Don, biden continues to hold the lead in the democratic field. You sat down with the president ial candidate, senator Amy Klobuchar, a we wideranging interview and talked about some of that. Heres some of what she had to say. Vice President Biden is a good person and was a great Vice President. I believe im the candidate for our times, and that is because im first of all from the heartland. I know how to win in purple districts and in red congressional districts. The report was coming in here to land at nasjax. It was coming from Guantanamo Bay, cuba, from the naval station there. But something wrong took place that made the plane skid off the runway and into the st. Johns river e. Which river, which is right there by the Naval Air Station. There were 143 on board. Thats a mix of 136 passengers and 7 on the air crew. A mixture of civilians as well as military personnel. All of them were able to get out of the plane. They have survived. Some of them have minor injuries. 21 of them went to the hospital but weve told all of them have been discharged. The real sad part about all of this is while the plane was still in the river and investigation is just starting today, there are animals on board the plane. There were peoples pets, cats and dogs and we dont know how theyre doing because crews have not been able to get on to the plane to get to those animals but we have been told theyre in the belly of the plane, which could be underwater. We have been told the cabin has no water in it. The people who are aboard thankful to survive that scary situation last night. And the ntsb is now investigating. The report also found the Trump Campaign benefited through information stolen and released through russian records. And just this week the fbi record is h this they will keep upping their game so we are very much reviewing 2018 as kind of a dress rehearsal for the big show in 2020. Meanwhile, a new umt maltimay House Democrats to get the unredacted Mueller Report, the attorney general will be held in context. It is gravely disappointing the attorney general is not withholding his oath of office and looking out for the American People and our system of justice but acting as a defense attorney and block on behalf of the president of the United States. That ag barr is in the way and will not last forever. We will have special counsel mueller before us. The American People will know the truth. Some republicans are defending the attorney general saying its enough hes given top Democratic Leaders limited access to some redacted parts of the report. They have been offered the unredacted version. Now theres one of those people who has been offered it, and they said they dont want to see it. They want the public to see it. Which is kind of a strange stance to take. I wonder if its because they want to continue on with their fantasy narrative while unencumbered with the actual knowledge they saw the whole thing the entire time. This is a disingenuine attack. And hes parpapparently never g up on his friendship with Vladimir Putin, regardless of the reason. What do you think of what Vladimir Putin said or does . We need to push our agencies to make this a high priority, work with our state and local governments to protect the integrity of the election and be ready to respond as we see further evidence of these russian trolls interfering. Theyre out there. We need to stand up for democracy. Trez victim Steve Mnuchin said he will decide by monday if hes going to comply to your request to release six years of trumps tax returns. What is your plan if he did not comply with your request . I think he decided a long time ago that never meant never. I think we need to move forward promptly with enforcement action. We had an interrent subpoena power in the house. I think the Judicial Committee could use that also. There are several methods that can be used to enforce this but i dont think we need to rely strictly on the courts. I think we need to be ready to enforce that subpoena power, whether its against attorney general barr or mr. Mnuchin or irs commissioner who really has the primary responsibility here under a law thats almost a century old that says shall but its being ignored by this lawless administration. I want to read to you something Steve Mnuchin argues here. He said your committees request risks undermining the privacy of all taxpayers. He also suggests there no legislative reason for releasing the president s tax returns, writing, quote, exposure for the sake of exposure is never permissible of congressional inquiries. What do you say of that . Thats the gist of what republicans said over the last two years as i moved six times and they covered up the tax returns, when i say we have multiple reasons to get this information, particularly to see whether the audit has been done in a proper way. We know long ago when president nixon wanted to show he wasnt a crook and he disclosed information, the irs had not done a very good job of the audit. We look at the audit. We also look at the basic confidence people have in our tax system, who we pay our taxes, we need to be sure everyone certainly the most powerful person in the world as president , is doing their job. Of course, i have been concerned about russian and saudi interference in our policies to see with reference to his businesses what kind of conduct or what kind of involvement