At the same time, here in new york former President Donald Trump about to head downtown. It is day two of his civil fraud trial. Thank you for having me back for day two. Im Gillian Turner and this is americas newsroom. The victim identified as henry cuellar. As he was parking his car tonight three armed assailants approached and stole his vehicle. He wasnt harmed and working with local Law Enforcement. Thank you to metro pd and Capitol Police for recovering the congressmans vehicle. Lets go live to Griff Jenkins on the scene. What can you tell us this morning . Well, i can tell you the residents walking these streets this morning are rattled. They say this is far too common. I will let you take a look here. You mentioned Capitol Police have a cruiser parked here in the navy yard area just a few blocks from the capitol in between the capitol and the National Major League Baseball stadium. The buildings here house many professionals on capitol hill to include members of congress. This is the one that Congressman Cuellar lived in parked out front when it happened 9 30 last night. Three assailants approached him at gun point. His phone, ipad and luggage were in the vehicle. This morning his car was recovered by the carjackers are still on the loose as officials look for them. It comes as carjackings are surging in the Nations Capital. 750 so far this year, up more than 100 from last year. 75 of those cases, a gun was involved. Now, a sad note, there is only a 25 closure rate on these carjacking offenses. James craig, running for the senate, says when he took over in 2013 in detroit more than 700 carjackings, got it down to 200 but far too unacceptable. Here is what he had to say earlier. Its a very violent and intrusive crime. Here we got per capita more Law Enforcement and not just the texas congressman, you had another lawmaker who was a victim of crime just in the recent past. Interestingly, congressman dan kildee, democrat of michigan walked out of the doors a few minutes ago. I asked him about it. He said it was very concerning. He spoke to Congressman Cuellar but said the attacks are far too common. Remember in february, gillian, angie craig assaulted in her Elevator Building had to fight him off. This is all a part of concerns both among now members of congress and residents in d. C. Thanks very much. Bill ted williams, homicide detective. Whats up with this . Motor vehicle theft up 106 from a year ago in washington. Robberies up 68 , homicides are up 37 . Happens at 9 30 at night and a nice part of town, ted. A very nice part of town. But i have to tell you, crime is off the charts. There is a crime wave going on in the district of columbia. I have to tell you where this carjacking took place is not too far from my law office. It also is not too far from police headquarters. Just think about it. Over 700 carjackings alone in the district of columbia. Not only that, but weve got over 200 homicides that have taken place. Weve got everything in this when it comes to crime is out of control. Guess what, guys . Remember when the city council wanted to defund the police . And they also now have put in a reform bill that support criminals more than the police. Theyve got to make some changes in the district of columbia. Gillian there is a lot going on in the city, obviously. In july we got a new police chief. I live there. Im a d. C. Resident. The same month that there were those two shootings at howard and Catholic University resulted in somebody being killed. The highprofile murder of the lyft driver and you have the mayor in a heated fight with d. C. City council about putting forward some legislation to try and curtail the crime. What do you see is the best way forward from here . The best way forward is for the city council and for mayor bowser to get on the same page. Mayor bowser is wanting to do something positive. The city council is more concerned about criminals and putting in reform to protect criminals than to protect lawabiding citizens in the district of columbia. Bill i want to share this with the viewers, a republican from wisconsin, his district is outside of milwaukee. Back in mid september, two weeks ago, he did this with a group of folks who live in d. C. How many people at some point during the past year have felt unsafe in washington, d. C. For their personal safely safety . How many people know someone who has been a victim of crime in the past year in washington, d. C. . Just about everybody in the room raises their hands. Your point is well taken. Go down to philadelphia now and roll this video. This is a Road Rage Case with a bunch of kids inside a car. The driver of a motorcycle, the driver of an atv and the driver of the car, they just start going at it, ted. It goes on for some time. He jumps on the back of the car starts breaking in their windshield of the driver there. This is center city, philadelphia. Weve been reporting on this for years in that town. It is very scary because the incident in which you are here describing is that guy got on the back of that car to break out that windshield, a gun dropped out of his pants pocket. He got out. Put the gun back in. The one thing i was very concerned about looking at this video is that the occupants, the driver of that car, the mother of two of the children that was in that car, got out and confronted this guy. This is something that you should not do. You should not confront somebody like this. Drive, get to a safe place, use your phone, call Law Enforcement. But you should not get out and confront somebody under these circumstances. But this is what is going on. This is the exception, guys. This is sadly this is the norm of what is going on with crime waves these major metropolitan cities. Bill you are right. More to come in all likelihood. Gillian an update on the story we brought to you yesterday. State police have rescued a 9yearold girl who vanished on saturday in a family trip. She was inside a cupboard in an rv. They have a custody in jail. After a terrifying 48 hours, you have basically given the most amazing detail. The 9yearold was found alive. She was found safe and reunited with her parents and a suspect is now in custody. The fourth grader had been found hidden covered inside a cabinet inside a camper where the suspect lived behind his mothers double wide house. 