Heavilyarmed police and federal agents conducted searches there after a boston man was shot tuesday when terrorism investigators sought to question him. Usaama rahim, aged 26 of the roslindale section of boston was shot and killed after police say an officer and an fbi agent approached him at a bus stop and he came at them with this knife. Officials say Surveillance Video not released publicly showed what happened. We saw the video. It appears the Law Enforcement officers were backing away before they exercised deadly force. Reporter investigators tell nbc news they believe rahim was preparing to attack police in boston within the next few days. Radicalized, they say, by isisinspired social media. They say he had been under 24 hour a day surveillance for weeks. Within hours of the shooting investigators began looking for others they believe may have been in contact with rahim, searching locations in warwick, rhode island boston and nearby everett. I saw a line of what looked like swat team members dressed in full cammo gear helmets, shield battering ram and a bunch of machine guns. Reporter Officials Say expect to see other scenes like this as isis reaches out more with social media and the fbi ramps up surveillance. Rahims brother is a former imam here in boston. He says that he was shot his brother was shot three times in the back but Authorities Say no he was shot in the torso and the abdomen and thats why they want to show this video, this Surveillance Video thats not been released to the Muslim Community to say this is how it happened. They claim that the authorities were actually backing up as he was coming toward them with the knife and wouldnt drop it. Now, weve asked to see that video. Its doubtful though it will be released publicly within the next day or so because the District Attorney here is investigating the shooting and he says he doesnt want eyewitnesses to have their memories contaminated be i the video. He wants to rely on what they say, jose. And, pete authorities are probably not saying right now other than that knife if they found any other weapons, either with him or anybody else theyve been dealing with . Correct. We dont know what they have found in the searches of rahims house or in the home of this man david wright from everett, massachusetts, which is not far from here what they found in the search of his residence as well. Pete williams thank you so much. Well be keeping a very close eye on the story throughout the rundown. Also developing this morning, intelligence officials can begin the process of getting domestic surveillance programs back on track now that president obama has signed the usa freedom act, the biggest surveillance overhaul since 9 11. But one Controversial Program is being phased out under the new law. It eliminates the nsas bulk collection of americans phone records. Phone companies will now control this data and the nsa will need a special court order to view those records. Senator Mitch Mcconnell fought to keep phone records in the hands of the nsa and called the new law a step in the wrong direction. Nobodys Civil Liberties are being violated here. A resounding victory for Edward Snowden. It is also a resounding victory for those who currently plotted against our homeland. Were joined by senator chris murphy, democrat from connecticut. Senator, pleasure to see you. Good to see you. You voted in favor of the freedom act. Whats your response to senator mcconnell who says were handing a victory to the terrorists . Well, thats patently ridiculous. The fact is we still even under this reform maintain the ability to go get this metadata. These are phone records who you called, when you called them, under a court order. The only difference now is that those records will be held by phone Companies Rather than held by the government. And, you know what Edward Snowden proved to us is that the government isnt terribly good at collecting and keeping secret and private our data. And all weve done here is just take this data and keep it one step removed from the u. S. Government and from the nsa. We still have all of the access we used to have and, frankly, there are a lot of other controversial parts of the patriot act that a lot of us had problems with that stayed as part of this reform. Were no less safe today, we just have a little bit better protection of american Civil Liberties and thats a good thing. Theres no choice to be made between protecting this country and protecting our Civil Liberties and i think we basically recognized that yesterday. But, senator, accepting your premise that the federal government is never good at keeping secrets and that information is often leaked theres no evidence that none of the information that the nsa has been bulk collecting for years now has in any way been compromised. In this specific incident it seemed as though the nsa was doing a pretty good job of not leaking it. Whats the difference between the nsa having it and private companies having the same information . Well, we have an ethic whether we like it or in the in this country in which private companies, whether it be amazon or verizon or google hold american data. We may not like that but that is the lay of the land. And, frankly, we shouldnt wait until theres some massive data breach. We shouldnt wait until theres an executive or some authority at the nsa that compromises the integrity of that data to make common sense changes. As a country we have always been careful about giving the government too much access to our own personal information for good reasons. Its