Capitol hill next week. Mr. Cohen clearly had some significant credibility problems. Prosecutors and agents have a lot of experience working with witnesses that have credibility problems. What he really did yesterday was create a whole bunch of additional witnesses that the house is now empowered to try to bring before them. Folks like Allen Weisselberg at the Trump Organization, the president s children. The good news is what we did see out of the Michael Cohen testimony was there was a lot positive for the president. He confirmed what weve all said, that there was no collusion with russia. The fact remains there are at least four or five areas where there is very credible evidence that the president committed very serious crimes. The list of contenders and the democratic primary just keeps growing. Another democrat throws his hat in the to 2020 ring as Washington Governor Jay Inslee announces hes running for president and running on one issue. Were the first generation to feel the sting of Climate Change and were the last that can do something about it. All right. A lot of reaction coming in today to the New York Times reporting that President Trump himself ordered top secret, sorry, security clearance for soninlaw and Senior Advisor Jared Kushner, overruling the concerns of intelligence officials. Now, to be clear, as head of the executive, the president has the ultimate authority to decide who gets a security clearance and who doesnt, but it is exceedingly rare for a president to overrule intelligence. President trump and those involved in this story continue to deny that he interfered. The times report reports that trumps decision was so troubling that the then chief of staff john kelly and White House Counsel Don Mcgahn both wrote memos documenting trumps order. But in an interview in january, President Trump told the New York Times he did not tell anyone to give kushner security clearance. Did you tell general kelly or anyone else in the white house to no, i dont think i have the authority to do that. Im not sure i did, but i wouldnt, i wouldnt do it. Jared is a good i was never involved with his security. Now, just three weeks ago kushners wife ivanka said the president had no involvement, or in her or her husbands clearances. Depp White House Press secretary told the washington post, quote, the white house treats all security clearances individually, neutrally, and equally. And in a statement to msnbc just moments ago, a spokesman for kushners lawyer said in 2001, white house and security clearance officials excuse me, 2018, white house and security clearance officials affirmed that mr. Kushners security clearance was handled in the regular process with no pressure from anyone. That was conveyed to the media at the time and new stories, if accurate, do not change what was affirmed at the time, end kweet. Quote. Ken, tell us what the story is, nbc news reported White House Security officials initially rejected Jared Kushners application after a background check which raised concerns about a potential for foreign influence. So, i guess if donald trump can legally arrange to get him clearance, why would he deny having done that . The only reason that makes sense to me, ali, is that they were trying to avoid embarrassment. You know, the notion that there was nepotism at play here, that donald trump was going to cast aside the rules and the bureaucracy for granting security clearances and simply give one to his soninlaw and his daughter. But thats what happened, because as you said, we reported that the career officials took a look at Jared Kushners security clearance application and said he didnt deserve one. They were overruled by their boss at the white house. That man did that because donald trump ordered it done through his chief of staff and his white house counsel. And both of those men wrote memos about it. Now put house is going to want to see those memos. They are investigateth the whole process of how the Trump Administration grants security cleerngss and there is a real Public Policy issue because there are valid concerns about whether foreign governments have influence over Jared Kushner because of his many foreign business entanglements. Bradley, there is a real Public Policy issue as ken says. There may not be a legal issue, though. Correct, ultimately there is not a legal issue here because what has been said by the white house is true in that the president has the ultimate authority. Ali, he could give you a security clearance today. He could give you the most top level security clearance and access to Nuclear Codes if he wanted to absent impeachment of the 25th amendment being invoked. Thats his constitutional authority. But granting security clearance is a time honored sacrosanct process everybody goes through. I go through, my clients have gone through. It is a very standardized process and is supposed to be handled by career Civil Servants on the investigative side and adjudicative side. They make the assessment based off the information they have, based on the same guidelines that applies to everybody no matter what your position or level of authority. That was not what happened here. Special choices, special privileges were afforded to Jared Kushner here. That is inappropriate. It is not necessarily illegal. Ken, you mentioned Congress Wants to see some of this stuff. House oversight chair Elijah Cummings is demanding documents having to do with security clearance. It is not just limited to Jared Kushner. It is not, ali. In fact, our sources told us on 30 occasions, the career specialists at the white house were overruled. So people they thought shouldnt get a clearance were granted one. We dont know the identities of those people. We know its a lot of the same issues. Foreign influence, business entanglements. There were people who came to the Trump Administration who had never had clearances before. It was very normal there would be delays and extra scrutiny. Whats not normal and what hasnt happened is for it to be bypassed. Congress wants to know the details about that. It looks like theyre going down the road to subpoenaing some of these documents. There will be a fight, though, because the white house will assert executive privilege. Bradley, you heard Chris Christie say it. The concern