A judge kept intact most of the ballot summary Secretary of State Jay Ashcroft wrote for an initiative petition dealing with school funding.

A Cole County judge heard arguments Thursday about whether Secretary of State Jay Ashcroft wrote a misleading ballot summary for an initiative petition seeking to prohibit public tax dollars from going to private schools.

The initiative petition would prohibit a tax credit program Missouri lawmakers passed that helps fund donations to pay for private school.

At issue, is the way an initiative petition that aims to bar the state from issuing tax credits to offset private school tuition is framed.
