Several republicans who have seen the document say it exposes massive and terrifying abuses of our civil liberties, more troubling than the underlying crime in watergate, thats for sure. Sean, this is bigger than anything anybody can imagine. This is federal Law Enforcement officials obstructing justice. Members of congress who have seen this memo have called it shocking, alarming, and said it mirrors kgb style tactics. It could cause many people to go to jail. It includes key fact that is support the russian investigation. It confirms that the trigger of the fbi investigation of the Trump Campaign was actually information regarding Trump Campaign adviser George Papadopoulos and not Christopher Steeles now famous dossier as republicans have been claiming. And it confirms that surveillance of carter page actually started a month after carter page left the Trump Campaign. One critic who gave the release of the memo a negative review was james comey. I think its a disgrace whats happening in our country and when you look at that and see so many other things, whats going on, a lot of people should be ashamed of themselves and much worse than that. The biggest revelation came not from the memo but from devin nunes himself when he told fox news that yes, there will be a season two in the Republican Campaign to undermine Robert Muellers investigation. This completes the fisa abuse portion of our investigation. We are in the middle of what i call phase 2 of our investigation which involves other departments, specifically the state department and some of the involvement they had in this. That investigation is ongoing and we continue to work towards finding answers and asking the right questions to get to the bottom of what exactly the state department was up to in terms of this russia investigation. Jennifer, youve been tweeting a lot ant what the republicans gave up in order to create this farce and this tv show as were calling it here tonight. What do you make of the fact that hannity is doubling down . That hes saying this is the biggest abuse of power Corruption Case in history, makes watergate look like steeling a snickers bar. He has such contempt for our Intelligence Community or he is that dumb. Dave and i were talking and saying this is watergate for stupid people by stupid people. And it is. The memo that devin nunes drafted himself did not have any new information as sean hannity says. The only new information we had is that the, quote, plan to manipulate the election happened with a secret fisa hearing in october, one month before the election, that was never leaked during the election and after carter page had left the Trump Campaign. So how this was an attempt to spy on the Trump Campaign and change the course of the election, its just one silliness after another. But there is something i think that is very serious about this. That is that really the basically effective oversight process thats been in place for Congress Since the watergate scandal has been destroyed. What Intelligence Agency is going to give the House Committee any sort of information. Why would they cooperate with their investigation. And because the house now will be hampered in conducting an investigation, which in the real context is necessary and proper in a democracy, they wont be able to do their job. So the constitutional crisis we talk about down the road we have it. It was brought on by devin nunes this week. Eugene, we have to play one more sean hannity. Please. This is what he believes should happen as a result of this supposedly bombshell. The special counsel must be disbanded immediately. By the way, nobody else will say this, all charges against Paul Manafort and general Michael Flynn need to be dropped. Its that simple. Is that going to happen . No, its not going to happen. Thats breathtaking. I dont believe manafort or flynn is mentioned in the bombshell not so bombshell memo at all. And it has nothing to do with anything. You know, the main impact of this memo really was to confirm the narrative that we knew about the start of this investigation, which is that it wasnt begun because of the dossier, some of which has been confirmed, but it wasnt because of the dossier, it started with George Papadopoulos. And so, in that sense, this is a giant boomerang and hannity, thats more than keeping a straight face, i dont know how he does that. But my guess is donald trump, whos not stupid, is probably really angry right now. Really angry that this thing that was built up, his friends at fox told him this is the way were going to get rid of the whole russia investigation came out and it was such a damp squibb, i bet the president is not in a good mood. And they released it to their own media outlets. If they were confident they might have given it to you folks at the post. David you make an appearance in this as an excuse as to why Christopher Steele should not be believed because he talked to you and they made it sound like theres some unlawful disclosure that theres there was a rule that he wasnt allowed to talk to you. And another thing thats erroneous that they told the court about the fisa information the court was aware that some of the information underpinning the warrant was paid for by an entity, though it did not name the Democratic Committee or hillary clinton, according to u. S. Officials familiar. So theyre not correct when they say there was no knowledge of the political influence. Your thoughts, david. This memo is garbage in the sense it cant be used to come to any conclusive understanding of what went on in the application process. Fisa applications, this