for a lot of people is not that donald trump can give top secret clearance or that there is a policy issue around it. Why is everybody lying about it . Back to kushners application, if you recall, he had to make several amendments. There were contacts he had with foreigners. He left off his form several times. There were a lot of red flags for kushner to get the clearance in the first place. Correct. We just heard on wednesday issues about the president making false statements and the president attacking Michael Cohen about his credibility. This president has problems with telling the truth on a regular basis and it raises that 64,000 question. Why did they lie . The president could do this. He didnt even have to put him through the vetting process if he didnt want to. Did they do it because they were embarrassed, they didnt want jared to get the embarrassment of a denial, is that why they originally lied about the president intervening . Youre absolutely right. The way this was handled from the start, from the very moment Jared Kushner submitted his standard form 86, which is the security paperwork everybody has to go through to get a clearance, was never done properly. He did not even list out his foreign contacts at the beginning and then he got to wait five months before he gives it to the fbi. None of my clients, none would have ever been granted interim access in that context. They would have been laughed out of the building. Its strange situation. Guys, thanks very much. Former trump lawyer and fixer Michael Cohens testimony is apparently going to be keeping democrats on capitol hill for months. The Associated Press reports democrats are going to be investigating Trumps Campaign ties to russia, potential conflicts of interest, possible Money Laundering and other oversight matters that democrats say were ignored under gop control. That includes calling a number of people in trumps orbit to testify, potentially including Trump Organization cfo Allen Weisselberg who cohen mentioned multiple times in testimony in front of the House Oversight committee. Weisselberg signed one of cohens reimbursement checks for paying alleged hush money ahead of the 2016 election. Joining me now, ariana berg, former federal prosecutor with the Southern District of new york. Marc fisher, Senior Editor with the washington post. Also coauthor of trump revealed. Mark, let me start with you. You know a lot about Allen Weisselberg and the role that he has played in sort of everything trump, right, the Trump Organization, the trump foundation. What is his role so far what has he been doing with authorities . Hes had some limited immunity. And what can he help congress understand . Well, look, in the world the intricate web of companies and entities that the Trump Organization has created through the years to mask some of the deals that theyve made, it would take a lifetime to unravel that web of entities because Allen Weisselberg has spent a lifetime putting together that web. And so he has been talking to prosecutors in the Southern District of new york. They gave him a limited immunity deal so that he would come forward and talk, but theres no evidence that he has been terribly forthcoming. And so if hes called before congress, i think we can continue to expect that he would be rather less than completely forthcoming. Hes the guy who knows everything. He knows exactly how the Trump Organization has structured its deals around the world, how they dealt with the trump foundation, how they did the hush money payments, those kinds of things. So this is an absolutely integral person. This is a small family operation, the Trump Organization. And other than the blood relatives, Allen Weisselberg is the number one person who knows how it all fits together. Ariana, lets follow this through a little bit. Weisselberg, first we say alleged hush money payments. Theyre processed through court, they paid these women, Michael Cohen paid these women. Michael cohen brought receipts about who paid him back. In this sense, if weisselberg is closely tied to things that were done that were illegal, what kind of footing does weisselberg have to not cooperate with congress or for that matter with the Southern District of new york . Yes, thats right. Allen weisselberg really presents, i think, the biggest potential body blow to donald trump as well as to his children and any other Trump Organization employees. But that, of course, assumes that when he comes to testify if he comes to testify that he tells the truth. And as youve just mentioned, ali, there could be potential criminal exposure there. In fact, i would suspect that there is quite a bit of criminal exposure there for Allen Weisselberg. And we have, as prosecutors and congress as well, certain tools to try to incentivize people to speak truthfully and under oath. I am guessing that he would assert his 5th amendment right against selfincrimination if he were called to testify in front of congress. Our understanding is that hes already been given limited immunity with the Southern District of new york, and my understanding is that that was just for grand jury testimony, largely against Michael Cohen. And, in fact, we know that Allen Weisselberg is still employed by the Trump Organization, still goes to that Office Building every morning, and so his allegiances are strong and clear with donald trump. Theres also been reporting that hes in a joint Defense Agreement with donald trump. And so presumably, we have to worry about him passing along information about what questions in preparation they want to ask of him. So immunity would be certainly something they would have to deal with if he were to come testify, and that would really be the only way to guarantee his testimony. If i were one of the prosecutors in the Southern District of new york that were working on this case against Michael Cohen and potentially Trump Organization employees, i would not be ecstatic about weisselberg coming to testify in congress. You never want a potential witness in your case to be on the record under oath with dueling potential statements. That creates lots of problems and also it might interfere with my ability to sign him up as a cooperate error charge him later. There are a lot of differences, mark, between alan