Why it may not be good news for lori loughlin, the other actress caught up in this. And new details about the Mysterious Illness linked to vaping. The Trump Administration cracking down on earn kinds of ecigarettes. But is it too little, too late . New fallout from the third democratic primary debate as candidates return to the campaign trail today all across the country. One. Most memorable moments from the debate, former hud secretary Julian Castro going after former vp joe biden asking what he had foregotten wa he had said moments before. Both using that exchange to ask supporters to donate. The Biden Campaign calls the comments low blow and cheap shot. The castro camp says being vicious for not giving biden a free pass. Got his facts wrong. Were up there to debate and what i was doing. Joe bidens plan would leave out 10 million people. Thats significant and i would point that out again. Medical records address concerns . Yes. What the hell concerns . Man, you want to wrestle . President trump is scheduled to hold a Campaign Rally on monday in new mexico. He previewed his dire reelection pitch this week when speaking at a retreat of House Republicans. You really have to elect me, whether you like me or not, it makes no difference, because our country will go to hell if any of these people get in. It will go to hell. Up know, i was joking but im really not joking. You have no choice. Because whoever they put in, the saner they are the worse theyre doing, and whoever they put in, it looks like its going to be a revolution to the left. Theyre going to take your money. Theyre going to take and very much hurt your families. I just dont think people can allow that to happen. Wow. All right. Joining me now to talk about all that is chief washington correspondent for Bloomberg News and writer for vanity fair. Good morning to you both. Good morning. Kevin, start with you. We heard aggressive comments there from President Trump and theres going to be an aggressive day today on the campaign trail for democrats. Now that weve had a dayplus to absorb what happened during the debate, does anybody perishably gain or lost ground after thursday night . I think i was in houston. Back last night. I think the consensus based on the reporting i gathered there is that the big three, joe biden, Elizabeth Warren and Bernie Sanders come away largely unscathed. I thought Elizabeth Warren continues to present herself as a disciplined candidate. Someone who really would be able. Her supporters say this, to bridge the gap of progressives and unify the progressive factions on the left to propel them into a general election matchup, but, look. The other tier candidates are still still have a lot of jockeying to do, jot nuft Julian Castro, former hud secretary, everyone talking whether or not that will hurt or hurt him that exchange with biden, but other candidates, buttigieg, Amy Klobuchar to an extent and cory booker. I dont think weve talked enough about booker. The test, can they propel themselves to elevate their candidacy and turn it into a fourway, fiveway race and andrew yang. A lot of folks laughed it off, but he has consistently prove pooen he is in this for the long haul. My last and final point. This is going to be a long democratic primary. I guarantee those ten families who get 1,000 a month arent laughing after that. I know. Abigail what did you think after thursday night . I agree with kevin. Were looking at a race between three people. Youve seen that divide form between the top tier Elizabeth Warren, sanders and joe biden and sort of the rest of the field. I think, you know, kevin hit the nail on the head. Those individuals sort of part of that Second Tier Group are really going to have to do Something Big or really get themselves, sort of the momentum to sort of try to get into that top tier and its really an open field i think when you look at those in terms of who might be able to make that jump. Give me names, though . Who do you think performed the best, abigail, and who didnt give themselves any favors thursday . I absolutely think Elizabeth Warren. Shes continued to sort of have a consistency youve seen across the three debates. Andrew yang continues to impress a bit. Beto orourke had really important moments in the debate, you kind of saw the old beto. The one we game familiar with during his senate run. I think he kind of had those viral moments or those moments where he seemed to be connecting in a way we didnt necessarily see especially during the first debate but even during the second debate as well. And i think mayor pete. Sometimes he has those moments as well. But in terms of people who had a bad night, i do think that for Julian Castro, the hud secretary, i think when you leave a debate stage and have e about, sort of your lines of attack, what you said age, i dont necessarily think thats a great sign for somebody especially an individual polling in the low single digits. Talking thursday night when former housing secretary castro delivered a strong attack against Vice President biden suggesting that bidens memory was failing him. Now getting backing from some of the other contenders here. Listen to what senator cory booker had to say about that. I think that we are at a tough point right now, because theres a lot of people who are concerned about joe bidens ability to carry the ball all the way across the end line without fumbling. I think castro had really legitimate concerns about, can he be someone in a long, Grueling Campaign that can get the ball over the line . And he has every right to call that out. What do you think, kevin . Talk about senator booker, heres your chance, about what he said and legitimate concerns about the Vice President or did he go a little too far there . The difference between what senator book sayer says in thatp and what was said on a debate stage are night and day. Its one thing to have a conversation and raise points in an open primary season. Its another do to what happened on the debate stage. Look, i mean it doesnt really matter what i think, just as a reporter, though, there were audible gasps in the debate spin room when that moment happened. But i also think, you know, we talk so much about joe biden, we talk so much about Elizabeth Warren and Bernie Sanders, all three of them have proven to be essentially