A Superior Court Judge has ruled that Oceanside’s Nov. 3 referendum on the North River Farms project proposed for South Morro Hills is invalid and that the 585-home Integral Communities development can proceed “assuming other pending litigation does not prevent it.”
The Legislature clearly intended to preempt referendums designed to restrict “development of housing within this state” under Government Code 66300, which was passed in 2019 to address the state housing shortage, said Judge Richard S. Whitney in the final ruling Thursday afternoon.
Oceanside City Attorney John Mullen said Friday the city has not decided whether it will appeal the case. The developer also faces an unrelated lawsuit filed by the local nonprofit Preserve Calavera, which challenges the environmental impact report approved for the project.

The Carlsbad City Council met in closed session Tuesday to discuss litigation and property negotiations. In open session, the council approved authorizing staff to work with Brookfield Properties, NRG Energy, and San Diego Gas & Electric to relocate the SDG&E North Coast Service Center from Carlsbad Boulevard and Cannon Road to the city-owned parking lot at The Shoppes at Carlsbad. Robert Prosser, Raúl Diaz and Patty Schreibman were appointed to the Historical Commission.

North County parents and students pushing for a full reopening of in-person instruction at two school districts plan to gather Monday morning to rally for their cause.
Several parents have been vocal about their dissatisfaction with San Marcos and Oceanside Unified School Districts’ timeline and capacity on reopening classrooms and have held protests in the past voicing their concerns. They say the slow reopening process has hindered their children’s academic and mental health while they’ve been learning remotely due to the coronavirus pandemic.

SAN MARCOS, Calif. (KGTV) A group of North County parents gathered outside of the San Marcos Unified School District office Monday morning and called for the immediate reopening of schools for full-time, in-person learning.
A judge said San Marcos Unified, as well as the Oceanside Unified School District, had the discretion to design their own school reopening plans and timelines. Classroom capacity in both districts has been the argument against a full-time return.