Michael Cohen and Allen Weisselberg. To arianas point, we dont know what his legal exposure is. There is a difference. If two of these guys, Michael Cohen and Allen Weisselberg, are going to tell you everything they know, its actually notwithstanding the payments of hush money, weisselberg probably knows as much if not more. Weisselberg knows a good deal more. Weisselberg has been at the inner core of the trump world since about 1973 when trumps father, fred trump, hired him as an accountant. Hes spent his entire life this is a 71yearold man who spent his entire adult life working for the trumps. And most of that time in trump tower. Hes one of the most trusted people and one of the most loyal people in the entire Trump Organization. And he certainly knows everything thats gone on through all the years. In sharp contrast to Michael Cohen, who although he was there for more than a decade, was really one of a series of lawyers who donald trump employed to be his fixer, his enforcer, to make problems go away. Those lawyers tended to come and go over the years with trump, but Allen Weisselberg is the one continuing Central Force in that organization. Ariana, let me ask you about the House Intel Committee expecting to question felix saider later this month. Hes a russianborn business associate of President Trumps. He worked with cohen on the trump tower moscow project. His name came up a couple of times in cohens testimony. How important is this . Well, i would say its very important. Hes coming to testify apparently march 14th. Adam schiff says he expects most of that testimony or hes going to try to make most of that testimony public. Im skeptical whether theyre going to be able to do that. As you mentioned, ali, felix saiders testimony will likely talk about the trump tower moscow deal and also any efforts that there were, coordination with the russian government to interfere in the u. S. Elections, littleknown fact about felix sater is we know from reporting that there was a november 2015 email between Michael Cohen and felix sater in which felix sater says, our boy, buddy our boy, can be elected as u. S. President and we can help engineer that. And he says something to the effect of, and ill make sure that the whole putin team gets behind it. So we dont know ouch. It could just be all big talk. We never know. We dont know what actions were undertaken to followup on that. But that would be certainly a line of inquiry that the representatives would want to pursue, and i would guess, given the mueller investigation, they would have to do that in a closed door session. It is an interesting situation where you have all these blustery exaggerators who say things and its hard to determine whether they were bragging about something over which they had no power or whether they actually went and did something and made phone calls and arranged meetings. Com safety. Were back with an nbc news exclusive. The United States is planning to end a large scale joint military drill or all of them with south korea. Officials say the move is part of the effort to ease tensions with north korea after the failed Second Nuclear summit between President Trump and kim jongun. Nbc News National security and military reporter Courtney Kube broke the story and joins me now. Courtney, if this happens, who benefits from it . So, this is something the u. S. Military has been looking at for sometime. Remember after the singapore summit of 2018, President Trump made it clear he was against the idea of these large thousands of people thousands of troops joint exercises between the u. S. And south korea. For years they have occurred at least twice a year, in the spring and in the summer. When President Trump made it clear he didnt want to do those any more, the military started looking at ways they could change the training and change the exercises so they didnt have the large ones, but they didnt have a real impact on readiness. With the announcement that were expecting any time in the next several days actually, the announcement is going to be that two of they have that are generally held in the spring, key resolve and full eagle, are ending. Theyre not going to conduct those any more. But they have been replaced with a series of smaller exercises that allow the military, both the u. S. And the south koreans, to continue to Work Together to continue to be prepared should they need to, you know, face some sort of conflict, ali. So, when were talking about readiness here, its never clear based on the way President Trump characterizes these joint exercises, whether they are about readiness or whether they are a show of force, or whether, in his opinion, theyre just costly and unnecessary. Whats the closest to the truth on that . So, for years ive been covering the military for nearly 15 years. And in that time i have heard over and over from the u. S. Military about how critical these are to readiness and to what they call inter operability. The u. S. And the south korean and other allied nations being able to Work Together, you know, know how their equipment works together and to be able to train and whatnot all at once. But these clearly also were and have been a show to north korea and in some ways to china, they act as a deterrent value. In the story in our story we talk about how one of the concerns from the u. S. Has historically been north korea potentially the best time of year they would invade south korea would be around march, in the early spring or late winter, because of the ground. They could roll their tanks across the still frozen ground. Thats when these spring exercises were usually conducted to coincide with that same time. The 22yearold passed away after he returned to ohio from north korea where he was held captive more than a year and fell into a coma. Kim and his evil regime are responsible for unimaginable cruelty and inhumanity. No excuses orlovish praise can change that. This response comes after President Trump made his statement, this one, in hanoi on thursday. I dont believe he knew about it. Kim jongun he felt badly about it. I did speak to him. He felt badly. He knew the case very well, but he knew it later. He tells me he didnt know about it and i will take him at his word. He didnt mention it in his brief statement, 99. 