essentially at the foundation of what have it is to be american to be skeptical about giving the government too much of a reach into our personal lives. So what weve done here is get the government one step removed from personal data about our lives so that they cant abuse it while still giving them the ability to go get it any time they want it when theyre trying to pursue a terrorist. I think thats a pretty good medium ground. I think it speaks to a lot of what it means to be an american having a healthy skepticism about the government reaching too far into our own personal private lives. Do you think, senator, and im thinking of the case that just wrapped up in boston where the suspect with the knife was shot by police. He had been under investigation and surveillance for two weeks now. Do you think that in cases like that the fact that the government is now having to taken a extra step to be able to reach that information, that Data Collection that that person may have is going to hinder those kinds of investigations in the future . Absolutely not. And this is a question that we asked our security agencies, a question that we asked the fbi, the cia, the nsa, and they all answered that it would not provide any hindrance to pursuing these targets. Remember, this is a fairly selective tool and its one amongst many. Traditionally, how we find bad guys is through nonpatriot act means, its a tip that comes from an individual who knows about the wrongdoing. Its social media posts that we find that are out in the open. Its a traditional warrant that we go through courts to get that has nothing to do with the patriot act. So we have to remember that the patriot act and this bulk collection exercise that was amended is not the only way that we find out information about people that are trying to do harm to the United States. In fact, it represents a fairly small slice of all of the tools that Law Enforcement has at their disposal. Senator chris murphy, what a pleasure being with you, thank you. Thank you. With government surveillance in the spotlight, the fbi is confirming for the first time that its been using a fleet of lowflying spy planes with the ability to record video and lock in on your cell phone. Nbc National Correspondent Peter Alexander has the details. Peter, good morning. Jose good morning to you. Just as government surveillance has been getting intense scrutiny this week new revelations that the nations top Law Enforcement agency is flying hundreds of planes with advanced surveillance capabilities, most registered to companies with fake names. And while the fbi insists all of its legal, Many Americans are now wondering just whos watching. As baltimore boiled over this spring most people here had their eyes on the streets. But Benjamin Shane was looking up. It was dark out, i saw the lights flashing on the plane and i saw it bank and then a couple minutes later it came back around. Shane took to twitter. Anyone know whos been flying the light plane in circles . Minutes later someone tweeted back this map showing that plane registered to the same owner as this singleengine cessna. It turned out to be one of a fleet of planes operated by the fbi. According to an Associated Press investigation, theyre all equipped with sophisticated surveillance cameras that can capture images like this and are often outfitted with cell phone tracking devices. In just the past month, the a. P. Reports, the fbi has flown more than 100 surveillance flights over 30 cities in 11 states. All intended to zero in on criminals. But privacy advocates are asking where does it stop . It seems very strange that the fbi has such a large fleet of aircraft that theyre using so frequently that theyre trying to hide them from the public. Reporter the planes according to the a. P. Are register under at least 13 fake company names. Local Law Enforcement agencies have long used helicopters and drones to monitor for criminal activity. According to the a. P. , the cell phone tracking capabilities on some of the fbi planes allow them to scoop up identifying information that can help trace a phones owner from all mobile devices below. I can assure you, the fbi is not doing widespread massive surveillance of First Amendment protected activities. This is a particular purpose and a lawful purpose. Reporter we spoke to the fub and they sent us a statement suppressing the Aviation Program is not a secret and is used for targeting specific individuals, they say, and not bulk collection activities or mass surveillance. Im just wondering in his mind what was so dramatically different four days into him running for reelection and making sure he won. Well you know, the other thing that i think is going on behind the scenes is the u. S. Is investigating all these people. I think theres probably a line out the door at the Attorney Generals Office for people wanting to talk to her and tell her what they know. And does this go all the way to blatter . It must. We know it goes to jack warner who is very high on the executive committee and to another member who is basically his number two, the Vice President at fifa jerome valcke. So its not difficult to envision that he must know that there must be some sort of evidence about him. I dont know. Cindy for a lot of people looking at this thing saying what is this fifa thing . Well jose, there hasnt been a ton of polling on this issue right now but to the extent we have some, it Shows Americans are closely divided on the question of Ground Troops. Its unclear what these Ground Troops would be doing depending on who you