Weve got a lot to cover this morning. Were going to begin, though, with coronavirus. Nbc news tracking data Shows Positive tests from the countrys most populous states helped drive the states to a new record for the most cases in a single day. More than 45,500 cases were reported yesterday, blowing past the previous record of more than 36,000 new infections set on april 26th. Californias nearly 7,000 new cases was among its highest ever reported. Florida broke its previous record set over the weekend by well over a thousand, adding more than 5,500 new cases yesterday. Texas nearly doubling its previous high from the day board, recording nearly 11,000 new cases. South carolina also reported its highest number of infections yet as well as oklahoma. However, officials in tulsa say it is too soon to attribute the records in that county to the president s rally last weekend, but we will be monitoring that. So in Texas Governor greg abbott warned his state is facing a, quote, massive outbreak and is urging residents to wear masks and stay at home when possible. As we mentioned, the state hit an alltime high with covid cases with texas adding nearly 11,000 yesterday alone. That is double from the day before. Double. Bringing the total to over 131,000 cases. This surge is coming as officials in some major cities, theyre warning hospitals could reach capacity within the coming weeks. But officials in houston are warning icu beds are already at 97 capacity. According to newsweek, 27 of those beds were occupied by covid patients. And in an effort to slow down the spread of covid, three state are enforces guidelines as hot spots continue to emerge nationwide. The governors of new york, new jersey, and connecticut have implemented a mandatory quarantine on visitors coming from viral hot spots. Some are calling it a total reversal. According to andrew owe moe, cu states on the list so far are arkansas, arizona, alabama, florida, north carolina, south carolina, washington, utah, and texas. Heres what we know. Residents are not barred from coming to the tristate area, but they must quarantine for 14 days upon arrival. Those caught violating the 14day rule face a fine. Its unclear how they plan to enforce these rules. So after a closed door lunch with the Vice President , florida senator rick scott spoke to reporters, striking a blunt tone on the rising spread of the virus in that state. I mean we havent beat it. You know, everything people are doing, theyre going to have to say, you know, wear a mask. Are you social distancing . So i hope everybody takes this serious seriously, because we havent beaten this. We dont have a vaccine. We hope to by the end of the year. Doctors have done a really good job at trying to figure out how to keep people alive and recover, but were not where we need to be. Joining me now is a politico reporter. You heard it from rick scott essentially saying we need to mitigate the spread of this thing. Marco rubio is essentially saying, youve got to wear a mask when you leave your home in order to stop the spread of this thing. Thats in stark contrast, and w andrew, between what theyre saying and what the president has been saying. It doesnt seem like the president is thinking about the coronavirus at this point. A couple of days ago, he said, were going to hit 115,000 deaths in this country. We have far surpassed that. I wonder if hes even getting briefed on the spread throughout the country. What do you make about this huge difference about what were seeing . The vigilance on capitol hill when it comes to the virus is very real. Im there every day among reporters, staffers, and lawmakers alike. Everybodys social distancing, everybodys wearing a mask, people are taking it seriously, republicans and democrats alike. Youre seeing that contrast on full display lately here. For example, all of the members or some of the members are urging Governor Ron Desantis to put in place a mask order, in other words, say that all residents of florida have to wear a mask when they go o outdoors. Theyre starting to put pressure not just on the white house but individual state governs ors t try to do better at home when it comes to the virus. Again, this is not just a local issue. It seems like theres not a federal lead, a federal response, a federal mandate from the top down. Governors, senators alike are trying to deal with this thing locally. With that, we are seeing this tristate quarantine as i laid out a little bit earlier from the governors of new york, new jersey, and connecticut. Things are switched around, right . Because when it was april, florida was looking at new york saying new yorkers cannot come down to florida. Is there an effort by lawmakers in some of these harder hit states where coronavirus cases are surging to change their approach moving forward when were seeing these really startling, scary numbers, frankly, coming out of states like texas, doubling within 24 hours . Absolutely. And ill give you an example with texas. Senator john cornyn, hes a member of the Senate Republican leadership, he called on the white house yesterday to continue federal fund firsthanding for testing sites in his home state of texas. At the end of the month, a lot of the funding will run out. I think thats a sentiment being suppressed not just by democrats but republicans and in these individual states, especially states that are seeing these massive new outbreaks like texas. Youre seeing republicans start to speak out against the white house response in a way thats getting more attention than it has in the past. Yeah. And were going to be talking about that later on in the hour, the fact that the president has threatened that theyre going to pull testing sites from hardhit states, specifically texas, which is also troubling when testing is needed now more than ever, when more and more folks are testing positive for the coronavirus. Also, everybody, the three white men involved in the kill of ahmaud arbery, they have been indicted. Gregory mcmichael, his son travis, and their neighbor William Bryan