ExxonMobil used employee ranking system to eliminate older workers, suit alleges

HOUSTON Exxon Mobil is facing a claim that it implemented an employee ranking system and took other efforts to eliminate older employees.  Jose Simonetty filed a complaint May 17 in Harris County District Court against Exxon Mobil Corporation alleging age discrimination.  According to his complaint, Simonetty began working for Exxon Mobil 30 years ago and on July 9, 2020, at age 62, he was terminated. He alleges that throughout his time at Exxon Mobil, he received awards and commendations for his performance and that once he turned 58 years old, he noticed a rapid, unsubstantiated decline in his performance ranking.   Simonetty claims that Exxon placed employees in this age group in performance evaluation programs that were essentially the last step for older employees and very few, if any, survive the programs to get their employment status to the company s acceptive level.  

Transvaginal mesh plaintiffs hit Houston law firms with lawsuit alleging fraud, breach of fiduciary duty

Clark Love & Hutson HOUSTON – Two are law firms were recently sued by former clients over the handling of their transvaginal mesh complaints. Seeking more than $1 million in damages, Linda Smith and Sandra Benoit filed suit against Clark Love & Hutson and the Lee & Murphy Law Firm on May 13 in Harris County District Court. According to the lawsuit, each of the women signed contingent fee agreements with the law firms to represent them in litigation against Boston Scientific Corporation.  Smith, a California resident, claims the firms created a higher value for a settlement for clients whose cases had been filed in a court of competent jurisdiction and discriminated against clients, like herself, whose “suit was not filed through no fault of her own.”

Woman claims unlawful prosecution by Harris County Toll Road Authority

Pixabay HOUSTON A woman claims she faced unlawful prosecution and was wrongfully banned from Houston toll roads by the Harris County Toll Road Authority.   Thien An Vo filed a pro se complaint May 10 in Harris County District Court against Harris County Toll Road Authority and its administrative hearing alleging violation of state laws and state penal code.  According to her complaint, Vo was an independent contractor who drove passengers for fares in the City of Houston. She alleges that in 2016 and 2017, the defendants cited and prosecuted her for failure to pay 15 toll passages despite her EZ-Tag account being active with available funds and her credit card filed with the account being active with funds available.  

Woman claims H-E-B Grocery s negligence after slip, fall

HOUSTON A woman is suing H-E-B Grocery after falling at its Harris County store and suffering injuries.  Alicia Paulin filed a complaint May 11 in Harris County District Court against H-E-B Grocery Company LP alleging negligence.  According to Paulin s complaint, she was at the H-E-B Grocery in Harris County on Sept. 20, 2020. She alleges that she slipped and fell while on the defendant s premises and suffered injuries.  Paulin claims the defendant s negligence for failing to maintain a safe property including making sure the floor was safe to prevent slips and falls. She also claims the defendant failed to inspect the premises or warn the public of any unreasonably dangerous condition.
