Hes getting everything wrong about it. President trump promising to rebuild the fbi less than two weeks after attacking the bureau, claiming it was in tatters. In his speech at the Fbi National Academy in virginia trump sang the praises of Law Enforcement graduates who had just completed a special program of specialized training and promised to always be a champion for the Nations Police officers. Being a Police Officer is not just a career. Its a calling. And ive seen it. I have so many friends that are Police Officers. So many people in the fbi. These are great, great people. I want to send a message today to those who threaten violence against our police. We will protect those who protect us. And we believe criminals who kill Police Officers should get the death penalty. Moments before the ceremony while speaking to reporters he made news surrounding a russia investigation hinting he wouldnt rule out pardoning mike flynn. I dont want to talk about pardons for Michael Flynn yet. Well see what happens. When you look at whats going on with the fbi and with the Justice Department, people are very, very angry. President trump is one of those people who is very angry. I cant believe he said that, dont want to talk about it yet. The first time i ever asked him that question, and we dont know the answer to that question because the white house and his lawyers wont say. So in addition to that major headline, the fact hes not ruling out a pardon for flynn, thats still a critical piece of information not only is the press trying to drill down on but undoubtedly investigators are as well. He made news on ray moore, that ray moore should concede after losing that seat in alabama. Then he was pressed on the fbi. The president , the white house have been critical of the fbi in the wake of revelations that a top official there was fired after Text Messages were found that were critical of President Trump. So they say there are conflicts of interest within the fbi. Kind of created a tense backdrop to the remarks he was giving today. He was asked, though, before leaving does he still think the fbi is in tatters . Take a listen to how he responded to that. Well, its a shame whats happened with the fbi. Were going to rebuild it to be bigger and better than ever. Its sad when you look at the documents, and how theyve done that is disgraceful. You have a lot of angry people seeing it. Everybody, not me everybody, the level of anger at what theyve been witnessing with respect to the fbi is certainly very sad. Reporter now as for the president s remarks at quantico, i heard you talking about this with hallie, some of them were reminiscent of campaignstyle remarks. Not only did he mischaracterize the visa lottery program, like its a lottery when its a vigorous screening process. Crime in chicago, what the hell is going on in chicago, a lot of people remember thats a similar phrase he would use out on the campaign trail. He did have high praise, though, for the Law Enforcement community while giving those remarks at quantico. Back to you. The questions he took when he spoke to you and other reporters, was that scheduled, was it planned . Because when i sat there and watched in real time, it seemed like it was unforced error after unforced error, and whether i was on trumps legal team or senior white house staffer on basically the eve of getting tax reform which would be a tremendous win for the president , why would he put himself out there and at the very least say things untrue on one hand and other things that leave him exposed and vulnerable . Reporter steph, the background to him talking to reporters, this is something President Trump has been doing with more frequency. He often will stop and answer questions on a whole range of topics. Today was one of those moments. Tax reform is probably one of the reasons he wanted to stop. He struck a note of confidence. We pressed him over and over again if he would get marco rubio onboard. Hes a no vote until they add more money to the Child Tax Credit. I put that question to the president squarely, will he be open to increasing the Child Tax Credit. He said, yes, he will be. That is a significant headline when it comes to tax reform. That is the key focus. He also said day the Child Tax Credit increases and democrats never do anything for children when we all know that the Childrens Health insurance program, im not even going to say its on life support, is no longer being funded and republicans are saying we dont have the money. So the president clearly exposed himself there when he didnt need to. Reporter right. I think as you pointed out, steph, these exchanges were having now with more frequency on the south lawn, the president is freewheeling to some extent. That was yet another example perhaps of that. Again, i think he sees it as a chance to push his agenda and right now that is taking aim clearly at the fbi what he has said have been conflicts of interest, vowing to rebuild it, and then again striking that very confident note on tax reform with republicans set to unveil what they hope will be their final version this evening. Clint, i want to bring you in. We talk about National Security issues. But lets talk about the fbi. You spent time in the fbi. Every