killed 7 yearold Amber Schwartz and would later claim to have killed 13 other girls. Is there anybody who is more of a danger to society than somebody than that. On august 12th, 2000, an 8 yearold was walking home alone from the elementary school. It was the day of my Birthday Party. I wanted to help my mom get everything set up. I was two blocks from home. And i noticed a gentleman sitting in his car. Reporter it was curtis Dean Anderson. I noticed he was watching me through his rear view mirror. And my gut instinct told me to cross the street. Excited for her Birthday Party, she kept walking. Anderson got out and asked her to help him grab a roll of duck tape out of his car. As soon as i reached in to grab the duck tape from the floorboard of the car, he just leaned over me from behind and he put his hand over my mouth. Reporter within seconds anderson was driving away, past mistys house where her mom was inside getting ready for the Birthday Party. And im watching my house. I just remember thinking i want to be home so bad. I wish i was home. Reporter anderson drove her across the freeway to this Shopping Center parking lot. Made me change my clothes. He at this point pulls out alcohol. And he poured the alcohol and said drink it. Reporter that night was spent in the parking lot of this truck stop off of highway 80 on the outskirts of vallejo where anderson abused her and pulled out a chain. It was like one of those long silver link chains. And he tied it tight around my leg and locked it up with a padlock. And i thought this is it. Like im not going to see my family again. Reporter meanwhile word spread quickly that another little girl from vallejo was missing. Police are asking for the publics help in locating a missing 8yearold. Sanchez was last seen at about 3 00 this afternoon. Youre searching for every little tiny clue that might lead you to something. He would put up blankets and towels to cover up the windows so nobody could see inside. He would leave me in the car to go watch my mom cry on tv. I want my daughter back. Reporter and then two days after the kidnapping, anderson left her alone and left behind his ring of keys. I picked the smallest one. And unlocked the padlock that he had chained around my leg. Reporter a few hours later, curtis Dean Anderson was in custody and misty sanchez was home. Home. Happy birthday to you. Thday to you. Her father carried her in as dozens of people celebrated her return. It was surreal. It was unbelievable. It was miraculous. To think a child that young was able to free herself and get away is stuff stranger than fiction. Reporter misty had her Birthday Party but things would never be the same. Although everyone was there to show their love and support, i was still not okay. Reporter for the next few years, she would go to therapy, known as the kidnapped girl she struggled to fit in at school. Her parents also struggled. After she turned 12, things got worse. I was loaded, drunk, doing god knows what. I remember thinking that this girl is self destructive and feeling bad that her encounter with the child kidnapper is the reason why she is so self destructive and figured it was a matter of time before she turned up dead somewhere. In 2009, she was severely injured as a passenger in a drunk driving accident. Once again she was nighing for fighting for her life. This time things would be different. Coming home from the accident, from the hospital, i found out i was pregnant. With my daughter. Who is now six. And that was life changing for me. That was my wakeup call. Keup call. Reporter now 24, she is living a clean live working and raising her daughter. She also helps counsel families of missing children. This is what im here for. This is my purpose. When i think about amber and all of the other girls that didnt make it, i just sometimes im like overwhelmed with the feeling of like why me . Reporter curtis Dean Anderson was sentenced to 300 years in prison. He died in 2007 from kidney failure. Now she says she owes it to the children that anderson killed and other victims to make sure that she makes a difference with her life. All right. Joining us now on the 9 is ted rollins. You reported that anderson died in 2007. Did she ever want to confront him . Was she angry about his death. She was very angry. She said when she found out he died she was angry because she felt he got away with it. He only did eight years and he deserved to rot. And she said she might have confronted him now that she is able to deal with it. For years she didnt want to think about it. Something else that i have heard about victims of this is they do succumb to reckless behavior. She mentioned it because she thought if that didnt kill me, nothing will. Or maybe they just want to die. How did she get over that phase . It was when she found out she was pregnant. She got in a horrible Traffic Accident when she was 16. She was off the rails doing everything. She woke up in the hospital and that was a bit of it. But then when she found out she was pregnant, her maternal extinct turned on and she changed her life. Loves being a mother. Absolutely. She has really turned it around. She is working with victim organizations. She started a clothing line, staying alive and working with families. She has met with sierras family. She is one of the unique people who got away. Like elizabeth smart. She is in an elite class. And part of the guilt factor is why did i survive. She thinks about the girls that didnt survive. She has turned it on its face and using it as a positive and helping others. When something bad happens, people want to move away from wherever that particular spot is. She is still here in the bay area. Yes. Still in vallejo. Her parents divorced sadly. This was very difficult on her parents and their relationship. So they divorced. But theyre all stale in vallejo, mom, dad and misty. And she loves vallejo even though such a horrible thing happened to her there. She is not going anywhere. Thank you, ted. Gasia, we will send it over to you. October is national Breast CancerAwareness Month. One in eight women and one in a thousand men is expected to be diagnosed with the disease