I encourage everyone to read it in full. The attack on our nations capitol onjanuary 6, 2021 was an unprecedented assault on the seat of american democracy. Its described in the indictment it was fuelled by lies, lies by the defendant, targeted at obstructing a Bedrock Function of the us government, the nations process of collecting, counting and certifying the results of the president ial election. The men and women of Law Enforcement who defended the us capitol on january 6 are heroes. They are patriots and they are the very best of us. They did notjust defend a building with people sheltering in it, they put their lives on the line to defend who we are as a country and a people. They defended the very institutions and principles that define the United States. Since the attack on our capitol, the Department Ofjustice Has remained committed to ensuring accountability of those criminally responsible for what happened that day. This case is brought consistent with that commitment. And our investigation of other individuals continues. In this case, my office will seek a speedy trial so that our evidence can be tested in court and judged by a jury of citizens. In the meantime, i must emphasise that the indictment is only an allegation and the defendant must be presumed innocent until Proven GuiltyBeyond A Reasonable Doubt in a court of law. I would like to thank the members of the Federal Bureau Of Investigation who are working on this investigation with my office as well as the many Career Prosecutors and Law Enforcement agents from around the country who have worked on previous january 6 investigations. These women and men are Public Servants of the very highest order and it is a privilege to work alongside them. For more on whats happening, lets hearfrom our north america correspondent, nomia iqbal. The former president is due to appear on thursday and can appear on thursday and can appear virtually one person but he will probably do that in person as he has done previously. Inside court he will face what is arguably the most serious indictment so far and probably the most serious indictment that the Department Ofjustice Has ever brought against a former president , and potentially a future president. He is being accused in this 45 page indictment of trying to subvert the Election Results of 2020, trying to overturn democracy. One of the charges includes Conspiracy To Defraud the United States. He has dismissed this indictment as is done with the previous two, saying this is a political witch hunt, the department of justice Being Weaponised by President Biden in order to stop them running for the white house, unsubstantiated claims he has made. The Republican Party by and large have backed him. They did so with his previous two indictments and have also seen his Approval Ratings tend to go up with republican voters. It is probably going to be the same with this indictment. However, how he does with the rest of the american electorate remains to be seen. Right now however he still remains the clear front rather the Republican Partys president ial nomination. Special Counseljack Smiths indictment caps an inquiry into events surrounding the january 6, 2021 riot at the us capitol. The investigation focused on mr trumps actions in the two month period between his loss and the attack on congress as lawmakers certified democratic president joe biden s victory. Following the attack, congress led its own investigation and impeachment inquiry of donald trump. I spoke to tim heaphy, the lead investigator to the house january 6th attack, about the way his work led to todays indictment. Thank you so much forjoining us on bbc news. Reading the indictment, provide . Reading the indictment, its provide . Reading the | indictment, its pretty provide . Reading the indictment, its pretty clear the Vice President has recounted for the Special Council direct communications that he had with President Trump in advance ofjanuary six about the key issue of his authority. Indictment also reflects that he took contemporaneous notes. Wrote some things down. Either during or right after those calls and the Special Council is in possession of that. We spoke was chief of staff. We need approach that was put on him by the end others. But mike pence gives a very interesting window to that by actually recounting the words used in the direct pressure applied. It looks like he is a key witness if this case ever goes to trial. The country is very much divided on whether President Trump is liable for what happened, if you should even be prosecuted and former president still has and former president still has a lot of support. And notjust among his base but widely among republicans. What you think it is important is case does go to trial . Im not a political expert and im not really qualified to opine on why it is that our political system is divided but i do believe in justice and i believe the law shall apply equally to everyone, whether he is a former president of the United States or someone of considerably less means and stature. If that concept is going to mean anything, that has to apply in situation like this. I was a prosecutor and worked in the Criminaljustice System for years and believed strongly that the system, in order for it to work, these allegations, allegations like this need to be adjudicated in court. Subject to Cross Examination and the burden of proof. The president is presumed innocent. With an opportunity to defend these charges. Whether that exacerbates divisional solves it remains to be seen, i dont know. If it remains to be seen, i dont know. ,. ,. , it remains to be seen, i dont know. ,. ,. ,. , know. There are enough facts to essentially explain the charges, but my guess is there will be more evidence, more testimony, more specific instances that are manifestations of this plan that will play out in the trial. The former president is facing several trials, with many of them taking place on or around key election days in 202a. Lets take a look at some of the trials mr trump will face. In october, the new York Attorney general s Civil Fraud Trial against mr trump starts in new york. Early next year, His Second Defamation Trial brought by Writer E Jean Carroll is set to open 15 january. Thats the same day as the crucial iowa caucuses, which kick off the 2024 primary season. Later that month, mr trump, his company, and three of his children will face a trial accusing them of luring people to invest in Sham Business opportunities. In march, the largest bloc of voters cast their ballots for their partys nominee for president on whats dubbed super tuesday. That same month, new yorks criminal case against Trump ForfalsifyingBusiness Records as a part of Hush Money Payments to Stormy Daniels will begin. Trumps Classified Documents Trial Will Begin In May just some 169 days out from election day in the us. In the midst of the trials, the Republican Convention will happen injuly, where delegates of the Party Officialy Select the partys nominee on the republican ticket. And finally, The General Election Day will come in november. For more, im joined by former us attorney for the Southern District of new york, david kelley. The courthouse in washington is slamed with a backlog of hundreds of 6january cases on the docket. There are defendants who were charged in 2021 who have yet to go to trial. Is a speedy trial even possible . That is a really good question. The civil trials are not ones at which he needs to appear personally, the criminal ones of those at which he needs to be present stop its really hard to see how its all going to shake out. For instance, a documents case, while it is set for may 2a, still too early to tell in the process with pre trial motions and discovery, whether or not it will go. With his new indictment, typically you can count on a trial going about a year after indictment. We will see if that holds the case here. The reason why only one defendant was charged in this case was in order to try to get it to trial faster than if they had tried or charged other defendants. I think for instance, the Co Conspirators who may be charged later. Its really hard to see how its going to shake out in terms of the schedule. Whats interesting with a new indictment is if you have a Parallel Universe Going On Were Trump has created a narrative that he was forced out of office before, illegitimately, and lost the election because of the big steel. And the indictment talks about the big lie, so if you have them going on, the trial going on, parallel to the campaign, it will be an interesting dynamic hearing from him, his voice, one narrative, and from the trial, facts, supported facts, supported by average, evidence that tell a different narrative. Its hard to predict because with every we have never confronted Something Like this. ,. ,. ,. , this. Given that, how do you think the this. Given that, how do you think the special this.
