Tonight the girls dad is talking to cornell barnard. Cornell . Reporter dan, kristin, manuel says his brave daughter was not hurt but still very scared about the breakin. Meantime a teenage suspect is under arrest tonight. Police say this is the 17yearold intruder who broke into a rohnert park home wednesday night, believing that no one was home. He put the extension over here and he walk inside. Reporter manuel says the intruder got in through a kitchen window. Manuel and his wife were not home, but their 17yearold daughter was. She called and somebodys walking by. Reporter their daughter said a man was outside trying to get into the house. Manuel told her to go upstairs to the bathroom and lock the door. She was locked in here, this is the only one she can lock it. Reporter his daughter called 911 where a Police Dispatcher kept the girl on the line as the intruder got in, the man kicked down the door and threatened the teen with a large hunting knife. The guy put the knife on neck to her and ask, do you call the police . At the sbbeginning, she says no. The intruder forced her to hang up, but dispatchers already sent officers to the home. Our officers were on the porch, he realized there was no place for him to go. He dropped the weapon and was taken into custody. Reporter the teen wasnt hurt. She said she had never seen the suspect before. Manuel said his daughter is too frightened. He warns future intruders to beware. Youre about to hear Oakland Police calling for an ambulance moments after tasing a person in custody. That person died tonight. We need a medical for a taser deployment. It happened near foot hill boulevard and 41st avenue around 2 30 this afternoon. Even now, nine hours later, theres still a lot of Police Activity there. Several agencies have launched investigations. None have released details on what led to the tasing. More developing news now, one person is in the hospital after the second rock slide in yosemite. Climbers say the rock fall was the size of a couple of apartment buildings, much larger than the one yesterday that killed a man from great britain. We cheated death we cheated death. The abc7 iteam asked why a criminal case against a driver accused of killing a teenager in San Francisco has been repeatedly delayed for several years. Dan noy is here now with a story youll see only here. A 16yearold boy died in a car crash caused by a woman driving more than 70 miles an hour in downtown San Francisco. She was charged in his death, but four years later, theres still no trial date set. His family wants to know why. Reporter friends say kevin sand was a great guy. He would always have a smile on his face. On a gloomy day, he would give a laugh. Reporter the Lincoln High School student was a member of the rotc grum corps and a passionate bicyclist. On a friday morning in september, his mother was driving him and his sister to school. Their minivan stopped at a light. Then a terrible collision. Like a bomb, an explosion. Horrendous. Ive never seen anything like it in my life. Reporter police say a silver mercedes suv hit the minivan from behind going more than 70 miles an hour. I watched it flip over. It flipped over like the back part flipped up and landed on the side. Reporter kevin sand was killed. His mother and sister were seriously injured. The driver of the mercedes was arrested. The offender is being charged with three felony counts. One of gross vehicular manslaughter and two counts involving reckless driving with serious injuries. Reporter that was four years ago. Kevins sister told us his family cant understand why getting yesterday is taking so long. Just last week, they were in court for a preliminary hearing. Its very unusual to see this kind of delay. Reporter former federal prosecutor is abc7s legal analyst. Theres an old saying in criminal law circles. And that is delay is a friend of the defense. And its usually and almost always to the advantage of the defense because the prosecution bears the burden of proof. Reporter we examined the court file, records show routine delays to give both sides time to gather evidence. We found these three motions for continuances filed by the defense attorney, delays of eight to ten weeks, all three motions were granted by the court. He said some were caused by a heavy case load and said both sides were afforded an equal number of delays. The prosecutor agreed to one and didnt file any motions objecting to the other two. At this point, i cant make a comment as to that aspect because its an ongoing case. Nks its been frustrating how long this has all taken. This attorney filed a lawsuit for kevins family against zhu. What are the dangers in having years go by in a prosecution . Witnesses move, memories, fade, people die. He says delays in the criminal case hamper the civil suit. We cant do discovery, we cant depose her because she has a fifth amendment right to remain silent. Zhu settled the lawsuit for an undisclosed sum. Shell plead not guilty at the arrangeme arraignment next week. If convicted on all counts, she could face seven years in prison. Tough for the family, of course.