immune to some of these political attacks. You havent really seen any significant dip in the polls. All of the politics aside on policy, the first third of that debate on medicare for all was a heck of a debate. Joe biden doubling down, asserting himself on his positions with regards to medicare for all and you also had Elizabeth Warren and Bernie Sanders drawing a stark contrast about medicare for all policy. That was a policydlriven debat that wasnt personal and all three candidates making very Different Cases on the issue for medicare for all. I think that even more so than some of these viral moments, i think that actually, quite frankly, will have more effect on the democratic primary than some of these back and forth conversations. What about the big moment, abigail, when beto orourke got that loud applause declaring he was down to take peoples ar15s and ak47s . Did himself favors, delivered republicans a favor wanting to take away their guns . Yeah. Look, republicans have said for the longest time democrats want to take away your guns, they want to take away your guns but beto orourke since the el paso shooting emerged as a leader in terms of the Democratic Party and their stance on gun control and i think you saw that onstage. I think hes becoming the face of the movement especially at a time when you look at the senate and Mitch Mcconnell refusing to take up these bills that have passed the house. I think the democrats are seeking a strong voice right now and i think beto delivered on the debate stage to be that person, be that voice. Certainly republicans are going to latch on to that comment and try to use it to their advantage but i also think when you watch beto orourke speak it came from a point sort of it was obviously driven by emotion and driven by personal, his personal experience with the victims in el paso. I think, you know, that resonates with voters. And a lot of people out there who say that the nra and Republican Party are going to say the democrats want to take your guns regardless whether those are the actual words that came out of their mouths. Exactly. Beto orourke actually speaking the words. Stay with us. Well discuss the day the open top political story. New today the house judiciary chair accusing the department of justice of a kov you areup for trying to block his committee from seeing the underlying evidence gathered during the special counsel ills investigation. We have been very clear for the last several months in court filings, in public statements, and in proceedings in the committee that we are, in fact, conducting an investigation, preparing to decide whether to recommend articles of impeachment to the house. This is another instance of a Trump Administration trying to cover up and hide from congress and from the American People in this case from congress, because the American People wouldnt see grand jury information, all kinds of information. And on the defensive. In a new court filing late friday the doj used the dems scattershot messages on the impeachment inquiry to argue it does not meet the legal threshold for them to access the secret grand jury evidence behind the Mueller Report. The doj filing comes a day after the house judiciary voted to ramp up its investigation of President Trump. And impeachment has been on the president s mind and on his twitter feed. Listen to what he told House Republicans gathered in baltimore. I told nancy pelosi, you have to do something other than try and impeach somebody that didnt do anything wrong. You have to. I said, its hard to impeach somebody who didnt do anything wrong. The Mueller Report is out theres no collusion after two and a half years. Meanwhile, another legal fight is heating up. This one is over whether the president s properties are profiting off of his presidency. A u. S. Federal Appeals Court revived a lawsuit alleges President Trump is making money from government officials who are doing business at his hotel in washington, d. C. Despite scrutiny over the blurring of lines between Donald Trumps businesses and his presidency, look what happened yesterday at his hotel near the white house. Secretary of state mike pompeo speaking at an event that was held by a conservative group. He took a shot at the media. Look around this is such a beautiful hotel. The guy who owns it must be successful somewhere along the way. That was for the washington post, in case in the back. All right. Kevin and abigail are back with us. Abigail, start with you in the mixed messaging on impeachment. You write about this extense ishly in a recent piece. Whats the overarching sentiment from conversations youve had with lawmakers what democrats are doing and what its behind the confusion . Shouldnt everybody be on the same page by now . Absolutely. Democrats have spoken with on the Judiciary Committee specifically are frustrated because when looking at the messaging thats coming out of the committee itself, they have been a little more clear what theyre doing. In the days after the mueller hearings, they came out with that initial court filing which was the first time wherein they said theyre investigating the president and the outcome could be articles of impeachment possibly. What youve had since then house leadership pushing back and some democrats in the front line seats or tough districts where donald trump might have won or they flip the seats from republican to democrat. So what youre getting is a message coming out of the Judiciary Committee that they are as entering an impeachment investigation with nancy pelosi pushing back on that idea saying were continuing to do the same thing weve been doing. Nothing escalated. This is a continuation of our work. Kevin, how damaging is this lack of cohesive messaging for democrats . Does the president have the most to gain from that . Well, yes and no. Look, i totally agree with what aboigail just said because this divide within the Democratic Caucus pertaining to impeachment really is because of the backdrop of the 2020 election, because not just the top ballot president ial race but the down ballot races. Those suburban districts. Thats really why there is a divide here, because quite frankly, im not sure a lot of swing voters made up their mind on the issue of impeachment, if they would like to see that as something for