9 certain that the North Koreans will not comment on this any further or on the familys statement. The family statement, of course, did not mention President Trump, but it was absolutely clear what they were saying. Kellyanne conway on fox news just a short time ago said the president agrees with the warmbier family and holds north korea responsible for their sons death, holds north korea responsible. Chairman kim, she said, did not know what happened to otto at the time when it happened. And, ali, i timed President Trumps statement yesterday on Otto Warmbier. It was a minute and a half. It wasnt a passing comment. He went out of his way to defend kim jongun. Kim jongun felt badly, he said, he tells me he didnt know about it. Ill take him at his word. I dont believe he would have allowed this to happen. I dont believe he knew about it. He knew about it later. It wasnt to his advantage to have allowed that. He thought about it, he thought about the background, he thought about the motivation. He thought about kim jonguns possible gains. He thought a lot about it. Ali, nothing happens in north korea without kim jongun knowing about it, especially when its an american hostage. So i have to say, rather like his statement yesterday about why the summit broke down, this strains credibility that kim jongun simply didnt know about it. But, look, its up to the president whether he believes this man or not. Right. But think about in helsinki with Vladimir Putin where donald trump said he said he didnt interfere in the election, i take him at his word. Then after khashoggi disappeared and was found to be killed in the Saudi Embassy in istanbul, he said he didnt have anything do with it and took him at his word. Is trump trying to be in peoples good graces because he thinks the personal relationship will help him get something he needs in the end, the nuclear deal or is he gullible . Hard to know whats going on in his head, but we do know that personal relationships do matter, and the relationships with the two men that you have outlined certainly matter to him. In fact, all three. But the fact that he would i mean, i was there in helsinki in the room when he equated Vladimir Putins view with the view of his own intelligence agencies. This is extraordinary. It seems likely that Mohammed Bin Salman knew a lot about the killing of jamal khashoggi, but still, President Trump defended him. Some republicans, as i think youve been mentioning, have been clearly distancing themselves from the president , senator Susan Collins said that she found the president s statement extremely hard to believe. Senator rob portman of ohio, actually, which is Otto Warmbiers home state, warned trump not to be naive about the, what he called the brutal nature of the north korean regime. The and the former senator Rick Santorum said trumps statement was reprehensible. Even those people who are clearly on his side find yesterdays statement a little hard to take. The reality of the situation is not very many people know who jay inslee is. At least not yet. So its going to be incumbent on him to get out there and get that message out there. And also show voters what hes about on Climate Change and a whole rash of other issues. I will say its interesting its always interesting to see how candidates react to donald trump in their announcement speefrpe speeches. Inslee mentioned trump. There are few issues where trump has undone what obama did on energy and climate and green policies. Jay inslee is someone who can combat that record directly and make his bench as someone who has done the opposite here in washington state. But as hes talking right here behind me, you can hear him making the pitch on other things Like Affordable Health Care and gun control, issues that are central to this race as well as Climate Change, ali. You have a future in Golf Tournament reporting. This is kind of interesting for me. Im always at a high yell and im having a conversation with you and im like leaning, what did she say . What did she say . Joe biden hasnt declared hes running, but he got into hot water after calling mike pence a decent guy. Lets listen to what he said. Followed on by a guy who is a decent guy, our vicepresident , who stood before this group of allies and leaders and said, im here on behalf of President Trump. The criticism, allie, came from people who were members of the Lgbt Community and their allies. Who said there is nothing, quote, decent about being an antilgbtq rights and that includes the vicepresident , whats the feedback been on this . Yeah, Cynthia Nixon is one of those people fighting back about positive comments about mike pence. Its one of those things where you look at what happens on twitter and you have to wonder whether thats the reality of what happened on the campaign trail. Thats what we see consistently. If you look on twitter, the consistent conversation there is often around russia and the president s legal troubles. On the campaign trail, i hear very little about that. I think its going to be interesting as we go forward, seeing the dichotomy between those two things. Look, joe biden has been someone who has been in the senate a long time. He is someone who likes to tout bipartisan credentials. Its not surprising he would give a little bit of praise to a fellow vicepresident. Finally, beto orourke, someone who is not declaring, he said hes made up his mind about running for president. Do we know what hes made up his mind about, what hes doing and when hes going to tell us . We know hes not running for senate. Thats definitely one decision hes made. Whether hes running for president jay inslee is finishing up behind me. Thats why youre hearing the big applause. The interesting thing is the entire lead up to 2020, theres been a lot of questions about the three bs, bernie, biden and beto. Bernie sanders jumped in the race a few weeks ago. Everyone is looking at joe biden and beto orourke to see if theyre going to jump in. If you look at early polls, those are the names that keep rising to the top. It will be interesting, if they stay in or out, there will be indications on this race. She stopped me and said she had just gotten off the phone talking with the president about this and tried to recast the way the president discussed this.
