Firearm Preemption News Today

INDIANAPOLIS -- You've probably heard about the gun control proposals laid out by the mayor of Indianapolis. Those proposals will be up for a vote tonight.

Yesterday, the Washington Supreme Court gave law-abiding Washington gun owners something to celebrate. In a unanimous opinion, the Court ruled that the City of Edmonds’ storage ordinances violated the state’s preemption law. These ordinances required firearms to be locked at all times within the home, and imposed liability on gun owners if their firearms were ever accessed by a prohibited person.

Yesterday, Governor Spencer Cox signed Senate Bill 115, to enhance Utah’s firearm preemption law. With this action, Governor Spencer Cox continues to show his commitment to the Second Amendment, adding to the list of pro-gun bills he has signed into law, which includes constitutional carry from last year.

Back in 2021, the South Carolina Court of Common Pleas ruled in favor of Attorney General Alan Wilson, agreeing that the City of Columbia’s anti-gun ordinances violate the state’s preemption law. In 2019, Columbia had passed ordinances to restrict the home-building of firearms, to allow for Second Amendment rights to be suspended and property to be seized without due process, and to ban firearms within 1000 feet of schools, even though existing federal law already does that.

Yesterday, NRA-ILA filed an amicus curiae (or friend of the court) brief supporting penalties against local officials who violate Florida’s preemption law with local infringements. This is the second amicus brief that NRA-ILA has filed to protect the Second Amendment freedoms affected by this important case, which is captioned as Fried v. State of Florida.

Today, the Utah State Senate voted to concur with the House on Senate Bill 115, legislation to enhance Utah’s firearm preemption law. It will soon be transmitted to Governor Spencer Cox for his consideration.

On Thursday, the House voted 58-16 to pass Senate Bill 115, to enhance Utah’s firearm preemption law. SB 115 has now been transmitted back to the Senate, where it awaits a concurrence vote.

On Friday, the House Judiciary Committee will hear Senate Bill 115, to enhance Utah’s firearm preemption law. The hearing will have an option to participate by video conference. To view the agenda and find information on participating, click here.

On Friday, January 28th, the House Committee on Public Safety voted 11-9 to advance House Bill 827, to restore and advance Virginia’s firearm preemption law to prevent localities from restricting Second Amendment rights. The Subcommittee #1 previously voted on Thursday to advance it to the full committee. It will now move to the House floor, where it can receive a vote soon.