is what you give to a secret court to get the right to spy on americans, run 50, 60 pages, they can cite Public Information but often they site private information. We have just the word of devin nunes here, or his staffers, this memo is an accurate characterization of the warrant they presented to get the warrant. The one or two words about me are inaccurate can you tell us whats inaccurate about the parts about you. Theyre trying to discredit steele in lots of way, he had a view of donald trump, the fbi after he spoke to me, i wrote a piece about him october 31st, i didnt name him but the fbi could figure out he spoke to me, that they terminated their relationship with him as if he was a bad source, this is after the application, so its irrelevant in a lot of ways, theyre doing it to discredit steele but he didnt have a relationship with the fbi. He was working with them informally out of his sense of civil responsibility. He wasnt lying to them and acting in a sort of negative way. But theyre trying to make him out to be the bad guy so they can make the warrant out to be bad. Even though its a side show. Its a very, very small slice of the russia investigation. It has nothing to do with a lot of what Robert Mueller is doing. Jennifer, the other interesting aside in this whole sort of debacle is that devin nunes didnt even view the underlying intelligence himself. He sent trey gowdy to do it for him. This is devin nunes tonight being asked whether he read the underlying materials before he had his staff draft this memo. Did you read the actual fisa applications . No, i didnt. This has been one of these bogus news stories that have been put out. The agreement we made with the department of justice was to create a reading room and allow one member and two investigators to go over and review the documents. I thought the best person on our committee would be the chairman of the oversight committee, trey gowdy, who has a long career as a federal prosecutor to go and do this. And then they, over a series of meetings would come back with their notes and brief the rest of the committee members. Do you think it would have been more successful to create a memo that was a bombshell if you yourself had done the home work . It depends on his reading comprehension skills, i guess. How they could put it out and not realize what was in it that was not helpful to their cause, i dont know. There is not a way you can claim the fisa application was a hoax, was based on a particular document, unless you looked at the fisa application, its hard to do that. Secondly we know things in this are false, including what david just mentioned. But another one, its been disputed that the court was told about a political angle and mccabe made a statement that the dossier was the only reason for the extension of the fisa court. And democrats have disputed that. Apparently that is not accurate either. So what he did say wasnt true. What he left out he didnt know about. This is, you know, with all apologies to shoddiness, this is a shoddy exercise. We mentioned trey gowdy. Trey gowdys reaction has been to put out a couple of tweets this evening. One says that he remains confident of the men and women of the fbi and the department of justice and the last one says, i also remain 100 confident in special counsel Robert Mueller. The contents of this memo do not in any way discredit his investigation. Thoughts on his way out the door, because he is not returning to congress. All right. Eugene im going to get you on the other side of the break. Now that the fox news audience has its memo, is trumps next move to fire Rod Rosenstein . Whats next for the real news here, bob muellers ongoing probe, why some lawyers with clients involved in the investigation think mueller may do something unprecedented, indict the sitting president of the united states. The Washington Post reports today that donald trump thought that releasing the memo would help build a public argument against the man standing between him and Robert Mueller, Deputy Attorney general Rod Rosenstein. People familiar with the discussions tell the post, trump suggested to aides that the memo might give him the justification to fire Rod Rosenstein, something about which trump has quietly mused or to make changes at the Justice Department which trump complained was not loyal to him. This morning he slammed doj leadership tweeting the top leadership and investigators of the fbi and the Justice Department have politicized the sacred investigative process in favor of democrats and against republicans. Rank and file are great people so is trumps next act to fire Rod Rosenstein . Three white house officials tell nbc news there have been no discussions or considerations about firing Rod Rosenstein, but when trump was asked this afternoon if he had confidence in his Deputy Attorney general, he didnt give a good answer. You figure that one out. So put a question mark next to Rod Rosensteins job status. There are other consequences of the nunes memo, consequences that may be long lasting affecting the fbi and Justice Department. James comey said it best calling out House Republicans who destroyed trust with the Intelligence Community, damaged relationships with the fisa court and exposed classified investigation of an american citizen. Very degreed gentlemen with me here tonight. Paul butler first i want to get your response to this new reporting that says another element of the memo has proven to be incorrect that, in fact, the Justice Department did tell the court of the political leanings of some of the folks providing them