ask. Some of the candidates in the republican contest have talked about increasing special forces or special forces that are there say giving them a more active role in conducting offensive operations alongside iraqis lundsy graham talked about using those 10,000 troops to accelerate training of iraqis. But one issue that will come up is why would it work this time . We already had an ethnic civil war in iraq while we were over there. We had a surge that put troop levels up to over 160,000 u. S. Troops who played a very active role not just in training iraqi force bus in patrolling streets and trying to clear them of insurgents, of terrorist groups that were the predecessor for isis. So after we left due to mostly political reasons inside iraq all that progress disappeared. Why this would be different with one sixteenth as many troops. They would probably say benjy, because it worked. Because of all of those things worked and had the americans stayed there in order to give assistance to Iraqi Armed Forces, maybe the Iraqi Armed Forces wouldnt be running every single time theyre confronted by isis. But thats certainly something that well see in the future discussed. Vicki, with Hillary Clinton in your state today, i want to talk about the notion of texas turning purple. In 2012 republican governor greg abbot got 44 of the hispanic vote. What does that say about the latino population in texas . Jose we have to keep in mind that texas is an overred state and that holds for latinos, too. With the exception of cubanamericans in florida, latinos in texas tend to identify more with the Republican Party than latinos elsewhere. So this notion that texas is going to turn blue because our population in the Latino Community is growing so rapidly is flawed we need to understand that latinos are more moderate. However, getting back to hillary, i think her play here is obviously the latino electorate but also that moderate white suburban female vote. Those same types of folks who voted for ann richards in the 1990s. So here we see Hillary Clinton coming obviously to get money. We know texas gives a lot of democratic money not a lot of democratic votes but a lot of democratic money but trying to make inroads with moderate female republicans and obviously democratic latino votes. I remember victoria when hillary was running against barack obama she was very insistent on coming on telemundo to speak to the latino voters in texas. She did well in the primary there. She did. She has currently go ahead. I was going to say currently she has about twothirds support here in texas among the democratic electorate and upwards of 70 for latinos so thats a very healthy margin going into the primary. But the general election is a totally different thing, victoria. It is. It is. But you know shes hoping she can get that moderate vote. She really thinks that coming into the general i think shes crossing her fingers that a very conserveative candidate on the republican side comes in so she can woo those texans who are your chamber of commerce republicans and that she can say, you know what . Now to the desperate rescue effort under way in china as new video of the eastern star cruise ship surfaces showing the moments before it plummets into the Yangtze River on monday night. Hundreds of divers have taken to the river to try to recover the over 420 people still missing, believed to be inside the hull of that ship. Sounds once heard coming from the hull are no longer being heard. This as the death toll reaches 19 14 others rescued alive. Joining me now live is nbcs asia correspondent ian williams. What do we know about the Recovery Efforts . Good morning, jose, the recovery effort is continuing throughout the night here but it is painstakingly slow. Only 14 people so far having been brought out alive. As you point out, 400 still missing. But the very latest were hearing, is they are cutting into the hull of the ship. They were marking out in red earlier the places they were going to do that so they are preparing to go inside the ship. Also, that ive been bringing in crane ships, two so far, and another three on the way, to try and raise the ship possibly as early as tomorrow. The assumption being that many of those people are still trapped inside. But that said, the search effort has gone well downstream on the yangtze, up to 135 miles away where they think some bodies could have been swept down river. At the same time dozens of divers have been inside the hull though today they only managed to bring out two dead bodies. One of the divers said the conditions were pretty awful, not only rain and wind on the surface but very very poor visibility. He said they were feeling their way inside the ship because things were so bad. Now, the weather is what we believe brought the ship down on monday. And there are already some questions being asked about why this ship decided to plow on through that terrible storm. Apparently, the local authorities did issue a weather warning, ago yellow weather warning and some ships did go to shore. But the eastern star chose to continue. That will be a question no doubt that which will go to the captain here and also the chief engineer both of whom survived. How they got out and why they got out, of course, is another question. But at the same time, the reports that this ship was impounded, was detained for a period in 2013 for unspecified reasons, that came out on the web page of the nanjing Maritime Safety administration today. So clearly as this search goes on and still so many bodies, so many survivors we hope