Down the investigation were within his authority as chief executive. And therefore it was too difficult to prove that the president had criminal intent. But the president has already claimed complete and total exoneration with the barr memo. The only thing the public has so far seen, democrats are worried that the narrative has already calcifie calcified. I said that barr is an agent of the president. He was put there for that purpose. So thats his job, to protect the president personally. And one could not, therefore, trust the accuracy of anything he produced. Congressman nadler is authorized to subpoena the support as early as today. And this new reporting certainly gives him cover to continue asking questions. But we should note that this is all coming second and thirdhand. Mueller and his team have not publicly voiced these concerns on the record and without access to the full report or even a more comprehensive summary, at the very least, it is difficult to draw substantial conclusions. So our big question today is when will Robert Mueller publicly address this has findings . And will he . Joining me now, nbc news intelligence and National Security reporter, ken dilanian, and former federal prosecutor and msnbc legal analyst, glenn kirschner. Ken, first, walk us through what you learned. Katy, one of the Big Questions since barr delivered his conclusions was why did Robert Mueller punt on the question of obstruction of justice . Why didnt he reach a conclusion about whether there was a prosecutable case and let william barr do that . And what were hearing is that some members of muellers team are frustrated that the attorney general pronounced that there was no case on obstruction. And that the intent may have been to allow congress and the public to evaluate the evidence, because the Mueller Report has evidence on both sides. Evidence that there was a legal case for obstruction and evidence that there wasnt. And so thats one of the things were hearing. And then the other thing, as you mentioned, is that members of muellers team were upset about the way that william barr presented the evidence on obstruction, seeming somewhat dismissive of it, in fact, when they say theres a compelling set of facts that add up to obstruction, whether or not you believe that there is a prosecutable case. And lastly what were hearing on collusion is that from another u. S. Official who has spoken to members of the mueller team, is that while everyone agrees there wasnt a conspiracy collusion case with the russians, there are a lot of interesting, compelling, perhaps damaging facts and descriptions in the Mueller Report about the trump teams contacts with russians and whether or not they were manipulated. Im guessing there are a lot of people getting a bit tired of unnamed sources talking about this stuff and probably want some people to stand by what theyre saying. If theyre concerned about misrepresentation, why not come out and say it with their names . Why doesnt Robert Mueller come out and say, i was misrepresented . Given all the reporting thats gone on, all the way the president has tried to tear down this investigation and the trust that has been undercut in the whole process, im not saying blaming any side here, but isnt it about time that we hear people say what they found, with their own voice, with their own names and their own face . It sure is about time. Everybody, i think, is thirsty for not just information, but Accurate Information about what the Mueller Probe uncovered, as far as potential president ial misconduct, collusion, obstruction. Now, we all know or weve come to learn, bob mueller is a rule follower. And i wouldnt expect him to violate his oath to kind of keep everything in confidence until the moment is right. Perhaps he doesnt believe the moment is yet right. But i think what weve seen in the reporting over the last 24 hours is there are apparently members of the mueller team who are becoming more and more concerned, so much so that they are now willing to sort of break ranks and talk, if only anonymously, about how they disagree with barrs generalization. But how much credibility do you get if youre only willing to talk anonymously at this point . I think you get significantly less than if youre willing to put your name and reputation and integrity on the line to support the claims that youre making. I do feel like the release of the report is gaining some momentum. Even barr said he expects to have something, albeit, redacted by midapril. I think the time will come very soon when were going to get a report, and lets just hope that we get a report that is as transparent and as inclusive as the law will allow so as not to compromise ongoing investigations. But i think continuing to play hide the ball with the information that might otherwise be really damning of the president or others is really not a game anyone should be engaged in at this point. Not at this point, two and a half years in. Lets also bring in New York Times chief White House Correspondent and msnbc political analyst, peter baker. Part of the reporting that your paper did, peter, surrounded summaries that mueller and his team prepped for the doj, for the attorney general. What was the intention for those summaries . I think the intention was that these executive summaries would at least be the first word out on what the mueller team found. In other words, it wouldnt just be two sentence fragments in a memo sent by bill barr, but it would be these executive summaries either whole or executively cited in anything that bill barr sent to the congress. All the attorney general gave us boils down to less than two sentences, directly quoted from Robert Muellers report. These executive summaries are four versions of what they found. They would give a more nuanced and more sophisticated, more comprehensive understanding of their findings that would presumably be, and what were told is, less definitive than the, you know, the simple declarations that the attorney general gave the congress. Ken dilanian, this report, the summary was prepared by not just william