A lawsuit pitting Democratic Gov. Roy Cooper against Republican legislative leaders over appointments to state boards and commissions is heading back to a three-judge panel. A single judge made that decision Thursday morning after a court hearing in Raleigh.

State Supreme Court Chief Justice Paul Newby has stepped into the legal battle between Gov. Roy Cooper and Republican legislative leaders over appointments to state boards and commissions. A hearing in the case scheduled for Thursday afternoon has been delayed one week.

Three judge panel temporarily blocks part of law altering board appointments

Republican lawmakers passed bills this year reworking key state boards and stripping the governors office of some of his appointment powers. Democratic Gov. Roy Cooper sued over that legislation.

The ruling temporarily blocks changes for three important boards where Republicans had taken the governor’s appointments and given them to the legislature or other Council of State members.

Gov. Roy Cooper has lodged an objection in Wake County Superior Court in his challenge to new state laws limiting his appointment powers. The court refused to hold a hearing on Cooper’s request for a temporary restraining order. Instead a three-judge panel will hold a Nov. 1 hearing on Cooper's pursuit of a preliminary injunction.