information and that the dnc had paid for the dossier, your thoughts . The memo shows how difficult it is to get a warrant. You have to jump through the hoops the fbi signs off then you take it to the department of justice that signs off, and then you go to a federal judge who knows its a big deal because its about spying on an american citizen, so she asks questions about the credibility of the information and credibility of the source. Its a 60page warrant. So all of the Material Information is there. Is it possible, in your view, for for the doj or the fbi to have gone to the fisa court to get a fisa warrant strictly based on one dossier written by one mi6 exofficial. I cant imagine a federal judge signing off on that, so its a lot of hype. And the memo ultimately reveals that Rod Rosenstein, who signed off on the reauthorization didnt take the loyalty pledge. So he understands that though theres a trump hotel and a trump tower, theres not a trump fbi or a trump Justice Department. He did that when donald trump was president. And so did dana boente. Lets talk about what a lot of people believe is the ultimate goal of this memo, other than to entertain donald trump and fox news, which is part of the goal. But the other part of the goal, reportedly, is to under mine Rod Rosenstein so that trump can fire him. Jeff sessions just a few hours before this memo was released defended Rod Rosenstein at an event at the doj. Lets listen to that. Rod and rachel are harvard graduates, experienced lawyers. Rod has had 27 years in the department, rachel has had a number of years in the department previously. So they both represent the kind of quality and leadership that we want in the department. In your view, harry, is Rod Rosenstein is his job in jeopardy tonight . How did the president put it . You tell me . Look, it was an agenda here, and by the way, as paul says about these fisa warrants, its all true and who does all this work, its the rank and file of the fbi that supposedly trump was extolling, but if he were to use this, as you said, debacle as everyone has said, shoddy sham of a memo as a pretext for firing rosenstein, it would be among the most brazen abuses of executive power really in the history of the republic. We can and should condemn this memo, and were doing it, but the thing to remember it is a bad joke of a memo, but the joke is on us. The effects of the hyped up campaign to release it is the sort of damage to the institutional relations of the fbi and doj, public confidence, all the things that director comey talked about. And if something as threadbare as this were used to try to discredit rosenstein, which would be to emasculate the Mueller Investigation, it would be disgraceful. In order to pull that off, donald trump would need to have at least enough support for such a move in congress on the senate side if he wanted to try to confirm lets say he wanted to fire Jeff Sessions and Rod Rosenstein, and hes seeming to build up support for it in the house. He has some already. Lets listen to contrast in the way house and Senate Members have responded to it. John mccain said the latest attacks on the fbi and department of justice serve no american interest. Our nations elected officials including the president must stop looking at this investigation through the warped mind set. In sharp contrast to that, arizonas republican congressman, paul gosar, called comey and mccabe guilty of treason, essentially. They said the abuse of fisa is not just criminal but constitutes treason. I will be leading a letter to the attorney general seeking criminal prosecution against these traitors to our nation. Your thoughts . Joy, this only becomes a constitutional crisis if congress, that means the republicans in congress, fail to do their duty. So the nightmare scenario is that President Trump uses this nunes memo to fire Rod Rosenstein, whos overseeing the Mueller Investigation, and to put someone in rosensteins place who would either fire mueller or dramatically reduce his scope. For example, saying mueller cant investigate money laundering. Thats only a crisis if the republicans dont step up and do their job, which is to say mr. President , this is abuse of office, thats obstruction of justice. If do you that you will be impeached. Weve seen lots of kind of trial balloons from trump to the republicans, what if . And as you know the response from the republicans has not been reassuring. Another republican, andy bigs, calling on mueller to resign, getting a new hashtag going. Richard nixon, could not have dreamed of having a better rear guard than donald trump has in this, particularly, House Republicans. I agree 100 with paul. I would say, were beginning in this last week to have something about walking nightmare. I dont think it affects mueller at all. He will do his job. But the rosenstein scenario, its one step removed from the you know, in the eyes of the american public, and its just as paul says, the new person comes in, he tells mueller, you cant interview the president , i want you to wrap this up in a couple months. Theres not much mueller can do in that situation. To the extent we are relying, and i think we are as paul says, on the dedication to country of the congressional republicans, you know, so far the signs are not promising. Indeed. Various legal scholars have argued why Robert Mueller wont indict donald trump, one says mueller will not indict trump for obstruction of justice or any other crime. He wont do it for the good and sufficient reason that the department of justice has a long standing legal opinion that sitting president