You are in the cnn newsroom. Hi, im jessica dean in washington. Jim acosta has the night off, and we begin with major developments in the Fulton County investigation into former President Donald Trump. The District Attorney there just notified two witnesses to testify before the grand jury next week as she prepares to seek a potential fourth indictment against trump and some of his allies. She will attempt to show that they conspired to overturn his 2020 election loss and today we got the strongest indication of eutenant governor and cnn contributor geoff duncan. Take a listen. I did just receive notification to appear on Tuesday Morning at the Fulton County grand jury and certainly will be there to do my part in recounting the facts. I have no expectations as to the questions and will certainly answer whatever question is in front of me and dont want to go any deeper to jeopardize the investigation but, look, for me this is a story that is important for republicans to hear, americans to hear, lets hear the whole truth and nothing but the truth about Donald Trumps actions and surrounding cast of characters around him. Joining me now in the studio cnn Political Correspondent sara murray and here to give us legal analysis cnn contributor and former Nixon White House counsel john dean. Sara and john, great to have you both here. I want to start with sara first. Walk us through these notifications from the Fulton County d. J. She subpoenaed a handful of witnesses and sort of said, you know, im putting you on standby to testify before the grand jury. Ill give you a 48hour notice when we need you there and today it sounds like some of these witnesses, geoff duncan among them and George Cheatyage independent journalist said please show up and testify before the grand jury on tuesday. This is a good indication she is going to start presenting her case early next week. Weve heard from other sources this is likely to take two days so she could begin the presentation on monday. Go through tuesday and then ask the grand jury essentially to hand up their indictments tuesday afternoon or evening, you know, weve heard she is likely to seek charges against more than a dozen individuals in this case so its not just donald trump that shes been looking at. Right, it is so many of his allies, as well. We know that duncan along with 75 other witnesses have already testified in this investigation. Walk us through what you think tuesdays going to look like for him and george as well. I think this is interesting. They testified before a Special Grand Jury that was set up just to investigate what donald trump and his associates were doing around the 2020 election. This grand jury that hes going before, they havent heard any of that. They have been Hearing Cases about armed robberies and Hearing Cases about murders, you know, sort of Run Of The Mill cases if Fulton County and so what i think is that the Fulton County District Attorneys team is going to come in before that grand jury and say either monday or tuesday, okay, today youre going to hear a different kind of case and then theyre going to put on witnesses that can sort of craft this narrative about the efforts to try to overturn the 2020 election, whether it was the phone call between donald trump and Brad Raffensperger where trump asked him to find the vote, whether its the fake elector scheme or the Voting Breach in coffee county, georgia, and then she will ask for the indictments shes seeking. I want to bring john into the conversation. John, good to see you, what do you make of a former Lieutenant Governor testifying against a former president of the United States in a scheme to try to overturn an election result . Must be a good witness because he already testified at a Special Grand Jury. Must tell a good story, a full story, an honest story and so she wants to bring him back to help educate this the regular grand jury which will hand down the indictment. Right, we know that we were talking about whats unique about a grand jury. Its just a prosecutor that jurors can ask questions to the people who are testifying. How do you expect it to play out gentleman. A grand jury, a secret proceeding. We actually dont get into grand juries. They dont televise them as they will the trial of this case. Theyre just ordinary citizens who are brought in as a shield between the government and a potential defendant to say, yes, indeed, there is a crime here and we believe it ought to go forward. I believe this grand jury is a standard 23person grand jury, men and women. Theyre probably taken from the voting rolls and if 12 of them vote for an indictment, an indictment will be handed down. Doesnt have to be unanimous. But it might well be. Well never know that. Right, right, so this is whats going to happen. Shell present the case, and theyll pass their judgment. Right. And, sara, i want to go back to a point you mentioned a little earlier. You said it isnt just trump shes looking at. Shes looking at other people, and shes talking about a conspiracy case here. Shes talking about racketeering. That involves other people. What do we know about these potential others that could be included . I think she wants to lay out the various facets that people put forward to try to overturn the election so, you know, Rudy Giuliani is a good example. Hes Donald Trumps former attorney. Hes been told he is a target of the investigation and showed up and gave totally bogus presentation before State Lawmakers with plenty of these conspiracy theories, you know, he also, we know from our reporting was involved in sort of coordinating fake electors across seven different battlingground states so someone shes going to be looking at and also looking at people who are behind this sort of campaign of harassment against Election Officials there as well as again there was a Voting Systems breach in rural coffee county, georgia, one of the things that will look and feel different about these indictments and what weve seen from the other from the many other indictments against donald trump. We saw unindicted, unnamed coconspirators in the federal indictment around Election Interference, but thats not what were expecting in this case. We are expecting an indictment that names the nails of other individuals that the District Attorney office believes helped donald trump in this effort to try to overturn the election. Right. It is so interesting to make that point, and, john, just talking about trump and his defense team, look, in this case, they have recordings of that phone call that sara talked about where he is asking Brad Raffensperger to fine the extra votes and have this other evidence. What kind of legal challenge do you see playing out for his defense team should he be indicted and go forward with this case . You must remember, jessica, with a conspiracy that all of the conspirators are guilty for the acts of each other, so i think shes going to bring a very big case, maybe at least we know at least maybe a dozen, if not as many as 20 different defendants will be involved this this conspiracy. Shes got cooperation from some of the fake electors. She has cooperation from other potential conspirators. So, this is a big case, and i think its where the defense is going to go is first trying to find a jury to find some sympathy with that will hang at least somebody will not agree to find beyond a reasonable doubt. Thats where