were charged after a video was linked. Arbery was fatally shot after he was pursued by the mcmichaels. Bryan is accused of using his pickup truck to box arbery in. Each are charged with several counts. The men could face life sentences without parole if convicted. Lawyers said what they did was not criminal. Also, mississippi is recalling their flags. Mississippi has the only state flag that includes the confederate emblem, a red field topped with a blue x with 13 white stores. Legislators chose it back in 1894 after the republicans gained reconstruction after the civil war. In 2001 voters chose to keep the flag in a statewide election, but the flag has remained controversial. There were separate statements issued, but controversy has arisen about whether a statewide election should be made to make this decision. This is coming as the ncaa and s. E. C. So that was the president yesterday commenting unprompted on the latest development in the Michael Flynn case after he was asked about progress with the coronavirus. And heres why the president was, quote, very happy. A divided federal Appeals Court ended the indication against former National Security adviser Michael Flynn. In a 21 case they ordered the judge, emmett a sullivan, to immediately end the Michael Flynn case. The doj motion to dismiss prompted judge sullivan to appoint a former federal judge to argue against dismissal in an amicus brief to the court. The Appeals Court may still keep the case for further review. So lets get into this. Joining me now, nbc legal analyst danny cevallos. One question, danny, what just happened here . Its confusing, but this is called a writ of mandamus. What they asked the Appeals Court to do is grant the motion to dismiss. The District Court hadnt ruled on it yet, and theyre vsh very, very unusual forms of brevity. In this case t court of appeals said this writ of mandamus is warranted because when it comes to prosecution, the government is the beginning and the end, the alpha and omega of all prosecutions, whether a guilty plea has happened, the defendant has been sentenced, no matter what. The executive branch is the fundamental power behind prosecutions, and to order an amicus, a friend of the court, to get involved and present arguments in opposition to the government when it has this exclusive power really unnecessarily puts the branches of government at odds. Thats what the Appeals Court, 21 decision of the Appeals Court says. So there was obvious immediate shock and surprise about this decision. Could the judge does he have grounds to appeal this decision at all . He could. I mean these are mostly legal issues, and its possible that the Supreme Court might be interested in this case. But its not strategically likely only because that could take a lot of time. And, frankly, the judge may just not have that much of a dog in this fight because he would rather move on with the case than risk having a Supreme Court tell him he was wrong as well. At least strategically that may be what he wants do. In this case, the Appeals Court is essentially ordering the District Court to order the dismissal of flynns case and getting rid of the amicus because hes no longer needed. This is a fascinating you never see this kind of thing. This is not a case that has farreaching kind of implications. Even more rarely is the district judge saying anything other than, okay, thats fine with me. So this is not Something Like some of the Supreme Court cases we had last week that have farreaching implications for the justice system. This is a very unusual set of facts. You and i have had a lot of conversations as of late where you begin your sentences with, this rarely happens, but. And then you go on. That is true. Danny cevallos, thank you as always. Just days after the president said in tulsa the coronavirus should slow down, the Trump Administration is planning to end its support for testing sites at the end of the month. The move will affect 13 reported testing sites in five different states. At least seven of those testing sites are in texas where coronavirus cases are surging. Houstons Health Department reacted in this statement saying, quote, losing the support of the federal government for testing sites will undoubtedly have catastrophic cascading consequences. And in a Conference Call with the prs, republican john cornyn said this, quote, its pretty clear to me that with the uptick of cases now is not the time to retreat from our jij lens in testing. Believe they need to extend that federal support in texas at least until we get this most recent uptick in cases addressed. And as youll recalling the president s aides have repeatedly said trumps remarks about slowing down testing was just a joke. When you do testing to that extent, youre going to find more people, find more cases. So i said to my people, slow the testing down, please. You know it was tongueincheek. Come on, now. That was tongueincheek, please. It was a comment he made in jest. It was a comment he made in passing. I think the president clearly said that in jest in a rally when he was talking about the numbers. In no way is it the president s policy or our policy to slow down testing. Meanwhile the president has said he does not joke around. And as the coronavirus cases spike across this country, Vice President mike pence urging republican senators to focus on, quote, encouraging signs. The Washington Post reports that the Vice President made the comments with lawmakers yesterday on capitol hill where, quote, multiple senators said that pence pointed to positive indicators, including fact that while infections are rising, the mortality rate is not. Pence reported, quote, thats partly because theres more testing and younger and healthier people are adding to those getting tested, adding only 3 are actually experiencing case increases. But the Washington Post data shows marked increases in 5 or more of counties and rising, quote, cases in around 20 or more states. Speaking to senator cornyn, he said theyre continuing work with states like ours who are