former fbi and current fbi agent ive spoken to in the last week or so is of one voice. As an agency it may have issues it deals with on an ongoing basis. To say the fbi is in tatters and in need after rebuild is not only incorrect but a lot of people felt highly inappropriate for the president to be commenting on the fbi in that fashion. For sure. Hes degrading the integrity of a u. S. Institution which is going out and trying to execute the Justice Program he laid out in a speech. You want fbi agents to go into trumpsupporting areas and do investigations, find leads, get tips. When he talks about making the fbi bigger and better, guess who was picked to do that, mueller. Right after 9 11, he kept the fbi together. They were talking about breaking it into two pieces. Mueller did it so well that he was actually asked to stay by a democratic president to stay longer. Back then there were issues with intelligence gathering, real structural issues in our Law Enforcement agencies that needed to be repaired. That still wasnt about agents. That wasnt about the men and women who put their lives on the line every day who most americans dont know of ever. And it also puts a divide between the state and local Law Enforcement. The whole part of the nexus, how we take down ms13 is to build confidence not to degrade them. I cant even put my finger on why he would ever do this. Its perplexing to hear the president say were going to rebuild it and make it bigger and better. With what money . Budgets across the board slashed, look at the state department, what mulvaney is doing. How that audience received the president s remarks because the president does consider himself the law and order guy yet he has pretty extraordinary overreach and anger when he realizes whats out of his, call it, jurisdiction. Reporter i think the audience was receptive to the president s remarks when it came to supporting local Law Enforcement. They have tried to draw a line between the policies of the Justice Department and this one on pattern and practice investigations, allegations that Police Officers are violating civil rights. The attorney general said this Justice Department will pursue those less aggressively because they make it harder for local police to do their jobs. The message of sanctuaries cities have been more controversial. Some local police saying that its good policing not to carry out federal immigration enforce many. Some agreeing with the Justice Department. In terms of the president s comments about the fbi i think hes trying to draw a distinction between what he sees as the leadership of the fbi under james comey. And now were going to change things and things will be better. It did seem he was trying to thread the needle. Obviously very strongly supportive. Is there any truth to a number of references he made to anger, everybody is angry at the fbi. Do we know thats true . Anger, so much anger. I took that to mean anger about the recent disclosure of the Text Messages between the fbi agent who was working on the clinton email and the russia investigation and a senior fbi lawyer saying that caused considerable anger. Of course when Robert Mueller found out about the texts in july, he relieved that agent of his responsibility for the russia investigation. Thats what i took that to mean. Obviously its an embarrassment for the bureau. Clint, to petes point the president is trying to draw a distinction between the fbi and the fbi under james comey, when we saw chris wright speak, he wasnt singing the same tune the president is at all. About the fbi being in tatters. So he may be drawing a line, but chris is not. The strategy will be lost on the public. They will not make that distinction. The people running the fbi right now were the deputies to muellers deputies. They all move up the chain, and theyve all been there a long time. Theres a long history and career. They are competent people who have worked their entire lives in this organization. Theyre not going to waste it on political partisanship. They dont have time for it. I cant recall any time in the military the intelligence community, the fbi any organization where people stopped and said, well, how would this play in terms of democrat republican . They march forward. They have a mission. Nobody talks about the structure, not really a conversation we have. It could be devastating to the republican party. Youre talking about a more conservative leaning organization, and so if you keep pushing this especially from congress, youre going to have a lot of conservative, former fbi members, retirees or people saying what am i listening to here . To get senator marco rubio onboard negotiators are planning to increase or maybe they already have the refundable portion of the Child Tax Credit. Mike lee, jeff flake, Susan Collins and bob corker all say they are undecided. Two other republican senators john mccain and cochrane could be absent because theyre suffering health problems. Senator mccain is hospitalized to deal with side effects of his treatment for brain cancer. Despite all of that President Trump was optimistic this morning. I think were doing very well on the tax. Its something that will be monumental. Have you seen the final tax bill . Ive