barr, but also Rod Rosenstein. How come we havent been hearing from him at all . He was somebody that was so integral in this investigation for so long. Is he now someone that wont appear again, just because barr is officially the attorney general and did not recuse himself from overseeing the investigation . Well, rosenstein is on his way out the door, but youre making a very important point. William barr hugged Rod Rosenstein pretty closely in that letter and communicated to the public that this wasnt just his decision, this was the decision of the Deputy Attorney general, who had been briefed all along for two years on the Mueller Investigation. Because, remember, people said, how can barr make a call in 48 hours on obstruction . It wasnt just barr, it was rosenstein. And i think eventually, congress will want to hear from Rod Rosenstein, because he has so much more familiarity with the Mueller Investigation than does barr. I also just want to go back to something about the anonymity, katy. Look, i want to communicate to our viewers, people are anonymous here because careers are at stake. Many of the people who worked on this investigation still work at the Justice Department. And theyre not allowed to talk to the press about sensitive matters involveing an investigation. And thats why youre hearing from them anonymously. And im glad to have the information. I would rather Robert Mueller come and testify and people go to public, but ill take information any way i can get it. I understand that, and i think as a reporter, youre going to get that. But i think at this point, this far along, with the public trust so fractured in this process, my question is, isnt it about time we hear from the investigator directly, from Robert Mueller . I know democrats are curious to hear from him. What are the chances, glenn, that democrats will be table to subpoena Robert Mueller or ask him to come and have him willingly show up and tell lawmakers and tell the public exactly what he found and characterize his report in his own words and not through the mouth of william barr . You know, bob mueller will follow the rules and he will, im sure, evaluate a request from congress to testify. Hell do what he thinks is right. But i have to tell you, if a lawful congressional subpoena is served on bob mueller, he will comply with his legal obligation to appear and testify fully and truthfully. And just going back to the report, the barr letter for a minute, katy. When bill barr says things like, well, trust me, Rod Rosenstein is with me. And trust me, even though bob mueller said i cant exclude or rule out obstruction by the president , i, bill barr, will do that. You know, i see that as something of an opening statement. And when we try cases and make Opening Statements, the judge is careful to instruct the jury, Opening Statements are not evidence. Theyre somebodys guide of the evidence, somebodys view of the evidence. But the only thing that is the evidence that you can make your decision based on is the actual evidence. The actual evidence is bob muellers report, not all of these different assertions being made by bill barr. Glenn kirschner, ken dilanian, peter baker, gentlemen, thank you very much. And joining me, democratic congresswoman from california, karen bass. Shes a member of the judiciary and Foreign Affairs committees. Congressman, thank you very much for joining us. How do you feel about needing to hear directly from Robert Mueller . Oh, i think it would be very important to hear directly from him. I mean, our first step is to get his full report, but i would not be surprised down the line at all if we get every single page, which we all know is doubtful, that we wouldnt want to hear from him, as well. What would be sufficient, in your eyes, in terms of what you get out of the report . Well, what would be sufficient would be all, apparently its 400 pages, all the underlying evidence, and all of the information so that we can look at the issues, whether we are talking about collusion or obstruction of justice, why did he come to the decision that there wasnt enough evidence to move, you know, to move forward. Why didnt he say that whether the president was indicted or unindicted, whether the indictment was sealed. You know, why did he come to the conclusions that he did . So, thats why its very important that we receive everything, the full report and the underlying evidence. Will you accept any redactions whatsoever . Well, im sure that there would be some redactions. So, it would be hard for me to say we wouldnt accept any. But heres what im worried about. Im worried about ten pages of full, you know, redactions. So, you know, i understand that some things have to be redacted, but if youre going to send us 400 pages and 300 pages are redacted, thats going to be completely unacceptable. Heres how the wall street journal is talking about this today. Their editorial board, theyre pushing back on democrats, saying the ag shuler understood on releasing the summary of conclusions last week that he would be open to contradiction by mr. Mueller if he took such liberties. Mr. Barr also knew that he would be called to testify before congress once the rest of the report is released. Theres a lot of talk from democrats that they just dont trust william barr, because he is a political appointee of the president s, and because he wrote that memo talking about what he believed to be president ial authority. What do you think of the prospect of ag barr being in such direct conflict with mueller . Do you think the chances are high of that . Oh, i absolutely think theyre high. Really and truly, the 19page memo he wrote was unsolicited. So you know that that was interpreted by many, including myself that he was auditioning for a job. We knew sessions was going to be fired. And so if he wanted to be in line for the job, we know that the way to deal with the president is to issue praise on him and talk about how theres no collusion, no conspiracy. He did that in an 18page memo or 19page memo saying that a sitting president couldnt be indicted. And then when