had the russians and saudis had with him. Minnesota senator and president ial candidate Amy Klobuchar sent a letter to special counsel mueller and asked him if he had access to the president s tax returns. Do you think mueller has obtained the frpresident s tax returns . I think its very uncertain, very appropriate that an abled member of the senate made this request. The oversight on committee is this uniquely empowers our commit dwr committee to get this. And Robert Mueller, unless hes investigating a tax crime, could not get the returns. So thats why its so important to enforce the kwts and when mr. Mnuchin says no once again and gives excuses, we continue to subpoena the documents. If somebody is contagious, 90 of people not immune are because of vaccinations will catch it as well. Saint lucia has not had a confirmed case of measles since 1990. They do not want it there. Attorney generals bill barrs testimony this week is raising new concerns about his relationship with the president and obstruction cited in muellers report. Calling it catastrophic. Take a listen. If the president is being falsely accused, which the evidence suggests the accusations against him were false, and he knew they were false, and he felt that this investigation was unfair, propelled by his political opponents and was hampering his ability to govern e. That is not a corrupt motive for replacing an independent counsel. The president does not have to sit there constitutionally and allow it to run its course. Joining me now to discuss is jill winebanks, former assistant Watergate Special prosecutor as well as msnbc contributor. Jill, thank you very much for being here. Is barr asking as the president s defense attorney . Do you believe hes starting to politicize the Justice Department . He has completely politicized it but more importantly, hes wrong legally, hes wrong factually, and it is threatening democracy with what hes doing and at some Point Congress is going to have to take action to protect the role of congress as well as the right of the American People to know the facts. When you say take action, is impeachment included in that . Impeachment is one method. Holding him in contempt is another. Enforcing their subpoena is probably only going to happen through holding him either in contempt or through starting impeachment against him. This is not the role we knew when he was confirmed who he was. He had written a memo that takes a very far right wing position that is not legally sustainable in terms of the power of the president. If you were to leave it to one man to say, im not guilty, therefore, i am stopping this investigation, then no investigation could ever succeed against him, and that is a dangerous thing. People are entitled to know what the facts are and based on the facts that have come out so far, he is guilty of obstruction of justice. Theres no question. And that is what this case is about now. It is about the obstruction of an investigation, and its an investigation that doesnt need an underlying crime. That is a misperception and misstatement by the attorney general when he says, well, there was no underlying crime, nixon has nothing to do with as far as the evidence shows the original breakin. The real focus was on what did he do to stop it being found out that it was people from the white house and people from the committee to reelect the please that were involved in the breakin . Thats what the crime was. And the evidence there was john dean, mccord, one of the burglars who finally flipped on the president and stopped taking hush money and decided to tell the truth to get a shorter sentence, and all of that was confirmed by tape recordings. In this case we have don mcgahn, who equals john dean and andy donaldsons notes which equals the tapes. They confirm everything mcghan said and show how bad things are in the white house and what was going on to conceal and cover up, to stop an investigation that has some validity. The investigation is did anybody conspire to obstruct the investigation . And clearly that was going on. And history taught us about the coverup more than the crime. Lets talk about don mcgahn. You mentioned him. The president said he will not allow the former white House Counsel to testify before congress, threatening executive plinch. Does the white house have authority over someone who doesnt even wore for them anymore . They dont. He is a private citizen. They cannot stop him. They can invoke executive privilege, they can claim it, but its an invalid claim here for two reasons. One, it has been waived and theres no question about that. Its been made public in the Mueller Report. So the president waived it. Once you waive it, its gone. More importantly, the reason they waived it is because it was never there to begin with. People are forgetting you cannot use executive privilege claims to conceal a crime. When the conversation is in pursuit of a crime, its not protected by executive plinch. That is exactly what happened in watergate. Richard nixon claimed executive privilege and the courts said no, you dont have privilege if this is a crime. And its up to you to prove it wasnt. He would have had the burden of proof, and he couldnt sustain that burden because it was clear the tape recordings were part of a criminal conspiracy to obstruct justice. No, he cannot stop mcghan from testifying. Its as