seen it. I think its going to do very well and we will be in a position to pass something as early as next week which will be monumental. Joining us live from capitol hill, garrett, walk us through first, the late change that could win marco rubio over. Reporter marco rubio had been the late addition as a holdout. He said yesterday he would vote no unless the righters increased the refundability of the Child Tax Credit. Generally speaking to add to the amount of money people could be able to get back in their refunds from this Child Tax Credit as lawmakers have been coming in to review the final copy, we heard from one of the lawmakers they have indeed added a couple hundred dollars to the refundability of this and are hopeful thats going to be enough to sway marco rubio and get him to vote yes. Rubios office has told nbc theyre waiting to see the final language here. This is the tax bill writers trying to come up with a compromise to keep everybody onboard. You raise a great question. Weve been hearing about all the compromises, gifts in this bill, the good stuff, the things people want, lowering additional rates. We have not heard much about how thats going to be paid for. Most likely will be sliding around some of the start and end dates for the cuts. We already know the cuts to the individual tax rates are set to expire in a couple of years. Theyre playing the game to keep the price tag down. Its very complicated. Theres congressional math involved that they cant go over a certain deficit increase. You just tweeted provisions removed from final tax bill per hill sources familiar with it, student loan deduction removal, medical expense, Johnson Amendment repeal, fetal personhood language. What does that mean . Higher ed tuition waiver tax, is that good for people who get the Higher Education waiver or bad . Im not sure which one were talking about. Its good for graduate students. It treated waivers for graduate students as taxable. If you get a 50,000 tuition waiver on 100,000 tuition, 100,000 would be taxable. This is good news. Weve gone in this direction and weve taken out the student loan deduction. People who lost the ability to deduct medical bills in an earlier version of the bill will now get the ability to deduct the high medical expenses . Income threshold will fall from 10 to 7. 5 so a larger number of families will have access. How are they going to pay for that . Thats good news. Reporter its a great question. We dont know the answer to that. As garrett mentioned there will be some changing of the start and end dates there and then some discussion of potentially setting income individual income tax cuts earlier. Theyre monkeying around with the minimum tax on the corporate side and individual side. I think we could be in for some surprises here in terms of how they fit this in the 1. 5 trillion deficit bobbing. Are they concerned with the projections . When you look at the analysis Steve Mnuchins team put out this is it, the one page, says virtually nothing. Lets be fair, its a summary, not an Economic Analysis. It is not any sort of Economic Analysis. It factors in there will be welfare reform and infrastructure, neither of which there is a plan for. Does anyone seem to be concerned about this . Not really. I have not heard a lot of concern other than senator bob corker who is a deficit hawk who has said theres too much red ink in the bill and doesnt believe it will pay for itself. So many others including members of the house and republican senators from Mitch Mcconnell all the way to Susan Collins up and down the spectrum believe that it will pay for is self. Theres a little bit of faithbased thinking, no analysis that suggests that. Most say there will be economic growth, possibly hundreds of billions of dollars worth of extra revenue but it will not cover the full cost and there will still be about a trillion if not more in red ink. Right. And, garrett, all of the analyses weve seen at best, even conservative groups have said its half a trillion, 500 billion. We have some estimates as high as 2 trillion. For purposes of the house there has to be a particular cap on it. Why all of a sudden the Wishful Thinking from people who otherwise would have described themselves as fiscal conservatives who are very worried about increases to the deficit . Well that treasury document is congressional fan fiction saying this can pay for itself if we get all of the other things down the line. You are seeing the stakes for republicans in congress have gotten so high this bill has taken on almost mythic proportions. Its so important for their future to say they passed it. Look, if youre a republican running for reelection in 2018 and you say we passed tax reform, we confirmed neil gorsu gorsuch, thats something you can go back and sell to your constituents. If you dont pass this bill and youre hanging your hat on a Supreme Court justice, thats just not going to be good enough. I think what youre seeing here is pure politics. Garrett, that is something you could go back and hang your hat on as a big win, but everyday constituents care less about headlines in politics and care more about how it actually impacts their lives. So to President Trumps base who many of whom have been who