still to be recovered, some very very difficult questions already being raised jose. 428 people still missing, thank you, ian for that live report. Six deaths and at least 100 injuries are linked to takata air bags including angelina sujata. I was going less than 25 mile per hour on impact but the air bag shot out of my car forcefully and sent metal fragments into my chest. In my perspective, an air be is supposed to save your life not hurt you. Thats why im here today. I hope that what has happened to me will not happen to anyone else. So far, seven of of the 11 automakers involved in the recall have identified which vehicles need replacement air bags. A commuter bus crash, a train crash caught on camera and an officer to the rescue. Lets zoom through todays top stories. One person dead eight others injured after a dramatic rush hour accident in chicago. Four cars were involved in the crash. A 51yearold woman walking on a nearby sidewalk was pinned under the bus. She was a visual effects editor for game of thrones who was in south africa trying to help protect animals from poachers. This morning 29yearold catherine chapel is being mourned by family and friends, identified as the victim of that deadly lion attack outsigh johannesburg. Chapel, a visual effects editor on the Emmy Award Winning show game of thrones, was in south africa to raise money for animal conservation. The american, originally from rye, new york was living in vancouver, posting pictures on instagram taking off for the trip from canada and enjoying johannesburg with holiday. At lion park despite sign after sign warning visitors to keep their win i dos shut witnesses told park rangers chapel and her male guide had them wide open taking pictures of cats like these, one only three feet away when it suddenly lunged. These are wild animals. Most of them were born in captivity, but theyre not tame. Reporter the attacking lion inging lion ness was moved to a solitary pen but wont be put down. The park insists it is safe if visitors follow the rules. Meanwhile, in the u. S. Chapels sister broke the news to friends on facebook writing tatekatie was a brilliant, kind, adventurous and high spirited woman. Her energy and passion could not be contained by mere continents and oceans. She was very much loved and shared her love for life with those she met. Chapels male driver is a man named pierre potgieter, he owns calabash tours. He is in the hospital and in addition to wounds on his arms he suffered a heart attack trying to save chapel. The company has denied his window was open and says chapel opened hers on her own accord at the last minute. Jose . What a tragedy. Katie, what would have prompted her to open that window with the lions so close is still remains to be found out but it as horrible tragedy. People do it all the time. And you look at the videos you see on the internet even people that have gone to that park after this attack her still opening their windows because they seem very calm at the time. And so i think youre lulled into this sense of comply say seine if you will and you think its safe. We know David Wrights arrest is linked to usaama rahim. Rahim had been under investigation by officials. He was shot and killed during a confrontation with Law Enforcement on Tuesday Morning. Reporter well, jose we have a lot of pieces of this puzzle but right now Law Enforcement is not laying out exactly how they fit together. It is calm here at the scene where yesterday police shot and killed 26yearold usaama rahim. They say they were approaching him to ask him questions about what they describe as terrorist related activities when he lunged at him with a knife. It was caught on surveillance tape which has yet to be released to the public. Authorities had been monitoring him 24 hours a day, surveilling him 24 hours a day for several weeks. They believe he was planning an attack on Law Enforcement within the next few days. Now since yesterday authorities have searched locations in three cities. They also arrested a second person, david wright. Right now were awaiting for him to appear in court to learn more about the charges he faces and how he may tie into this alleged, but right now theres no threat to the public. We dont know yet what wrights relationship was with rahim, do we . Reporter thats correct. We dont know how these two men tied together. We dont know if they were both involved in this alleged plot. You know perhaps radicalized by messages on social media, by isis. Those individuals can join on the ground and they might do something at home. We need to battle isis in cyber space. How do we do that . Now, the family says that was out of character and even if he was under the influence they did not think that that officer needed to use deadly force. He wasnt armed, right . He didnt have any weapon on him, right . Thats correct. So what do we know about this 20yearold . Well he grew up or was a resident of woodland hills, a suburb in the northern los angeles area. And he was just finished up being a student at moore park college, a Community College to the north of that area and is going to transfer to cal state long beach in the fall. He intended to pursue a legal career. One of his friends told me he actually wanted to become a public defender. You are also reporting the l. A. County District Attorneys office is investigating. When do you think well get more details on their probe . Its difficult to tell with how the criminal investigation or if any criminal investigation will result in charges. That District Attorneys investigation is