simple as that. Now, if mcghan refuses to testify because hes threatened by the president , which we know the president is not above, or below, im not sure which is the proper analogy here because the president will do anything, really in realistic terms he can and should testify. He must show the bravery that america deserves. He certainly cooperated with the Mueller Investigation speaking about don mcgahn. Another former watergate prosecutor of yours authored a the New York Times oped saying while these investigations, similar, mueller had a steeper hill to find because he didnt have the physical evidence that Archibald Cox had. Do you agree . In 2018 you tweeted theres so much more evidence needed to prove obstruction, all needed to prosecute that part of the state. Jill, does your offer still stand . It does still stand. Any prosecutor would be proud to take this seat. Nick possibly misper speceived evidence. He was not part of the obstruction team all. Hes focusing on the trial of the burglars, which has nothing to do with the trial of the defendants in the watergate obstruction of justice case. That case had no physical evidence. We had the testimony of john dean, corroborated, of course, by the tapes. We had the testimony of jeb mcgruder, corroborated by the tapes. We had a lot of other witnesses. But there was no physical evidence of obstruction. That oped is just missing the mark completely. It focuses on the underlying crime, which is not an issue because you dont need an underlying crime to have an obstruction of justice. And there is a motive for obstruction in both cases, and thats all it takes is to have a motive and to take acts in furtherance of that to obstruct and impede and donald trump has admitted on nbc to lester holt and in the oval office to the russians that he did the firing of comey to stop the investigation. He took a lot of other steps. He dangled pardons. These are similar things to what Richard Nixon did and for which he was named unindicted coconspirator in lieu of being indicted because we felt that impeachment was the way to go and that is indeed what happened. There were three articles of impeachment and one covered the obstruction of justice. One covered his misuse of power, his abuse of power. And one covered lying to the public and one covered the refusal to obey subpoenas of the congress. And thats where were getting to. I think the American People need to have a public hearing where they can see don mcgahn, where they can see corey lieu endo yousky, where they can hear Annie Donaldson corroborate her notes and everything that is happening. I do think in some sense if the democrats continue to position themselves as investigation upon investigation to somehow lure the president from office, i think that will have a backlash and the reason i think it will is because his supporters will become energized and rallying, will rally for him. I do think Congress Really as an oversight responsibility and they should conduct that. But they have to be sort of very careful about how theyre framing all of this. Joel, we saw three 2020 candidates take turns grilling barr on wednesday. Senators Kamala Harris, cory booker and Amy Klobuchar. Looking through the lens of their 2020 bids, how did they do . I think they did well and the two who stood out was Kamala Harris and Amy Klobuchar. These are two former prosecutors and women who have shown themselves to be incredibly impressive in that type of setting. And whats most important is it reminds voters of what potentially that would look like with an Amy Klobuchar or Kamala Harris on stage with donald trump r donald trump prosecuting case if you will against donald trump. A lot of primary voters were probably happy to see that and i wouldnt be surprised to see a boost in their numbers in the coming days and weeks. A new poll looks out who would come out ahead if the president ial election was right now. The Democratic Party is very energized to replace donald trump. Look, its clear to me now joe biden is the person to beat here. And heres the reason why, we think of the Democratic Party as a Young College educated party but the fact of the matter is most democrats are over age 50. Fair not all college educated, and joe biden is cleaning up with those people. And it tends actually the Democratic Party is about 20 very liberal but theres a large part of the Democratic Party that is conservative, not my kind of conservative, but conservative. And joe is right where the party is. So hes dominating and hes dominating fundraising. He had a terrific launch. He just seems to be right where the party itself is and not the party that necessarily puts itself forward on cable news. I think Vice President biden has had a really great launch here, and i think thats fine but i think the bigger point to Pay Attention to is whats the reason for the biden surge in polling that weve seen . Top democrats are opting not to challenge republicans in 2020, Stacey Abrams and just joining those outbid this week. How would you explain that . Is there a recruiting problem here . Im told that Chuck Schumer is blowing the recruitment of qualified Democratic Candidates to beat republicans. The other problem you have is its interesting because the republicans are defending 22 seats while the democrats are only defending 12. Thats a delta of ten additional seats republicans have