seeing spikes why Lindsey Graham and kevin kramer said ppe is in a good position. Im not sure how cutting funding to testing sites meaning continuing to work with hardhit states. Senate democrats are blocking the bill to overhaul policing yesterday, calling the legislation flawed and a nonstarter. The measure, which needed 60 votes, failed 5545, unlike the measure introduced by house democrats. It did not include outright bans on choke holds or noknock search warrants that killed breonna taylor. It did not touch on qualified Police Immunity which Shields Police from lawsuits. Senator minority leader Chuck Schumer called the bill partisan while senator tim scott accused democrats of taking their time and biding time until after the election. Heres how the president reacted after the failed vote. The democrats dont want to do it because they want to weaken our police. They want to take away immunity, take away a lot of the strength from the police and Law Enforcement generally, and we cant live with. We cant live with that. This is a great bill. All right. Meanwhile the house will vote on a separate Police Reform bill introduced by democrats which is expected to pass today. Lets get into this. Joining me once again, politico reporter andrew desiderio. A lot to dissect. We moved through a lot there. Lets talk about this Police Reform bill. Democrats blocking the republicans bill to overhaul policing yesterday. Some would argue if this was even an overhaul of policing at all. It was more to placate protesters, some are arguing. Where do you expect things to go from here . So the lawmakers i spoke to yesterday pretty much expect that this issue is going to be dead in the water, at least until at least election day at that point. You know, each side yesterday, you know, the tensions were raw on the senate floor. Each side, their positions are more hardened than they were before. The odds arent great in this polarized senate in terms of getting something done, but what you did hear were a strong minority of democrats saying, look, this is a divided government, divided congress. Republicans control the senate. This is the way to achieve some sort of result. You did see some sort of democrats hoping to amend it. According to democrats, that was not a deal they were going to take, especially with the guarantee from Senate Mcconnell on which types of amendments would come up. Theres a lot of distrust and it seems unlikely this issue will come up again in the another. Again as we have seen on so many other issues, it seems like more changes are happening more quickly on the local level versus the federal level where things seem to be stalled once again, because weve seen reform across the country. Lets quickly talk about this cutting funding to testing sites. The federal government cutting funding to funding sites especially the hardhit states like texas. You have cornyn saying nows not the time to cut fujd. You have doubling numbers in texas as we mentioned in the first half of the show. Its really troubling. You need testing more than ever. Is there an effort to change the president s mind on this decision to cut funding to some of these sighttes . You heard some were urging Vice President mike pence during their lunch to not pull back on testing. Individual senators have contact with the white house on a daily basis to urge them to do certain things. But on this matter in particular youre hearing from republicans from these newly hardhit states like texas, like florida, for example, who are telling the president and the Vice President and the task force, now is not the time to cut back on funding for testing, which is slated to run out at the end of the month. I want to touch on a t latest piece you have out, andrew. Tell us about this new partisan bill to pose sanctions on china for its interference with hong kongs independence. Thats right. Last week Chris Van Holland went to florida and asked for the passage of a bill that wows sanction kai na over its continued encroachment into hong kongs independence. But cramer is actually a cosponsor of it. What i reported yesterday is the white house actually asked senator cramer to block this bill, which is quite unusual, but what it underscores is two things, number one, just how strong the president s grip on the Republican Party is these days to the point they would be willing to block a bill that theyre a cosponsor of. And, number two, it shows how difficult it is for the china hawks in congress there are dozens of them to try to push the Trump Administration to get tougher on china on an array of issues from hong kong, coronavirus pandemic, human rights abuses, and things like that. It was a really remarkable turn on the floor last week. No one knows why cramer had done this, even though he supports the bill. Trump won by six points back in 2016 according to exit polls. Republican senators on capitol hill voiced their concerns about trumps dropoff in support. I think right now obviously trump has a problem with the middle of the electorate with the independents. Theyre the people who are undecided. I think he can win those back, but probably it will require not only a message that deals with substance of policy, but i think a message that uses perhaps a different tone. The president has on obviously been presented with a very challenged situation. Obviously how he handles it and how people perceive him handling it will have an impact on whether they want him reelected or not. The democrats have shown an interesting strategy, and it may well work. The first strategy is making sure the republicans arent successful even in discussions about Police Reform, continue the chaos and take advantage of it and make sure biden never gets out of his basement. It may work. And there was a quote, precovid. I thought the president could carry the day with women and collegeeducated voters, with high unemployment and the economy shredded by covid he needed to adjust his message. The dcn says the basketball event will still be televised over four nights in august. Among