itll start. Its going to take a long time to put a jury together and this case probably wont happen, get tried until well after the election is my guesstimate. And, john, what do you what sticks out to you about this potential fourth indictment . Weve now been through these other three, which you have given analysis on and taken a look at. What sticks out to you as unique about this fourth one . Well, its a rico case, makes it unique. There is a federal rico statute. As sara was mentioning, Rudy Giuliani appears to be one of the targets of the case. He made his bones in new york as a prosecutor on the federal rico statute. So he knows rico law, but here hes dealing with a very broad georgia statute, and thats a unique statute, so i think thats what will make its kind of a speaking indictment, she likes these cases of the shes brought other rico cases. She can tell a story rather than just a chapter of a book, she puts out the whole book when she tells this story. It will be fascinating to see, sara, i want to ask you, just kind of about security and we know that fani willis has said there has been constant threats against her, against others. This has been, of course, a years long investigation. We know that there are Security Measures in place and more will be implemented. Youve been down there in georgia around this area. What do you take away from all of this and what should people keep in mind . I think one of the things that made the climate around this is she is a black democratic District Attorney in the south and a lot of the threats she receives are reflective of that, racist and sexualized and her and her staff have had to endure it and why weve seen the security go up and barricades go up and a Huge Police Presence and her personal security has been beefed up and i suspect well see even more of that this week just because, you know, its hard for them to discerning what is going to be the difference between an internet troll, someone who is firing off, you know, threats via email or leaving anonymous voice mails versus someone who would try to show up. Thats something that they take very seriously. You have to. You are better to be safe than sorry. John, i want to talk about the political implications here. Theres obviously all the legal issues for former president trump, but this is all happening. He was in iowa today talking to voters there. He is running to be the gop nominee in 2024. While he has three indictments and likely a fourth against him, hes joked that another indictment just makes him stronger in the polls going into the 2024 election. What do you think . Im not sure it makes him stronger for the general election. It might appeal to his base. He is very good at playing the grievance card, that he has been a victim, he is not. These are based on his own behavior, and this is standard operating procedure. Hes being treated like any other defendant. So what hes going to do with this in georgia in particular, hes run some of the nastiest Political Ads attacking fani willis rather viciously and falsely. Whether the Georgia Judges will tolerate that or not, i dont think so. Its pretty unseemly so well see how this plays out. If he continues this behavior. Yeah, it will be. Theres so much that will come in the next days and week ahead. John dean and sara murray, thanks to both of you. We appreciate it. Thank you. Former President Donald Trump hitting the Campaign Trail in iowa today and making his first appearance since we learned more about a possible fourth criminal indictment. In less than 48 hours georgia prosecutors plan to seek new charges related to trumps efforts to overturn that states 2020 election results. Today Former Georgia Lieutenant Governor geoff duncan revealed to cnn he will testify before a grand jury tuesday. Duncan is also a cnn political commentator. All of this as the son of the current president faces mounting legal troubles of his own, just yesterday the Justice Department appointed a Special Counsel to oversee the prosecution of hunter biden. Joining us now to discuss all of this Seung Min Kim from the Associated Press and laura barone lopez. Great to see you both. Laura, i want to start first with you. We see the former president campaigning. What are we expecting to see from him in the next few days as this goes on in georgia because now this would be a fourth indictment. He kind of has a playbook here. He does. He right away sometimes gets ahead of the indictment, especially if his team is notified of the details then he will often post on truth social ahead of it attacking the prosecutor in this case he would be attacking the Faultening County District Attorney fani willis and her entire team and saying it isnt true, this isnt something hes done and rallying his base around him and seen each time an indictment has dropped, the Republican Base really supports him and so does a significant amount of Establishment Republicans in the Republican Party particularly House Republicans saying that they want to investigate the investigators and that is what i think we can expect to see come next week. A replay of all of this. Trump made a brief visit to the Iowa State Fair today in iowa. There were also several of his 2024 rivals there, and my colleague key young law asked voters what they thought and i want to play that. Well listen to that. Are the indictments changing how you feel . No, because i do think a lot of that is for effect. A lot of those are trumped up. I dont believe most of it. You know, theyre just out to get him, you know, it might turn around too and biden might be the first one in jail. And so for all of us here on cable news were talking about this a lot, were talking about it nearly every day but have we seen any indication that trumps legal troubles are impacting his standing in the race . I mean, he continues to be the top candidate in national polling. He continues to be the top candidate in iowa, the state where almost all of the republican candidates are campaigning this weekend. So in terms of actually really making a difference in his commanding lead in the republican primary race, were not seeing it because of voters that she talked to. The former president has been effective at making his legal troubles about the voters themselves. We constantly hear from him that they are coming after me because i fought for you so theyre coming after you. And hes really been a master of making his legal troubles about sort of his voters at large which is why you see that enduring support from his base, particularly in iowa in favor of the former president. Now as this criminal process progresses and you have, for example, criminal trials, right, and then the president ial caucus nominating season perhaps that changes or if other republican candidates really take the gloves off a little bit more, perhaps starting in the debate in less than two weeks, that changes but its really hard to see that calculus changing right now and historically no republican primary president ial candidate has blown a lead this large, so thats something to keep in mind as well. Yeah, it is such a good data point for everyone right now and, laura, we heard seung min mention his opponents. Mike pence has been more direct lately on the third indictment, the one he had this unique role in but by and large most of the opponents are kind of either siding with trump or not talking about it at all .