47yearold Craig Nelson Ross junior, was arraigned overnight facing kidnapping charges. Additional charges are anticipated. New York Governor Kathy Hochul detailed how ross, 46yearold led to his own capture. Investigators believe he dropped a ransom note at 4 20 in the morning yesterday. A fingerprint from that note went into a State Database Hitting a 1999 dwi out of saratoga. Police leaders praised the special Operations Response Team that performed an entry and subdued the suspect who suffered minor injuries. Highly trained and capable unit we use for this type of thing and what they train for and live for is to make entries like this and save someones life. Charlottes aunt released a statement saying were thrilled that she is home and we understand that the outcome is not what every family gets. A huge thank you to the f. B. About 45 minutes north of albany, new york. That mug shot is rather interesting. You wonder what was going on in his own personal life. We may get details on that also but again i think the key in this is to whether or not he knows the family. How did he know where that mailbox was and the residents was and the cops had the house staked out so a lot of answers still out there. One of the Family Friends spoke earlier. Seemed to take advantage of every break in court. The lunchtime and conclusion yesterday before that judge. So youve got donald trump and hunter biden both facing legal challenges on the same day at the same time. Former president expected back in court as i mentioned. That 250 million civil trial against him. Also in Delaware Hunter Biden will be arraigned on gun charges that were filed after his earlier plea deal collapsed. This thing has gone back and forth and now it is where it is back before the judge. David spunt has more for that case outside the courthouse now. David. Bill, good morning. Were waiting for hunter biden to arrive here to this Federal Courthouse in wilmington, delaware. Not here quite yet. Court begins at 10 00 and we expect at some point soon they have to go to security and talk with the attorneys before the hearing begins. Were told hunter biden will plead not guilty. We know so because his attorney said so in a court filing just a few weeks ago. It relates to three felonies surrounding a gun purchase from 2018. He is back in this federal Court Building after this plea deal famously fell through in a very public way. He was charged with lying about drug use on a form to purchase a gun, lying to an employee at a gun shop and physically possessing the gun. His attorney maintains he had it for less than two weeks. Now this plea deal was supposed to be just maybe about an hour back in july. It went several hours when the judge asked pointed questions about the proposed deal. It ultimately fell through. Now hunter could face up to 25 years behind bars but thats unlikely given no prior felonies. Part of the original plea deal included a Diversion Agreement on this specific gun charge, bill. It would have allowed hunter to avoid jail time by pleading guilty, special counsel david weiss said that agreement is null and void. Hunters attorney said it is valid since it was signed. The tax charges are still out there. We know they are out there because special counsel david weiss said he would likely refile tax charges against hunter biden in either washington, d. C. Or california where he lives. Another quick note, hunter biden will appear before a Magistrate Judge today, not the same judge who famously blew up that plea deal. Of course, it is notable today he is pleading not guilty to something he was ready to plead guilty to just about two months ago. Bill remarkable stuff. Turn of events. See how it goes. Not expected to be a long hearing. We expected the last one to be brief. Well see. David, thank you. You never know. Thank you. Gillian lets get into it with jonathan turley, Law Professor at George Washington university and constitutional law attorney. Jonathan, you have today for hunter biden as sort of the culmination of this fouryear investigation into taxes and foreign Business Dealings and today its illegal gun possession. Its interesting. It is interesting. In nightmare i shall way for the biden family. It was rip it up. Those were the words of Defense Counsel when this matter back controversial before the judge in delaware. The judge had asked why the Gun Charge Provisions of the Plea Agreement contained a sweeping Immunity Deal for hunter that would seem to hold him harmless of any crime. The prosecutors admitted at the time that they had never seen anything quite like that and the whole thing collapsed. In the middle of all this, according to reports, Defense Counsel stood up and told the prosecutors to just rip it up. And they did. And this is what happened. Because once you basically have a deal like this collapse in court and you break off any agreement with the Department Of Justice, they tend to go at you full bore. They tend to go for all of the possible charges and were already seeing that on the gun side. We may see it on the tax side. Bill todays hearing he will enter a plea, the judge will tell him what is expected and what do you expect from the hunter case . Because the trump case could go into december if not into the new year. But on the biden case, how long . Well, the interesting unknown here is whether the biden team will challenge the underlying federal law. This is a law that hunters father supported and they would have to challenge it on the basis of Supreme Court cases that President Biden opposed vehemently from the Supreme Court. So it would be a bit of a reversal of fortunes and that could indeed be their plan. They could be arguing that recent federal cases makes the underlying statute unconstitutional. That would create a rather interesting dynamic for the white house. Gillian lets look at former President Trump now on his way or about to get on his way from trump tower back to the courthouse in lower manhattan. His team seems to believe they had a pretty good day yesterday, if you listen to what his attorney said this morning on our air. Take a listen. Thats right, so remember originally we had a decision that came down from the Appellate Division that Disimmediate Aivanka Trump and addressed the fact that statute of limitations and limitations on years that they can go back. Our position. This judge did not acknowledge it until yesterday when he said you just spent the entire day wasting my time effectively. 2011 is what we looked at. It was great. Im happy that he acknowledged it. It was a good step in the right direction. Gillian what do you think . Well, its hard to say how the judge will actually rule. That acknowledgement was important, although it is notable that its rather belated. The trump team had to go to court to force this issue on the statute of limitations. If the court ruled along those lines, it would be a huge advance for the trump team. I think that quite frankly yesterday was a success because the former president got what he wanted most, which was an appeal to the court of public opinion. Every time he is shown being dragged to this court in this long procession, i think its going to inflame people in the country who view this as a political prosecution. It will also thrill many. Thats the problem. Is that were watching the same scene and this country is seeing two vastly different things. But trump knows the public well.
