Democratic attorneys general and groups like the American Civil Liberties union are announcing they will sue to stop the president. Joining me now is the director of the aclus National Security project. Thank you very much for being here this morning. You guys are just off of securing the victory for an american citizen who was unluflly detained without charges in iraq by the trump administration. So you guys are on a roll now versus the administration. Give us help us understand the basis for your lawsuit now. I will read a little bit from your executive director Anthony Romero who said this is an illegal power grab that hurts American Communities and flouts the checks and balances that are hallmarks of the democracy and well follow a lawsuit this week. Explain what standing the aclu believes it has to be the filer of the lawsuit. Thank you for having me, joy. Standing is one thing we have considered and well make more details public this week. There is no National Emergency. The president admitted it in the rose garden. Leaders of both Political Parties said so, Security Experts and people at the border have all agreed. Two, the authority that the president is claiming is illegal and unprecedented. He is unlike any other president ever before him invoking Emergency Powers to seek construction of a border wall over congressional will. Thats a very dangerous thing. The constitution assigns to congress the power of the purse to decide how taxpayer money will be spent. That is what the president is seeking to unlawfully usurp at this point. Lets get into what a lot of people are saying might be the achilles heel of the president s side of the argument against what you just said when he said he didnt have to do this. But he wanted to get his wall built faster and thats why he did it. People are saying that undermines his case. There are people on his side saying no, it doesnt. This is mark meadows, a supporter of donald trump on fox news yesterday. The president did a real shrewd thing. Before they signed the bill and sent it to him, before they voted on it he said, im going to declare a National Emergency. He put them on notice and yet congress didnt act. I think the Supreme Court will look at that and say why did congress not act . The aclu filed over 200 legal cases against president s. You are familiar with making arguments against the administration. Would it be an argument that you think would stand up in court for them to argue that they warned congress that they would declare a National Emergency if they didnt give him the money . Not really. A number of things in context here. One is Congress Reached a bipartisan deal to fund a particular amount. The president didnt agree and wants something more and different. It is important to focus on the specific authorities, 2808. Thats only been invoked by two president s to support military construction needed for military overseas. What the president is seeking to do here is very, very different. Hes going against congressional will seeking to build a pet project that is domestic, permanent and simply not supported. Meanwhile the Defense Department has to figure out how to pay for Donald Trumps wall that includes figuring out which military projects to defund. Its only been done twice before from overseas projects. We have heard a bit this morning from acting defense secretary patrick shanahan. Take a listen. You have not determined that specifically a wall is required to meet that National Emergency. There have been no determinations by me. We always anticipated that this will create a lot of attention, so deliberately we have not made decisions. We have identified the steps we would take to make those decisions. This is the important part of that. We laid that out so we could do it quickly. We dont want to fumble through the process. Joining me now, Jonathan Capehart of the washington post, jennifer are you ben of the washington post. Thank you very much. I will go to my lawyer at the table, jennifer. One of the things that was most interesting is that they are going to make the argument that the only time a president has invoked a National Emergency visavis construction of military facilities has been for overseas which presumably means it is related to war. So the aftermath of wars. Is there some way for this administration to finesse the idea that what they are calling a crisis along the border is the equivalent of that. First of all, you raised the right issue. Its not only there is no emergency. The statutes they are using to move the money around are inapplicable. On this one which is the big pot of money, 3. 5 billion, it talks about military construction for the support of the military. You cant assign the military to the border, then invoke this to build construction to support them. This is meant to be transfers from one construction project to another. Thats a complete misreading of the statute. Go back to something your previous guest said. The issue he warned a congress and they didnt do it, thats a bad fact for him. Thats a determination by the legislative branch they dont want to do something. Congress decides, the president cant decide to appropriate it even if you wont. Hes also looking at this compromise bill. He signed a bill that specifically excludes building money for a wall and says i will violate that wall by doing it anyway. Exactly. Its completely nonsensical. Unconstitutional. What i worry about is that he has said this. Donald trump is famous for great actions. What if he doesnt actually move the money around . He just tells the base, i have done