Right now were awaiting to see what doj is going to do next now that a federal judge has denied his request for access to classified documents to continue its investigation. Legal experts are scratching their heads at the decision. Also in the denial, judge cannon appointed a Special Master. Who he is and the deadline the judge set for him. Joining me now is nbc news justice and intelligence correspondent ken dilanian, also lisa ruben and carol lamb. Walk us through the decision from the judge here. Why did she say no to doj about being able to access those classified documents when they said it was a matter of National Security. This judge who was appointed by former President Trump really adopted the trump view of the case almost in its entirety and basically told the Justice Department that they cant be trusted to in their assertions that something is classified. They cant be trusted to decide which material is relevant for a criminal investigation and which material is privileged. It was a remarkable ruling in that respect. Its one thing to be sceptical about the government. This is the National Security division of the Justice Department and fbi. The experts and Classified Information, telling this judge that National Security is implicated and she said, i dont believe you. In fact, she said, you havent shown me any evidence that these documents fell into the wrong hands while they were at maralago. The doj said thats exactly what we want to investigate. Thats why we need access to these documents. Shes continued to block them from having being able to use these documents in their criminal investigation. She did throw them a slight bone in the sense that she said that they may use these documents, which she already said before, in a National Security damage assessment. The Intelligence Community can look at the contents. She added that the fbi can participate in that. She said theres no reason that cant continue and she said the fbi can ask questions about were the documents moved, who had access to them without speaking to the contents of the documents. But, look, she is steadfast in her view that a Special Master must review all of these documents, all 11,000 seized at maralago in august, and the doj just disagrees and thats why were expecting an appeal to be filed any minute now, katy. Carol, can you think of a parallel circumstance where the judge says to the Justice Department, i dont believe you and im going to let somebody else, a third party, come in and make this decision . Certainly not in this context and these kinds of circumstances. I was thinking about it this morning, i was thinking the only kind of analogy i can come up with is if you were trying to prepare breakfast and you found that you were missing a loaf of bread, so you send a Family Member out to get the loaf of bread and they come back without the loaf of bread, and you say, wheres the loaf of bread and they say, well, there were all of these ingredients listed on the package and how do i know that those are really the ingredients in the loaf of bread . So i sent it out for a lab for a thirdparty analysis. And you say, what about breakfast . What are we going to do . And you say, well, well have to wait 2 1 2 months for the lab results to come back. Thats what disturbs me most about this judges order and ill give her the benefit of the doubt that she thinks shes doing the right think. The problem is, its so impractical. She has laid out a course of investigating the investigators here that is going to take such a long time because there are so many steps that she wants this Special Master to go through in order to establish that the fbi was saying the truth here with respect to things that are not very nuanced. You know, lets say there are 100 documents that are marked classified. This judge could have sat down with 100 documents and taken a look at them herself. It would have taken her less time to do that than it took her to draft that order. The impracticality here is what i think is difficult and troubling and i think thats why the doj is faced with a very pressing decision here whether to go ahead and appeal the judges order. So what might be the reason for them not to appeal this . Is there a drawback for them to do so . I think one consideration they have to you know, they have to look at is, what is the 11th circuit, the Appellate Court here really going to do, what are the parameters of the relief theyre going to ask for. Are they going to say, look, we only asked to be able to use these 100 or 130 documents that were not even asking for a determination that they are actually at this point in time classified. We went in and took what the Search Warrant asked us or allowed us to take which was documents that were marked classified. That was clearly legitimate. We took them. Now let us do your investigation. Thats the limited relief that they can ask for and theyre probably thinking right now, well, the Special Master is a very wellrespected judge and perhaps since judge cannon did say prioritize those documents marked classified, maybe we can just get that done quicker instead of going to the 11th circuit because once they go to the 11th circuit, once they appeal, they are out of the District Court level and so everything will stop with respect to the District Courts order. I think theyre looking at time right now which aspect will go faster. Judge deary is a former he worked in brooklyn. Lets put it that way. Patrick cotter who served as a federal prosecutor in brooklyn said he was surprised by the trump teams decision to include him in their two choices for Special Master. He spoke to the Washington Post and he said the judge wasnt much of a personality and i mean that as a compliment. He wasnt a good, old brooklyn boy trying to impress you. He was a very matter of fact judge. He will do a credible job and will do it quickly. I guess there are a lot of people out there scratching their heads and thinking, why did donald trump choose somebody like this . What do you know about judge deary. He has a long history in brooklyn. He was the u. S. Attorney in the Eastern District of new york between 1982 and 1986 when he was appointed to the bench by ronald reagan. He does get high marks from people on multiple sides on the political aisle. What i will say about judge dearie, he recently took inactive status. Hes currently a senior judge which means he has a reduced caseload. In late august, he said he was going to be inactive. That indicates to me he was looking forward to some sort of retirement, just slowing down. This is not the job you would want to take if you were trying to slow down. At least if youre going to do the job on the expedited time schedule that the department of justice wants you. So judge dearie does get high marks but i too am scratching my head. His reputation is impeccable. He has Security Clearances, but the trump folks wanted