democrats to pursue. Speaker pelosi wants to take this in a piecemeal approach, but President Trump feels that should democrats go down this proceed, that he would be able to say, hey, wait a minute. Why didnt you put usmca on the floor on work with me on drug pricing . The politics are incredibly complex and could change on a news cycle dime. Thank you both for joining me this morning thank you. New today, the white house is getting ready to roll out its plan to reduce gun violence, but theres still confusion where the president stands on background checks. Nbcs hans nichols has details for us. Hans, good morning. Whats the latest on that . Reporter good morning. The president appears to be keeping allies and adversaries guessing where hell come down on background checks. Hes had some time to think about it. Hinted in both directions, but, remember, the window for legislating on this doesnt stay open forever. This morning, President Trump under pressure from both republicans and democrats to clarify his position on background checks. On thursday, mr. Trump hinted he would support them, but within limits. If its meaningful well make a deal. If this is a movement by the democrats to take your guns away, then its never going to happen. Reporter his comments coming after a lastminute bid by senators joe manchin and pat toomey to get their bill passed to expand background checks. Reporter as the president deliberates, some republicans warning him against aggravating his political base. Expect the president to call around and get views on that subject as well. Thank you, joining us from washington this morning, hans nichols. Joining me, kentucky representative, chairman of the house budget committee. Congressman, thank you so much for joining me this morning. Sure. Your fellow democrat senator chris coons set beto orourke talking about taking peoples guns is not a wise political move, and feels it will be used against the party. Do you agree . Do you think comments like that will make it harder to pass bipartisan gun control legislation . Really dont think so unless beto orourke becomes our n nominee, which right now looks like a long shot. Well have a candidate next summer and he or she will state their positions on weapons and everything else. You know, one of the things that i think is hysterical about this is, when barack obama was running for election in 2008, everybody was saying, oh, Barack Obamas going to take your guns away. Now theyre twice as many guns in the United States as there were when he took office. So if he was going to try to take their guns away he did a pretty poor job. Youre saying regardless who the candidate ends up being from the Democratic Party, the other side is just going to say that they want to take their guns, regardless of the words actually spoken like beto did . Theyre going to say that. I think another important aspect of this political calculation is, a question of how many votes does that move . If you would have your vote lost because of that beto orourke statement even the policy youre not voting for a democrat anyway. Thats why i think this thing is way is way exaggerated and really not going to make a difference, i think, in the ultimate vote. Switch topics. New questions about your partys strategy as Speaker Nancy Pelosi and Judiciary Committee chairman jerry nadler seem to be contradicting each other over whether an impeachment action is actually under way. Lets listen. If we have to go through well have to go there, but we cant go there unless we have the facts. Some call this process an impeachment inquiry. Some call it an impeachment investigation. Theres no legal difference between these tomorrows. The New York Times asked the same question. Is this an impeachment inquiry congressman, ill ask you that same question. Speaker pelosi talked about process and the fact we have other committees doing investigations that could lead to articles of impeachment different than the ones the Judiciary Committee is investigating. So im not sure theres much difference between them as possible. The reality is, and im a strong supporter of impeachment. I think if we dont move towards impeachment of this president then we might as well eliminate the impeachment provision from the constitution, because it will be meaningless, but right now there are 24 democrats on the Judiciary Committee and 17 republicans. Its unlikely were going to get any of the republican votes for impeachme impeachme impeachment. That means 22 of 24 on the committee have to vote for impeachment to even get it to the floor and thats not going to be easy. I understand where Speaker Pelosi is. The worst thing would be to go down this path, take something to the floor that didnt get 218 votes and then you give President Trump in his strange way of thinking a claim to being xaun e scone e e e sconer exhazaunesa exzaunet breathtaking. Do you think the recess, four, five weeks you had off would kind of slow momentum here . Actually accelerated the momentum because you had probably a couple dozen democrats who came out for impeachment during the reez and that means to me that they were hearing from their constituents that they wanted to move to take this president to task for his, his offenses. So i actually think that it was a good sign for those of us who favor impeachment that so many people went home, heard from their constituents and announced, and some in very, very tough districts. Some who switched some republican districts. So, again, i dont think its slowed momentum at all. I think itsen han eactually en it. Was there a candidate thstoo out to you on thursday at the debate . Not really. I work with many and known so many of them and known joe biden since he came to the senate and i was a staffer there in the 70s and i know Elizabeth Warren well and bernie and served with beto. Sure, sure, but you love this stuff. Right . Its tough. Yeah. You know, i kind of go along with many that Vice President biden held up very well there. Elizabeth warren is she has enhanced her stature some. Several others had great moments, but i think weve got to be careful about relying on great moments to pick our nominee, and i think thats what much of the analysis of the debate was. Who had a great moment . You know, Julian Castro had a tough moment that backfired on him. Beto