he went through his confirmation process, you remember that many people didnt feel he should be confirmed. And if confirmed, at a minimum, he should recuse himself. He did none of that. So its very hard to take him seriously, which is why we have to see the entire report. We need him to come before the Judiciary Committee. I know chairman nadler is going to have him come before the committee. He needs to explain himself. I want to ask you about another subject. The house has reauthorized the violence against women act earlier today. The vote total was not as bipartisan as it usually is. Why is that . Well, i think that its unfortunate. I think that many of my republican colleagues were squared away from voting for the violence against women act because of the threats from the nra. You know, the National Rifle association wanted people who had been either victims or perpetrators of abuse to have access to guns. Thats something that is, you know, completely ludicrous. So i know that that is one reason. I also think that some of my colleagues were not happy with the protections and the expansion of the violence against women act, to include the lbgt and trans community. So those might be some of the reasons why they chose not to vote for it. One thing i want to do, and i havent seen it yet, i havent looked at the vote, but out of 199 republicans, theres only 14 that are women. And so the question is, how did the republican women vote . And also the cosponsor it was my legislation. The cosponsor of the legislation was a man. So even out of the 14 women, they couldnt have one of them step up to be the lead cosponsor of the legislation . It was a pretty sad moment, i have to say. And one final question, the death of the rapper nipsey hussle, he did a lot of advocateadvocate work in your district. That was such a tragedy. I will tell you that the grief, the outpouring of grief. You know, he had turned his life around and made really significant contributions to the community, starting businesses, hiring people. He was a developer getting ready to embark on a major project. So he definitely has a stamp on the south l. A. Area in a very positive way. So i think it was such a tragedy, his loss. The oversight and Reform Committee announced it will subpoena an Accounting Firm tied to president trump. But perhaps the most anticipated investigative effort comes out of the ways and means committee. In a letter to the irs, chairman richard neal requested six years of trumps personal and business taxes and asked the agency to confirm the president is, in fact, under audit, something hes used as a justification for not releasing his tax returns for years now. In a statement, neal said, this request is about policy, not politics. My preparations were made on my own track and timeline, entirely didnt of other activities in congress and the administration. But the president and his press secretary have made it clear that they will oppose neal request. Im always under audit, it seems. But ive been under audit for many years, because the numbers are big and i guess when you have a name, youre audited. But until such time as im not under audit, i would not bin klined to do that. Look, were not interested in playing a bunch of political games like the democrats in congress clearly want to spend their time doing. The president s focused on actually solving real problems. Joining me now from capitol hill, nbc news correspondent jeff bennett. So what is the policy that neal is referring to, not the politics . Reporter hey, katy. Well, chairman neals request is rooted in an legal technicality, part of the irs code that says the irs has to furnish or turn over to these relevant committees the tax returns of any taxpayer, once theyre requested. And i actually looked up the code and it reads this way. It says, the treasury secretary shall furnish any committee with any return information specified in such a request. And neal is actually turning the president s audit excuse on its head. The president says, im under audit, ive been under audit, and because im so rich and so famous, its taking a long time. Im not being glib, hes actually said something pretty close to that. So neal is saying, okay, then, lets make sure that this audit process is fair and thorough. Lets make sure that the irs is doing its routine function in auditing sitting president s and Vice President s. And over the course of that process, i also want to see the last six years of your return, mr. President. So when you hear the white house say that theyre not inclined to comply, this is one of those rare moments in American Life where the view of the president does not really matter. At least not directly, because neal is not making the request of the white house or of president trump. Hes making the request of the irs commissioner, and he has the law on his side. The question is, will the treasury secretary slow walk the request . If he does, well, then you have democrats who are getting ready for a protracted legal battle. So walk me through that. So they made the request of the irs and nancy pelosi cited the very same law that you just cited. So theyve made the request of the irs using this section of the u. S. Code. And how can the treasury secretary, steve mnuchin, how can he slow walk that . Reporter there are all sorts of procedural things he could do to slow up that process. But democrats on that committee have said, if they dont get a satisfactory answer from the irs by this time next week, thats the timeline that theyve been giving me, then theyre going to issue subpoenas and fight this in the courts, katy. But the question really is and as you well know, donald trump has dispensed with almost 50 years of precedent, both as a candidate and as a president in not releasing his tax returns. And so you have democrats and republicans to include lindsey graham, who make the case that the American People deserve to know if this president or any president s public Decision Making is influenced by his or her but in this case, his private interests. So did the president benefit from that huge gop