him and there must be a reason why. Lets get reaction from donald trump, what he said. I think if it happens, i think you have problems in this country, the likes of have perhaps which weve never seen before. I dont think the people of the United States would stand for it. What kind of problems, mr. President . I think they would have big problems. I just dont think they will stand for it. They will not stand for this ultimate of hoaxes. Big problems. A lot of investigations going on into trump. And betsy, you have new reporting involving the former president. Explain that. A recent batch of subpoenas that the Justice Department sent out asks witnesses for a broad variety of information related to the save america pac. Trump stood up this pac just days after the election in 2020 and its become perhaps his single most important fundraising vehicle during his post presidency. The Justice Department is looking at this pac and asking questions about it. We would expect that doj is interested in the way that this pac used lies about the elections outcome to try to raise money from trump supporters. What we now know is that save america has paid 3 million to cover the legal bills for trumps newest the newest member of trumps legal team. Hes one of the top lawyers handling both the maralago mess and the January 6th Investigation that the Justice Department is concurrently conducting. We know that save america is using funds that it has raised to pay for him to do this work for trump. 3 million is a lot of money. Bring on trump as a client. It just shows the extent to which so many of the different pieces of this story about trumps money, trumps Postelection Actions and his current daunting legal problems are mixed up and interwoven in some complex ways. Theyre looking into a lot of different avenues. Back to Special Master. Ken, when is judge dearie going to get to work and how long do you think it will take . Hes been told to prioritize those 100 or so classified documents. And thats actually crucial, katy. Thats what the Justice Department cares about most is the classified documents. Presumably he could get through those rather quickly. He has a support staff. They may have to get Security Clearances. He does not as a sitting federal judge. He has until november to conduct this, according to the judges timetable, conduct this review of all 11,000 documents. But it really looks like what the doj most cares about is getting access to the classified documents and that can be done rather quickly. And theres this question of what happens with any potential appeal and whether the Appeals Court grants a stay and gives them the classified documents right away. We need to wait and see on that, katy. You just answered a question thats been lingering in my head, ken, which is do all federal judges have total Security Clearance . Can they review anything from the federal government . They dont technically have a clearance. But like lawmakers, its inherent in their responsibility. When they have Classified Information that comes up in a trial, they are deemed clear to see that information and then they make arrangements to make sure that its stored correctly and goes to the right places. They put those lines on hold and then it sounds as if folks are actually lining up in order to stand in line which had one kind of witty correspondent saying the british have outbritished themselves. He says that he was queueing as we call it since the early hours of this morning and that he had to stand in line for around 14 hours. Today buses arrived on Marthas Vineyard to move a group of roughly 50 migrants who flew from cape cod where theres more room and resources. The group of women and children arrived on wednesday as part of a broader strategy by republican governors to relocate migrants from red states to blue ones. Joining me right now is nbc news correspondent emilie ikeda live from Marthas Vineyard. The migrants have now been moved to joint base cape cod because theres better resources for them. Tell me what youre learning there and how confused the migrants were and the people of Marthas Vineyard were when they just showed up. Reporter its a vastly different picture here at st. Andrews church from just an hour or so ago. We watched the nearly 50 migrants, some children as young as 2 years old, board a stream of buses, as you mentioned, that carried them to joint base cape cod where the governor says its much better equipped for a more sustainable response. They would have designated areas for legal services, also Health Care Services and remember this is a community that was not aware that the migrants were being flown here. And so we witnessed some tearful, heartfelt goodbyes between the venezuelan migrant and is the volunteers when they boarded the buses earlier this morning because the Community Just immediately jumped sprung into action. Republicans have said that the recordbreaking influx of Border Crossings has strained a lot of those Southern States and its not fair for them to have to bear all of the wait of that burden, the brunt of that burden, but democrats say republicans are using these people fleeing dangerous situations as political pawns and President Biden condemning these recent actions of governor desantis. But there is this is limited space. This is a space that just acted as the winter homeless shelter. There are only two bathrooms in the entire facility. And so while locally on the ground we sprang into action, the Community Came together to support them, we needed a longerterm solution here and thats where cape cod comes in. And were this is up to the migrants if they want to go. This is totally their option to go. If they choose to. And then at the on the location on cape cod, theres going to be Wraparound Services provided to them. Its open access for their immigration attorneys, theres going to be laptops set up to continue those meetings with immigration attorneys. Of course, we have vendors for food, shelter, everyone is going to have much more adequate bedding. Theres going to be a larger space for families, a different floor for families to be settled on, and Mental Health crisis management, along with weve contracted and for people to come in today Case Management to help people with longerterm solutions around housing and around Educational Services for children. This is what compassion at government looks like. This is what good, smart, wellrun government looks like and i couldnt be prouder of my Island Community, the people i represent, and our state, the State Of Massachusetts. When it comes to the political statement that was made by ron desantis and has been made by other republican governors bussing in or flying in the migrants, how do you think theyre going to respond or react to images of the migrants being hugged and, you know, kissed and waved goodbye to. It seemed like they got a really warm welcome. Look, desantis