India is to appeal against a decision not to extradite a london couple suspected of arranging the murder of their adopted son. Its alleged they arranged for the 11 year old to be killed in the indian state of gujarat for an insurance pay out of 100 and £50,000. A uk court rejected the extradition on human rights grounds. Face to face with the british woman wanted over the murder of her adopted son gopal sejani. Here he is in an indian hospital shortly after he was attacked. The 11 year old manages a smile for the camera while battling for his life. Doctors spent three days trying to save him. Gopal was an orphan a farm boy living in poverty in the indian state of gujarat in 2015. Arti dhir and her husband Kaval Raijada traveled from britain to adopt him, offering him a better life with them in england. But the Indian Police claim the couple had another motive. This boy was adopted when mrs arti dhir was here in india in 2015 and fter a few days she took an insurance policy in his name which was for a huge amount and she paid two premiums and she knew very well that in the event of death of gopal she would be paid ten times the insured amount. He never made it to london. In february 2017, he was abducted and stabbed by two men on motorbikes. The insurance money was never paid out. But the court said its possible they could be prosecuted here if there was evidence an agreement to murder was made in this country. These defendants may well have committed some of the acts in the uk, for example some money was sent from the uk to india, some meetings potentially took place in the uk. The Court Unanimously ruled judges can be classified as workers and so should be entitled to whistle blowing protection. Our Legal Affairs correspondent, clive coleman, said the judge in question had tried to raise concerns about workload and security. Yes, well, this is a particular judge judge claire gilham. She sat as a districtjudge at Warrington County Court and when cuts to the Justice System and to the court system started to bite in 2010, she became very concerned about the increased workloads onjudges, but also judges security. She herself had been warned by the police that a litigant in person and, of course, litigants in person, people who had to go to court because they werent getting legal aid had to go themselves that one these people had a settled intention to kill her, she was warned by the police. She raised her concerns and she says, as a result of raising those concerns, she was bullied by seniorjudges and court staff and her concerns simply werent taken seriously and that led to her health suffering she suffered a breakdown and shes fought a legal battle all the way to the Supreme Court to establish the right thatjudges are entitled to blow the whistle like other workers and not suffer as a result of that. And today, a unanimous ruling the judgment given by lady hale, the president of the Supreme Court, thatjudges, alljudicial office holders, are entitled to whistle blowing protection. Now, after the ruling, i spoke spoke tojudge gilham. I felt forced to go off sick. I felt that there was a strong reaction. I didnt feel that i was supported while i was off sick and, after trying to get back to work and have these issues addressed by every possible means internally, i felt i had to take the matter to court. And you fought a very long battle, legal battle. You are a judge well equipped to do that, but youve taken it all the way to the Supreme Court and today, unanimously, they vindicated your claim that judges should be entitled to blow the whistle on matters of public concern. Yeah. I think the Supreme Court clearly felt that there is a public duty here. You take an oath of office and all the consequences that go with it and youre doing a public service. And so you have a duty to speak out if things arent going right and you should be protected. So shes had a long fight and as you point out shes a judge and the fact that she struggled with it shows how its tough for anyone going through that sort of thing. She is obviously part of a select group, though, as ajudge. Are there wider implications as a result of this . I think the real point of this case is look traditionallyjudges havent commented about you know matters concerning the administration of justice, political matters, if you like. Their position is such that they just. It simply isnt the role ofjudges to get involved in that sort of thing. What this case establishes really is that if they have serious concerns about the workings of justice, faults within the Justice System and it is in the Public Interest that those matters are raised then they have the whistle blower protection to do that. Now, judges are very seldom likely to do that. If you speak to some judges off the record theyll tell you that you know raising those sorts of concerns may not do yourjudicial career a whole lot of good. But what this establishes is that if the matter is important enough and it is in the Public Interest, then judges along with other workers have the right to blow the whistle safe in the knowledge that they have the protection that if they do blow the whistle, they should not suffer a detriment as a result of doing that. Clive coleman are Legal Affairs correspondent. Premature birth which is defined as a birth before 37 weeks is globally the biggest cause of death among newborns. While incubators can save the lives of some premature babies they can also leave them with long term disabilities. Now scientists in the netherlands say they are within 10 years of developing an alternative an artificial womb that could save many more lives and reduce the risk of disabilities. As part of our 100 women series sofia bettiza reports. Imagine a future where babies are born from machines. In 2017, researchers in the us successfully tested an artificial womb on lambs. And now a group of doctors in the netherlands are working on the first artificial womb for humans. After being born, a premature baby would be placed in this, an artificial womb full of liquid. And we will close the bag. This is the artificial placenta and it is connected to the baby with the umbilical cord of the placenta and the umbilical cord of the baby. The hope is that this could increase the chances of survival of premature babies. Around the world, about 50 million children are born prematurely every year. And half of them dont survive. Like james. His mother gave birth to him when he was only 2a weeks old. He died two months later. At that time, artificial womb was like magic. We dreamt about it, if that was a possibility, but it wasnt. When premature babies are put in an incubator, they get oxygen pumped into their lungs to survive. But theyre not yet developed enough for this. An artificial womb, on the other hand, would have a baby floating in fluids and kept in a sealed environment until it is fully grown. This will change the lives of many people, because those babies are going to survive. Dr oei says the technology is nearly ready. But is Society Ready . A group of designers in amsterdam have created this to represent what the technology could look like. The inflatable balloons are like wombs with babies inside and the tubes coming out of them would carry the fluids that babies need to survive. This was one of the first sketches. Lisa created the model because she feels the key to society accepting this new technology is the way it will look. You wouldnt really imagine putting your baby in a plastic bag. You wouldnt feel comfortable with that. So we need to think about a design that you feel comfortable. This technology seems to offer parents hope, but could it actually end up presenting them with an extremely difficult choice . As it is now, if the child is 22 weeks, we just simply do not treat and, unfortunately, the child dies. But with the artificial womb, it seems to be the case that they have to actively say no, were not going to say the child, not going to sav the child. Which can, you know, evoke feelings of being a bad parent, you know. Despite some concerns, doctors plan to Start Testing artificial wombs on humans within the next ten years in the hope this could save the lives of millions of preterm babies around the world. There are still a handful of flood warnings across england despite waking up this morning to the rain this is how it looked in norwich. The rain is clearing quickly her. It drags on the north east and we could see a pulse of rain in south eastern parts of england before it clears. Withjust a light wind and good spells of sunshine, perhaps they are showery in western scotland, it actually feels quite pleasant out and about. Through this evening of over about, you can see towards morning that the showers are gathering strength for the rest. It will not be quite as chilly across northern ireland, but we could see a touch of frost and the glens in scotland and the mist and fog as we get into thursday morning and that will be something to watch for in the morning rush. Sunshine and showers then. They will be prevalent across western and southern areas, but i dont think anybody is exempt. As a result, it is going to feel quite cool in that blustery wind.