in their lifetime. What do you hope that women who see the pink ribbon on the cereal box at the Grocery Store do for themselves. The most important thing about Awareness Month is to bring awareness to the fact that Early Detection is so important. Bring it to the forefront of the persons mind that im behind in my mammogram or i need to see my doctor. Those are really important things. I would love for everyone to remember that Breast Cancer detection, Early Detection, finding a cancer early makes it much more curable. Regular mammograms, self exam is important. Lets talk about the mammogram. A study found that mammograms dont save lives. And a lot of women said why am i going through the pain and expense of getting one if it doesnt help me in the long run. It has been a controversial issue. For those who treat Breast Cancer and take care of women with Breast Cancer, i think we have to take that with a grain of salt. Which is cancers can be still highly curable if found at a later stage. But finding them earlier, by mammogram, particularly when theyre small, theyre curable and we can subject women to far less invasive treatments if we find them early. It is important to find cancer earlier when the fewer treatments are necessary. You said get to know your own body. What is normal for me is not your normal. Talk to me about why women need a personal baseline. I think its an important thing. Women tell me every day that my breasts are solum pee i have no idea lumpy so i have i dont know what to look for. If you notice anything different. If you notice a new lump that doesnt go away. Skin changes. The nipple inverting, Something Like that, very important to bring it to the attention of your doctor. Likely it will be absolutely nothing and you will have a reassuring moment when the doctor says that is nothing to worry about. If you detected your own small cancer when it is curable, it was a good important trip you took to the doctor. I remember when saying i have to ill be late for work because i have a mammogram this morning. You never set the m word. Now we talk about it in the news room. Its your first. Ive had 7. Its so much more out there these days. Im assuming thats a good thing. I definitely agree. I think its very common that people avoid talking about their breasts and avoid talking about their health. Especially the c word, cancer. When i would like to see the opposite. Women need to talk about it when theyre getting together for coffee or movies or at work. They realize and talk about it being an important part of your General Health and making sure that theyre talking with their doctor about the risks. Every woman has a different level of risk. That can change, how often they should have mammograms. I know in the past 20 years or so it has changed. Cancer is not necessarily a death sentence. Since the mid90s there has been a steady increase in cure rates. Thats because of innovations with surgery and radiation and full body treatments. It has made a big difference. I am a generation where i want him to be the spokesperson for prevention. I think having problems with dogs can be prevented if you do things right from the beginning. Have you always been attached to your father . This is what i want to do. Growing up you get a gist of everything in life. Ive always been natural with him and always been good with animals as well. Its not a like a job to me. Its an easy thing, you know. Is it great having your son there . Im a father so i cant imagine working with my son. I would embrace it. I think you want to make sure that whatever you teach good moral values, being great member to society. Being a great role model. You want to see it. You want to see it at one point. I worked really hard, i sacrificed a lot of days as a father. I accomplished my dream. I want him to particular his dream. If we can do it together, even better. When did you start your love with dogs . Im a farm boy. I grew up on a farm. Its not just dogs. Dog is the closer one to the city. How can i continue this love by making sure that i teach people how to have a more balanced relationship with dogs. Thats it. Im teaching humans how to have a Good Relationship with dogs. Speaking of relationships, is there anything that your fear does that you dont agree with . Do you feel comfortable going up and saying i think we should do it this way . I have my opinion, my voice. I tell him and he says whether if its a good option or not. And he knows best more than i do. So i cant ever question him. I bring the common sense. He brings the curiosity which is important. You as a father you want to hear your kids. You also want to remind them how simple things can be. They play reruns. We already did it. I talk about my dog charlie quite often. We have pictures that we can show. One thing i have a question about he is an english lab. His anxiety. Im a father like i said. I have two children. Yep. Whenever i play with my children together, he cries a lot and barks. When im one on one with them, he is fine. He plays great with the children. What can i do to calm him down a little more. Distance is a keeping a dog at a distance when a dog is anxious about what it is. It is a good activity or exercise for them. Meaning whatever youre doing here, the dog has to wait at a distance. That allows him to relax. When he is part of that scenario, that dynamic, he gets anxious about it. Yeah. So you do the ons of what he is doing. You keep a distance and the dog relaxes. Its really that simple. Ten years now. Thats why im part of my generation is a rehabilitation frame of mind. His generation is how to prevent that. I think its great. The new family pet is a wild baby raccoon. It is cute now. They found it five months ago and brought it home. They have named the raccoon bandit. They say it is just like any other pet. The family plays, feeds, even sleeps with the raccoon. Your charlie is sometimes on the bed. Im not going to sleep with a raccoon. Right. This family does however and they know they cant keep him forever since of course raccoons are wild animals. We raised one before. Oh. And we turned he got mean. Oh, okay. So we turned him loose.