tax cut . We dont know. We know that Michael Cohen says that donald trump has inflated his own income when it came time to get a loan, but deflated it when it came time to pay taxes. There are all sorts of questions about that. So theres the politics of it. Neal is pointing to the policy. But look, lets keep it real. Democrats are playing politics here, too, because chairman neal is catching it from the far right of his own party, who have for months, ever since democrats regained control of congress, have been pushing him to get these tax returns. Some of those liberals even threatening to primary richard neal. So hes feeling the pressure here, too. The far left of his own party. Donald trump has been claiming audit now since the very since the early stages of the campaign. His lawyers released a letter saying he was under audit, but they never released a letter directly or any documentation directly from the irs confirming this. And theyve refused to do so. And again to all of these viewers who dont know this, even though weve said it a thousand times, we can ask the irs, but they dont have to respond to us. In fact, they cant talk about an individuals taxes. And when it comes to the president of the united states, his taxes and his tax returns are literally locked in a vault. Jeff bennett, jeff, thank you so much. For keeping it real. Reporter always. And if you have the cash, you can rub shoulders with the president at maralago, or at the very least, you can get on to the property. So why that worries security officials. It shouldnt come as too much of a surprise. Stay with us. Too much of a surprise stay with us you pay and you get in. That is how one white house official described Donald Trumps maralago to the Washington Post. This week, we learned a Chinese National was arrested by secret service at the resort and just three weeks ago, mother jones reported that a maralago member claims she could sell chinese executives special access to the president. Today, House Oversight chair, elijah cummings, will meet with the secret service to address the clubs security policies. Joining me, Washington Post political reporter and msnbc political analyst, david fahrenthold, and former assistant director for counterintelligence at the fbi and an msnbc National Security analyst, frank figliuzzi. Gentlemen, thank you so much for being here. So the reporting on the Chinese National had been that she got past security and she was skac y carrying malware in her bag. Heres some reporting that Pete Williams has sent out. He said a senior Law Enforcement official says the current thinking about the woman arrested over the weekend at maralago says she may well have thought there was a chinese american event going on there that she wanted to attend. And while their investigation is still underway, they are leaning against the idea that she was a spy. As for the malware on the thumb drive, the current thinking is that if she acquired it in china, virtually anything sold there would have malware on it. Regardless of what this womans intentions were, david, explain the security holes and how one goes about getting into the club. Well, the thing you have to remember is that this is its Donald Trumps home in florida, but its also a working club that has hundreds of members. And then even hundreds more people coming in on a deal basis who are staff, who are going to balls or luncheons in the big ballrooms. Theres tons of people coming in. And the secret service has to check them all. But theres always mistakes. And the more people you have coming in, the more opportunities you have for there to be mistakes. So while people going to the club have to check in and make sure their name is on a list, theres also this culture weve heard from members of making exceptions. So youre not on the list . Call ahead. Youre not on the list . Well, i know you. And people get in even though theyre not on the list. And that culture of exceptions is what made it possible for this woman to get in. She wasnt on any list, she didnt know anybody. But they were used to making exceptions. She said that her name matched a members name and said, well, okay, come on in. Getting into a political rally with the president as a member of the press is difficult since youve got secret service. You have to be vetted by secret service to get through some of those rallies, especially when you were going on to Donald Trumps property, maralago, or his golf clubs in florida. They needed to know who you were. Why why would it be concerning if the president s not there, that somebody could get past those guards . I see this as symptomatic as a much larger security issue at maralago, but around the president generally. So people should understand that malware on a thumb drive, incertifiinser inserted anywhere on that property could potentially find its way to the president S Communications and beacon that back or monitor even keystrokes on a keyboard. And thats something we need to be worried about. Is this woman a spy . Highly unlikely based on what were seeing and hearing so far. But this is a Security Posture the president insists on thats driven by whoever can or defaults to who can ever book a weekend in palm beach. And someone with malicious intent could potentially get past the guards. And what if that were the case. And so the secret service is essentially pushed aside and doesnt control the domain. Why is that . Because we have a president who spends his weekends as a resort thats based on profit and not upsetting clients. Hes not at a ranch. Hes not at camp david. Hes in an open, public environment thats going to have breaches. And its, again, symptomatic of somebody who uses a personal cell phone for government business, ignores security clearance recommendations. And ignores security briefings from his intelligence officials. David, it is not just those who might have malicious intent. At his club, if you pay to get in, you essentially pay to get access to the president , to be able to rub shoulders with him, if he is there. And bend his ear on any number of issues that you might