have suffered at this time of exaggerated income inequal, look at Mike Bloombergs oped calling it the billiondollar blunder how this tax bill doesnt just not address the issues that ail america it exacerbates the problem. Yes, republicans will be able to walk home whistling dixie by the end of the year, but they have to get reelected in the years to come. And whether youre talking about the Economic Analysis ali just went through or some of the points Mike Bloomberg makes in his piece, it could be tough to live with specifically for President Trumps base. Sahil . I think thats right. I think where the rubber meets the road is going to be what middle class families will feel specifically between now and the 2018 election because thats the next big test. We looked at the numbers and we found the average middleclass family would get about 800 to 1,200 depending on the analysis, abouted 15 to 23 a week. Are they going to notice that . I look at the stimulus plan when president obama offered an 800 tax break to married couples and 95 of working households almost identical to what the plan would look like immediately. Almost nobody felt it. Much higher percentage falsely believed they never got a tax cut or got a tax hike. I think it will be difficult for republicans to sell this from a messaging standpoint. As garrett mentioned they want to end the year having done something. They dont want to be home emptyhanded for christmas and going into an election year. Political correspondent sahil kapur, garrett, thanks to both of you. Here is the other problem, stephanie, there are broken promises. This was pitched as something and seems to be something else. Were all waiting to see the final version. We want to take a close look at what republicans originally claimed and what has emerged in this close to final version of the bill. Claim number one, the bill will not increase the debt. The reality, this is the senate scorekeeper, will push the debt up by at least a trillion dollars more over ten years. By the way, this is one of the more conservative estimates. Virtually no one can give us evidence the debt is not going to go up. You may not care about this but the promise was its not going to increase the debt. Its going to increase the debt. Claim two, it was designed to benefit the middle class. Corporations get a permanent tax cut, individual tax cuts sunset, expire by 2027. Almost everyone making less than 75,000 a year is going to be paying more out of their paychecks so its not only just a temporary tax cut, tax cuts for people making under 75,000 may go up. Claim number three, it wont benefit the wealthy. The reality by 2027, the wealthiest americans get 62 of all of the benefit of this tax cut. It also lowers the top tax rate, individual tax rate, from 39. 6 to 37 i want you to stay on that just for a minute. Think about all the people pushing back about whether its Health Care Issues or tuition, who is it, i would love to know, what lobbying effort, what member of the gop made the argument to cut that top tax rate from 39 to 37 . It clearly was not a promise the president made on the campaign trail. Not at all. With the exception of some reporting we had seen after the Senate Version went through at a fundraiser President Trump, some rich donors in new york may have had the president s ear, have something for me. I cant find any evidence of who even asked for it. We dont know who asked for this but your top marginal rate will go down and, by the way, this raises the threshold for when the alternative minimum tax and the estate tax kick in. While the amt which benefits the wealthy and the estate tax benefits the wealthy are staying in the bill, you actually get to make more money before you pay either of those taxes. So, again, big win for the rich. And the new 20 rate for passthrough businesses, President Trump and his family, stand to benefit substantially from that. Thats a big, big discount. If you work and get a wage from a company, you cant fiddle with that. If you are a contractor and passthrough income you get to pay 20 . The claim number four which is an interesting one this is the one we really sit on, the cuts are going to grow the economy significantly. The Treasury Department claimed this week let me just grab this for a second in this the Treasury Department loves onepagers. We like documents we can read. They claim this will lead to 2. 9 increased growth over ten years. The reality most nonpartisan groups and experts predict 2. 