A plea agreement calls for Posey to spend three months on home detention, and to never again serve as a police officer.

Posey's two previous trials — conducted in June and September — ended with mistrials when the juries were unable to reach unanimous verdicts.

Jurors in the U.S. District Court trial began deliberating Wednesday, then returned for more work on Thursday before announcing they were deadlocked.

Two former Muncie police officers have been sentenced to federal prison after pleading guilty to excessive force charges.

Posey's second trial on a federal count of obstruction of justice is set to begin on Sept. 11.

On July 7, Posey was arrested following a rear-end collision on U.S. 31 near Markland Avenue in Kokomo.

"As I sit here, I don't see you as a bad apple," Judge Sweeney told Kurtz. "I don't see you as part of the systemic problem that Muncie has."