is using people as political pawns and spending his time not helping the people of florida with their many needs of, you know that they have down there. Instead spending his days, weeks, months, creating a secret political plot to use migrants as pawns and these are people. Like, we need to be focused and grounded that these are women, children and families and you have a governor of one of the largest states in the United States using them as political pawns for a political stunt just so he can jump on Tucker Carlson and beat his chest about how tough he is on immigration. Theres nothing tough about using women and children and families as our political tools. Ron desantis is a coward. What is tough, what is strength is this community, this Island Community, this State Of Massachusetts coming together to show overwhelming support for people in need for vulnerable people. The response here in my district and my state represents the best of what america has to offer. And what were the stories the migrants told you about what they were running from, why they crossed the border into this country . Sure. Yeah, i mean the stories ranged and a lot of them are heartwrenching. Some people were, you know, traveling for several months just to get to the border. Some people were fleeing from Gang Violence and the like that was plaguing their home their home country and their families. And they wanted and they need refuge. And a lot of these people, you know, were lied to when they were told to get onto the plane and told they were being sent to get immigration help, go to their immigration appoints. Some were told they were going to different cities across the United States and so they showed up here with a lot of confusion. And so these are people that have been through a lot and we are going to do everything we can to support them and help them through the next steps of their journey. However, katy, its worth noting, no one is expecting a breakthrough. This is just designed for the president to convey what hes been saying publicly. There was some expression of hope that things were moving along last month. We heard that from the president. But since then, weve seen the administration say that the russians are now they were willing to negotiate with for the release of run russian who is detained here, there arms dealer, in exchange for these two. Now the russians are saying according to Administration Officials they want numerical parity, they want two for two. What youre hearing from the administration is that things are not really progressing. I never saw any statement from the russian side saying that they were ready for a deal. Secondly, they are trying to up the ante, as they always do. Victor boot is a real criminal, deserves to be in jail. These americans are not. So it is a it is a good deal for the russians. And, remember, putin wants to get boot out of jail. He has deep tying with Intelligence Services in russia and that, i think, is why we were hopeful that they might be able to do this deal. Is it going to be possible to really make progress at this moment, in this period of time when russia has invaded ukraine and were putting all of these sanctions on them . Is there a reason to hold out hope . I know bill richardson, the former u. N. Ambassador went to moscow last week to try and do something regarding this. Hes been successful in prisoner swaps before. Is there a reason to stay hopeful even though were seeing such tension with russia . Yes and no. Im not hopeful. I never was optimistic in the beginning. We talked about this deal, i was nervous because the russians had said nothing about it. Having said that, i would say two things. One, getting boot out of jail for putin would be a Major Political victory for him back at home. Theyve been asking to get boot out of jail since when i was in ambassador in russia a decade ago. And the russians can compartmentalize. Theyre good at this. They can keep things in different tracks. It opens up the possibility i just havent seen any hints theyre willing to do this deal at this time. Ambassador, carol lee, thank you very much. Lets turn now to the war in ukraine and a horrifying discovery in one of the cities that has been recaptured by the ukrainians. A massive burial side was found in the city of izium. The count went well over 400. The head of ukraines National Police say they believe most of the people buried there are civilians. Megan fitzgerald is live from ukraine. Megan, what are you seeing, tell us about this. Reporter so just within the last hour, we heard from president zelenskyy who is calling on World Leaders to label russia a State Sponsor of terrorism. He says not doing so would be betrayal. And, of course, this comes after this horrific discovery in the forest of izium which was a city that he just visited days ago on wednesday. What investigators are saying they found among the bodies that they exhumed today, there was a mass grave of ukrainian soldiers where they saw ropes around their necks, hands died behind their backs. They found bodies of families, children, middle age, elderly bodies. And the majority of them showed signs of torture and a violent death. There are investigators on the scene right now processing this scene. The bodies will be transferred to the forensic examiner to identify them and they will be laid to rest once more. The concern here, katy, is that this isnt even the worst of it. As the ukrainians have been able to force the russians out of these areas, this is what were starting to see. We saw this in bucha several months ago. And the fear is that this will be even worse because the areas that were talking about, the kharkiv region, down in the south, these are regions that have been occupied by the russians for months as opposed to bucha was just several weeks. And so right now we know that there are some 30,000 War Crime Investigations that are taking place. 20,000 of them are for civilians and the big concern here is that that number will just continue to rise, katy. It makes you wonder what russia might do with its back up against the wall if this is what they were doing as they were pushing forward and taking territory. And in response, the russians attack electricity, they attack dams, they are terrorizing ukrainian citizens and i think we cant lose site of that asymmetry in this war. With respect to what might be the response, again, i dont know. I think we should not overestimate putins craziness. I think that sometimes theres a habit to do that and say if hes going to be cornered hes going to use a nuclear weapon. I tend to believe that is just a threat because at the end of the day putin is not isolated internationally. Hes isolated in the west. Hes not isolated in the global south, hes not isolated in other parts of the world. If he did use a nuclear weapon, he would be. He would become a world pariah. I dont think he wants to do that.