it. I did it. It becomes difficult to sue him. There is a question of whether its ripe, whether the issue has come to pass. He can play a lot of games with just declaring things. There is already a wall. They were finishing the wall. Why cant he just declare hes done this. He may not want to get challenged in court. As a result, really do nothing. Hes just play acting for the base. What if already ann coulter and some of the right have said we dont want to hear this idea that you are going to do a National Emergency and you are building the wall and finished the wall. Hes not going unchallenged among the other people who talked to his base. They are calling b. S. Already on this entire thing. What if he doesnt move the money . Then what . Most of the talking heads are going with it. Ann coulter is an outlier. It is interesting. Donald trump doesnt want a wall as much as he wants the fight. He wants to take this in to 2020. Whats interesting is he didnt have to declare a National Emergency to move the money. Jennifer is right. Why did he declare a National Emergency other than to make this look more controversial, make it look like he was taking a stronger stand than he was really doing. But, look. This thing has opened up a can of worms. It will be a defining moment for republicans in congress whether or not they are going along with this. They had been warning him over and over again, do not do this. Do not challenge the constitutions system of checks and balances. The congressional power of the purse. Dont cross the line. He has crossed the red line. It will be fascinating to see what elected members of congress do to protect their prerogatives. You are here dealing with paying attention to whats happening on capitol hill. Lindsey graham has already sounded the bullhorn for any republican who may want to be recalcitrant. We are going to dutifully support donald trump no matter what he does. They have their chief enforcer, steven miller, out doing the rounds of the sunday show. Essentially also making it clear. Nobody is to walk away from the policy. Everyone better stay on board. Here hes doing it this morning on the sunday shows. The president was saying that like past president s, he could choose to ignore this crisis, choose to ignore the emergency as others have. Thats not what hes going to do. Hes still trying to pretend there is an emergency which they cant prove. We sent cameras down this weekend and they showed the vast expanse of no emergency. Yeah. Welcome back to earth, too. President trump as charlie said, this is all about the fight and the president s base loves the fact that he fights, whether it is a real fight or not. They like the action of him pretending to fight. The fact that senator graham is there saying, weve got to support the president , this is where i part company with charlie in that i have no faith in the republicans on capitol hill that they will not go along with the president as he, you know, blithely skips over the red line that should be talk about a wall. That should be a wall that congress should not break through. We have seen time and time again as the president crosses each red line of usurping their authority, their checks and balances authority that they go with it. Primarily we see it in the polls because the Republican Party base, the Republican Party is still pretty much solidly behind the president. If you are a republican member of congress and you are staring at the 2020 elections and you might be up and you are afraid of a 2020 challenge from the right which at this point i dont know where they are falling off the flat earth where these folks are coming from. You will stick with this guy no matter what. As we saw with the muslim ban, the courts said, hey, mr. President , actually hes filling the courts with his flunkies. Exactly. Its not like the courts can be trusted. We talk about institutional decline on the show. The pillars of the constitutional framework depend on people agreeing, first of all, that the article i power is the article i power. But when its own members and leaders dig a ditch underneath themselves and decide to fall into it and say, we dont have power, we are the employees of the president , thats one pillar down. When donald trump is able to put whoever he wants on the court and they are loyal to him personally and not to the constitutional framework thats another pillar down. Has donald trump shoveled so much ditch under the framework he could get away with it which would then reestablish a unitarian executive on a level we have never seen before. Im with jonathan on the congressional part of this. We have a house of representatives thats actually doing its job. That makes a big difference. Nancy pelosi will get the resolution passed that will disable this emergency and then force members of the senate to vote. I am not optimistic that it will pass or pass with a vetoproof majority which they eventually need. I think there is a penalty to be paid. Susan collins will be toast. I think Cory Gardener will be toast. Tom tillis will be toast. These are senators up in purple or bluish states. As far as the courts go, i will take a little bit of optimism out of the recent decision by the Supreme Court which was to disable the louisiana law regarding abortion. John roberts cares about the institution and his own reputation. He is desperate to keep the court functioning, keep the court above a tax that the political arm of the white house. If he needs to, hell join the four liberals when push comes to shove. Yeah. We dont want to rely on that. The precedent