to defend. But there are only two states where clinton won that are competitive and i would say one is not competitive. One is colorado, with gardner. Hes very vulnerable to a democratic pickup and the other is maine. But Susan Collins is very popular in maine and shes unlikely to be bheeaten by a democrat. You have a lot of people looking at the senate. The senate, we talk about executive temperament, people who want to get things done as an executive will not fair well in the senate, requires a legislative mindset. But couple that with the idea that many are believing the democrats will not pick up the senate because of this recruitment problem, and it sort of feeds on itself, why do you want to be a senator in a minority praerarty . Having said that though, he just have to look back in history and in 2007 at this time, it was clearly going to be Hillary Clinton versus rudy giuliani. Well, it didnt happen on either side of the aisle. Last time around no one at this point saw Bernie Sanders as a mortal threat to Hillary Clinton. Well, he was and it was a skprettive race all the way to the end. There are surprises coming. The only thing that might prevent this from turning out the way prior contests have, that is with lots of surprises, is you would have so many candidates that i think the average democrat is perplexed, even if they have a favorite. They look at that chart you all put up with 20plus candidates and they all blur together. Who has its a fulltime job to keep up with all of these candidates. Looking at it right now, its filling up the entire skrien almost. The official number we stand is 21. Lets look at the poll again if we can. In second place Elizabeth Warren 12 . That is an 8 jump from a month ago and its triple the support for a month ago. Larry, where do you think the surge is coming from . What does she need to do to keep it climbing . Its coming from people who are noticing that she is spending more time arguably than any of the other candidates on policy. On hard policy with details. And that matters to a lot of people who take the time and trouble to vote in president ial caucuses and primaries so that in addition to other things is the source of her strength. What can she do to continue it and sustain it . More of the same. Shes got the most elaborate proposals in the field at the moment and if she keeps that lead, it will help her. Whether its enough to win the nomination, again, you cant even talk about this as multi dimensional chess. Its like multi dimensional chess in ten parallel universes. Dont even bother to figure it out. When we touched on it earlier, the already massive democratic field has grown even bigger as colorado senator Michael Bennet has announced his bid. Larry, 21 is a great number if youre playing blackjack but is it a great number for a party trying to beat an incumbent president . Not necessarily. There are good things that come out of that. You have people campaigning everywhere with a basic message that donald trump has to be a oneterm president. Thats what they all have in common. And your message is being distributed in as many places as possible. If you only have two candidates, youre only going to be in so many places. Having said that, its confusing. I have been pushing for 31 so we can open a baskinrobbins with 31 flavors, flavor per candidate, but thats not in the interest of the Democratic Party. We all might need a built of ice cream after all of this stuff. Lets look at another quinnipiac poll here. This one asking democrats which one has the best chance of beating trump in 2020. I would argue with anybody who says absolutely this candidate or that candidate has the best chance. Who knows what condition they will be in a year from now, a year and a half from now when the election actually occurs . All right. That may be a very controversial position overall but with a lot of democratic voters, that has real appeal. So theres an undertow in this race, sub currents in this race you have to keep an eye on. In iowa today i will note Bernie Sanders, who certainly has some ground to make up with joe biden, started out at the Farmers Market in des moines, hes off to ames, i think, to perry, to ft. Now, at the end of the day, its things like that that are going to matter, because joe bidens got his big bump right now but as the weeks go on and people start to talk about, well, how do you beat donald trump, because again theres that core issue, there will be an awfully big interest in the policies that may appeal not just to primary and caucus states but to the battleground states and sanders is doing a lot of that now. My suspicion is you will see him bump back up in some of these polls. I want to ask you about the president s tweet tirade after the Firefighters Union endorsed joe biden for president. What do you think is behind that tirade there . We reported for a while joe biden has been one of the contestants that trump sees as threatening. He sees joe biden as a great candidate, a real contender. And i its interesting to see joe biden is already going after trump. He is running as if he already has the nomination. Hes intentionally contrasting himself with the president and outright attacking him on his policies and his actions. Were starting to see trump push back on biden there. Its bog to be key for trump to create an unfavorable candidate whoever he