orourke certainly got the most reaction on his assault weapons statement, but ultimately i think the frontrunners probably s solidified their position. I want to solidify Julian Castro. No anticipation on bidens memory Going Forward . Absolutely no. Joe biden has always been this way. Hes very spontaneous and authentic and he sometimes says things he wishes he hadnt said. And in this particular case, it turned out that secretary castro was absolutely wrong about his claim about whether joe biden had changed his position in two minutes. So, again, these are the things i think that these are small news items of the moment, but ultimately, the choice of our nominee will be much more substantive than that. Congressman john yarmuth, thank you for taking time out to be with us. Thank you. The committee chairman, jerry nadler, telling my colleague Lawrence Odonnell this we are, in fact, conducting an investigation, preparing to decide whether to recommend articles of impeachment to the house. Now, you can call that an impeachment investigation or inquiry. Those terms have no legal meaning but thats exactly what were doing. Joining me now is a former National Social justice director for Bernie Sanders 201 campaign and Boston Herald radio host and a nationally sindt kayndica columnist. Starting with Speaker Nancy Pelosis remarks added to the confusion this week and watch this and get your reaction on the other side,. A support what is happening in the Judiciary Committee because that enables them to do the process of interrogation in their investigation and i salute them. Impeachment is a divisive measure and if we have to go there well go there but we cant go there unless we have the facts and we will follow the facts. What are americans supposed to make of this . Thats a great question. Me and a lot of americans are trying to figure it out. An investigation, an interrogation, an inquiry . By the time this is figured out well need an impeachment for dummies. Its only 134 democrats out of 235 actually onboard with this impeachment. Dems have to make sure if they strike they cannot miss. You cannot afford to have everybody getting excited about something thats not going to move forward through the house and through the senate. They need to be clear. Obviously Speaker Pelosi is still saying this is something we shouldnt move forward with, didnt mention it at all during the democratic debates. People will be frustrated if theres not a clear direction and leadership. Any chance theres a strategy behind the talking points about impeachment . I dont think they know what theyre doing. I mean, its no question about it that if democrats move forward with impeachment, which they are, its going to mobilize Trump Supporters. All those millions of Trump Supporters that stayed home during the Midterm Election will now awaken and going to support this president 100 . As you know, the president has 94 support of the Republican Party. Thats enormous. If you look at his fundraising totals, hes killing it. I mean, the rnc and the gop raised 105 million in the second quarter. So its just going to mobilize his base and its going to make democrats in vulnerable swing states you know, they could be voted out of office. There is definitely a risk for democrats here politically, that cant be underestimated. Lets play what ranking Judiciary Committee member doug collins is saying about this. Here he is on thursday. The Judiciary Committee has become a giant instagram filter to make you appear that somethings happening thats not. The difference between formal impeachment proceedings and what were doing today is a world apart no mooter what t ematter chairman just said wharchts d. What did he mean by that . And what instagram filter is he talking about. Basically saying the house Judiciary Committee already can request documents and do an investigation without calling it an impeachment inquiry. They already have the tools at their disposal. The fact theyre talking about it and using the i word is to grab Media Attention. Alluding to this is a lot of showmanship and its going to backfire on democrats. The American People get to decide who is our president. If voters dont want President Trump they have a chance to not vote for him in the next election. So for democrats to try and forcefully remove him from office, first of all, its going nowhere. Theyll never get the twothirds vote they need from republicancontrolled senate. Its a total waste of time and going to take away Media Attention from all the democrat political candidates. Its going to hurt them directly, because impeachment will take over the nation. Its going to gobble up all the oxygen in the room and all those democrat candidates ignored and that will hurt their campaigns. What do you think about that . Does the Judiciary Committee have enough time to decide on articles of impeachment by the end of the year or will it spill into next year . Probably not. An instagram filter they should use. The black and white filter. Is it moving forward, are you not . Tough to do, even though it is, a lot of people can ignore their constituents, are they moving forward. It can be a political folly. Trump voters have been mobilized since the moment President Trump got in office. Consistently campaigned year over year day in day out. If theyre mobilized to come out for trump theyre going to come out of trump. I dont know if this will make them come out more because theyre committed to keeping him in office. The question is what will democrat voters feel about their leaders . Moving forward . Poop or get off the pot . That simple. Thank you both so much for joining me this morning. Coming up top of the hour, up with david gura. David joining us now. Whats in store . That last comment. Yes. Joining us on the show, going into the last debate focus on the frontrunners, former Vice President joe biden and senator Elizabeth Warren and that gap widened between them and the other candidates on that stage. Then there is an other group of Democratic Candidates who did fought qualify for that debate who were not on the stage who still believe that they have a shot at this nomination and Maryanne Williamson is one of them ho joins us op up this morning and one oether guest, cheadle, pointing him out, called him his africanamerican astonishing phrase.