s may not be indicted. But today politico reports that two attorneys, they describe as working with clients swept up in the russia probe and who have interacted with the special counsels team say it is possible that mueller could indict the president for obstruction of justice. If i were a betting man id bet against the president , said one of the lawyers. The second attorney speculated that mueller could try to bring an indictment against trump if only to demonstrate the gravity of his findings. Its possible that mueller may go that route on the theory that as an open question it should be for the courts to decide the attorney said. Even if the indictment is dismissed it puts pressure on congress to treat this with independence and honesty that it will never, ever get. Joining us now is the reporter who wrote that piece, darin samuelson and back with us is paul butler. Lets talk about the reporting you did darin. According to your piece, both of the lawyers you spoke with based their opinion on the law, and. Did you take that to mean these lawyers believe that mueller can indict or he will indict . I think it means they can indict as they want. And as theyve been reading the tea leaves as they see the stories out there published by the media, they take their own interactions with the special counsel as well, theyre not ruling it out. I know the legal scholars would argue that a president cant be indicted while sitting in office, but theres certainly debate about that, and these lawyers are not ruling it out. One even went so far as to say the spring of this year. Wow. Lets talk about this question. I know where you stand on this question, paul butler. Lets listen to ken starr. This is ken starr Ronald Rotunda, he was arguing that ken starr could indict bill clinton. It is proper, constitutional and legal for a federal grand jury to indict a sitting president for serious criminal acts that are not part of and contrary to a president s duties. In a memo made public last summer, in this country, no even even president clinton is above the law. That was from 1998. Now what Ronald Rotunda says is he thinks nothing could bar a federal grand jury for bringing star charges against a sitting president. But the differences then and now mean that where starr had the authority to indict clinton if he chose, mueller most likely does not possess the same power. Give us both sides of the argument, that he can and he cant, and which side is stronger. The constitution contemplates that the president might commit a high crime or misdemeanor. But the text spells out a remedy, which is impeachment, meaning the house charges him with a crime and the senate if convicted then removes him from office. At that point, after impeachment and conviction he could be indicted but not before. Theres also a legislative issues with regard to special counsel mueller who unlike ken starr is not an independent counsel. Mueller has a boss, Rod Rosenstein, which is why the nunes memo and the pretext the president might use to fire rosenstein, hes the boss, mueller is not independent and the Justice Department regulations which mueller and rosenstein work with them both, theyre boy scouts they love to follow rules which our country needs that the moment. The Justice Department rules suggest that in their view a sitting president cannot be indicted. Darin, in your piece you also spoke to adam schiff, he told you i think its far more likely if the special counsel finds evidence of criminality, its presented to congress. He says mueller would have steep reservations that 12 jurors should decide the fate. Schiff said he might stay any criminal proceedings until after the presidency. Did you get the sense that perhaps these lawyers are saying that and floating this idea that there could be an indictment of the president as interest for their client, as a way to create leverage for themselves. I didnt take it that way. I know a lot of people speculated thats what the lawyers were trying to get across, get the message to President Trump that this is coming at you fast you might want to act. The impression i got is they see congress as not acting and mueller seeing that, that the presentation would not be something that would lead to impeachment and mueller might want to put his cards on the table, let the court decide, it would go quickly im sure to the Supreme Court and we would get a landmark u. S. Versus trump decision. This has never been argued in front of the Supreme Court. Weve seen other president s, in the nixon and clinton era that set some precedent but not this question. The prosecutors, ron rotunda and ken starr, they did consider indictment, same thing in watergate, they were looking at indictment, they thought the prosecutors could indict Richard Nixon but they did go the route of impeachment because thats what the house of representatives was going to be doing. They shared that information with them and that led to the impeachment proceedings that led to nixons resignation. There was the belief they could indict nixon. The last question i would throw to you then, could trump try to pardon himself . Thats right. Thats a concern some people said why the president couldnt be indicted because then he could turn around and pardon himself. That would be clearly obstruction of justice and abuse of power, abuse of office, so further grounds of impeachment. So once again were looking for the congress to fulfill its constitutional responsibilities, which is to reign the president in. Im not sure people feel hopeful if thats the remedy, looking to congress. Thank you both very much.