runs against, especially looking at where his Approval Ratings are right now. Hes going to either have to see his Approval Ratings rise by the time 2020 rolls around or going to have to create an unpopular candidate to run against. I think thats some of what were seeing already. Hes already starting to name call and create an unpopular idea around these candidates who are surging in the polls. Do you think the president is essentially helping joe biden by putting so much of his time and attention on the former Vice President . Absolutely, 100 , totally yes. There couldnt be theres simply no question. Hes legitimizing his candidacy in a sense . Well, when you listen to what larry was just saying, everybody is saying today, that theres a great desire to beat donald trump. And so if you are already in a race with donald trump, if its a back and forth between you and trump, an awful lot of democratic voters, that helps them to take sides. So, yes, trump is helping biden. Its interesting that hes doing this game of saying biden isnt that smart. I think that is always a dangerous game for a president who often trips over his own tweets. I want to talk now about this weeks showdown on the hill. Attorney general william barr making a decision to skip the house hearing on thursday about the Mueller Report and escalating an alreadyacrimonious battle between democrats and the department of justice. What are the expectations come monday . Thats the deadline for barr to release the full unredacted report to the Congress Members . Were certainly seeing democrats continue to go after barr. I think its important to note that this is sort of in lieu of going after trump. They dont think its smart to go after an impeachment right now but theyre turning their attention to barr now. Theyre turning their attention to holding him accountable for the way he presented the Mueller Report and especially with the news mueller may not have been fully happy with the way barr presented it. I dont think were expecting the department of justice to release publicly the unredacted documents hes already leased the report with some parts redacted, so i dont think were going to see any working together on this issue. I want to look how he answered that question. Lets watch. Im explaining my case for the presidency in terms of what i seek to do in the office. There are lots of reasons why various candidacies are historic. We can talk about the benefits that would come from having somebody who is different in that office, whether it be a white day male or a straight woman of color or an africanamerican male, whatever it is. All i can speak to is who i am and what i am, and how that forms me. I think each of us has that responsibility. Charlotte, what did you think about that answer . Its kind of the only way he can answer that question. Look, hes a white guy. Hes not going to not be a white guy in a year. It is true that millions of women in this country, who are looking to elect a woman president. Its also true that the black and hispanic voting bloc are really important for whoevers going to win the nomination. So the thing about his marriage and his identity as a day man is that it does set him apart from some of the other white men in this race who dont necessarily have any kind of identity hook at all to help them really reach out to any particular constituency. Dynamic we have not seen on the national stage, certainly not a president ial run. I want to look at a quote from your article. You write, quote, hes running as a healer, not a fighter, at a moment the party seems to be in fighting mode. Do you think this is a positive or negative in the 2020 race . This is a great question, one of the things thats interesting about pete and whats interesting about being an lgbtq american in particular is that hes had to bring people along with him on his journey as he came out and then got married. Both he and chasten came out in conserve tv communities in the midwest. Not everybody was on board to begin with. There were people, especially in chastens family, who had to learn to accept their son and his marriage. And thats one of the things i think pete brings to the case, hes able to reach out to people who maybe have not been on board with what democrats are saying or maybe even voted for President Trump and is able to say listen, heres why you should come over to our side. He has a real flun ensy with languages and one of the things thats a strength for him is he essentially speaks democrat with a republican accent. He likes to say on the trail there are people who voted for trump and pence and hix. And thats actually true. Republican with a democratic accent. Well put and great reporting. Once we saw what we say on april 30th with juan guaido being supported by some members of the army, something we had not seen before, with one of the most famo famous Prisoners Released and walking on the streets, once you see those two symbols, i dont think theres no way back. There might be a long way to go before Nicolas Maduro leaves power. And its really hard for a lot of People Living in the United States considering the hardships ordinary people are facing in venezuela, when asking why isnt it done . Why isnt this overthrow here just a done deal . Yeah, i know, its hard to believe, right . We see people really starving in venezuela. Many dont have access to water