Once again, hes claiming hes being cheated out of a win. If you count the legal votes, i easily win. If you count the illegal votes, they can try to steal the election from us. If you count the votes that came in late, were looking to them very strongly but a lot of votes came in late. Again, we have to say no evidence for this right now. Patience is really the word of the week. Were anxiously awaiting results in those Battle Ground states including pennsylvania. There was hope we would know the outcome tonight. As the day goes by, that seems more and more unlikely. Reporter as the country waits on pins and needles, all eyes on five states, nevada, North Carolina, georgia and pennsylvania. Biden needs two states to hit 270 to declare a win, President Trump needs four and the final ballot counts to make the difference are very, very slowly strike ling in. Biden today said he has no doubt hell win once the votes are counted and call for patience. I ask everyone to stay calm, all the people to stay calm. The process is working. The count is being completed and well know very soon. President trump in the meantime continuing to make up substantiated claims of voter fraud. Bay area Melanie Morgan says they wont go down without a fight. We will not be ones with pitch forks in the street if we lose this election. We will absolutely honor the election results. While the math favors biden, she believes there is a victory path for the president but if biden does win the slim margin should be a wakeup call to democrats who thought they should have a landslide. How likely are they to be successful remains to be seen but several scenarios could play out. If there is one legal strategy driving the trump president ial campaign, it might be filerly, file often. The team now has active lawsuits in most of the remaining Battle Ground states and Golden Gate University law professor Kathleen Morris says there is a reason for the number. He said the issues from the trump team range from mail in ballots to voting deadlines and individual Battle Ground states themselves believes the legal team tipped their hand toward a broader strategy. Try to get something that might affect the outcome of the election. Reporter historically, federal courts have been hesitant to step in without a clear federal issue. Bush versus gore when the Supreme Court halted a recount in florida effectively handing the election to george w. Bush. Since then, many legal scholars have questioned whether the court had clear grounds to act. After bush versus gore you cant say anything with confidence because there was no jurisdictional basis. Reporter with the 2020 vote so close, even a success in one key state could be significant they say as for repeat of bush and gore. Whether there is a case that can go to the Supreme Court that can alter the outcome of the election, i think well know a little bit more about that in the coming hours and days. Reporter adding more drama and anxiety to a historically tense election. If the challenge were to reach the Supreme Court, there could be at least some deja vu because three current sitting judges, justices were also on the court for bush versus gore in 2000. Joining me now, San Francisco chronicle insider abc 7 news contributor phil talking all things elections. Why dont we start with the president speaking about a half an hour ago claiming that he feels like hes being cheated. What was your reaction to his comments . Well, first off, what we saw was sort of the broad donald trump statements with lack of specificity. I mean, he didnt have specifics. He said basically it boiled down to this, larry, that he was ahead in most of the states that are being contested until they started counting the late votes coming in. And he says that that shouldnt be the case. That its improbable they would be breaking towards joe biden and not him. He hasnt been through a lot of elections and a lot of tight elections. What were seeing is marpar fore course. Thats what happens. Second challenge is to say he doesnt want them to count votes, lets say, that were arrived after the election but were postmarked before the election, well, local laws cover that yes or no. He says he wants greater access to observe the count. Thats being granted. What he didnt have was a specific large enough case or a large enough number to actually change the election. And i dont know if you saw the president and listened to him but he was rather tired. He was rather withdrawn and it sounded to me like the air was coming out of the tires. Well, i think everyone is pretty exhausted given the situation. Weird for the Republican Party because in some places Trump Supporters say stop the count, stop the count but in others, its keep counting because they need the votes in a state like arizona. Thats right. Whatever shoe fits youll wear it given the state. In close elections like this, its usually the underdog who says i want every vote counted. I want them all counted because therein lies the chance of making it up. The president feels like he got the early vote and he did and thats why he made a big move on that on Election Night. He was saying i won. I won. Now everything from that Going Forward is a take away. The fact is in close elections and in big elections, its hypered that the count isnt over until its over. And youre going to go up and down, up and down and up and down. We may have states swing one way and the other. The margins might be very small and it can be frustrating but thats the way it is. Yeah. I think we should be clear, Everyone Wants a legitimate count and count them all and well see what happens in the end. This is getting ahead a little bit, i know, if joe biden wins, what happens with Kamala Harris senate seat . Any idea who would take over . Youre not getting ahead of anybody in San Francisco, sacramento and points between. People are lobbying and saying if it happens, lets get going on this. There are a host of possible candidates but i was talking with one advisor who said very simply there is only two things that sitting governors should be looking for making an appointment like this. I said what . Who has been with me or with me when i ran for office and who will be with me next time . Within that group you can find anyone that qualifies. The Trump Campaign is not conceding filing lawsuits in multiple states and just an hour ago you heard the president s News Conference saying there is in fact fraud going on. He says without evidence. Spencer, what is your take . Well, i dont think things are i dont think the mood in the country is going to settle down for awhile. No matter what the outcome, theyre are going to be people very upset and disappointed and some will probably express their frustration in ugly ways. I think thats unfortunate. So i just urge everyone to try to calm down a little bit, you know. Sip some hot tea, do some deep breathing exercises and hope for a more peaceful outcome to this thing. Yeah, my take away, were not used to this in this country. Were used to things being pretty fast and this is a different situation so we just have to try to be patient. Crowds gather every night to watch the bats take flight. This is amazing reporter welcome to waugh bat colony, home of 300,000 plus mexican freetail bats in the houston area. 300,000. A night. Wow. People started noticing the bats in the bridge in the early 1990s. 93 when is we first started receiving reports. They selected this bridge because its an awesome construction. Its perfect for bats. So the way that its built, it has concrete beams with little crevices in between. So its nice and warm for female bats when theyre giving birth. If you look in the crevice, youll see the bats sleeping. Its daytime, and theyre hanging out, hanging by their toes, and sound asleep during the day. Once sunset nears, then theyll shiver and warm their bodies up and be ready to fly. This is an example of the bats that youll see in waugh bridge. This is a members call free tail bat. Notice the narrow wings for fast flight and the long tail. Part of the tail is free from the membrane, the skin. And so thats how it gets the name free tailed. The bats in waugh bridge eat insects, primarily moth eaters. So theyll go up to 10,000 feet and catch moths that are flying in from mexico. So theyre really, really good pest control on moths that attack our crops. So this colony of 300,000 bats eats about three tons of insects a night. Theyre using echolocation, kind of like sonar, to be able to catch the insects, find them and catch them. If you come to see the bats, come early. Come before sunset. Because usually they will fly out at sunset, or a little after. So come hit on the hillside, get yourself situated, and just wait for the bats. One sign that you can tell that the bats are close to coming out is to watch for the predators. And they come every evening and theyll sit and wait. Once you see them start arriving, you know that its pretty quick the bats will be coming out. Thinking like when a tornado, like a funnel cloud as they swirl up. When the bats emerge in the evening, they typically fly out the east side of the bridge. So somebody says go, in the group, and theyll drop out of the crevices. And either do a little swirl underneath the bridge or theyll be so hungry and ready to catch those insects that they fly immediately out. Springtime is when the females in the bridge are giving birth, and each mother gives birth to one pup. And usually during those times they come out later in the evening. So when its dark. So that they are not eaten by a predator. It was amazing. Because you get to see all of them just like rushing through it. Then in the distance, like a little dark cloud, so cool. Like a wave. A living wave. You know, it just became one with the night. And it was really beautiful. Theyre so little, but as they come down, you just see them dropping down from under the bridge. And they look like little shadows in a long wave going in circles and going into waves. It was really cool.
