EDWARDSVILLE — A flight nurse claims she was not paid for overtime despite working more than 40 hours per week. Elizabeth Yarnell filed a complaint April 28 in the Madison County Circuit Court against Air Methods Corporation, alleging violation of the Illinois Minimum Wage Law, unjust enrichment and negligence. Yarnell alleges in her complaint that while working as a nurse as a member of Air Methods' medical flight crew, she was required to work two, 24-hour shifts each week. She claims her shifts were spent either working on an emergency call or staying at Air Methods' facility. She claims she worked more than 40 hours per week. Yarnell claims she was not paid overtime pay despite working more than 40 hours and that Air Methods' deducted eight hours out of each shift for "sleep time" unless it was interrupted, in violation of the Illinois Minimum Wage Law. She alleges she should be paid for "hours worked," meaning "all the time an employee is required to be on duty or on the employer's premises" and was not properly compensated.