or power. The truth does that this is not going to happen without the support of the army. Well, look, the important thing is that russia has been trying to interfere in our elections for a long time. I was at an event this week with secretary pompeo that the hill hosted and he got asked about the russian meddling issue and what he said is, look, theyve been trying to do this for years. Its not going to stop them. So the important thing is that the government is taking it seriously and they are trying to ensure the integrity of our election process. Do i wish the president had mentioned it to Vladimir Putin during the phone call . Sure. But do i think that would have changed anything . Absolutely not. Amy, why are republicans concerned about this . Republicans are concerned about this. And i think what were seeing is a little bit of good cop, bad cop. That President Trump talks about having had a good conversation meanwhile our secretary of state is saying, absolutely not. Mr. Pompeo wants to be all over the russia thing. What i thought was interesting, felipe, is that the president said that putin smiled. Now no one has followed up on this. Does this mean the president of the United States is on Video Conference with Vladimir Putin . Are they facetiming . Are they skyping . What is happening here. And what does that information give to Vladimir Putin when hes watching President Trump react to his remarks. Or it is possible that that didnt happen. We dont know. Peter, i want to talk about this, the white house keeps trying to change the subject to the Obama Administration and shift the issue when election meddling comes up saying it was president obama who should have done more to stop russia. Was that fair . I was in washington this week and i got a very alarming briefing about this issue. I dont recall president obama overruling our intelligence agencies and contradicting them when they declared that russia was meddling but interfering in the 2016 elections nor did i have hear mr. Obama do what mr. Trump did yesterday which is once again to basically as the former fbi person you had on the show say the door is open. There is no doubt about it that this administration seems to have little or no concern. Frankly there are serious cybersecurity jobs unfilled at the white house and National Security counsel and the chief of staff to the president has told department of Homeland Security dont breathe a word of it and from the briefing this week were under assault, our democracy is under assault and the russians are doing even more for 2020 than they did in 2016. Lauren, President Trump overshadowed his good jobs report with this phone call to Vladimir Putin. So the question is why do this now . Could he be trying to divert attention from other topics like the attorney general, what do you think is going on with the timing here . I think it is anybodys guess. What motivates this president is difficult to discern. But the important thing is he should be talking about the economy. Look, we added 263,000 jobs in april, unemployment is at 3. 6 which is the lowest since 1969. I think a more a politician that practices more restraint would just be talking about that and nothing else. But President Trump is not traditional and so he is talking about the other subjects. But i think especially looking ahead toward 2020, the president and his allies in congress should just hammer the economic message home as hard as they can. Amy, the overall jobs report was better than expected. The Unemployment Rate is down. Lowest. 1969. But the impact isnt being felt equally by all. There was no change in the Unemployment Rate among africanamericans and hispanic americans are behind the National Average as well. What should the Trump Administration be doing differently to address this. We do know that africanamerican and hispanic unemployment is down. It might not be down where it was comparatively but under the Trump Administration it has lowered lowered, but i agree with lauren that President Trump is stepping on his own message when he keeps taking the bait and talking about russia and tells reporters he had a good conversation with Vladimir Putin. The conversation that President Trump should be having with the American People is about the economy and the success. The tax cuts, deregulation, all of that good news. But what we do know about President Trump is he goes after his enemies. He cant help it. He cant. Peter, the disparity in the numbers . The disparity were not discussing is in the Agricultural Sector and that is what the numbers dont represent. So in looking at them much more deeply and carefully, what were seeing in states critical to donald trump, wisconsin, nebraska and kansas, we have bankruptcies way up in dairy and in corn and other sectors. We have suicides that are alarming in these sectors. So on top of that, if you add what trumps wish list is, which is to basically destroy health care for americans, that is 32 million americans that would be without health care and theyre also be millions of people with preexisting conditions who will no longer have health care either. Then it makes it a lot easier in a sense for the democrats to point out that, yes, the unemployment numbers may be the best in 50 years or this or that, but the reality is for millions and millions ever americans things are getting worse not better.
