Suit: Texas company fraudulently purchased, resold PPE

HOUSTON A Texas-based company and its owners are facing fraud claims relating to the purchasing, resale and investment of personal protective equipment.  Joel Garza, Sr., and Joel Garza, Jr., filed a complaint April 5 in Harris County District Court against McCreless Enterprises LLC, Caleb McCreless, Rick Figueroa and Patron Partners LLC alleging fraud. According to the plaintiffs complaint, they entered into two consecutive side letter agreements with the defendants for the purchase and redistribution of personal protective equipment (PPE) from China and Vietnam. The Garzas claim that they invested $147,600 and were to receive 30% and 10% of the profits. They allege that Caleb McCreless took the investment funds and put it into his personal accounts to make himself appear wealthier than he actually is and that the defendants frauduently were double selling the PPE which put their investment in jeopardy.  

Injured worker claims construction site was not properly staffed

HOUSTON A worker clearing debris at a construction site in Dayton has filed a work injury case against a Cleveland, Texas construction company. Frank Harrell filed a complaint  April 5 in Harris County District Court against Guy Nicholson, individually and doing business as Weston Construction alleging negligence.  Harrell alleges in his complaint that he suffered serious personal injuries while working on clearing a debris field in Dayton on Dec. 16, 2019, and that the defendant is a non-subscriber to worker s compensation.   He claims the defendants neglected to properly secure and maintain the equipment used at the construction site and failed to have the site properly staffed. Harrell also claims the defendants failed to provide training or have proper safety policies in place as well as failed to provide emergency medical care. He also alleges the defendants violated regulations and standards of the Occupational Safety and Health Administration.

Man slips on alleged defective flooring at Houston apartment complex, sues for $250K

HOUSTON A man is suing the owners of his Houston apartment complex alleging he suffered severe injuries due to a defective floor.  Vincent Laday filed a complaint April 5 in Harris County District Court against Lyons Village and Lyons Village LLC alleging negligence.  Laday was a resident of the defendants Lyons Village apartment complex located in Houston, according to his suit. He alleges that on April 21, 2019, he suffered severe bodily injuries and bruises due to a dangerous condition on the floor of the apartment complex premises.  Laday claims as a result of his injuries he has also suffered disfigurement, incurred medical treatment expenses as well as physical impairment and mental anguish. He alleges the defendants were negligent for failing to inspect the apartment complex premises to ensure its safety for residents and also failed to properly maintain the apartment complex and address specifically a defective floor. Foreign exchange student suffered sexual abuse from host parent, suit alleges

HOUSTON A Spain foreign exchange student who resided in Harris County when he was 15 and 16-years old, is suing his former host parent who was charged with sexually abusing him.  R.A.M. filed a complaint April 5 in Harris County District Court against Hayim Nissim Cohen alleging sexual assault and intentional infliction of emotional distress.  R.A.M., is a 17-year old male who applied with Estudiar en USA for placement in the U.S. as a foreign exchange student. He alleges that after being placed in Cohen s home, who was serving as a host parent, he suffered sexual abuse and assault by Cohen and that Cohen engaged in sexually explicit conduct with him including forcing him to get into Cohen s bed.  R.A.M. further alleges that from September 2018 through April 2019, when he was 15 and 16-years old, he was forced to touch Cohen s genitals. 

Deshaun Watson plaintiffs to identify themselves, per judges orders

Apr 9, 2021 Two Harris County District Court judges have ordered Houston attorney Tony Buzbee to re-file the civil lawsuits that allege sexual assault and harassment against quarterback Deshaun Watson with the names of the accusers made public. In separate hearings on Friday, state district Judge Dedra Davis granted Watson s attorney, Rusty Hardin, a request to identify one of the 22 plaintiffs. Buzbee will have two days to re-file. A second judge made the same determination in the cases of 12 other women Friday afternoon.  Hardin held a press conference Friday afternoon explaining why he and Watson had been silent. This has been incredible ordeal for Deshaun, Hardin said in an opening statement. We toyed with the idea of having him here today but ultimately decided against that because it served no purpose because it was not going allow him to answer any questions.
