The trial for the man accused of stabbing and killing an 18yearold at the bart station begins tomorrow. Last week the lawyer for john lee cowl filed a motion to move it out of the county. She does not think her client can get a fair trial because of all the coverage this case received. His mental competency is also in question. Now down to the south bay where we are learning some new details about what led up to an officer involved shooting in a san jose gas station. We cover this all. Abc 7 News Reporter reports the suspect was allegedly trying to set fire to one of the gas station pumps. A male has driven away with a pump still attached to his vehicle. He has since returned, but now he a lighter in his hand. Her employee called her at home asking what to do after reporting a driver threatening to set one of the gas nozzles on fire. I dont know. Thats crazy. Could have been dangerous. Yeah. Could have been blown up. I dont see why they would target like the gas station on fire. The threat of the fire has many nearby residents thankful that the situation didnt escalate. According to police, the man was armed with a metal bar and charged at officers. In an email, San Jose Police say officers used multiple less lethal options that had no effect. The officers ultimately discharged their firearms in response. Shots fired. A couple of gunshots to the torso. The area was littered with evidence markers including the nonlethal items police described. Not only was traffic impacted, but busses werent stopping at the mall because of the police investigation. He lives just blocks away from the gas station. He says hes grateful that the gas station employee was able to shut off the gas. He says his neighborhood and the mall could have been at risk. Many people are at the sh shopping center. A great grandmother badly beaten has passed away. This 89yearold was out exercising when she was attacked at a playground.