for congress is atrocious. This is from the same people who were on the roof when barack obama passed daca because congress refused to act. How dare he do this without us . But its different now because there is an r next to the guys name. The first way you undermine a democracy is the legislative branch stops behaving like a democracy and behaves like a monarchy. If the president committed obstruction of justice, fired the director of the fbi to negatively impact or shut down our investigation of russias activity possibly in support of his campaign, as a counterintelligence investigator you have to ask yourself why would a president of the United States do that . All those same sorts of facts cause us to wonder is there an inappropriate relationship, a connection between this president and our most fearsome enemy the government of russia. New details this morning from former deputy fbi director Andrew Mccabe explaining his rationale for opening a counterintelligence investigation of the president of the United States. Even as donald trump continues to spark questions about his relationship with vladimir putin, trumps new bff Lindsey Graham says the real problem, believe it or not, is the fbi. Mueller will tell us about what trump did or didnt do. Im going to tell the country about mccabe and the people at the department of justice and how they behaved. Did they take the law in their own hands . Did they abuse the fisa process because of a political agenda . Did their hatred of trump go so far they abandoned their role of Law Enforcement agents and became advocates for a political cause. Joining me is natasha bertrand, timothy obrien, and jill winebanks, msnbc contributor and former special prosecutor in the watergate scandal. You interviewed mr. Mccabe on thursday. What was your take away from speaking with him. My big takeaway is okay, there were a lot of things he was passionate about and animated about during our hourlong conversation on thursday. The decision to open the counterintelligence investigation into the president was not one of them. He was very, very sober when he was discussing what went into the decisionmaking that would make them take this really unprecedented step. He explained that they had an arcticulable basis that was reason enough the president needed to be investigated for whether or not he was compromised by vladimir putin. This is not something he was excited about. This is not something the bureau thought was something they took lightly at the time. The fact the president had fired jim comey really sealed the deal on the fact that they really wanted to investigate, look, whats going on . They had been collecting evidence for months before jim comey was fired. Thats what mccabe told me anyway. By the time the president took the dramatic step to fire the person investigating him and the campaign they said, look, we cannot ignore this anymore. This person may be compromised. This is the most stunning headline i have heard about any president of the United States ever. The fact that it isnt a daily headline is shocking. Natas natasha, one of our favorite legal eagles, she raised the question if mccabe might have an ax tro grind with the president because of insults donald trump made about mccabes wife and the fact he himself was fired and investigated for having a lack of candor when talking with investigators within the agency. Did you talk to him about the issue, whether he personally has an ax to grind against donald trump . Yeah. His ax to grind now is probably more with the justice department. He feels he was treated unfairly by the inspectorgeneral and feels the doa did trumps bidding and the reason why they fired him last march is because the buildup the president had conducted over the previous couple of months attacking him for his wifes state Senate Campaign taking money from terry mcauliffe, that contributed to the breaking point of firing jeff sessions. He didnt talk much about the possibility hes been compromised by the russians or may pause a National Security threat to the country. He made it clear that the fbi doesnt open investigations based on a few people with a hunch, right . This goes through multiple levels of review. It is something that has to go to the highest levels of doj which is why Rod Rosenstein was consulted about this before they decided to appoint special counsel. This is not something he alone would have been able to launch just because he had something against the president. Of course of note that the president started it, didnt he . Indeed. Jill, absent the fact that natasha made that one man cannot just launch a counterintelligence investigation of the president of the United States because hes mad at him. Thats not possible to do. Number two, the fact that mccabes own issues are sitting in the midst of a giant ocean of other evidence of contacts with virtually every senior person involved in the Donald Trump Campaign with russians. Constantly lying about their contacts with russians. The weird interactions. Jared kushner wanting a secret location where the u. S. Intelligence world couldnt see it. All the other evidence sits there. I wonder as somebody involved in investigating the previous worst thing we have heard about a president. With nixon there was never a sense that he was working for another country. This is shocking. Am i over the top with my shock . As somebody whos been through this, what do you make of it . No, joy, you are correct. Natasha is correct. First of all, i have been saying from the beginning that facts matter. Facts matter to the voters. Facts