the other changes, five voting delegates have been asked to participate from home. Official business will be handle remotely. The changes come in major contrast to the president s plan to continue to host large rallies and events despite the recent uptick in certain states. The ceo of the Democratic ConventionJoe Solmonese said, the think that i believe more than anything is that donald trump needs the roar of a crowd to feel he is in charge, and joe biden was born to be in charge. With that lets check in with bill karins on the weather who is also checking covid numbers. I feel like were back in april, bill, with the numbers were seeing. The location has shifted, doubling the numbers in texas, really startling. Yeah. For the people in those states, we know how you feel being in the northeast where the case kept increasing and you felt like it was everywhere around you. And now being on the side of it, its like, oh, god, its happening again. We were kind of hoping it would fade for every p. Lets get into the fatalities first. The question is are the fatalities going to increase. Yesterday we had 808 reported. Today its at 620. The last two days were above 620. We were waiting to see if all the new cases will equal more fatalities. Well find that out in the days ahead. Of course, weve already highlighted the hunl number of cases reported the last couple of days. Yesterday we broke the wednesday record by 5,000. That was the most we ever had on a wednesday reported. Heres the other thing. The sevenday average peaked in the beginning of april at 32,425. This is according to the worldometers sight. If were over 32,000 today, well be the new peak for the pandemic in our country for the cases that are going to be counted. A lot of people are saying were testing so much more. Were about half a million cases per day right now, but if you look at the blue lines, those are the negative. The orange is the positive test. At one point we were down to 5 . So the positive rate has increased. And if you look at the blue lines and total number of tests, it hasnt increased in the last two weeks and thats where you see the spikes. Its not just increased testing. Were seeing more people testing positive, and the Community Spread has increased. Even dr. Fauci said that yesterday. Lets talk about the forecast heading into the upcoming weekend. Very summerlike. Dodging thunderstorms along the gulf coast. As we head toward the weekend forecast, watch out. Washington, chicago, des moines, Severe Weather on friday. On saturday, it will stretch into areas of the northeast. So dodging thunderstorms in the northeast are pretty typical. I know that you have been following this somewhat rocky recovery, if we can even call it that. What are we expecting this morning as far as jobless claims . Another key read on the jobs market in the states when it hits this morning, were expecting initial claims to reach 1. 3 to 1. 4 million american workers, which is concerning because this would be the 12th straight weekly job. And it begs the question, where are the jobs and why are we seeing the layoffs. It says despite the reopening of economies, Companies May be concerned about their sales and layoffs are in place. The tally is brought to about 47 million jobs americans fighting for unemployment claims in the last 14 weeks. We have fresh news out too from the imf on its Global Growth forecast. It suggests the last ten weeks has not been kind the slump is worse than anticipated in april. 4. 9 contracture, versus the 3 drop from april when it comes to the United States the economy likely to contract 8 this year. So it tells you just how bad conditions are out there. They did point to the hit in Consumer Spending in particular that that has been extreme because of social distancing lockdowns but also people saving because the uncertainty is great for people still given the economic hit. Were getting information from economists about what they think the economic recovery from the coronavirus pandemic will look like. Theres a lot of talk will it be an l, a w, a v . Were hearing a reverse, theres a sharp downturn and a recovery by the recovery is not as big as the downtown r turn. Well see an Economic Growth lower than otherwise. That is in sharp contrast than what the Trump Administration has been saying, particularly larry kudlow, theyve been saying itll be a v shaped recovery, based on early data, especially on things like jobs and retail sales. Those increases are still getting the numbers to below where they would be. Another thing to worry about, however, even the reverse radical recovery wouldnt be the reverse scenario in that there could be a w recovery, a sharp recovery after the initial wave and then a deeper drop as a second wave spreads. Thats something to keep an eye on with increasing cases. If that shows in the Economic Data, that could lead to a w recovery. Lets talk about the numbers. Theyre drastic, awful to see. I feel like were back in april again with the numbers spiking across the south and west. I know axios is reporting this as well. It is getting worse. Is it inevitable at this point, in your estimation, nick, that another shutdown is on the horizon. I think thats a good question. Weve been doing this weekly math now for eight weeks looking at the bright spots and dark spots on the recovery and growth in coronavirus cases in the United States. Almost every week weve done this. Ive had a little bit of a bright spot, not today. This is the grimmest math weve had in all corners of the United States are seeing increased rates of coronavirus infection. And with not due to testing at all, really. This is rates of increase are outpacing the testing and it gets back to the point you mn mentioned, will it lead to shutdowns . A lot of places are saying its not acceptable, like texas but will we see these rates continue to more, lead to more hospitalizations and that might lead to more shutdowns. A lot of infections are happening with younger people which might lead to fewer hospitalizations. Nicholas, thank you my friend.