independent from the Police Departments internal review. And, greg both sides are admitting or saying that he was on some hallucinogenic mushroom . So to the best we know, his friends have all confirmed this. However, the toxicology report will take at least another perhaps six to eight weeks to come out. In colorado the Movie Theater shooting trial set to resume in a couple of minutes. The prosecution has been showing the jury interviews recorded last july between james holmes and one of the Court Appointed psychiatrists. Holmes said he wanted to kill as many people as possible. Hes accused of killing 12 people and wounding 70 others in a shooting rampage during a midnight screening at a suburban colorado theater. Joining me now is our msnbc legal analyst. Faith, the jurors are seeing these interviews which are extraordinarily compelling but also seeing holmes private journal. How can the defense counter this evidence . They will counter with their own expert. The interviews they are watching, this is one interview, by Court Appointed psychiatric trift by the name of dr. Reed. He conducted this interview over the course of 22 hours. At the conclusion he said although james holmes does suffer from Mental Illness and i dont think thats even in dispute in this case given the evidence and what james holmes wrote in his journalism and what he did but he found him legally sane at the time he committed the crime and thats the real distinction in this case jose that jurors have to make whether or not he was legally sane at the time he did the shooting and what that means is did he know right from wrong at the time he committed the crime . So the state has the burden of proving. So the trial has become the battle of experts. States are putting on their two experts and defense will counter with their own expert to say he was not legally sane when he killed those 12 people. Can you in a court of law prove that you are motherinlawly ill and yet legally sane . In other words, one thing doesnt necessarily take the other one away . In colorado the way this works, the way their insanity defense works once james holmes the defendant raises the insanity defense, then burden shifts to the state. They now have the burden to prove he was legally sane at the time he committed the crime. Whats not in dispute here is that james holmes suffered from a Mental Illness. When you look at his journal and some of the thing wrote just the word why with a question mark over and over on various pages, and even in this interview when he gave this interview to dr. Reed a lot of the things he says and then what he did, the horrendous nature of the crime he committed its not in dispute he suffered from a serious Mental Illness but the jurors have a very narrow definition of legal insanity to consider here. Its very difficult. Only about 1 of the defendants in criminal trials raise the insanity defense and three out of four of those cases they are unsuccessful because a very narrow division. At the time he committed this shooting did he know right from wrong. They look at his actions. Did he try to evade capture. He didnt want to get caught. Prosecutors will argue he didnt want to get caught. Designee plan it very well. It was planned. It was premeditated. He wrote in his journal he thought about doing this at an airport but because of the security he had a 99 chance of getting caught pep also wrote that there was a Police Station about three minutes away from the Movie Theater so he could possibly get caught right away afterwards. He knew that what he was doing, he knew that there would be security on location and he was concerned about that. That will work again him in his insanity defense in the case. It looks like something out of Science Fiction but the official name of the saucer is the low density supersonic deaccelerator. Its to help with future landings on mars. Once there it has a rocket engine on the bottom of it. It will launch it even higher about 180,000 feet and that will kick it up to above mach 3. Screeching through the atmosphere at supersonic speed. What is a decelerator. Basically its a brake ike an aerobrake to slow a spacecraft down from the space. The way its been done in the past is parachutes and rockets. They will use this slow it down from mach 3 to less than mach 2. This is from a test last year that successfully test this inflatable thing but the parachute to slow it down to an acceptable landing speed failed. How long will this mission last . Its an hours long mission. A lot different than a normal rocket launch. Take two hours just to get into launch position above the earth and then just a few minutes for the launch up and back down again. So you know they will have to be waiting on pins and needles to see if they can pull it off. What do they hope to learn from all of this in the long term . The big goal is to use this kind of technology to land bigger thing on mars. Weve done a one ton rover. If we put people on mars we need to land habitats. So those bigger landings will be possible. Its basically inherently hardwired into the minds of these incredible insects. So this pipeline or this corridor that they are talking about would be very helpful. Incredibly helpful. Basically a natural causeway that connects minnesota to mexico. I35 over 1500 miles of habitat that will not only secure the potential survival of these butterflies, their goal is to quadruple the population from 56 million to about 225, 250 million 20 years from now but also help all other important insects like bees and hummingbirds and other creatures.