should matter to the members of congress on both sides of the aisle. We have a set of facts here that really lead us to conclude they did the right thing at the fbi. Had they not started a counterintelligence investigation based on what they knew, we would be blaming them now for having been irresponsible in carrying out their responsibilities. It is important to think of all the facts. You mentioned some of them. We have to ask ourselves why all the lies . If there was nothing going on, why all the lies . Mccabe in his book has laid out details of behavior, things like returning the intelligence reports without any indications he had opened them and said i rejected them because putin told me otherwise. This should cause great alarm. Nixon may have said i am not a crook and he was, but he was our crook. Now we have a crook who may be in cahoots with our biggest enemy. Thats a serious concern. I want someone who is at least an american crook. Tim obrien, thats amplified by the fact that the president of the United States is now usurping unprecedented authority. If hes exercising that kind of authority outside of the constitutional framework and perhaps outside the interests of the United States, one wonders why you have people like Lindsey Graham running point as if he worked for the trump organization. Richard burr, the gentleman supposedly leading the investigation of him was on the campaign. There was a transparent attempt to help donald trump all of the transition. They were all with him during the campaign. We havent even gotten into the other compromises by russians into things like the nra which were all on board for republicans. I wonder if we are thinking too small about this potential scandal. We are. Its clear that trumpism has bled downward from the oval office into his staff in the west wing and into a large portion of the gop. I think one of the lessons when people look back at this historically will be that the gop lost its political courage. It didnt really step up either as traditional conservatives or as citizens respecting the rule of law to offer a counterbalance to a president who historically in his Business Career and now in his presidency never really respected the rule of law. I think was engaged in activities during his campaign and the transition that clearly alarmed Law Enforcement officials. The thing we have to remember is Law Enforcement is seeing things most of the rest of the public and the media wasnt witnessing. There was good reason we now know through the paperwork thats come out and we havent seen all of it that the russians and the kremlin penetrated the veil of the Trump Campaign team and the trump transition team. It possibly wasnt limited just to donald trump. There is an issue around Jared Kushner that remains. Thats where Andrew Mccabes sobriety and importance of what hes saying comes home to roost. Dont forget how reluctant the fbi was to engage in investigations of the Trump Campaign. Really in stark contrast to how open they were about the investigations about hillary clinton. Sounds like the fbi was running rough shod into investigating trump. They didnt seem interested in doing it. They didnt seem super motivated to do it. They felt they had to. First of all, he was in betos backyard. Lets start with that. Secondly, he knew beto was drawing a sizable crowd. I wasnt there. But i can tell you from what i saw on television beto had a huge crowd. More importantly, he has a huge following. Email, he can raise money. We know if he decides to get into the race, hes going to be one of the top tier candidates. This is an interesting time. Donald trump, i feel sorry for him. The media wont suggest cute clothes for him. Its upsetting that the media wont get cute clothes and let him try them on and fawn over him. Why wont they . He has to wear something other than an ugly suit. Thats the reality. Beto is the antitrump. Hes optimistic. Hes younger, healthier and he demonstrates that you can be from a border state and not run your entire campaign on fear, bigotry and racism. Thats what hes concerned about. I know the horse race is bad for the world. We shouldnt do it. But i think people have so much anxiety because they want to know who will it be, who will emerge and can they win . The horse race thing is interesting. When you do a poll, you have biden and sanders at the top. They have name i. D. We did a onetwo punch. Joe biden comes up at the top as he does in every poll because hes the former Vice President. Bernie sanders was the other guy who ran. Hes at 22. Kamala harris at 13. Elizabeth warren is at 8. Those look low. Beto is at 7. Now to the second little graphic. What i look at in the poll is not so much the top number. Its hard to read for folks at home. I look at the line. If you look at everybodys line, the line at the top, the green line is biden. Its steady. The beto line, steady. The only line that jumps is c kamala. Am i wrong thinking the person making more difference now than in past polls is kamala. Shes moving. She had a stellar launch. It was perfect. Normally it takes two runs in order to get that kind of presence on the campaign trail. Look, im not going to endorse i know too many of them. To this moment shes run a very good campaign. She has to worry about that number or that line going back down. Yeah. In addition to focusing on the four early states youve got to run a National Campaign as you concentrate on those four early states. You cant peak too soon. Heres the thing. The biggest thing i think senator harris has going for her is the number of haters who