2 growth over that period. Here is what Federal Reserve chair janet yellen said about the rosy estimates. If the package were to stimulate growth of that magnitude, the Federal Reserve would welcome that. But it would be challenging to achieve numbers like that. Its not impossible. The economy is a dynamic thing when people start to feel good about it as many do right now, you start to see the stock market go up, people who were not engaged in the workforce trying to get back into the workforce, businesses making investments. It all comes back to demand. We are a demand driven economy. Factories build and expand. Ali, this is hard cuts and on the other side a lot of hope. Thats right. And the one thing you do want to point out, remember, when youre kicking up the deficit this much, you stand to see loads of programs cut. The greatest chance we have for kids to have economic and social mobility is through education. We talk about the number of people who may be eligible to get certain credits, and they dont know how to file their taxes. No one teaches you that. As part of the curriculum theres no personal finance. If we cut school budgets, if we cut programs that help americas poorest, specifically kids, were going to only continue and support a welfare state which is the opposite of what republicans want to do. District court for the district of columbia struggling to answer questions from a republican during his appearance. This came a day after the committees chairman, republican Chuck Grassley said two of the president s nominees would not be confirmed to the federal bench amid questions of their qualifications. Joining us is analyst, former chief spokesman for the Justice Department matt miller. Matt, in fairness we dont often cover the appointment and hearings of District Court judges. Some people do. How unusual is this that two of these nominees wont get approved and this one nominee couldnt answer what republican senators thought were basic questions . So ill take the first question first. In terms of federal judges, judicial nominees, its something thats rare but it does happen. It happened at times in the obama administration, at times in previous administrations but these are the first two nominees to have withdrawn under the Trump Administration and i think two things. One, its a sign that in both cases they were grossly unqualified and said offensive thin things. One had blogged in defense of the kkk, the kind of thing thats hard to make up. And it shows a little bit of pushback from the republicans saying there will be some bare minimum standard. At the same time theyve done that. Earlier this week a federal Appellate Court nominee was confirmed rated unqualified by the american bar association. Theyre not stopping all the unqualified nominees. What you saw in the hearing was another nominee while he did pass the bare minimum standard under questioning and not harsh questioning, factual questioning from a republican senator shows he has no place on the federal bench. Lets talk about why this is important because the president has had 12 Circuit Court judges approved, the most of any president in his first year. And Supreme Court. You have a Record Number of judges. You have neil gorsuch to the Supreme Court. So if you take President Trump. Those who care about school prayer, gay marriage, these are lifetime appointments. So does the success or track record, the speed the president has the go egotten their seats, this a huge win for him . This isnt a project that just started with donald trump. I doubt very much this is the kind of thing trump actually cares about. Its hard to think that he cares about judicial philosophy. He doesnt. President trump loves to have support and for evangelical family value voters who supported President Trump win, lose or draw through the access hollywood tape, many of us scratched our heads saying this is morally reprehensible behavior. Why are you okay with it . This is the devils bargain they made and this started before he was elected. The reason hes had so many judicial nominees to send up, Mitch Mcconnell and republican senators the last two years basically stopped confirming judges. There were a few confirmed but most famously they wouldnt let garland through. So he came in to office with double the vacancies that president obama had when he entered office. The republicans made sure there were vacancies to fill. Theyre threatening even to suspend the blue slip process, a process that allows home state senators to slow down and blog nominee that is they disagree with. Matt, good to talk with you. How is the fcc getting away with this . The federal Communications Commission did something absolutely despicable today. They voted to put an end to Net Neutrality. As long as they tell us theyre doing it now, Internet Service providers will be allowed to slow down or block web traffic to any website or streaming service they like which benefits the big Telecom Companies and does the opposite for all of us. Even though 83 of americans support Net Neutrality and 2 million of the people who wrote to the fcc to oppose Net Neutrality were bogus. Many turned out to be dead people. Anger over that video, all kidding aside, pales in comparison to the anger over the fccs decision to scrap Net Neutrality rules which banned internet provideers from blocking or restricting access to specific content. With us now is one of the fccs commissioners who voted against repealing Net Neutrality rules. Commissioner clyburn, thank you for being with us. Ultimately this went down along party lines. It was fully expected. Were trying to get ive been struggling to get a bigpicture sense of what the unintended consequences of this may be. Im prepared to take Certain Companies at their word that theyre not intending to throttle back services, and theyre not intending to favor some services over others, but by repealing the Net Neutrality law, what remains is the need for an Internet Service provider like our Parent