The activists say there are 14 other chicano murals across the city and they are still lobbying the san jose Historic Commission to preserve them. Thomas henderson is accused of defrauding Foreign Investors of 110 million. He and two others told investors the money was helping foreign nationals obtain green cards. Prosecutors say more than 200 investors were scammed. The u. S. Attorneys office says that money could have been used to generate more than 2,000 jobs in oakland. That was the promise. Reporter it was pretty controversial when the judge released him from jail two days after the attack outside the water mark condominiums, today after hearing new accusations tied to a different crime she ordered him to remain in jail without bail. The video is chilling. She tries to fight off an attacker as she attempts to get inside her condominium building on august 11th. San Francisco Police arrested 25yearold austin vincent, whose charged in the attack, and booked him into the jail. Despite felony assault charges, judge Christine Van achen agreed to release vincent into a Mental Health Treatment Program but a woman who was following the case claims she recognized vincents mug shot as the same man who waved a knife at her and Three Friends in february, and allegedly threatened to kill them. This afternoon vincent pleaded not guilty to felony charges stemming from that incident, including assault with a Deadly Weapon and making criminal threats. His lawyer says vincent should remain free so he can get treatment for his mental illness. He was getting the help he needed. He was having the root cause of some of his issues being addressed and now hes in jail, where hes not going to get help with those issues. Reporter this time the judge denied the defense request to once again release vincent. Theres always a balance thats done and we believe that balance definitely merits keeping the defendant in to advance public safety. Reporter the defense admits it is investigating two more complaints against vincent but declined to give us more details saying the complaints have not yet been substantiated. Prescribing high levels of opioids and narcotics to four elderly patients in 2016 and 2017. All four patients died. Dr. Keller also allegedly gave patients prescriptions without a legitimate medical purpose. The judge set bail for 12 million. Reporter the judge reminded this new jury not to talk to anyone, not to text anyone about the details of this case. All it takes is for one of those 12 individuals to viole tha court order, and its very likely, we got a mistrial. Raj, i know im sounding like a broken record here, i need to remind you guys, theres only one alternate left. The judge shed light on the alleged juror misconduct that forced her to kick out three women from the jury. The judge said there is a chance two exjurors could be held in contempt of the court. It all depends on the nature of the offense but if found guilty these women could face heavy fines or even jail time. The judge said she is still gathering information about the third womans role in all of this. Now, you might recall this trial started back in april. But now theres a chance that deliberations could last into the fall. Thats because the jury is taking a long break next week and two jurors are asking for weeks off in september. Our nbc bay area news legal analyst dean johnson who is not involved in the trial says scheduling conflicts might be the push the jury needs to make a decision. People always have lives to get back to so there are always deadlines in their heads. California is among 17 states with socalled red flag laws which allow police or family members to petition for police to take guns away from a relative. After the 2014 mass shooting near Uc Santa Barbara california passed a law allowing family members to request a gun to be confiscated from a relative they believe presents a threat. A uc davis researcher says their data shows 21 Mass Shootings were likely prevented by the law. Most subjects were white men, 14 to 65 years old, 52 guns overall were recovered and in three cases subjects that purchased guns that had not yet been allowed to pick up because of californias tenday waiting period. Researchers stress the study doesnt definitively prove that red flag laws work. Only the people calling police with their concerns can make a difference.
