is because the actual regs give him the discretion if he thinks that s warranted or whether he thinks there s a basis for some kind of criminal investigation. he certainly s not privy to what was done by the chicago attorney looking at it, but from the outside it doesn t look like there was any evidence of criminal intent. he could have handled it himself and determined there was no need for a special counsel. obviously from his own remarks, he s very much relying on public interest here. it s a sitting president and he wants to cover the insulation of usuals special count. he didn t have to, but i see why he did. actually there could be unintended benefits for the biden administration because by having a special counsel run a criminal investigation, that could insulate them from a lot of congressional inquiries