Company comcast to put out on a website if they are allowing services to have faster or slower access if theyre throttling back which means it isnt against the law if the requirement is theyll have to tell people theyre doing it. Right. And all you have to do is disclose. Correct. And there will be few, if any, restrictions. We have taken ourselves out of the game. We pulled our own teeth at the fcc, so were toothless, were powerless. If they disclose, then they can block, they can slow down, they can control. When they say they have no incentive to do so, i say pass this pro law. They have indeed slowed down competing traffic, blocked competing voice services. Theyve done so in the past if theyve had business interests. Theyve shown preference to their interest over competitors attempting to thrive online. Thats whats at stake. Its more than just voting with party lines. Help us understand who is it that wants this . Who are the republicans . We know obviously that ajit pai, your colleague, wants this. What is the argument they or who are the people making the argument this will be good for the American People . I cant seem to find it. We passed strong Net Neutrality rules in 2015. There were tens of millions of when it comes to communications will be a cop on the beat, the one that will protect you. We answered two questions on yesterday. Number one, we said that Broadband Service provider, not you, will be on charge of your online experience. Number two, we punted. We said the federal trade commission, the ftc, will be the one to protect you. What we did not tell you is that the fcc doesnt have real clear authority, and the ftc can only help you after a harm is done. So if you can prove that its unfair or deceptive, then the ftc can protect you. But its not deceptive if ive disclosed, and who knows what the definition of fair will be going forward. Given what a huge role the internet plays at this point in all of our lives, have you asked fcc chairman aji pi about that video he made for the daily caller . Yes, youre seeing the deejay shake take action, but hes in that video with a woman who is involved in spreading the pizzagate conspiracy, and this is the man who is the chairman of the fcc. Have you had a conversation with him about it . I have not. I saw the still, but i only saw the video this morning. I would just say this. He has the freedom to express himself, number one, and i wish i were as happy as i see him in that video. I am not happy because i know the consumers that want, expect openness and inclusiveness over the internet. Those who are trying to have Business Models that are dependent on an open and online experience, they are at risk now. In a couple of months when all of these rules go into effect, because its going to take a few months for all of them to go into effect, Small Business owners who are trying to make a living on line, individuals who are trying to get informational services, they will not be assured that the applications and the services they are trying to have access to, that they would not be blocked or slowed down. And that in and of itself, with Small Businesses being the backbone of our economy that are dependent on an open and fair internet experience, they will be at risk. So the issue is that the companies, if we go into a world where companies can pay for a fast lane, basically, or somehow subsidize it so there is a slow lane and a fast lane, the ones that can pay for it, the Biggest Companies in the internet space right now were all moms and pops. They started as Small Businesses, in a garage or something. There are fears that we will be freezing the internet in time. You wont be able to be a facebook competitor or a netflix competitor because the real netflix and the real facebook will be able to pay for the fast lane. But all the critics of that neutrality need to say all of you need to take a breath and calm down. Youre hyper ventilaventilating something that we have no proof will happen. What do you say to that . My thought is your Internet Service provider today does not look like youre Internet Service provider of 10 years ago. They have content. They actually own media companies. They have all these side businesses that there are lots of people who are dependent on their Business Models being able to thrive on line, might be competing with these very same Internet Service providers. The fear is they will be a preference, so favoritism to their business interests and my interests, my dotcom, will be left in the dust. So in 2015, we leveled the playing field. We said, you cannot prefer your traffic over others. Now all you have to do is put it in a small print in paragraph 25, and you will be able to do what you want. You will be able to control my experiences, you meaning the Internet Service provider, and i have to hope for the best. And there is no agency that will stop it. And ten years ago, you didnt have to hope for the best. You knew that you had the same access to the internet if you wanted to start a dotcom. Because we had those rules in place, absolutely. And also ten years ago, the internet played a much different role in our life. People now consider the internet to be a utility. Ten years ago, it wasnt. It was an extra.