have come to criticize her over strange things is indicative of how dangerous people think shell be. The fact that shes part jamaican like the guys who founded hiphop. And marcus garvey. And the weed thing. Did you inhale . While you were listening to tupac. Not what she said at all. Right. There are people who see her as a potential threat. Thats why they are going after her within the africanamerican community. The issue i see is its not just potentially too soon. I dont consider this race complete until we find out what joe biden or beto orourke say or even what bernie says. Those guys will determine what happens to the unaffiliated white vote, people looking for a certain kind of candidate. Sherrod brown wont make much of a ripple. But those three thats where the race is. It was a morning poll. That is interesting. The Democratic Party in terms of the congressional delegation has a paucity of white men. But the white guy looms large in the president ial realm, milieu because that goes somewhere. In the same poll we dont have a graphic when people asked for their second choice, biden and bernie were the only two people. They dont know the others. Look, in a democratic primary, you have to be careful. Put together a coalition. Remember, barack obama was the nominee in 2008. Hillary clinton was the nominee in 2016. This is a campaign where you have to build a big enough coalition because once you leave the early states, you have to start competing for black votes, brown votes, every kind of voter. The Democratic Party is diverse. Quick lightning round. Who is the most undervalued candidate now. Cory booker. He has a big chance to go up in the polls. I dont think hell be the nominee but he could hit double digits by summer. Most undervalued . A lot of them. Heres why. Youre going to get a frontrunner out of New Hampshire and be left with all of the what i call second tier candidates who will make a difference once we have the first debate in june. Can Elizabeth Warren break out of her issues and be top tier . Yes. Absolutely. 70 of the population in some states have no problem with blackface. He perpetuated this narrative that something happened, that the two men did something to this white woman felt threaten and thats why she called the police. Thats not what happened. I think in that respect, it is healthy. It is also a bit unfair. These four people are not the beyer entirety of the freshman class. De the record of most folks were not good. Most of the people were not where they are. There is the ball and everybody goes in for it. So theyre going to have to be on their best behavior and they have to do it right and good staff work. But, you know there is a vast array of views within that Democratic Party. Nancy pelosi is going to have to manage everyone from Abigail Spanberger whos very moderate all the way to representing omar. Thats her challenge. Thats the range, right . Aoc, ihan omar, it is a broad spectrum. Is that because the media fixated on these four women as characters or as you say they are where the energy is. Where do you come down on this . I think energy is there. We flip districts that were purp purple. I am talking the big picture, looking at 2020 at this race for the president , the energy and the winner of that primary is going to be a more progressive democrat, it is not a slightly center left democrat. The one that has a bold issue to tell america what we are proud about but a new kind of instagram way of doing it. Thats what we are looking forward to in 2020. I dont think it is mutually exclusive, there is a lot of energy and excitement around these women. I think the case that these women represent people that trump base is afraid of. Trump ran vocally against latinos and muslims and refugees and these women represent groups that trump basis afraid of and not like. On the one hand theyre being highlighted because of the freshness and energy that they represent. They also are being highlighted because of the conservative presses is obsessed with them because of who they represent visually and culturally. I think both of those things have contributed to the ground attention that they receive. Lets do a quick round robin on this. I a hogot a hold of the talking voice from the rnc. They are obsessed. Tucked into them they were telling their pundents of the democrats racing to the radical left. Thats what they are telling people to go out and say. There is this real fear of things like the green new deals because there are ideas. People are talking about them. They are scared. They have been saying this for as long as i remember. They have always try to paint democrats in this way. I think it is important for democrats, you know, you kind of run through the base during the primaries and coming right to the certain or the general election. They have to do both. They have the give voice to this progressive view and they have to be ready to counter act that kind of image. Brown has been doing a good job of it. And an interesting footnote to all of this. In 2020, hispanics will actually pass africanamericans as the Largest Group of eligible voters. Not registered voters, but eligible voters. So were seeing a shift happening in politics at the state level, the federal level and the local level. And fear of their numbers is what is driving this hysteria. Hysteria is not just about their bodies, its about them ever becoming citizens and being able to vote. Thats right. And people will say it if you push them. But Denver Public schools have struggled in the sense of teachers cant afford to live there any more.