have an interest in. Thats right. Weve already seen the you know, the way that that access, that paidfor access can be used to influence him. Propublica had that great story about some random dentist from scranton who, because hes a member of trumps club, got in and gave him a note that said, dear king and then laid out a proposal to the American Dental Association wanted in front of the president. But its not just influence. There are so many intelligence opportunities here for people to just get into the president s you know, the same area. They dont have to go right up to him. As frank talked about, they could insert malware, install eavesdropping equipment, or just overhear whats being said and observe him and his aides. Theres so much to be gained by getting in that space, and it seems relatively easy to get into that space. We saw he hosts World Leaders there and he hosts World Leaders and has dinner with them on the porch at maralago and in front of other members and talks about foreign policy, talks about launching missiles, talks about what hes thinking with north korea. So, look, i get the fact that we have a president who wants to do things differently, but this kind of attitude of, you are not the boss of me, when it comes to security, he needs to understand that his security is tied to National Security. Its bigger than him. We cant have these kinds of breaches occurring, and we cant have these kinds of vulnerabilities. Back in january, my colleagues here at nbc news reported that Jared Kushners application more topsecret clearance was rejected by two career White House Security specialists. Today, we have learned that kushner is senior white house official one in documents released by the House Oversight committee. As the Washington Post reports, a whistleblower named Tricia Newbold told the panel that kushners clearance was specifically denied last year because of foreign influence, private business interests, and personal conduct. Joining me now, nbc news White House Correspondent, Kelly Odonnell and Washington Post political Investigative Reporter tom hamburg. So miss newbold is giving us some more reasons why Jared Kushner was denied. What veelse have you learned . Miss newbold testified last weekend for hours before the House Oversight committee, and she described in some detail the pressure that she felt under and the extent of the denials that she and a colleague in the security clearance Processing Office had issued, for individuals she described in the documents that were first released as white house official 1, white house official 2, and white house official 3, as you just mentioned. We now know that white house official 1 was Jared Kushner and that she had expressed multiple reasons for concern about kushner, but her recommended denial of his security clearance was overruled by her superior in that office. And kelly, what does the white house say . Reporter well, they refuse to really talk about the security clearance process. Jared kushner himself was interviewed and he said that hes been accused of a number of things that turned out to be false, but he did not directly answer this. I happened to be the Pool Reporter yesterday in an event with the president and i asked him if he had approved the security clearance for Jared Kushner or others, and he responded, thank you, thank you, meaning he didnt want to engage in questions. Then i asked something on a different question, and he did give an answer, so he could hear me and he could choose whether or not he wanted to respond. So the white house has said that the procedures have been followed properly, but they dont discuss publicly the process for security clearance. This has been a daging issue. It was one that john kelly, the former chief of staff to the president had a lot of issues with. And it raises questions, because, in particularly, kushners case, he does have international businesses. He had to do many repeat attempts on his documentation, the forms that he had to provide, augments that to provide more contacts and more information. The president has been asked about whether he intervened and said no in an interview. And subsequently, theres been reporting that he did because he does have the authority as president to grant security clearance to anyone he chooses. But he has not engaged on the question since that time. So its one of the reasons we have repeatedly raised this issue with the president , to try to find out if he did so, why he did so, and so forth. So its one of those things that the white house really has just tried to avoid talking about. And Congress Wants to get at this, and they have suspected carl kline, the official who overruled at one point, no longer working in that personnel security office, but theres a dispute there about how much hed be willing to talk about in a public setting. Katy . And how much do Congressional Democrats expect to get out of this process, that the president has ultimate authority, tom to issue a security clearance, to whomever he pleases, what can democrats find out . And how can they how can they push back . So, weve heard from both the chairman of the oversight committee, ely elijah cummings. Theres no dispute that the president does have authority to issue a security clearance and can overrule recommendations, but the question is, was this close adviser and relative of the president , in fact, present some National Security issues in his approval process, was it handled normally . And we quoted a former Justice Department official in our story today, david chris, who served in both the bush and the obama administrations and an expert in security clearance issues. And he said, this is a very significant issue. The question is not a legal one, but its an intelligence matter. And the question is, is there someone in the white house close to the president who could be considered vulnerable in some way to manipulation by foreign governments . And its that question that the security clearances are designed to answer. And its that topic which both intel and House Oversight committees want answers to.
